4、yAsdemand,在部門,從事(管理、銷售、技術(shù)、生產(chǎn)、后勤等)工作,并遵守崗位工作制度與合理的工作安排(包括但不限于工作內(nèi)容、工作地點(diǎn)).PartyBagreestoengagein(management/sales/technology/manufacture/logisticsetc.)workinthedepartmentandabidebytheworksystemandreasonableworkarrangement.(Includedbutunlimitedtojobcontent&workingplace.)2、乙方應(yīng)當(dāng)根據(jù)甲方崗位責(zé)任要求,保質(zhì)保量完成工作任務(wù);A
5、ccordingtoPartyAspostresponsibilityrequirement,PartyBshouldfinishworkingtaskwithqualityandquantityguaranteed.3、 甲方本著“一專多能、 一職多崗的用人原那么,可以根據(jù)經(jīng)營(yíng)需要及乙方的工作水平調(diào)整乙方的工作職務(wù)和崗位,乙方應(yīng)服從安排.Basedontheprincipleof“oneskillwithmultipleability,onepostwithmultiplework,andaccordingtothebusinessdemandandPartyBscompetence,Par
6、tyAmayadjustPartyBsdutyandpost,whilePartyBshouldobeytheadjustment.三、勞動(dòng)保護(hù)和勞動(dòng)條件LaborProtection&LaborCondition1、甲方根據(jù)國(guó)家有關(guān)平安生產(chǎn)、勞動(dòng)保護(hù)、職業(yè)衛(wèi)生的規(guī)定,為乙方提供必要的工作條件和勞動(dòng)保護(hù)設(shè)施,保證乙方的平安與健康;Accordingtotherelatedstipulationofsafetymanufacture/laborprotection/occupationalhealthfromthestate,PartyAprovidesnecessaryworkingc
7、onditionandlaborprotectionfacilities,insuringPartyBssafetyandhealth.2、甲方根據(jù)國(guó)家有關(guān)規(guī)定制定工時(shí)制度,乙方確因生產(chǎn)經(jīng)營(yíng)需要延時(shí)的,甲方應(yīng)當(dāng)依法安排乙方補(bǔ)休或支付相應(yīng)的加班費(fèi);假設(shè)乙方實(shí)行的是級(jí)別工資,那么在當(dāng)月的績(jī)效考核中表達(dá);Accordingtotherelevantregulationsofworkinghoursystem,ifPartyBneedstoextendtheworkinghoursduetotheneedofproductionandoperation,partyAshallarrangepartyB
8、compensatorytimeofforpayovertimesalaryinaccordancewiththelaw;IfpartyBisimplementedwagelevels,thecompensationshouldbereflectedintheperformanceappraisalforthemonth.3、 甲方根據(jù)國(guó)家有關(guān)規(guī)定為孕期、 產(chǎn)期、 哺乳期的女職工提供勞動(dòng)保護(hù);PartyAshouldprovideprotectionforwomenworkersinpregnancy,childbirth,breastfeeding,inaccordancewiththere
9、levantprovisionsoftheState.4、甲方負(fù)責(zé)對(duì)乙方進(jìn)行政治思想、職業(yè)道德、業(yè)務(wù)技術(shù)、勞動(dòng)平安衛(wèi)生及有關(guān)規(guī)章制度的告知、教育和培訓(xùn).PartyAisresponsibletoprovidepoliticalideology,professionalethics,businesstechnology,laborsafetyandhygiene,andrelatedrules,educationandtrainingforPartyB.四、勞動(dòng)報(bào)酬Laborremuneration根據(jù)“按勞分配原那么,實(shí)行同工同酬,乙方的報(bào)酬不得低于當(dāng)?shù)刈畹凸べY標(biāo)準(zhǔn).具體薪酬標(biāo)準(zhǔn)、支付方式以及
10、支付時(shí)間按公司制定的?薪酬治理制度?執(zhí)行.Accordingtotheprincipleofdistribution,andequalpayforequalwork,remunerationofPartyBshallnotbelowerthanthelocalminimumwagestandard.Specificcompensationstandards,payment,andtimeissetbythe“thesystemofcompensationmanagementbythecompany五、社會(huì)保險(xiǎn)SocialInsurance甲方應(yīng)根據(jù)國(guó)家有關(guān)社會(huì)保險(xiǎn)的法律、法規(guī)和政策為乙方繳納根
11、本養(yǎng)老、根本醫(yī)療、失業(yè)、工傷、生育保險(xiǎn)費(fèi)用;社會(huì)保險(xiǎn)費(fèi)個(gè)人繳納局部,甲方從乙方工資中代扣代繳.Inaccordancewithnationallaws,regulationsandpoliciesrelatingtosocialinsurance,PartyAshallpaythebasicpension,basicmedical,unemployment,workinjuryandmaternityinsurancecosts,forthePartyB;socialinsurancepremiumspaidbyindividualspartiswithholdwagesfromPartyB.
