對于帶有歐共體部件型式認證標志的遠光和/或近光前照燈以及已獲認證的車燈組件所使用的光源（白熾燈及其它），任何成員國不得基于與其制造或性能方法有關的理由禁止其投放市場。共90頁第8頁1976L0761—EN—01.05.2004—007.001—52.AMemberStatemayprohibittheplacingonthemarketofheadlampswhichfunctionasmain-beamand/ordipped-beamheadlampsandlightsource(s)(filamentlamp(s)andother(s))foruseinapprovedlampunitsbearingtheECcomponenttype-approvalmarkwhichconsistentlyfailtoconformtotheapprovedtype.ThatStateshallforthwithinformtheotherMemberStatesandtheCommissionofthemeasurestaken,specifyingthereasonsforitsdecision.Article4ThecompetentauthoritiesoftheMemberStatesshallinformeachother,bymeansoftheprocedurespecifiedinArticle4(6)ofDirective70/156/EEC,ofeachapprovalwhichtheyhavegranted,refusedorwithdrawnpursuanttothisDirective.▼BArticle51.?M3IftheMemberStatewhichhasgrantedECcomponenttype-approvalfindsthatanumberofheadlampswhichfunctionasmain-beamand/ordipped-beamheadlampsorlightsource(s)(filamentlamp(s)andother(s))foruseinapprovedlampunitsbearingthesame▼BECcomponenttype-approvalmarkdonotconformtothetypewhichithasapproved,itshalltakethenecessarymeasurestoensurethatproductionmodelsconformtotheapprovedtype.MThecompetentauthoritiesofthatStateshalladvisethoseoftheotherMemberStatesofthemeasurestaken,whichmay,wherethereisconsistentfailuretoconform,extendtowithdrawalofEECcomponenttype-approval.ThesaidauthoritiesshalltakethesamemeasuresiftheyareinformedbythecompetentauthoritiesofanotherMemberStateofsuchfailuretoconform.2.ThecompetentauthoritiesofMemberStatesshallwithinonemonthinformeachotherofanywithdrawalofEECcomponenttype-approval,andofthereasonsforsuchameasure.Article6?M3AnydecisiontakenpursuanttotheprovisionsadoptedinimplementationofthisDirectivetorefuseorwithdrawECcomponenttype-approvalforamain-beamoradipped-beamheadlamporforalightsource(s)(filamentlamp(s)andother(s))foruseinapprovedlampunitsorprohibittheirplacingonthemarketoruseshallsetoutindetailthereasonsonwhichitisbased.MSuchdecisionshallbenotifiedtothepartyconcerned,whoshallatthesametimebeinformedoftheremediesavailabletohimunderthelawsinforceintheMemberStatesandofthetimelimitsallowedfortheexerciseofsuchremedies.共90頁第9頁1976L0761—中文—2004年5月1日—007.001—52. 但是，若帶有歐共體部件型式認證標志的遠光和/或近光前照燈以及已獲認證的車燈組件所使用的光源（白熾燈及其它）一貫不符合已獲認證的型式，成員國可禁止其投放市場。該成員國應立即將采取的措施通報其他成員國和委員會，說明做出此決定的理由。第四條對于其依據(jù)本指令發(fā)放、拒絕發(fā)放或已撤銷的認證，各成員國主管當局應通過指令70/156/EEC第四條（6）規(guī)定的程序相互通報。▼B第五條1. 倘若已發(fā)放歐共體部件型式認證的成員國發(fā)現(xiàn)某些帶有該歐共體部件型式認證標志的遠光和/或近光前照燈以及已獲認證的車燈組件所使用的光源（白熾燈及其它）與認證的型式不符，則應當采取必要的措施確保這些產(chǎn)品型號與其認證的型式相符。該成員國主管當局應就采取的措施向其他成員國的主管當局提出建議，若始終不能相符，應采取措施直至撤銷該歐共體部件型式認證。該主管當局在接到另一成員國主管當局關于此類不相符的通知時，應采取相同的措施。2.各成員國主管當局應在一個月內(nèi)相互通報對歐洲經(jīng)濟共同體部件型式認證的撤銷以及采取此措施的理由。第六條對于該指令實施過程中，依據(jù)所采用的條款作出的拒絕發(fā)放或收回遠光或近光前照燈或已獲認證的車燈組件所使用的光源（白熾燈及其它）的歐共體部件型式認證或禁止其投放市場及使用的決定，都應詳細說明該決定所基于的理由。該決定應通知有關各方，同時應告知當事方依據(jù)成員國現(xiàn)行法律可以使用的補救辦法以及運用此類補救辦法的時效。