安防工程合同(中英文對(duì)照)

1、安防工程建設(shè)合同甲方：XXXXXX 簡(jiǎn)稱甲方乙方：YYYYYY 簡(jiǎn)稱乙方合同號(hào)：依據(jù)?中華人民共和國(guó)合同法?和國(guó)家、行業(yè)部門現(xiàn)行的建設(shè)工程質(zhì)量評(píng)定標(biāo)準(zhǔn)及設(shè)施驗(yàn)收標(biāo)準(zhǔn)的規(guī)定，經(jīng)雙方友好協(xié)商，簽訂本合同。第一條：工程合同1、 工程技術(shù)細(xì)節(jié)：依據(jù)合同附件中的工程材料明細(xì)和設(shè)計(jì)方案進(jìn)行安裝和施工。2、 工程范圍及造價(jià)：乙方負(fù)責(zé)對(duì)甲方工程現(xiàn)場(chǎng)進(jìn)行視頻監(jiān)控施工和安裝，以適應(yīng)甲方的要求，乙方須按照合同預(yù)算清單中的工程進(jìn)行施工。工程預(yù)算為人民幣： 伍萬(wàn)伍仟陸佰捌拾圓整￥55,680工程材料明細(xì)詳見(jiàn)附件。3、 工程造價(jià)變更，如在施工期間任何一方對(duì)工程提出工藝變更要求，經(jīng)雙方協(xié)商并同意變更，可簽署工程變更單，由此

2、造成的價(jià)格變動(dòng)，按照變更單上的金額結(jié)算。第二條：工程進(jìn)度所有工程分以下幾個(gè)局部進(jìn)行實(shí)施：1、 工程材料的采購(gòu) 12天2、 綜合布線施工 57天3、 設(shè)備的采購(gòu)及安裝調(diào)測(cè) 12天4、 工程完成時(shí)間：本工程必須在 2021年 月 日 之前完工。5、 如有特殊情況由甲乙雙方協(xié)商解決。第三條：工程實(shí)施：1、 甲乙雙方均應(yīng)按照合同附件中的有關(guān)設(shè)計(jì)方案和時(shí)間安排施工。2、 甲方應(yīng)指派專人到工程工程實(shí)施現(xiàn)場(chǎng)進(jìn)行協(xié)調(diào)和監(jiān)督，并就需要協(xié)商解決的問(wèn)題與乙方聯(lián)系,乙方施工人員必須支持并配合該人員的工作。3、 甲方負(fù)責(zé)聯(lián)系廠區(qū)有關(guān)工程技術(shù)人員，就施工期間出現(xiàn)的樓宇應(yīng)急問(wèn)題進(jìn)行處理。甲方應(yīng)協(xié)助乙方辦理有關(guān)施工手續(xù)。4、

3、 乙方應(yīng)按合同規(guī)定的時(shí)間提供布線工程所需的材料和設(shè)備，并提供產(chǎn)品證明。5、 乙方應(yīng)遵守甲方的各項(xiàng)管理規(guī)定，以及施工平安及防火等事項(xiàng)。乙方應(yīng)制定施工隊(duì)伍的施工平安措施及材料、工藝的正確標(biāo)準(zhǔn)，布線施工中出現(xiàn)的平安問(wèn)題，由乙方自行負(fù)責(zé)。6、 為使工程得以順利實(shí)施，雙方如有需要改動(dòng)的地方，達(dá)成一致后應(yīng)以書面形式制成備忘錄,作為本合同的補(bǔ)充條款，與合同同樣有效。第四條：驗(yàn)收1、 乙方需嚴(yán)格按照工程方案精心施工，確保工程一次交驗(yàn)到達(dá)甲方要求及測(cè)試報(bào)告的參數(shù)要求。2、 驗(yàn)收時(shí)，工程應(yīng)到達(dá)設(shè)計(jì)要求，即甲方可以立即投入使用。3、 驗(yàn)收時(shí)，乙方將以文本方式，向甲方提供布線統(tǒng)計(jì)、配置及竣工圖、測(cè)試報(bào)告、布線分配表等

4、在內(nèi)的書面文檔，以作為付款的依據(jù)。4、 驗(yàn)收標(biāo)準(zhǔn)：參照中國(guó)工程建設(shè)標(biāo)準(zhǔn)化協(xié)會(huì)標(biāo)準(zhǔn)、建筑與建筑群綜合布線系統(tǒng)工程施工及驗(yàn)收標(biāo)準(zhǔn)等，雙方協(xié)商制定。5、 甲方確認(rèn)驗(yàn)收合格后，簽發(fā)工程驗(yàn)收合格書。第五條：付款1. 工程完工并驗(yàn)收合格后，甲方須在一個(gè)月內(nèi)支付工程款90%，計(jì)人民幣 伍萬(wàn)零壹佰壹拾貳圓整￥50,112。2. 預(yù)留工程款10%作為質(zhì)保押金，工程完工后6個(gè)月付清,計(jì)人民幣伍仟伍佰陸拾捌圓整￥5,568。第六條：違約責(zé)任1、 本合同簽訂后任何一方提出終止合同執(zhí)行時(shí)，根據(jù)工程進(jìn)度按工程總款項(xiàng)的10%30%賠償對(duì)方的經(jīng)濟(jì)損失。但以下情況除外：a) 不可抗力b) 經(jīng)雙方協(xié)商解決達(dá)成一致2、 甲乙雙方應(yīng)

