ThesalaryoftheEmployeeshallbemonthlypaidbytheEmployerinaccordancewithapplicablelawsandregulationsofP.R.C.ItshallbepaidbylegaltenderandnotlessthanthestandardminimumsalaryinTianjin.b. ThesalaryoftheEmployeeisRMB$permonthintheprobationaryperiodandRMB$aftert

Ifthedelayordefaultofsalarytakesplace,theEmployershallpaytheeconomiccompensationexceptthesalaryitselfinaccordancewiththerelevantlawsandregulations.4.WorkingHours&Rest&Vocationa. ThenormalworkinghoursoftheEmployeeshallbeeighthourseachday,excludingmealsandrestforanaverageoffive

5、daysperweek,foranaverageoffortyhoursperweek.b. TheEmployeeisentitledtoalllegalholidaysandotherpaidleavesofabsenceinaccordancewiththelawsandregulationsofthePRCandthecompanysworkrules.c. TheEmployermayextendworkinghoursduetotherequirementsofitsproductionorbusinessafterconsultationwiththetradeunionandt

6、heEmployee,buttheextendedworkinghourforadayshallgenerallynotexceedonehour;Ifsuchextensioniscalledforduetospecialreasons,theextendedhoursshallnotexceedthreehoursaday.However,thetotalextensioninamonthshallnotexceedthirty-sixhours.5.SocialSecurity&Welfarea. TheEmployerwillpayforallmandatorysocialsecuri

7、typrogramssuchpensioninsurance,unemploymentinsurance,medicalinsuranceoftheEmployeeaccordingtotherelevantgovernmentandcityregulations.b. DuringtheperiodoftheContract,theEmployeeswelfareshallbeimplementedaccordancewiththelawsandrelevantregulationsofP.R.C.6 .WorkingProtection&WorkingConditionsa. TheEmp

8、loyershouldprovidetheEmployeewithoccupationalsafetyandhealthconditionsconformingtotheprovisionsoftheStateandnecessaryarticlesoflaborprotectiontoguaranteethesafetyandhealthduringtheworkingprocess.b. TheEmployershouldprovidetheEmployeewithsafetyeducationandtechniquetraining;TheEmployeetobeengagedinspe

9、cializedoperationsshouldreceivespecializedtrainingandacquirequalificationsforsuchspecialoperations.c. TheEmployeeshouldstrictlyabidebytherulesofsafeoperationintheprocessoftheirwork.7 .LabourDisciplinea.TheEmployermaydraftbylawsandlabourdisciplinesoftheCompany,Accordingtowhich,theEmployershallhavethe

10、righttogiverewardsortakedisciplinaryactionstotheEmployee;b.TheEmployeeshallcomplywiththemanagementdirectionsoftheEmployerandobeythebylawsandlabourdisciplinesoftheEmployer.c.TheEmployeeshallundertaketheobligationtokeepandnottodisclosethetradesecretfortheEmployerduringtheperiodofthisContract;Thisoblig

11、ationofconfidentialityshallsurvivetheterminationofthisContractforaperiodoftwo(2)years.8.Termination,Modification,RenewandDischargeoftheContracta. TherelevantclausesoftheContractmaybemodifiedbytheparties:i. Thespecificclauseisrequiredtobemodifiedbythepartiesthroughconsultation;ii. Duetotheforcemajeur

12、e,theContractcannotbeexecuted;iii. TherelevantlawsandregulationshavebeenmodifiedorabolishedbythetimeofsigningtheContract.b. TheContractmaybeautomaticallyterminated:i) ThisContractisnotrenewedattheexpirationofthisContract;ii) TheEmployerislegallyannouncedtobebankruptcy,dismissed,orcanceled;iii)Thedea

13、thoftheEmployeeoccurs;iv)Theforcemajeuretakesplace;v)TheconditionsofterminationagreedintheContractbythepartiesarise.c. TheContractmayberenewedattheexpirationthroughconsultationbythepartieswiththefulfillmentoftheprocedurewithin15daystotheexpiration;d. TheContractmaybedischargedthroughconsultationbyth

14、eparties;e. TheContractmaybedischargedbytheEmployerwithimmediateeffectandthetheEmployeewillnotbecompensated:i. TheEmployeedoesnotmeetthejobrequirementsduringprobationaryperiod;ii. TheEmployeeseriouslyviolatesdisciplinesorbylawsoftheEmployer;iii. TheEmployeeseriouslyneglectshisduty,engagesinmalpracti