共90頁第10頁1976L0761—EN—01.05.2004—007.001—6▼M3Article7NoMemberStatemayrefusetograntECtype-approvalornationaltype-approvalofavehicleongroundsrelatingtoitsheadlampswhichfunctionasmain-beamand/ordipped-beamheadlampsortothelightsource(s)(filamentlamp(s)andother(s))foruseinapprovedlampunitsifthesebeartheECcomponenttype-approvalmarkandarefittedinaccordancewiththerequirementslaiddowninDirective76/756/EEC.Article8NoMemberStatemayrefuseorprohibitthesaleorregistration,entryintoserviceoruseofavehicleongroundsrelatingtoitsheadlampswhichfunctionasmain-beamand/ordipped-beamheadlampsortothelightsource(s)(filamentlamp(s)andother(s))foruseinapprovedlampunitsifthesebeartheECcomponenttype-approvalmarkandarefittedinaccordancewiththerequirementslaiddowninDirective76/756/EEC.Article9ForthepurposesofthisDirective,'vehicle'meansanymotorvehicleintendedforuseontheroad,withorwithoutbodywork,havingatleastfourwheelsandamaximumdesignspeedexceeding25km/h,withtheexceptionofvehicleswhichrunonrailsandofagriculturalandforestrytractorsandallmobilemachinery.Article10AnyamendmentsnecessarytoadjusttherequirementsoftheAnnexestotakeaccountoftechnicalprogressshallbeadoptedinaccordancewiththeprocedurelaiddowninArticle13ofDirective70/156/EEC.Article11MemberStatesshalladoptandpublishtheprovisionsnecessaryinordertocomplywiththisDirectivebefore1July1977andshallforthwithinformtheCommissionthereof.Theyshallapplytheseprovisionsfrom1October1977atthelatest.OncethisDirectivehasbeennotified,theMemberStatesshallalsoensurethattheCommissionisinformed,insufficienttimeforittosubmititscomments,ofanydraftlaws,regulationsoradministrativeprovisionswhichtheyproposetoadoptinthefieldcoveredbythisDirective.Article12ThisDirectiveisaddressedtotheMemberStates.共90頁第11頁1976L0761—中文—2004年5月1日—007.001—6▼M3第七條若汽車上的遠光和/或近光前照燈以及已獲認證的車燈組件所使用的光源（白熾燈及其它）帶有歐共體部件型式認證標志并且其安裝遵照了指令76/756/EEC規(guī)定的要求，任何成員國不得基于與上述前照燈相關的理由拒絕向該汽車發(fā)放歐共體型式認證或國內(nèi)型式認證。第八條若汽車上的遠光和/或近光前照燈以及已獲認證的車燈組件所使用的光源（白熾燈及其它）帶有歐共體部件型式認證標志并且其安裝遵照了指令76/756/EEC規(guī)定的要求，任何成員國不得基于與上述前照燈相關的理由拒絕或禁止該汽車的銷售、注冊、投入運行或使用。第九條本指令中，“車輛”指的是符合下述特征的車輛：用于道路行駛；裝有或未裝車體；至少有四個車輪；最大設計車速超過25公里/小時。在鐵路上行駛的車輛、農(nóng)用拖拉機、林業(yè)拖拉機以及機動機械設備除外。▼B第十條對于因考慮到技術的進步，為了調(diào)整附件中的要求而進行的必要的修正，應按照指令76/756/EEC第十三條規(guī)定的程序加以采用。第十一條1. TheapplicationforECcomponenttype-approvalpursuanttoArticle3(4)ofDirective70/156/EECofatypeofheadlampshallbesubmittedbythemanufacturer.2.1.1AmodelfortheinformationdocumentisgiveninAppendix1.2.1.2Thefollowingmustbesubmittedtothetechnicalserviceresponsibleforconductingthetype-approvaltests:共90頁第15頁1976L0761—中文—2004年5月1日—007.001—8▼M3附件I型式認證的管理規(guī)定1.本附件涉及以下各項的型式認證1.1.發(fā)出不對稱會車光或行車光或發(fā)出上述兩種光，裝有R2和/或HS1白熾燈，符合附件II所規(guī)定的要求的汽車前照燈；1.2.發(fā)出不對稱會車光或行車光或發(fā)出上述兩種光，符合附件III所規(guī)定的要求的汽車密封式前照燈；1.3.發(fā)出不對稱會車光或行車光或發(fā)出上述兩種光，裝有H1，H2，H3，HB3，HB4，H7和/或H8鹵素白熾燈，符合附件IV所規(guī)定的要求的汽車前照燈；1.4.發(fā)出不對稱會車光或行車光或發(fā)出上述兩種光，裝有H4鹵素白熾燈，符合附件V所規(guī)定的要求的汽車前照燈；1.5.發(fā)出不對稱會車光或行車光或發(fā)出上述兩種光，符合附件VI所規(guī)定的要求的鹵素密封式汽車前照燈；1.6.已獲認證的車燈組件所使用的，符合附件VII所規(guī)定的要求的白熾燈；1.7.裝有氣體放電式光源的，符合附件VIII所規(guī)定的要求的汽車前照燈；1.8.已獲認證的氣體放電式汽車車燈組件所使用的，符合附件IX所規(guī)定的要求的氣體放電式光源。2.歐共體部件型式認證的申請2.1. 制造商應依據(jù)指令70/156/EEC第三條（4）提交前照燈的歐共體部件型式認證申請。2.1.1. 附錄1提供了信息資料文件的式樣。2.1.2. 必須向負責型式認證試驗的技術測試機構提交以下項目：共90頁第16頁1976L0761—EN—01.05.2004—007.001—92.1.2.1.