12、六、勞動(dòng)紀(jì)律和規(guī)章制度Labordisciplineandregulations1、甲方依法制定的勞動(dòng)紀(jì)律和規(guī)章制度,乙方有義務(wù)遵守;LabordisciplineandregulationslegallystipulatedbypartyA,partyBshallhavethedutytoabidebyit.2、簽訂本合同前,甲方已對(duì)乙方進(jìn)行了勞動(dòng)紀(jì)律、操作規(guī)程、治理制度等相應(yīng)的培訓(xùn);Beforesigningthiscontract,PartyAhastoprovidepartyBthelabordiscipline,operatingprocedures,managementsystem
13、andthecorrespondingtraining3、乙方應(yīng)當(dāng)遵守甲方的工作操作規(guī)程,服從工作安排;PartyBshallabidebytheworkingprocedures,obeytheworkarrangementofpartyA.4、 乙方違反勞動(dòng)紀(jì)律或規(guī)章制度,甲方有權(quán)按本單位的規(guī)章制度,給予紀(jì)律處分,直至解除本合同.IfPartyBviolateslabordisciplineorregulations,PartyAisentitledbytherulesoftheunittogivePartyAdisciplinaryaction,uptoterminatethiscont
14、ract.七、勞動(dòng)合同的變更Thechangeoflaborcontract訂立本合同所依據(jù)的客觀情況發(fā)生重大變化,致使本合同無法繼續(xù)履行的,經(jīng)雙方協(xié)商同意,予以變更勞動(dòng)合同相關(guān)內(nèi)容.Iftheobjectivesituationthiscontractbasedon,changessignificantly,toresultthecontractunabletoperform,bymutualconsent,relatedcontentinlaborcontractsshallbechanged.八、勞動(dòng)合同的解除Theremoveoflaborcontract一雙方協(xié)商一致,勞動(dòng)合同可以解
15、除.Thetwopartymayterminatethelaborcontractwithmutualagreement.二乙方有以下情形之一的,甲方可以即行解除勞動(dòng)合同:Ofanyofthefollowingcircumstances,partyAmayimmediatelyterminatethelaborcontract.1、在試用期內(nèi)被證實(shí)不符合錄用條件的;Beenprovennottomeettheconditionsofemploymentduringthetrialperiod.2、采取欺詐手段訂立本合同的;Adoptedfraudulentmeanstoenterintothi
16、scontract.3、嚴(yán)重違反勞動(dòng)紀(jì)律或規(guī)章制度給甲方造成重大損害的;SeriouslyviolatedlabordisciplineorregulationstocausesignificantharmtothePartyA.4、嚴(yán)重失職、營(yíng)私舞弊,或泄露甲方商業(yè)秘密,給甲方利益造成重大損失的;Grossnegligence,malpractice,ordisclosureoftradesecretsPartyA,tocauseheavylossestotheinterestsofthePartyA.5、乙方同時(shí)與其他用人單位建立勞動(dòng)關(guān)系,對(duì)完本錢單位的工作任務(wù)造成嚴(yán)重影響,或者經(jīng)用人單位
17、提出,拒不改正的;PartyAbuiltlaborrelationshipswithotherunit,tocauseaseriousimpactonthecompletionofthetasksoftheunit,orrefusedtocorrecttherulesmadebytheemployer6、被依法追究刑事責(zé)任的.Beinvestigatedforcriminalresponsibilityaccordingtolaw三有以下情形之一的,甲方可以提前30日以書面形式通知乙方解除勞動(dòng)合同:Ofthefollowingcircumstances,PartyAcangivenoticet
18、oinformPartyBtoterminatethelaborcontractaheadof30days.1、乙方不能勝任工作,經(jīng)培訓(xùn)或調(diào)整工作崗位仍不能勝任工作的;PartyBisnotcompetentforwork,aftertrainingoradjustmentofjobs.2、乙方患病或者非因工負(fù)傷,醫(yī)療期滿后,不能從事原工作,也不能從事甲方另行安排工作的;PartyBwasillorinjuredduetonon-workrelation,aftercompletionofmedical,PartAisnotcompetentforhisoriginalwork,oralter
