攝影師經(jīng)理勞務(wù)合同合同編號：__________photographermanagerservicecontractthiscontract(hereinafterreferredtoas"thiscontract")ismadeandenteredintoonthedatehereinafterwrittenandbetween[photographer'sname],apersonoffulllegalageandcapacity("photographer"),and[manager'sname],apersonoffulllegalageandcapacity("manager").1.services1.1photographeragreestoprovidemanagerwiththefollowingservices(collectively,the"services"):(a)managephotographer'sschedule,bookings,andotherrelatedtasks;(b)promotephotographer'sworkandincreasephotographer'svisibilityintheindustry;(c)negotiatecontractsandotherrelatedtasksonbehalfofphotographer;and(d)providemanagerialandconsultingservicestophotographer.1.2photographeragreestoprovidemanagerwithreasonablenoticeofanyschedulingchangesorcancellations.2.term2.2upontheexpirationoftheinitialterm,thiscontractshallautomaticallyrenewforsuccessivetermsof[termlength],unlesseitherpartyprovideswrittennoticeofitsintentionnottorenewatleast[numberofdays]priortotheexpirationoftheinitialtermoranysubsequentterm.3.payment4.representationandwarranty4.1photographerrepresentsandwarrantstomanagerthat:(a)photographerhasthefulllegalrightandauthoritytoenterintothiscontractandtoperformhisorherobligationshereunder;(b)theservicesprovidedphotographerhereundershallbeofprofessionalqualityandshallnotinfringeuponanycopyright,trademark,patent,orotherintellectualpropertyrightofanythirdparty;and(c)photographerisnotsubjecttoanylegalrestrictionsorobligationsthatwouldpreventorlimitphotographer'sperformanceofhisorherobligationshereunder.4.2managerrepresentsandwarrantstophotographerthat:(a)managerhasthefulllegalrightandauthoritytoenterintothiscontractandtoperformhisorherobligationshereunder;(b)managershallusereasonableeffortstopromotephotographer'sworkandincreasephotographer'svisibilityintheindustry;and(c)managerisnotsubjecttoanylegalrestrictionsorobligationsthatwouldpreventorlimitmanager'sperformanceofhisorherobligationshereunder.5.indemnification5.1photographeragreestoindemnifyandholdharmlessmanagerfromandagainstanyandallclaims,demands,actions,suits,proceedings,judgments,losses,damages,liabilities,andexpenses(includingreasonableattorney'sfees)arisingoutoforinconnectionwith:(a)photographer'sbreachofanyrepresentationorwarrantymadeunderthiscontract;(b)photographer'sperformanceornonperformanceofhisorherobligationsunderthiscontract;or(c)anyactoromissionofphotographerinconnectionwiththeservicesprovidedunderthiscontract.5.2manageragreestoindemnifyandholdharmlessphotographerfromandagainstanyandallclaims,demands,actions,suits,proceedings,judgments,losses,damages,liabilities,andexpenses(includingreasonableattorney'sfees)arisingoutoforinconnectionwith:(a)manager'sbreachofanyrepresentationorwarrantymadeunderthiscontract;(b)manager'sperformanceornonperformanceofhisorherobligationsunderthiscontract;or(c)anyactoromissionofmanagerinconnectionwiththeservicesprovidedunderthiscontract.6.termination6.1eitherpartymayterminatethiscontractuponwrittennoticetotheotherpartyif:7.miscellaneous7.一、附件列表：攝影師個人資料攝影師作品集經(jīng)理的個人資料經(jīng)理的聯(lián)系方式合同履行時間表費用明細表推廣計劃旅行安排住宿安排餐飲安排二、違約行為及認定：攝影師未能按照約定提供服務(wù)或提供的服務(wù)不符合專業(yè)質(zhì)量標準攝影師未能按照約定時間支付經(jīng)理傭金或報銷費用攝影師未能按照約定通知managerschedulingchanges或取消經(jīng)理未能按照約定推廣攝影師的作品或增加其行業(yè)知名度經(jīng)理未能按照約定時間收取傭金經(jīng)理未能按照約定履行合同義務(wù)三、法律名詞及解釋：攝影師：指具有完全法定年齡和能力的個人經(jīng)理：指具有完全法定年齡和能力的個人服務(wù)：指攝影師同意提供給經(jīng)理的管理服務(wù)，包括安排時間表、推廣作品、談判合同等傭金：指攝影師同意支付給經(jīng)理的合同收入的指定比例推廣：指經(jīng)理同意進行的宣傳活動，以提高攝影師的作品知名度和行業(yè)地位報銷：指攝影師同意支付給經(jīng)理的合理支出，包括旅行、住宿和餐飲費用四、執(zhí)行中遇到的問題及解決辦法：問題：攝影師未能按照約定時間提供服務(wù)解決辦法：經(jīng)理應(yīng)與攝影師協(xié)商，重新安排時間表，確保合同履行問題：攝影師未能按照約定時間支付傭金或報銷費用解決辦法：經(jīng)理應(yīng)向攝影師發(fā)出書面催款通知，要求其在規(guī)定時間內(nèi)支付傭金或報銷費用問題：攝影師未能按照約定通知managerschedulingchanges或取消解決辦法：經(jīng)理應(yīng)與攝影師保持密切溝通，確保及時了解攝影師的日程變化和取消情況問題：經(jīng)理未能按照約定推廣攝影師的作品或增加其行業(yè)知名度解決辦法：攝影師應(yīng)與經(jīng)理協(xié)商，制定詳細的推廣計劃，并監(jiān)督經(jīng)理的推廣活動問題：經(jīng)理未能按照約定時間收取傭金解決辦法：攝影師應(yīng)按照約定時間支付傭金，確保經(jīng)理的權(quán)益得到保障五、所有應(yīng)用場景：
