7、ances of this p roject, p arties A and B have hereby equally and voluntarily entered into the following agreement executed on the basis of mutual resp ect.建筑裝飾工程施工合同Con tract合同精品關(guān)于材料供應(yīng)的約定AGREEMENT ON THE SUPPLY OF MATERIALS1.乙方提供的材料：乙方供應(yīng)的材料、設(shè)備，如不符合設(shè)計(jì)、施工要求，應(yīng)禁止使用。如已使用，對(duì)工程造成的損失由乙方負(fù)責(zé)。如甲方要另增加材料由甲方供應(yīng)，并應(yīng)符合

8、下列規(guī)定：Material p rovided by P arty B: Any materials or equip ment supp lied by P arty B which do not meet the design and construction requirements are p rohibited. Anyextra materials requested by P arty A which were not in the original design must be p aid for by P arty A.2.甲方提供的材料：另擬補(bǔ)充附件甲方提供材料、設(shè)備表甲方

9、負(fù)責(zé)采購供應(yīng)的材料、設(shè)備，應(yīng)符合設(shè)計(jì)施工要求的合格產(chǎn)品，并應(yīng)按時(shí)供應(yīng)到現(xiàn)場(chǎng)。乙方發(fā)現(xiàn)甲方提供的材 料、設(shè)備有質(zhì)量問題或規(guī)格差異，應(yīng)及時(shí)向甲方提出，甲方仍要求使用的，由此造成工程損失，責(zé)任由甲方承擔(dān)。 甲方供應(yīng)的材料按時(shí)抵達(dá)現(xiàn)場(chǎng)后，由乙方負(fù)責(zé)保管Material provided by Party A: (see the annex:“Table of Materials to be provided by the Owndf Party A”).acquires materials for the p roject, it should first check with P arty B th

11、ed by P arty B.四、關(guān)于工程質(zhì)量及驗(yàn)收的約定合同精品FULFILMENT OF THIS AGREEMENT1.本工程應(yīng)符合建筑裝飾工程技術(shù)規(guī)程和市建設(shè)行政主管部門制定的其它地方標(biāo)準(zhǔn)質(zhì)量評(píng)定驗(yàn)收標(biāo)準(zhǔn)The execution of this p roject must be consistent with the“Architectural and Engineering Rulesadministrative dep artments respo nsible for the devel op ment of buildings and local standards and

12、quality evaluation acce ptance criteria.2.本工程由乙方進(jìn)行設(shè)計(jì)，提供施工圖紙一式兩份，雙方簽字確認(rèn)Party B must p rovide a dup licate copy of the construction designs and drawings, and both copies should be signed by both p arties.甲方提供的材料、設(shè)備質(zhì)量不合格而影響工程質(zhì)量，其返工費(fèi)用由甲方承擔(dān)，工期相應(yīng)順延If materials p rovided by P arty A for the construction do

14、修改意見及增減工程項(xiàng)目，須提前與乙方聯(lián)系，在雙方簽訂工程項(xiàng)目變更單能進(jìn)行該項(xiàng)目的施工、因此影響工程竣工日期的，責(zé)任由甲方承擔(dān)。凡甲方私自與施工人員商定更改施工內(nèi)容、增 加施工項(xiàng)目所引起的一切后果，甲方自負(fù)，給乙方造成損失的，甲方應(yīng)予賠償If, during the construction, P arty A wishes to prop ose a change to the design, he should sign aProject”with Party B and must assume responsibility for resulti ng delays or increase

16、ibility of P arty B to make sure that all construction works are carried out to the requirements of the design and to makesure that all internal walls and hidden construction p arts are to the required standard.工程竣工：乙方完工后即應(yīng)通知甲方驗(yàn)收，甲方應(yīng)在竣工當(dāng)日組織驗(yàn)收，并辦理驗(yàn)收移交手續(xù)，雙方簽 驗(yàn)收單。如果甲方在規(guī)定時(shí)間內(nèi)不能組織驗(yàn)收，須及時(shí)通知乙方，另定驗(yàn)收日期。如通過竣工驗(yàn)

P arty B must notify P arty A when the p roject is compi ete and ready for ins pection by P arty A.After inspection both parties must sign an“Engineering Quality Acceptance”document. If Party A is not availableto ins pect the construction site on th

25、et the scheduled compi etion date.違約責(zé)任LIABILITY FOR BREACH OF CONTRACT1.由于甲方原因?qū)е卵悠陂_工或中途停工，工期順延If P arty A causes any delays to the compi etion of this p roject, then the scheduled compi etion date should be adjusted accordingly.2.由于乙方原因逾期竣工的，每逾期一天，乙方向甲方支付工程造價(jià)0.1%0（大寫:千分之一）的違約金If P arty B causes any

26、delay to the compi etion of this p roject, then P arty B must pay to P arty A a fee of 0.1%（in words: 1/1000）of the total overall project fee for each day beyond the scheduled compietion date.3.甲方未辦理有關(guān)手續(xù)，強(qiáng)行要求乙方拆改原有建筑承重結(jié)構(gòu)及共用設(shè)備管線，由此發(fā)生的損失或事故（包括罰款）由 甲方負(fù)責(zé)并承擔(dān)責(zé)任If P arty A instructs P arty B to make any al

27、terations to a load bearing wall and P arty A has not sought and received p ermission from the buildingprop erty management, P arty A shall be respo nsible for any resulting costs and shall indemnify P arty B for any additional exp enses incurred.4.乙方擅自拆改原有建筑承重結(jié)構(gòu)或共用設(shè)備管線，由此發(fā)生的損失或事故（包括罰款），由乙方負(fù)責(zé)并承擔(dān)責(zé)任If

28、 P arty B makes any unauthorized changes to load bearing walls or building pip elines and such changes result in damages or loss, it shall be therespo nsibility of P arty B to pay for such loss.5.工程未辦理驗(yàn)收、結(jié)算手續(xù)，甲方提前使用或擅自動(dòng)用工程成品由此造成無法驗(yàn)收和損失的，由甲方負(fù)責(zé)并承擔(dān)責(zé)任P arty A shall be respo nsible for any extra costs in

29、curred due to his use of the prop erty before the final compi etion meeting and signing of the“Engineering Quality Acceptance”document.糾紛處理方式DIS PUTES1.因工程質(zhì)量雙方發(fā)生爭(zhēng)議時(shí)，憑本合同文本向有關(guān)行業(yè)協(xié)會(huì)申請(qǐng)調(diào)解，也可向所在區(qū)、縣建設(shè)行政主管部門或消費(fèi)者 協(xié)會(huì)投訴If there is a dis pute between the p arties, this contract should be submitted to the releva

30、nt trade association for mediation and also to the hostdistrict and county building dep artments in charge of administrative compi aints, or to consumer associations.2.當(dāng)事人不愿通過協(xié)商、調(diào)解解決、或協(xié)商、調(diào)解不成時(shí)，可以按照本合同約定向 提起訴訟-p articularly with the neighbors.-上海仲裁委員會(huì)申請(qǐng)仲裁-人民法院if, after negotiation, mediation and/or c

31、onsultation, the p arties have failed to reach an agreement, then the dis pute should be:submittedto the-Shanghai Arbitration Commission-filed as a lawsuit.九、合同變更和解除AMENDMENT AND TERMINATION1.合同經(jīng)雙方簽字生效后，雙方必須嚴(yán)格遵守。任何一方要求變更合同內(nèi)容或解除合約，由雙方協(xié)商解決，經(jīng)雙方簽字 確認(rèn)后生效After this contract is signed it must be strictly adhered to.
