對工程承包商保險(xiǎn)責(zé)任的要求（中英文對照）InsurancetobetakenoutbytheContractor.承包商承擔(dān)保險(xiǎn)：Inaccordancewiththeprovisionsofcontract,theContractorshallatitsexpensetakeoutandmaintainineffect,orcausetobetakenoutandmaintainedineffect,duringtheperformanceoftheContract,theinsurancesetforthbelowinthesumsandwiththedeductiblesandotherconditionsasspecified.TheidentityoftheinsurersandtheformofthepoliciesshallbesubjecttotheapprovalofEMPLOYER.ThecostsforinsurancetobeincludedinBidprice依照合同之規(guī)定，在合同履行期間，承包商負(fù)責(zé)投?；虼俪赏侗Ｒ员３衷摫ｋU(xiǎn)有效，保險(xiǎn)金額、扣除條款及其他條件規(guī)定如下。保險(xiǎn)公司和保險(xiǎn)單形式均須獲得業(yè)主正式批準(zhǔn)。標(biāo)價(jià)含保險(xiǎn)費(fèi)。1.ConstructionandErectionInsurance施工和安裝保險(xiǎn)ThefollowinginsuranceshallbetakenoutandmaintainedbytheContractorduringtheperiodofdelivery/installation/construction/fieldtesting/commissioning/trialoperationattheSiteoftheWorkscoveredundertheContract:依照合同規(guī)定，承包商須在現(xiàn)場工程交付/安裝/施工/現(xiàn)場測試/調(diào)試/試運(yùn)行期間投保和保持以下保險(xiǎn)：(a)ErectionAllRisksInsurancetocovertheentireWorks(permanentand/ortemporary)fromanyandallkindsofdamageswhichitisstandardinternationalpracticeforacontractortoinsureundersuchapolicy;“安裝一切險(xiǎn)”：范圍含全部工程保險(xiǎn)（永久和/或臨時(shí)性工程保險(xiǎn)），即承包商依照保險(xiǎn)單規(guī)定按標(biāo)準(zhǔn)國際慣例投保的所有損害保險(xiǎn)；(b)"Third-PartyLiabilityInsurance"tocoverinjuryordeathtopersonsordamagestopropertycausedbytheWorksorbytheContractor'svehicles,toolsand/orequipmentorperEmployerpersonnel;“第三方責(zé)任險(xiǎn)”：范圍包括由于工程施工或承包商的車輛、工具和/或設(shè)備或工作人員造成的人員傷亡或財(cái)產(chǎn)損害；(c)"Workman'sCompensationInsurance".ThistypeofinsuranceisrequiredunderLawtobesecuredbytheContractorforhisemployees.TheContractorshall,therefore,faithfullycomplywiththerequirementsofsaidlaw.依照法律規(guī)定，承包商須保證為其雇員提供“職工賠償保險(xiǎn)”。因此，承包商應(yīng)如實(shí)遵照上述法律要求為其雇員投保職工賠償保險(xiǎn)。(d)AutomobileLiabilityInsurance“機(jī)動車責(zé)任保險(xiǎn)”：CoveringuseofallvehiclesusedbytheContractororitsSubcontractors(whetherornotownedbythem)inconnectionwiththeexecutionoftheWorks.“機(jī)動車責(zé)任保險(xiǎn)”：范圍包括承包商或其分包商為執(zhí)行施工使用的所有機(jī)動車輛(無論所述機(jī)動車輛是否屬于承包商或其分包商所有)的責(zé)任保險(xiǎn)。TheContractorhastheresponsibilitytoensuretheinsurancesasmentionedabovebythewaytoemployatrustyInsuranceCompanywhichisacceptabletoEMPLOYER.TheseinsuranceswillbeeffectivetoFinalAcceptanceCertificateissuedbyOwnerspecifiedinContractAgreement.承包商負(fù)責(zé)確保提供上述所有保險(xiǎn)，并投保守信可靠的、業(yè)主接受的保險(xiǎn)公司。上述保險(xiǎn)的有效期至業(yè)主發(fā)出合同協(xié)議規(guī)定的最終驗(yàn)收證書之日。