北京市外籍員工雇傭合同(中英文)ContractofForeignStaffEmployment甲方：PartyA：地址：Address：乙方PartyB：性別Gender國籍Nationality：護照號碼PassportNo.在京居住地址Address(Beijing)：聯(lián)系方式Contact：其他緊急聯(lián)絡人Contactpersonincaseofemergency：乙雙方遵循合法公平、平等自愿、協(xié)商一致、誠實信用的原則，簽訂本合同，并承諾共同遵守。PartyAandPartyBagreetosignthiscontractandpledgetofulfillalltheobligationsstipulatedhereinafter,inlinewiththeprinciplesoflegality,justice,equality,voluntarinessandmutualagreement.一、雇傭期限Employmentterm雇傭期限為年，自年月日起至年月日止，其中試用期為個月，自年日起至年月日止。Theemploymenttermisyear(s),lastingfromto.Theprobationperiodismonth(s),lastingfromto.二、雇傭內(nèi)容及工作時間Contentandworkinghours2.1甲方根據(jù)工作需要，安排乙方完成以下內(nèi)容的工作任務：PartyAgivesPartyBthefollowingworkassignmentsaccordingtoitsoperatingrequirements:工作內(nèi)容Jobresponsibilities：工作地點Place：2.2工作時間：乙方每日工作時間不超過8小時，平均每周工作不超過40小時，每周休息日為周六、日。甲方安排乙方延長工作時間，應安排乙方同等時間補休或依法支付加班酬勞。PartyBworksnomorethan8hoursperday,nomorethan40hoursperweek,andSaturdayandSundayaresetastheofficialweeklyrestdays.PartyAmayextendParty'sB'sworkinghoursonthebasisofmutualagreement,andpartyBshallgetcorrespondingdeferredholidaysorpaidfortheextendedworkhoursinaccordancewithrelevantlawsandregulations.三、報酬及其他福利Remunerationandotherwelfarebenefits乙方的報酬為稅前元/月，大寫：乙方在試用期期間的報酬為稅前元/月，大寫：PartyB'試用期過后，甲方為乙方提供住房補助￥5000.00元/月(伍千元人民幣每月)，甲方憑乙方出具的租房發(fā)票報銷，報銷時間在每月的8號。如遇節(jié)假日或休息日，應提前到最近的工作日支付，如因特殊原因延期支付報酬的，甲方應在五個工作日內(nèi)向乙方說明原因。Aftertheprobation,PartyAshallprovidePartyBwithamonthlyhousingallowanceofRMB5,000.00.PartyAshallprovidetheinvoiceofrentpaymentforreimbursement.Themonthlydateforreimbursementisonthe8thdayofeachmonth.Ifthe8thdayofthemonthfallsintheweekendor,thepaymentshallbebroughtforwardtothenearestweekday.PartyAshallinformPartyBandexplainthedetailedreasonwithin5workdaysincasePartyAfailstopaythesalaryduetospecialreasons.甲方應于每月8號以貨幣或轉(zhuǎn)帳形式足額支付乙方上述報酬。如遇節(jié)假日或休息日，應提前到最近的工作日支付，如因特殊原因延期支付報酬的，甲方應在五個工作日內(nèi)向乙方說明原因。PartyAshallpaysalarytoPartyBbeforethe8thdayofeverymonthintheformofcashorbanktransfer.Ifthe8thdayofthemonthfallsintheweekendor,thepaymentshallbebroughtforwardtothenearestweekday.PartyAshallinformPartyBandexplainthedetailedreasonwithin5workdaysincasePartyAfailstopaythesalaryduetospecialreasons.甲方可根據(jù)生產(chǎn)經(jīng)營的狀況或乙方任務量和工作表現(xiàn)，適時調(diào)整乙方的報酬。PartyAcanadjustPartyB'ssalaryaccordingtoitsoperatingconditions,PartyB'sworkloadandperformance.當乙方的工作任務發(fā)生變化時，甲方可按規(guī)定調(diào)整其相應的報酬。乙方接受新的工作任務后，即視作接受甲方按照該工作任務重新確定的報酬。PartyB'slaborremunerationwillbeadjustedincasePartyAadjustsPartyB'sjobresponsibilities.Acceptingthenewpositionisregardedasacceptingtheadjustedsalary.乙方應遵守國家及地方的稅法制度，自行繳納其個人收入的個人所得稅，甲方無義務為其代繳。PartyBshallpaypersonalincometaxvoluntarilyaccordingtothestate'staxlaw.PartyAdoesn'tshouldertheresponsibilitytowithholdandremittaxesforPartyB.乙方在合同期內(nèi)享受中國法律規(guī)定的節(jié)日，公休假日，另外公司每年為其提供5天的帶薪休假。PartyBisentitledwithalllegalholidaysinaccordancewiththestate'sregulations,Inaddition,PartyBenjoysapaidleaveof5dayseachyear.四、雇傭合同的解除和終止ContractCancellationandTermination合同期滿雙方不再續(xù)簽或者雙方約定的合同終止條件出現(xiàn)時，雇傭合同即終止。Thiscontractshallbeterminatedonceitexpiresandbothpartiesdonotextendthecontract.經(jīng)合同雙方當事人協(xié)商一致，本合同可以解除。Thecontractmaybecanceledbasedonbothparties'mutualnegotiation.乙方應遵守中國政府的法律、法規(guī)及有關規(guī)定，乙方如違反上述規(guī)定，甲方有權(quán)即時解除合同；乙方因健康原因，經(jīng)醫(yī)生證明連續(xù)病休15工作日后仍不能繼續(xù)工作，甲方有權(quán)提前終止合同。PartyBshouldabidebyChinalaws,decreesandrelatedregulationsandPartyA'sworkingsystems.Duringtheduration,PartyAisentitledtocancelthecontractincasePartyBviolatesChinalawsanddecrees,andterminatethecontractbeforeexpirationincasePartyBcannotresumehisorherworkforhealthreasonsafterthemedicalcertificationofcontinuoussickrestfor15workingdays.乙方因歸國或其他私人原因未正常出勤且超過十天且未向甲方做出書面說明的，本合同自動終止。ThecontractwillautomaticallyterminateincasePartyBisabsentforover10dayswithoutwrittenexplanationduetohomecomingorotherprivatereasons.4.5乙方被證明無法完成本合同項下的工作任務，甲方有權(quán)隨時解除本合同。Aisentitledtocancelthecontractatanytime.乙方應嚴格遵守甲方的工作規(guī)定以及規(guī)章制度，盡職盡責，否則，甲方有權(quán)隨時解除合同并追究因此而造成的經(jīng)濟損失，并有權(quán)對所造成的經(jīng)濟損失在乙方的報酬中作相應扣除。PartyBshouldabidebyPartyA'sworkingsystems,rulesandregulations.Otherwise,PartyAisentitledtocancelthecontractandclaimacorrespondingcompensationofan
