2、我國(guó)強(qiáng)制隔離戒毒的法律研究 類別（領(lǐng)域）：法學(xué) 學(xué)位申請(qǐng)人：XXX 指導(dǎo)教師：XXX教授 摘 要 當(dāng)前，毒品濫用問(wèn)題在我國(guó)日益嚴(yán)重，已成為影響社會(huì)安好穩(wěn)定的重要因素。2022年出臺(tái)的中華人民共和國(guó)禁毒法融合了公安強(qiáng)制、勞教戒毒兩種傳統(tǒng)戒毒模式，在重構(gòu)我國(guó)戒毒體制根基上，第一次設(shè)立了 “強(qiáng)制隔離戒毒”制度。禁毒法實(shí)施以來(lái)，強(qiáng)制隔離戒毒作為一種特意針對(duì)我國(guó)吸毒成癮人群實(shí)施的戒毒模式，對(duì)遏制我國(guó)毒品濫用問(wèn)題發(fā)揮了重要作用，對(duì)維護(hù)我國(guó)社會(huì)穩(wěn)定意義重大。然而，強(qiáng)制隔離戒毒制度也因禁毒法、禁毒條例中相關(guān)立法的不完善，未對(duì)傳統(tǒng)戒毒體系的敝端舉行必要的改革，使得我國(guó)強(qiáng)制隔離戒毒制度在概括實(shí)施存在一些亟待解決的

3、問(wèn)題，本文針對(duì)這些問(wèn)題提出了一些完善該制度的建議。 本文首先以強(qiáng)制隔離戒毒的一般理論為啟程點(diǎn)，概述了強(qiáng)制隔離戒毒模式的法律特征和本質(zhì)，對(duì)該模式和其他禁毒模式的識(shí)別和聯(lián)系舉行了提煉和總結(jié)，闡述了強(qiáng)制隔離戒毒制度在我國(guó)戒毒體系中的地位和作用； 結(jié)合禁毒法、禁毒條例等相關(guān)法律文件以及該制度實(shí)際運(yùn)行過(guò)程中的處境，理論聯(lián)系實(shí)際，從法律實(shí)施主體、救濟(jì)途徑等五個(gè)方面分析了當(dāng)下我國(guó)強(qiáng)制隔離戒毒體系存在的法律問(wèn)題。結(jié)果，通過(guò)對(duì)域外國(guó)家和地區(qū)的類似戒毒模式舉行借鑒和對(duì)比，提出完善強(qiáng)制隔離戒毒制度的相關(guān)想象。 在我國(guó)現(xiàn)有的戒毒模式中，強(qiáng)制隔離戒毒的地位舉足輕重。雖然強(qiáng)制隔離戒毒制度在立法層面存在缺陷，但不能全盤(pán)否決

4、其在我國(guó)現(xiàn)行戒毒工作中發(fā)揮的積極作用。我們應(yīng)當(dāng)立足我國(guó)概括國(guó)情，專心總結(jié)強(qiáng)制隔離戒毒制度立法中存在的問(wèn)題，同時(shí)借鑒域外國(guó)家和地區(qū)的先進(jìn)做法和告成閱歷，以降低復(fù)吸率、保障人權(quán)、促進(jìn)禁毒工作法治化為目標(biāo)，從加強(qiáng)執(zhí)法主體權(quán)力制約、暢通法律救濟(jì)渠道、保障戒治人員合法權(quán)益、側(cè)重戒毒過(guò)程醫(yī)療性質(zhì)、強(qiáng)化檢察監(jiān)視機(jī)制等五個(gè)方面對(duì)該制度舉行“革新”和完善，讓強(qiáng)制隔離戒毒制度真正表達(dá) “權(quán)責(zé)統(tǒng)一，程序正值，以人為本、科學(xué)戒毒”的戒治原那么，更好的提升我國(guó)戒毒工作的社會(huì)效果和法律效果。 關(guān) 鍵 詞：強(qiáng)制隔離戒毒； 禁毒法；戒毒模式 論文類型：應(yīng)用研究 Title: Perfecting Legal Research

The “Peoples Republi

6、c of China Anti-Drug Law“ promulgated in 2022 incorporates two traditional modes of detoxification, including compulsory public security and reeducation through labor, and has established the “compulsory isolation and detoxification“ system for the first time on the basis of reconstructing Chinas dr

7、ug treatment system. Since the implementation of the Anti-Drug Law, the compulsory isolation of drug addiction as a form of detoxification specifically targeted at drug addiction groups in China has played an important role in curbing the problem of drug abuse in China and is of great significance t

8、o safeguarding social stability in our country. However, due to the imperfections in the relevant laws in the Anti-Drug Law and the Anti-Drugs Regulations, the compulsory isolation drug treatment system has not carried out the necessary reform of the traditional anti-drug system, which has caused so

9、me urgent needs for the implementation of the compulsory isolation drug treatment system in China. This paper proposes some suggestions for improving the system in response to these problems. This article begins with the general theory of compulsory isolation and treatment of detoxification. It outl

10、ines the legal characteristics and nature of the compulsory isolation detoxification model, refines and summarizes the differences and links between this model and other anti-narcotics models, and expounds the compulsory isolation drug rehabilitation system in China. The position and role of the sys

11、tem; combined with relevant laws and documents such as the Anti-Drug Law and the Anti-Drug Ordinance, and the actual operation of the system, the theory is linked to reality, and the current situation in China is analyzed from five aspects: the main body of law enforcement and the relief approach. T

12、here are legal issues in the compulsory isolation and detoxification system. Finally, through reference and comparison of similar detoxification models in countries and regions outside the region, the author proposes relevant concepts for improving the compulsory isolation and detoxification system.

13、 In the existing mode of drug treatment in our country, the status of compulsory isolation and detoxification plays an important role. Although the compulsory isolation drug treatment system has flaws at the legislative level, it cannot completely deny its active role in the current drug treatment w

14、ork in China. We should base our countrys specific national conditions, conscientiously sum up the problems in the legislation of the compulsory isolation drug rehabilitation system, and draw on the advanced practices and successful experiences of foreign countries and regions to reduce the relapse

15、rate, safeguard human rights, and promote the rule of law of anti-drug work. Strengthen the power constraints of law enforcement subjects, smooth access to legal relief channels, safeguard the legitimate rights and interests of drug addicts, lay emphasis on the medical nature of drug treatment, stre