19、nativearrangedjobs.3、勞動(dòng)合同訂立時(shí)所依據(jù)的客觀情況發(fā)生重大變化,致使勞動(dòng)合同無法履行,雙方協(xié)商不能就變更勞動(dòng)合同達(dá)成協(xié)議的.Iftheobjectivesituationthiscontractbasedon,changessignificantly,toresultthecontractunabletoperform,mutualconsentcannotbereached,inchangeofthislaborcontracts.四有以下情形之一的,甲方可以提前30日通知工會(huì),經(jīng)工會(huì)同意后,與乙方解除勞動(dòng)合同:Ofthefollowingcircumstances,P
20、artyAcangivenoticeaheadof30days,toinformtheLaborUnion,afteragreement,PartyAmayterminatethelaborcontract.1、甲方依照企業(yè)破產(chǎn)法規(guī)定進(jìn)行重整的;PartyArestructuredpursuanttotheEnterpriseBankruptcyLaw2、甲方生產(chǎn)經(jīng)營(yíng)發(fā)生嚴(yán)重困難的;ProductionandbusinessoperationofPartyAmetseriousdifficulties.3、甲方轉(zhuǎn)產(chǎn)、重大技術(shù)革新或者經(jīng)營(yíng)方式調(diào)整,經(jīng)變更勞動(dòng)合同后,仍需裁減人員的;product
21、ion,technologicalinnovationorbusinessmethodofPartyAadjusted,afterthechangeoflaborcontracts,stillneededtoreducestaff.4、其他因勞動(dòng)合同訂立時(shí)依據(jù)的客觀經(jīng)濟(jì)情況發(fā)生重大變化,致使勞動(dòng)合同無法履行的.Ifotherobjectivesituationthiscontractbasedon,changessignificantly,toresultthecontractunabletoperform.五乙方有以下情形之一的,甲方不得解除勞動(dòng)合同:Ofanyofthefollowingc
22、ircumstances,partyAcannotterminatethelaborcontract.1、在本單位患職業(yè)病或者因工負(fù)傷并被確認(rèn)喪失或者局部喪失勞動(dòng)水平的;Injuredduetooccupationaldiseaseorwork-relatedreasons,andwasconfirmedashavinglostorpartiallylosttheabilitytowork.2、患病或者非因工負(fù)傷,在規(guī)定的醫(yī)療期內(nèi)的;Illnessornon-workrelatedinjurywithintheprescribedperiodofmedicaltreatment.3、女職工在孕
23、期、產(chǎn)期、哺乳期的;womenworkersinpregnancy,childbirth,breastfeeding.4、在本單位連續(xù)工作滿十五年,且距法定退休年齡缺乏五年的;Workedcontinuouslyfor15yearsandlessthanfiveyearsawayfromhislegalretirementageInthisunit.5、法律、行政法規(guī)規(guī)定的其他情形.Othercircumstancesstipulatedbylawsandadministrativeregulations.六乙方解除勞動(dòng)合同,應(yīng)當(dāng)提前三十日試用期內(nèi)提前三日以書面形式通知甲方,甲方在乙方完成業(yè)務(wù)
24、以及清理完債權(quán)債務(wù)的情況下,可以解除勞動(dòng)合同.Ofthefollowingcircumstances,PartyBshallgivenoticetoinformPartyAtoterminatethelaborcontractaheadof30daysaftercleaningupthecreditsanddebts.七有以下情形之一的,乙方可以通知甲方解除勞動(dòng)合同:Ofthefollowingcircumstances,PartyBmaygivenoticetoinformPartyAtoterminatethelaborcontract.1、在試用期內(nèi)的;Duringthetrialper
25、iod.2、甲方以暴力、威脅或者非法限制人身自由的手段強(qiáng)迫勞動(dòng)的;PartyAforcedPartyAtolaborbyviolence,threatorillegalrestrictionofpersonalfreedom.3、甲方未按勞動(dòng)合同約定提供勞動(dòng)保護(hù)和勞動(dòng)條件的;PartyAfailedtoprovidethelaborprotectionandlaborconditions.4、甲方未根據(jù)勞動(dòng)合同的約定支付工資報(bào)酬的;PartyAfailedtopaywagesinaccordancewiththelaborcontract.5、法律、行政法規(guī)規(guī)定勞動(dòng)者可以解除勞動(dòng)合同的其他情形