Beforecommencingthesoilinvestigationworksatsite,theContractorshallsubmittheaboveInsurancePoliciestogetherwiththeofficialreceiptsevidencingpremiumpayments.在現(xiàn)場進(jìn)行土地勘察工作之前，承包商應(yīng)連同正式收據(jù)一起提交上述保險(xiǎn)單，以證明其已經(jīng)支付保險(xiǎn)金。BeneficiaryforErectionAllRisksshallbetheContractorwithinthePlantfence,andEMPLOYERoutofthePlantfence;BeneficiaryforThirdPartyLiabilityRiskshallbeEMPLOYER.安裝一切險(xiǎn)受益人為電廠圍墻內(nèi)的承包商，以及電廠圍墻外的業(yè)主；第三者責(zé)任險(xiǎn)受益人為業(yè)主。DeductibleslimitforErectionAllRisks:安裝一切險(xiǎn)的免賠額限制如下：USD200,000.00A.O.AforLossorDamageduetoActsofGod由于自然災(zāi)害造成的任何一次事故的損失或損害扣除金額為200,000.00美元；USD200,000.00A.O.AforLossorDamageduetoCommissioning/TestingandMaintenancecausedbyTurbine由于汽輪機(jī)的調(diào)試/測試和維修期間發(fā)生造成的任何一次事故的損失或損害扣除金額為200,000.00美元；DeductiblelimitforThirdPartyLiabilitiesapplicableforpropertydamage:USD5000.00A.O.A適用于財(cái)產(chǎn)損害的第三方責(zé)任險(xiǎn)的免賠額限制為：一次事故5000.00美元。DeductiblelimitforThirdPartyLiabilitiesapplicableforpersonalinjury:Nil適用于人員傷害險(xiǎn)的第三方責(zé)任險(xiǎn)的免賠額限制為：零美元。BeforePAC,theOwnershallbearthedeductiblesforthelossand/ordamagewhichiscausedbyreasonoftheOwner(includinghisemployeeandconsultant);Ifthelossand/ordamageiscausedbyanythirdparty,theContractorshallbearthedeductiblesforthelossand/ordamagewhichcannotbeclaimedfromtheinsurer;TheContractorshallbearthedeductiblesforthelossand/ordamagewhichiscausedbyotherreason(excludingForceMajeure)；FromPACtoFAC,theContractorshallbearthedeductiblesforthelossand/ordamagewhichiscausedbytheContractor.EMPLOYERshallbearthedeductiblesforthelossand/ordamagewhichiscausedbyotherreasons.臨時(shí)驗(yàn)收之前，業(yè)主須承擔(dān)由于其(包括業(yè)主雇員和顧問人員)造成的損失和/損害的免賠額；若上述損失和/損害由于任何第三方造成，承包商須承擔(dān)造成的損失和/損害的免賠額（該部分保險(xiǎn)金不能由保險(xiǎn)公司賠付）。承包商還須承擔(dān)由于任何其他原因（不含不可抗力因素）造成的損失和/損害的免賠額；臨時(shí)驗(yàn)收到最終驗(yàn)收期間，承包商須承擔(dān)其自己造成的損失和/損害的免賠額。由于其他原因造成的損失和/損害的免賠額則由業(yè)主承擔(dān)。TheContractor確保業(yè)主免于任何由于承包商或分包商的現(xiàn)場人員的所有事故、疾病或死亡引起或與事故、疾病或死亡有關(guān)的shallindemnifyEMPLOYERagainstallactions,suits,claim?s,demands,costorexpensesarisingfromorinconnectionwithanyaccident,illnessordeath(otherthansuchasmaybeattributabletoEMPLOYER,itsagentsorservEmployerants)topersonsemployedbytheContractororhisSubcontractoratSite.承包商應(yīng)確保業(yè)主免于任何由于承包商或分包商的現(xiàn)場人員的所有事故、疾病或死亡引起或與事故、疾病或死亡有關(guān)的（不是由于業(yè)主、其代理商或雇員引起）所有訴訟、訟案、索賠、要求、成本或費(fèi)用。TheContractorshallindemnifyEMPLOYERagainstalllossand/ordamagearisingfromitsimproperdesignfortheWorks.承包商須向由于其工程設(shè)計(jì)不當(dāng)對業(yè)主造成的所有損失和/損害提供賠償。