The Chinese version of standards has precedence to their English translations which are only for internal reference.本英文版為內(nèi)部資料，僅供參考，以中文版為準(zhǔn)。Tentative Method of Jiangsu Province on Levying Pollution Discharge Fee on the Basis of Total Amount of Discharged Water PollutantsArticle 1To strengthen the supervision and management of water environment, prevent and control pollution to water and improve the water environment quality, this method has been formulated in accordance with “Law of Peoples Republic of China on Prevention and Control of Water Pollution”, “Tentative Method on Levying Pollution Discharge Fee” issued by the State Council (Guofa 1982 No. 21), “Reply Approval by State Planning Commission and the Ministry of Finance on Trial Implementation of Levying Pollution Discharge Fee on the Basis of Total Amount of Pollutants in Discharged Water” (Ji Price 1995 No. 2090) and “Tentative Regulations of Jiangsu Province on Control of Total Amount of Pollution Discharge” (Jiangsu Provincial Government Decree 1996 No. 38) and other laws, codes and regulations, and with reference to the charging scheme of the state based on total amount of discharge.Article 2This method shall be implemented on all enterprise and institution entities and individual industrial and commercial households within the territory of the province that are discharging waste or sewage water to the environment either directly or indirectly (hereinafter referred to as pollution discharge unit).For any city (town) sewage water treatment plant from which the tail water has met the sewage water discharge standard specified by the state or locality, water pollutant discharge fee shall not be levied for tentatively for the living sewage water it is receiving.Article 3Charging on the water pollutant discharged on the basis of total amount means that pollution discharge fee shall be calculated and charged concurrently on a number of main pollutants. For each pollutant, the pollution discharge fee shall be calculated on the basis of its pollution equivalent and unit pollution equivalent charge rate, and correction will be made on the equivalent charge rate according to the functional types of water bodies into which the pollutant is discharged. The specific charge rate is given in the appendix.Article 4A pollution discharge unit shall report on a monthly or quarterly basis to the local environmental protection department the amount of discharged waste or sewage water, type and concentration of pollutant, which shall be taken as the basis for levying the pollution discharge fee after being verified by the environmental protection department or other designated organizations.The reported data can be determined by making measurement, calculating materials or according to the discharge coefficient of given pollutants. The material calculation coefficient or pollutant discharge coefficient adopted shall subject to approval by the environmental protection and other relevant departments.Article 5Concurrent with the implementation of this method, the provisions in Article 6 of “Tentative Method on Levying Pollution Discharge Fee” issued by the State Council shall still be implemented, i.e., for any pollution discharge unit that fails to meet the discharge standard after paying the pollution discharge fee, the charging standard shall be raised by 5% each year starting from the third year since starting the charge.For any pollution discharge unit for which the charge rate was already raised before implementing this method, the proportion of charge rate raised as accumulated in previous years shall remain valid, provided that the amount of pollution discharge fee calculated according to this method shall be adopted as the base amount for the charge.Article 6For any pollution discharge unit with one of the following cases, the pollution discharge fee shall be charged at a double rate according to the relevant regulations:1.Any project newly built, modified or expanded and project for tapping potential capacity, innovation and transformation implemented after the publication of the “Environmental Protection Law of Peoples Republic of China (for Trial Implementation)”, which is discharging pollutant exceeding the standard;2.The pollutants discharged have exceeded the standard again as a result of deliberate stopping the normal use of water pollutant treatment facility, or dismantling or shutting down the water pollutant treatment facility without approval by the environmental protection department;3.Any project for which the state or locality has set the time limit of control and treatment, and which is still discharging pollutant in excess of the standard beyond this time limit;4.Any industrial enterprise discharging water pollutant in excess of the standard in Huaihe River and Taihu Lake basins, concentrated domestic animal or poultry breeding farms discharging water pollutant in excess of the standard in Taihu Lake basin, guesthouse or restaurant and other catering and entertainment service enterprise discharging water pollutant in excess of the standard in Class I protection zone of Taihu Lake basin, and any industrial enterprise still discharging water pollutant in excess of the standard in Yangtze River basin after June 30, 1999;5.Evading the payment of pollution discharge fee by way of discharging or pouring waste or sewage water into seeping wells and pits, fissures or karst caves, or by reducing the concentration through dilution and by other means;6.Any unit discharging water pollutant in excess of the permissible total amount quota verified by the environmental protection department.For any unit concurrently with two or more of the above cases, the doubling multiples shall be lower than the sum of the multiples of all single items.Article 7The pollution discharge fee shall be levied on a monthly or quarterly basis.