26、.Othercircumstancesstipulatedbylaws,administrativeregulationsbywhichemployeemayterminatethelaborcontract.九、勞動(dòng)合同的終止Terminationoflaborcontracts一有以下情形之一的,勞動(dòng)合同即行終止:Ofanyofthefollowingcircumstances,thelaborcontractmaybeimmediatelyterminate1、勞動(dòng)合同期滿的;Thelaborcontractexpired.2、勞動(dòng)者開始依法享受養(yǎng)老保險(xiǎn)待遇的;Workersbegant
27、oenjoyendowmentinsurancetreatmentlawfully.3、勞動(dòng)者死亡,或者被人民法院宣告死亡或者宣告失蹤的;Laborerdied,orwasdeclareddeadormissingbythepeoplescourt.4、甲方被依法宣告破產(chǎn)的;PartyAwasdeclaredbankruptbythepeoplescourt5、甲方被撤消營(yíng)業(yè)執(zhí)照、責(zé)令關(guān)閉、撤銷或者提前解散的;BusinesslicenseofPartyBwasrevoked,orderedtoclose,cancellationorearlydissolutionof.6、法律、行政法規(guī)規(guī)定
28、的其他情形.Othercircumstancesstipulatedbylaws,administrativeregulations.二乙方應(yīng)在勞動(dòng)合同期滿前30天通知甲方,甲方同意續(xù)訂,乙方應(yīng)及時(shí)申請(qǐng)辦理續(xù)訂手續(xù);假設(shè)甲方不同意續(xù)訂,到期即辦理終止合同手續(xù).乙方未辦理終止合同手續(xù)而離職的,甲方保存追究其法律責(zé)任的權(quán)利.PartyBshallgivenoticetoinformPartyAtorenewthelaborcontractaheadof30days.IfPartyAdisagreedtonewalease,thelaborcontractwouldgoexpire.IfPartyB
29、leftwithouttheterminationprocedures,PartyAwouldretainrighttopursueitslegalresponsibility.十、違反勞動(dòng)合同的責(zé)任Breachofdutyofthelaborcontract一賠償經(jīng)濟(jì)損失Compensationforeconomiclosses甲方有以下情形之一,給乙方造成經(jīng)濟(jì)損失的,應(yīng)當(dāng)承當(dāng)賠償責(zé)任:Ofanythefollowingcircumstances,partyAshallbeliableforcompensationoftheeconomiclossesofpartyB.1、由于甲方制定的勞動(dòng)
30、合同條款無效的;SinceLaborPartyestablishedthetermsoftheinvalidcontract;2、違反勞動(dòng)合同法規(guī)定的條件解除勞動(dòng)合同的.Conditionsinviolationoftheprovisionsofthe“LaborContractLaw“toterminatethelaborcontract.乙方有以下情形之一,給甲方造成經(jīng)濟(jì)損失的,還應(yīng)當(dāng)承當(dāng)賠償責(zé)任:Ofanythefollowingcircumstances,partyBshallbeliableforcompensationoftheeconomiclossesofpartyA.1、 乙
31、方違反?勞動(dòng)合同法?規(guī)定的條件或者勞動(dòng)合同的約定解除勞動(dòng)合同,給甲方造成經(jīng)濟(jì)損失的,應(yīng)當(dāng)根據(jù)損失的程度,承當(dāng)賠償責(zé)任;PartyBviolatedtheconditionsintheLaborContractLaworterminatedthelaborcontracttocausetheeconomiclossesofpartyA,PartyBshallbeliableforcompensationoftheeconomiclossesofpartyA.2、乙方違反勞動(dòng)合同約定的保密事項(xiàng),給甲方造成經(jīng)濟(jì)損失的,應(yīng)當(dāng)依法承當(dāng)賠償責(zé)任;ConfidentialmattersPartyviolationsoflabo
