EmploymentContract(全日制勞動合同)甲方(用人單位)名稱NameofPartyA(Employer):住所Address:法定代表人(或主要負責(zé)人)LegalRepresentative(orPrincipalResponsiblePerson):乙方(勞動者)姓名NameofPartyB(Employee):居民身份證號IDCardNo:住址Address:聯(lián)系電話ContactNo.:聯(lián)系郵箱Email-box:根據(jù)《中華人民共和國勞動法》、《中華人民共和國勞動合同法》等法律、法規(guī)、規(guī)章的規(guī)定,在平等自愿,協(xié)商一致的基礎(chǔ)上,同意訂立本勞動合同,共同遵守本合同所列條款。TheParties,intendingtobeboundhereby,agreetoenterintothisEmploymentContractonthebasisofequality,freewillandmutualconsultationpursuanttotheLaborLawofthePeople’sRepublicofChina(“PRC”),theEmploymentContractLawofthePRCandotherlaws,regulationsandrules.1.勞動合同類型及期限Article1TypeandTermoftheEmploymentContract1.1.勞動合同類型及期限按下列第【】項確定。ThetypeandtermoftheEmploymentContractshallbedeterminedassetforthinItembelow:1.1.1.固定期限:自年月日起至年月日止。FixedTerm:Fromto;1.1.2.無固定期限:自年月日起至法定的解除或終止合同的條件出現(xiàn)時止。Open-ended:Fromtothedatewhenastatutoryobligationoragreementtoterminatethecontractarises;or1.1.3.以完成一定工作為期限:自年月日起至終止。Project-based:Fromtotheexpirationoftheterm.1.2.本合同約定試用期,試用期自年月日起至年月日止。ThisContractspecifiesaprobationaryperiodcommencingonandendingon.2.工作內(nèi)容、工作地點及要求Article2JobDescription,WorkplaceLocationandWorkRequirements2.1.乙方從事【】工作,工作地點在【】。PartyBshallengageinthejobof,withtheworkplacelocatedat.2.2.乙方應(yīng)履行甲方制定的崗位職責(zé),按時、按質(zhì)、按量完成其本職工作。PartyBshallperformhisorherworkdutiesprovidedbyPartyA,andshallcompletehisorherworktaskinaccordancewiththeprovisionsintermsoftimelimit,qualityandworkload.2.3.乙方承諾,愿服從甲方根據(jù)工作需要、乙方工作能力及其表現(xiàn)而安排或調(diào)動的工作崗位。并同意在下列情況下本合同不作變更處理。PartyundertakestoacceptthearrangementorchangeofworkmadebyPartyAinlightofPartyA’sworkrequirementsandPartyB’sworkingabilityandperformance;PartyBagreesthatthisAgreementmaynotbealteredunderanyofthefollowingcircumstances.2.3.1.乙方的工作地點由所在部門安排。今后因工作需要乙方在甲方所在本市的全部經(jīng)營辦公場所及附屬場所(包括公司自有產(chǎn)權(quán)的物業(yè)或租賃的物業(yè),)之間調(diào)整時。PartyB’sworkingsiteistobearrangedbythedivisionheorsheworksin;PartyAistochangePartyB’sworkingsitewithinallitsbusinessofficesandattachedsitesinthecitywherePartyAisdomiciled(includingPartyA’sownpropertyorotherpremisesleasedbyPartyA),onthebasisofPartyA’sworkingrequirement;2.3.2.甲方因工作需要,臨時指派乙方到境內(nèi)外短期出差地點工作的。PartyAassignsPartyBtoworkathomeorabroadonbusinesstravelforashorttermonthebasisofPartyA’sworkingrequirement.2.3.3.甲方因工作需要,安排乙方臨時外借到其它部門或其他單位工作的。Inresponsetoworkingrequirement,PartyAtemporarilyassignsPartyBtoworkatotherdivisionsofPartyAorotherentities.3.工作時間和休息休假Article3WorkingHours,RestandLeaveEntitlements3.1.工作時間按下列第【】項確定:TheworkinghoursshallbedeterminedassetforthinItembelow:3.1.1.實行標(biāo)準工時制。乙方每日工作時間不超過8小時,每周工作時間不超過40小時,每周至少休息一天。Thenormalworkinghourssystemshallbeimplemented.PartyBshallworknomorethan8hoursaday,and40hoursaweek,andshallhaveatleastoneday’sresteachweek.3.1.2.實行經(jīng)勞動保障行政部門批準實行的不定時工作制。Anon-fixedworkinghourssystemshallbeimplementedwiththenecessaryapprovalfromtherelevantlaboradministrationauthorities.3.1.3.實行經(jīng)勞動保障行政部門批準實行的綜合計算工時工作制。Acumulativeworkinghourssystemshallbeimplementedwiththenecessaryapprovalfromtherelevantlaboradministrationauthorities.3.2.延長工作時間:甲方由于生產(chǎn)經(jīng)營需要經(jīng)與工會和乙方協(xié)商后可以延長乙方工作時間,一般每日不得超過一小時;因特殊原因需要延長工作時間的,每日不得超過三小時,但每月不得超過三十六小時。