6、 pactci me n - n Ia indv luai ml-er, bt ioing a te wib opertin ,nd a frm conentatd e on l o reu eduatm e_ "s o imo - n i- -Vas num_s of第一章總則第一條 為了進(jìn)一步加強(qiáng)對(duì)勞務(wù)派遣人員的規(guī)范化管理, 充分調(diào)動(dòng)勞務(wù)派遣 人員的工作積極性和創(chuàng)造性,更好地為地稅事業(yè)服務(wù),根據(jù)國(guó)家和省、市有關(guān)規(guī) 定,結(jié)合我局實(shí)際,特制定本辦法。第二條本辦法所指勞務(wù)派遣人員,是我局因工作需要,由勞務(wù)派遣公司統(tǒng) 一派遣、經(jīng)市局同意接受、使用期限在一個(gè)月以上的人員。第三條首次接受勞務(wù)

7、派遣公司派遣的人員,均實(shí)行一個(gè)月試用期制度。第二章勞務(wù)派遣人員的派遣、使用及條件第四條 勞務(wù)派遣人員由勞務(wù)派遣公司按照市局提出的勞務(wù)派遣人員用工數(shù)量、崗位要求和聘用條件等統(tǒng)一派遣,由市局進(jìn)行監(jiān)督、檢查及考核。第五條勞務(wù)派遣人員的使用,依據(jù)金昌市地方稅務(wù)局與金昌市鍥城偉創(chuàng)人 力資源有限責(zé)任公司簽訂的勞務(wù)派遣協(xié)議書進(jìn)行。勞務(wù)派遣協(xié)議應(yīng)當(dāng)約定派遣崗位和人員數(shù)量、 派遣期限、勞動(dòng)報(bào)酬和社 會(huì)保險(xiǎn)費(fèi)的數(shù)額與支付方式以及違反協(xié)議的責(zé)任。勞務(wù)派遣公司要將我局與勞務(wù)派遣公司簽訂勞務(wù)派遣協(xié)議書的事實(shí)告知 勞務(wù)派遣人員。第六條勞務(wù)派遣人員應(yīng)具備下列條件(一)思想品德好,遵紀(jì)守法,無(wú)違法亂紀(jì)等行為。(二)誠(chéng)實(shí)守信,

15、 a frm conen_td edcatont o r - la eduatme_"so imo - n i nitaiesVas mes of(四)稅收征管崗位應(yīng)具有中專以上文化程度,其他崗位應(yīng)具有初中以上文化程度。(五)身體健康,無(wú)傳染性疾病,持有本人身體健康證明(縣、區(qū)級(jí)以上醫(yī) 院體檢證明)。(六)持有本人所在社區(qū)介紹信、計(jì)劃生育證明(或未婚證明卜身份證等。(七)從事符合國(guó)家規(guī)定的技術(shù)工種,須持有效的職業(yè)技術(shù)資格證書。(八)根據(jù)工作性質(zhì)和實(shí)際崗位需要,要求具有的其他特殊條件。第三章勞務(wù)派遣人員使用程序第七條勞務(wù)派遣人員使用程序(一)用人單位根據(jù)工作需要提出需求申請(qǐng),由市局人教

16、科審核后,報(bào)市局研究決定。(二)市局人教科按照市局的決定,提出用工數(shù)量、崗位要求及聘用條件, 交由市局機(jī)關(guān)后勤服務(wù)中心負(fù)責(zé)與勞務(wù)派遣公司協(xié)議、派遣。(三)凡勞務(wù)派遣公司派遣到我局的人員,需填寫金昌市地方稅務(wù)局勞 務(wù)派遣人員登記表,并提交個(gè)人身份證復(fù)印件、身體健康證明和計(jì)劃生育證明, 技術(shù)工種需要提交相關(guān)的上崗證件。第八條 勞務(wù)派遣人員由勞務(wù)派遣公司與其簽訂勞動(dòng)合同。勞務(wù)派遣公司與勞務(wù)派遣人員簽訂的勞動(dòng)合同應(yīng)當(dāng)載明被派遣勞動(dòng)者 的用工單位、工作崗位、派遣期限等情況。第四章勞動(dòng)派遣人員的管理basd m thi at ual, stvng o be "lean ng Ind "

34、規(guī)定制度。第十一條勞務(wù)派遣人員的管理、監(jiān)督、 考核等參照金昌市地方稅務(wù)局行政執(zhí)法 (管理)責(zé)任制考核辦法以及市局相關(guān)制度規(guī)定執(zhí)行。第十二條各用人單位應(yīng)結(jié)合勞務(wù)派遣人員的崗位制定崗位責(zé)任制, 并對(duì)崗位責(zé)任制執(zhí)行和落實(shí)情況進(jìn)行經(jīng)常性的監(jiān)督檢查。第十三條各用人單位應(yīng)加強(qiáng)對(duì)勞務(wù)派遣人員的教育培訓(xùn), 不斷提高其綜合素質(zhì), 增強(qiáng)其服務(wù)技能, 積極引導(dǎo)其愛崗敬業(yè), 努力工作, 不斷提高服務(wù)質(zhì)量。第五章 勞務(wù)派遣人員的考核、獎(jiǎng)懲第十四條勞務(wù)派遣人員的考核分為經(jīng)常性考核和定期考核兩種。經(jīng)常性考核由各用人單位根據(jù)市局相關(guān)制度和勞務(wù)派遣人員的崗位責(zé)任制情況進(jìn)行考核。定期考核分別為半年考核和年度考核。 半年考核結(jié)合市

52、0元/人月,當(dāng)年評(píng)為優(yōu)秀等次的,從次年1 月1日起在當(dāng)年工資基礎(chǔ)上加薪100元。年度加薪最多不得超過(guò)6次。第十七條勞務(wù)派遣人員當(dāng)年年度考核評(píng)為不合格等次的,留崗查看 3個(gè)月,期間扣發(fā)工資100元/人月。留崗查看期滿后,經(jīng)市局考核合格后方可繼續(xù)上崗。第十八條因違反勞動(dòng)紀(jì)律、出現(xiàn)服務(wù)態(tài)度和工作作風(fēng)等行為,造成經(jīng)濟(jì)損 失或不良影響,尚未構(gòu)成辭退條件的勞務(wù)派遣人員, 將視情節(jié)給予適當(dāng)處罰。對(duì) 于情節(jié)較輕的,扣發(fā)半月工資;對(duì)于情節(jié)較重的,扣發(fā)全月工資。第六章勞務(wù)派遣關(guān)系的解除第十九條勞務(wù)派遣人員有下列情形之一的,由我局退回勞務(wù)派遣公司:1、在試用期內(nèi)不符合我局工作要求的。2、嚴(yán)重違反勞動(dòng)紀(jì)律或者市局的規(guī)