TheContractorshallinitiateandsuccessfullyobtainsecuritypaymentscoveringlossesand/ordamagesarisingoutoftheContract.FailuretoinitiateEmployerorsettletheclaimwithinareasonableperiodoftimeshallconstitutesufficientgroundsforEMPLOYERtoexerciseitsrightsundertheContract.ShouldtheContractorfailorrefusetomaintainitsinsuranceabove,EMPLOYERwillsecure,renewormaintainsaidinsurance,andanyandallexpensesincurredtherebyshallbedeductedfromanyandallsumsdueormaybecomeduetotheContractor.ThePerformanceBondsubmittedbytheContractorshallalsobeusedwherenecessarytocoversuchexpenses.承包商應(yīng)發(fā)起和獲得所有損失和/損害的賠償金。若承包商未能在合理的期限內(nèi)開始或解決該索賠，則業(yè)主有足夠理由履行其合同賦予的權(quán)利。若承包商未能或拒絕進(jìn)行上述投保，則業(yè)主將提供、續(xù)?；虮３稚鲜霰ｋU(xiǎn)有效，但由此招致的全部費(fèi)用從任何或所有到期付款中扣除。根據(jù)需要，可以從承包商提交的履行保函中扣除上述費(fèi)用。2.AllRiskInsuranceforTransportationofEquipmentandMaterials.設(shè)備和材料運(yùn)輸一切險(xiǎn)保險(xiǎn)WithoutprejudicetotheContractor'sobligationsandresponsebilitiesundertheContract,theContractorshallinsuretheequipmentandmaterialstobesuppliedanddeliveredwithareputableinsurancecompanyacceptabletoEMPLOYER.TheinsuranceshallbetakenoutinthejointnamesoftheContractorandEMPLOYERfortheirrespectiverightsandinterests,andshallcoverallRisksincludingseaandlandtransport,andwarrisk,fromplaceoforigintotheSite.在與合同項(xiàng)下規(guī)定的承包商義務(wù)和責(zé)任不相沖突的情況下，承包商應(yīng)為將提供和交付的設(shè)備和材料投保一切險(xiǎn)保險(xiǎn)，承包商應(yīng)投保信用可靠的、業(yè)主接受的保險(xiǎn)公司。由承包商和業(yè)主依照各自的合同權(quán)利和利益聯(lián)名共同投保，一切險(xiǎn)范圍為從原產(chǎn)地到工程現(xiàn)場之間的所有運(yùn)輸保險(xiǎn)，包括海運(yùn)險(xiǎn)、陸運(yùn)險(xiǎn)、戰(zhàn)爭險(xiǎn)。Theinsurancecoverageshallbeonehundredandtenpercent(110%)ofthedeliveredcostandinsurancepremiumsshallbepaidbytheContractor.Undersuchinsurance,theindemnitymustbepayableinUSdollars,freelyusabletoreplaceorrepairsuchgoods.TheContractor,actingasagentforEMPLOYER,shallinitiateproperactionandpursuesettlementregardinginsuranceclaimswheneverdamagesand/orlossesareinflictedonthegoods.TheContractorshallbeauthorizedtoreceivetheindemnitydirectlyfromtheinsurancecompaniesunlessotherwisedirectedbyEMPLOYER.保額為交付的材料或貨物的價(jià)值的百分之一十（110%），保費(fèi)由承包商支付。依照本保險(xiǎn)單之規(guī)定，保險(xiǎn)賠付必須采用美元支付，其應(yīng)能夠自由使用，以更換或修復(fù)保險(xiǎn)賠付部分的貨物。作為業(yè)主的代理人，當(dāng)貨物出現(xiàn)任何損害和/或損失時(shí)，承包商應(yīng)采取適當(dāng)?shù)男袆雍娃k法處理任何有關(guān)保險(xiǎn)索賠。除業(yè)主指示外，承包商應(yīng)獲得授權(quán)，以便直接接受保險(xiǎn)公司的賠付。EMPLOYERshallbenamedasco-insuredunderallinsurancepoliciestakenoutbytheContractorpursuanttoGC34.1,exceptforWorkman’sCompensation，andtheContractor'sSubcontractorsshallbenamedasco-insuredsun