甲方依法保證乙方的休息休假權(quán)利。OverTime:Duetoitsoperationalneeds,PartymayextendPartyB’sworkinghoursuponconsultationwiththeTradeUnionandPartyB,providedthattheextendedworkinghoursforagivendayshouldgenerallynotexceedonehour.Ifanextensionofworkinghoursisnecessaryforspecialreasons,theextendedworkinghoursforagivendayshouldnotexceedthreehours,providedthattheextendedworkinghoursforamonthshouldnotexceed36hours.PartyAshallensurethatPartyBwillreceivetheirrestandleaveentitlementsaccordingtothelaw.4.勞動報酬及支付方式與時間Article4WorkRemuneration,PaymentMethodandDateofPayment.4.1.乙方的勞動報酬包括每月發(fā)放的固定工資和以及相關(guān)的津貼補貼、每季度考核發(fā)放的績效工資等部分組成,按照甲方薪酬管理規(guī)定執(zhí)行。合同簽訂后甲方發(fā)給《職工薪酬告知書》,具體明確薪酬類別和標(biāo)準?!堵毠ば匠旮嬷獣纷鳛楸竞贤母郊?,與本合同具有同等法律效力。TheremunerationforPartyBincludesfixedmonthlysalary,allowance,quarterlyperformance-basedwageandthelike,andtheremunerationistobepaidinaccordancewithPartyA’sregulationsonremuneration.Afterexecutionhereof,PartyAistosendPartyBaNotificationofEmployee’sRemuneration,whichspecifiesthetypeandstandardoftheremuneration;suchNotificationconstitutesanannextothisAgreementandhavethesamelegalbingingforceasthisAgreement.4.2.在履行本合同期間的日常操作中,甲方依照《職工薪酬告知書》中約定的薪酬標(biāo)準作以下扣除處理的,本合同不作變更處理。If,inthecourseoftheperformanceofthisAgreement,PartyAdeductsanypaymentoftheremunerationinaccordancewiththeNotificationofEmployee’sRemuneration,thisAgreementmaynotbedeemedasbeingaltered.4.2.1.由公司代扣代繳的個人所得稅。IndividualincometaxeswithheldandpaidbyPartyAonbehalf;4.2.2.由職工個人承擔(dān)的社會保險費、住房公積金、企業(yè)年金的扣款。Thepartofsocialinsurancepremium,housingaccumulationfunds,enterpriseannuitytobebornebyPartyB;4.2.3.因職工違反公司規(guī)章制度所發(fā)生違約金、賠償?shù)瓤劭睢enalty,compensationandthelikearisingfromPartyB’sbreachofPartyA’sregulationsorrules;4.2.4.因職工發(fā)生事假等非帶薪假期所作的扣款。DeductionofremunerationmadebyPartyAowingtoprivateaffairleaveandleavestakenbyPartyBotherthanleaveswithpayment;4.2.5.因法院對職工涉案判決所指定公司執(zhí)行的扣款。DeductionofremunerationmadebyPartyAundertheorderofcourtonthebasisofthejudgementofcaseconcerningPartyB;4.2.6.其它符合法律及公司制度而發(fā)生的扣款。DeductionofremunerationincompliancewithlawsorPartyA’sregulationsystem.4.3.在本合同期間,甲方因調(diào)增職工薪酬標(biāo)準的,本合同不作變更處理。If,duringthevaliditytermofthisAgreement,PartyAincreasestheremunerationforemployees,thisAgreementmaynotbedeemedasbeingaltered.4.4.甲方每月5日以貨幣形式通過銀行轉(zhuǎn)賬到乙方個人帳戶的辦法支付乙方工資,包括崗位工資、工齡工資及按月發(fā)放的相關(guān)補貼。乙方同意屬于乙方可得的績效工資、補貼津貼等按甲方薪酬管理規(guī)定的日期和形式發(fā)放,屆時甲方以電子郵件等形式通知乙方。PartyAshall,onthefifthdayofeachandeverymonth,payPartyBremunerationbytransferringthecurrencytoPartyB’saccountthroughbank,includingpost-basedwage,workingage-basedwageandrelevantallowancetobepaidonamonthlybasis.PartyBagreesthatalltheperformance-basedwage,allowanceandthelikemaybepaidonthedateandbythemeansprovidedbyPartyAwithrespecttoremuneration,andPartyAistonotifyPartyBbymeansofemailofthepaymentthereafter.4.5.若乙方提供了正常勞動,甲方支付給乙方的工資報酬不得低于本市政府規(guī)定的最低工資標(biāo)準。TheremunerationpaidbyPartyAtoPartyBmaynotbelessthantheminimumlevelprovidedbythelocalmunicipalgovernment,providedthatPartyBprovidesnormalworkforPartyA.4.6.甲方每月向乙方發(fā)放上月工資清單。該清單屬于保密范圍,應(yīng)妥善保管,不得泄露給本人家庭成員以外的任何第三人、員工之間不得相互打探,如有疑義可以向甲方人力資源部咨詢。