15、ceforselfishendsandbringssignificantlosstotheEmployer;iv. TheEmployeeisbeingpunishedbyphysicallabourforitsmisfeasancev. TheEmployeeisbeingchargedwithcriminaloffences:f. TheContractmaybeterminatedbytheEmployerbygivingnoticeinwrittenform30(thirty)daysinadvance:afteri. TheEmployeefailsillorisinjuredto(

16、otherthanduetowork)andcompletionofmedicaltreatment,isnotabletoperformhispreviousfunctionoranyotherfunctiontheEmployerassignstohim;ii. TheEmployeedoesnotshowsatisfactoryperformanceandaftertrainingandadjustingmeasuresisstillnotabletoperformsatisfactorily;iii. Thecircumstanceshavemateriallychangedfromt

17、hedatethisContractwassignedtotheextentthatitisimpossibletoexecutetheContractprovided,however,thatthepartiescannotreachanagreementtoamendthecontracttoreflectthechangedcircumstances.iv. TheEmployerisbeingconsolidatedinthelegalconsolidationperiodonthebrinkofbankruptcyorthesituationofbusinessisseriously

18、introuble,undersuchcondition,itisrequiredtoreducetheemplouee.(inlegalprocedure)g. TheEmployeeshallnotbedismissed:i. TheContracthasneitherexpirednorconformedto8.d,8.e,8.f,8.g;ii. TheEmployeeisillwithoccupationaldiseaseorinjuredduetoworkandhasbeenauthenticatedfullyorpartlydisabledbytheLabourAuthentica

19、tionCommissioninBaodiCounty,Tianjin.iii. TheEmployeeisillorinjured(otherthanduetowork)andiswithintheperiodofmedicalleaveprovidedforbyapplicablePRClawandregulationsandCompanypolicy;iv. TheEmployeeiswomanwhoispregnant,onmaternityleave,ornursingababyunderoneyearofage;orv. i.TheapplicablePRClawsandregul

20、ationsotherwiseprohibittheterminationofthisContract.h. TheContractmaybedichargedbytheEmployeebygivingnoticeinwrittenform30(thirty)daysinadvance.However,theEmployeemayinformtheEmployertodischargetheContractatrandomunderthefollowingoccasions:i. TheEmployeeisstillintheprobationaryperiod;j. .TheEmployer

21、forcetheEmployeetoworkbyviolence,duressorillegalrestrictiontophysicalfreedom;k. i.TheEmployerdoesnotpaytheremunerationoftheEmployeeaccordancewiththerelevantclauseintheContract;l. .TheEmployerviolatestherelevantregulationsofStateorTianjinforitsterriblesafeandhealthcondition,whichisharmfultotheEmploye

22、eshealth.I.TheContractcannotbeterminatedbytheEmployeebeforetheexpirationifnotconformingto8.d,8.h,j.TheEmployershallpaytheeconomiccompensationtotheEmployeriftheContractisterminatedconformingto8.d,8.f,8.h.i-8.h.iv.AdditionalfeeformedicalallowanceshouldbepaidtotheEmployeeiftheContractisterminatedconfor

23、mingto8.f.i.9.BreachLiabilitiesa. Duetoeitherpartysfault,ifbreachingtheContract,thatpartyshallundertakethebreachliabilityaccordingtotheextenttotheperformanceoftheContract;ifthepartiesbothbreachtheContract,theyshallundertakeitsseparateliabilityaccordingtotheconcretesituation.b. Duetoeitherpartysfault

24、,ifbreachingtheContracttodamagetheotherparty.The damage should be compensatedby the faulty party accordance with therelevantlawsandregulationsofPRC.c. Duetotheforcemajeure,causingthenon-performanceorthedamagestoeitherparty,theotherpartymaynotundertakethebreachliability;c.TheEmployeewantstoresignandh

25、asreceivedtrainingprovidedbytheEmployer,theEmployeeshallcompensateforthetrainingcost.Themethodofcompensationshouldbefixedaccordingtotherelevantcompanyregulationsasfollows:TheEmployeeshallcompensateRMBwithin_year(s)intheCompanyiftheContractisterminatedbytheEmployeeathiscause;TheEmployeeshallcompensat

26、eRMBwithin_year(s)intheCompanyiftheContractisterminatedbytheEmployeeathiscause;TheEmployeeshallcompensateRMBwithin_year(s)intheCompanyiftheContractisterminatedbytheEmployeeathiscause;10.LaborDisputesWherealabordisputebetweenthepartiestakesplaceduringtheperformanceofthisContract,thepartiesconcernedmayseekforas