5、按照本合同所規(guī)定的時(shí)間表來(lái)組織安排施工與管理。甲方應(yīng)在開工之前為乙方提供適宜的施工條件，乙方應(yīng)在規(guī)定的時(shí)間內(nèi)完成工程，假設(shè)由于乙方原因造成工期延誤不能及時(shí)竣工，每延誤一天，按工程總款項(xiàng)的0.1%賠償甲方。但以下情況除外：a) 不可抗力b) 工程量變化和設(shè)計(jì)變更c(diǎn)) 一天內(nèi)，非乙方原因停電造成停工，累計(jì)超過(guò)4小時(shí)d) 乙方提出書面的工期順延請(qǐng)求而甲方兩日內(nèi)無(wú)故不予以答復(fù)的e) 合同中另行約定或雙方代表經(jīng)協(xié)商同意給予延期的其他情況3、 假設(shè)乙方施工達(dá)不到設(shè)計(jì)要求，或購(gòu)置材料明顯不能到達(dá)合同規(guī)定的質(zhì)量等級(jí)的，更換材料的費(fèi)用和由此造成的損失由乙方承當(dāng)，造成的延期參照本合同第六條第2款執(zhí)行。第七條：維護(hù)

6、及效勞1、 熱線技術(shù)效勞：乙方應(yīng)向甲方提供包括直線 、 、電子郵件等必須的通信聯(lián)絡(luò)方法，如出現(xiàn)任何問(wèn)題和故障，先由乙方技術(shù)人員提供24小時(shí)熱線效勞，假設(shè)無(wú)法解決，乙方須派技術(shù)人員2日內(nèi)提供現(xiàn)場(chǎng)技術(shù)效勞，并保證故障的解決。2、 從驗(yàn)收之日起，乙方將對(duì)本工程所提供的視頻產(chǎn)品提供整體1年的免費(fèi)維護(hù)；產(chǎn)品方面，線纜提供3年質(zhì)保，設(shè)備提供2年質(zhì)保，如果在質(zhì)保期內(nèi)設(shè)備材料本身出現(xiàn)問(wèn)題而影響使用，乙方負(fù)責(zé)免費(fèi)及時(shí)更換。3、 工程驗(yàn)收合格后發(fā)現(xiàn)的問(wèn)題，凡因施工原因造成的，乙方負(fù)責(zé)無(wú)償修理；如因甲方使用或管理不當(dāng)造成的系統(tǒng)設(shè)施損壞，乙方有償提供相關(guān)配件及效勞。第八條：本合同一式二份，甲乙雙方各持一份。自雙方簽字

12、ys2.4 Finish time: the project must be completed before2021-5-312.5 Any emergency should be solved by the mutual discussion of the Parties.3 Item implement3.1 Party A and Party B shall arrange the work according to the design plan and time relating to the appendix in the contract. Party A shall assi

13、gn a specified person in the support of the constructors of Party B to coordinate and supervise the implement of engineering item at the site and inform Party B the problem required to be solved .3.2 Party A shall instruct the relevant engineering technician to deal with the building emergencies dur

14、ing the construction and help Party B handle the relevant work procedures.3.3 According to the time stipulated in the contract, Party B shall provide the necessary material and equipment of cabling project and product certification.3.4 Party B shall comply with the regulations of Party A and other r

15、ules construction security and fire prevention and shall draw up the construction security measurements and the standard of material and technology. Any safety problem during the cabling construction is under Party Bs obligation3.5 For the sake of the successful implement of project, anything requir

16、ed to be changed by the mutual consent of the parties shall be made into written memorandum as the additional term of this contract which is as valid as contract itself.4 Acceptance4.1 When the project is checked first time, Party B shall make sure it meets the demands of the Party A and accord with

17、 the parameters of testing report.4.2 At the time when the project is checked, it shall meet the design specification, i.e. it can be used by Party A immediately.4.3 Party B shall provide Party A with written files in the form of text including cabling statistics and configuration, complete work cha

18、rt, testing report and cabling distribution table, which are considered as the basement of payment.4.4 The Parties referring to standards from China Association for Engineering Construction Standardization and construction and acceptance specification of generic cabling system for building and build

19、ing groups shall negotiate to make the acceptance standards.4.5 If the project is qualified, Party A shall issue the project acceptance certificate,5 Payment5.1 When the project is completed and proved to be qualified after the inspection, Party A should pay 90% of project price in a period of one m

20、onthRMB fifty thousand one hundred and twelve yuan￥50,112。5.2 10% of project costRMB: five thousand five hundred and sixty eight￥5,568as quality assurance deposit, which shall be fully paid after six months from the termination date of project.6 Responsibility for breach of contract6.1、One party who

21、 breach the contract after it was signed will pay for the other party 10% to 30% percent of total cost of the project according to on-going situation excluding the following cases:a) force majeureb) reach an agreement by two parties、 Both party A and party B should arrange and carry out the project

22、according to scheduled time. Party A should prepare proper constructing condition for party B before starting working and party B should finish work within stated time. Nevertheless, if party B could not finish project due to its own reason, it have to pay party A 0.1% of total cost for the project

23、per day excluding following cases: a) force majeureb) change of volume or design for the project c) power breaking off not due to party Bs reason for more than 4 hours in one dayd) party A does not reply party Bs written request for postponing working in two days without reasone) other cases shown i

24、n the contract or agreement achieved by two parties6.3、If works of party B could not reach requirement of design or materials could not reach quality requirements stated in the contract, party B should pay for cost for changing materials and loss due to this reason. Time for postponing will be arran

25、ged according to term 2 in clause 67.Hotline technical service: 1、 party B will provide party A contacting info. such as direct tel. no.，cell phone no.，email address. Any problems or faults, technical workers in party A will provide 24 hour hotline service. If it doesnt help, party B should send tec

26、hnical workers to provide technical service in spot in 2 days and ensure that the problem could be solved.2、Since checking and accepting day, party B will provide one-year free maintenance service for video product; as for other products, there will be three-year qualitative guarantee for circuitry and two-year qualitative g