PartyAshall,onamonthlybasis,sendPartyBremunerationlistforthelastmonth;suchremunerationlistmustbetreatedasconfidentialinformationandkeptproperly,andsuchlistmaynotbedisclosedtoanythirdpartiesotherthanthefamilymembersofPartyB;employeesmaynotenquireofoneanotherabouttheremuneration;intheeventofanyobjection,PartyBmayconsultPartyA’shumanresourcedepartment.5.社會保險Article5SocialInsurance甲乙雙方依法參加社會保險,按月繳納社會保險費。PartyaandPartyBmustparticipateinsocialinsuranceandpaysocialinsurancepremiumsonamonthlybasisinaccordancewiththelaw.6.勞動保護、勞動條件和職業(yè)危害防護Article6LaborProtection,WorkingConditionsandProtectionsAgainstOccupationalHazards甲乙雙方都必須嚴格執(zhí)行國家有關(guān)安全生產(chǎn)、勞動保護、職業(yè)衛(wèi)生等規(guī)定。有職業(yè)危害的工種應(yīng)在合同約定中告知,甲方應(yīng)為乙方的生產(chǎn)工作提供符合規(guī)定的勞動保護設(shè)施、勞動防護用品及其他勞動保護條件。乙方應(yīng)嚴格遵守各項安全操作規(guī)程。ThePartiesmuststrictlyimplementrelevantnationaloccupationalsafety,laborprotectionandoccupationalsanitationproceduresandstandards.Anyjobexposedtooccupationalhazardsshallbespecifiedinthecontract,andPartyAshallprovidePartyBwithworksafetyandhygienefacilities,laborprotectionequipmentandothernecessaryconditionsforPartyB’sworkactivities.PartyBmuststrictlycomplywiththeworkdisciplines,operatingproceduresandsafetyrulessetbyPartyA.7.勞動紀律Article7Discipline乙方應(yīng)嚴格遵守甲方制定的各項規(guī)章制度和勞動紀律(詳請參照《員工手冊》執(zhí)行)PartyBshallstrictlyobeyPartyA‘regulationsanddiscipline.PleaserefertoPartyA'semployeemanual.8.保密義務(wù)Article8Confidentiality8.1.乙方應(yīng)遵守甲方《保密條例》,不得泄露甲方秘密,不得在合同期內(nèi)再受聘其他任何單位從事與甲方相同或類似或有競爭沖突的業(yè)務(wù)。不得引誘甲方的其他在職職工離職。PartyBshall,aftersigningofthisAgreement,observePartyA’sConfidentialityRules,andmaynotdiscloseanyofPartyA’sconfidentialinformation;duringthevaliditytermhereof,PartyBmaynotengageinanybusinesssimilarwithorincompetitionwithPartyA’sbusinessforanyotheremployer,andPartyBmaynotinduceotheremployeesworkingforPartyAtoresignfromPartyA.8.2.乙方在合同期內(nèi),屬其崗位職務(wù)行為或主要利用甲方的物質(zhì)技術(shù)條件所產(chǎn)生的所有專利、版權(quán)和其他知識產(chǎn)權(quán)歸甲方所有,乙方無權(quán)進行商業(yè)性開發(fā)。Anyandallpatents,copyrightsandotherintellectualpropertyrightsproducedbyPartyBashisorherworkdutyormainlybyutilizingPartyA’smaterialduringthevaliditytermofthisAgreementshallbePartyA’sproperty,andPartyBisnotentitledtoanycommercialrightspertainingthereto.8.3.甲乙雙方另訂《保密協(xié)議》,具體確定雙方的權(quán)利義務(wù)。乙方在本合同存續(xù)期間和終止解除后承擔(dān)甲方《保密協(xié)議》中規(guī)定的保密義務(wù)。PartyAandPartyBaretoenterintoNon-disclosureAgreementseparately,soastostipulatetheobligationsandrightsofthetwoparties.DuringthevaliditytermofthisAgreementandaftertheterminationhereof,theconfidentialityobligationstipulatedintheConfidentialityAgreementhasbindingforceuponPartyB.8.4.乙方如在本合同存續(xù)期間,違反《保密協(xié)議》約定的,視作違紀行為,按《職工違規(guī)處理辦法》有關(guān)規(guī)定處理。If,duringthevaliditytermofthisAgreement,PartyBbreachestheConfidentialityAgreement,PartyBshallbedeemedashavingbreachedPartyA’sdisciplinesandistobetreatedinaccordancewiththeRulesforTreatmentofEmployeesinBreachofRegulations.8.5.乙方因違約給甲方造成經(jīng)濟或名譽損失的,應(yīng)承擔(dān)侵權(quán)賠償責(zé)任,甲方有權(quán)利向乙方追償經(jīng)濟損失。IfPartyBbreachesthisAgreementandtherebycausesanyeconomiclossorreputationloss,PartyBshallbeartheliabilitytherefor
