INSTITUTECARGOCLAUSES(A)

RISKSCOVERED

Risks

1Thisinsurancecoversallrisksoflossofordamagetothesubject-matterinsuredexceptasexcludedbytheprovisionsofClauses4,5,6and7below.

GeneralAverage

2Thisinsurancecoversgeneralaverageandsalvagecharges,adjustedordeterminedaccordingtothecontractofcarriageand/orthegoverninglawandpractice,incurredtoavoidorinconnectionwiththeavoidanceoflossfromanycauseexceptthoseexcludedinClauses4,5,6and7below.

"BothtoBlameCollisionClause"

3ThisinsuranceindemnifiestheAssured,inrespectofanyriskinsuredherein,againstliability

incurredunderanyBothtoBlameCollisionClauseinthecontractofcarriage.IntheeventofanyclaimbycarriersunderthesaidClause,theAssuredagreetonotifytheInsurerswhoshallhavetheright,attheirowncostandexpense,todefendtheAssuredagainstsuchclaim.

EXCLUSIONS

4Innocaseshallthisinsurancecover

4.1lossdamageorexpenseattributabletowilfulmisconductoftheAssured

4.2ordinaryleakage,ordinarylossinweightorvolume,orordinarywearandtearofthesubject-matterinsured

4.3lossdamageorexpensecausedbyinsufficiencyorunsuitabilityofpackingor

preparationofthesubject-matterinsuredtowithstandtheordinaryincidentsoftheinsuredtransitwheresuchpackingorpreparationiscarriedoutbytheAssuredortheiremployeesorpriortotheattachmentofthisinsurance.(forthepurposeoftheseClauses"packing"

shallbedeemedtoincludestowageinacontainerand"employees"shallnotincludeindependentcontractors)

4.4lossdamageorexpensecausedbyinherentviceornatureofthesubject-matterinsured

4.5lossdamageorexpensecausedbydelay,eventhoughthedelaybecausedbyariskinsuredagainst.(exceptexpensespayableunderClause2above)

4.6lossdamageorexpensecausedbyinsolvencyorfinancialdefaultoftheownersmanagers

charterersoroperatorsofthevesselwhere,atthetimeofloadingofthesubject-matterinsuredonboardthevessel,theAssuredareaware,orintheordinarycourseofbusinessshouldbeaware,thatsuchinsolvencyorfinancialdefaultcouldpreventthenormal

prosecutionofthevoyage

Thisexclusionshallnotapplywherethecontractofinsurancehasbeenassignedtothepartyclaiminghereunderwhohasboughtoragreedtobuythesubject-matterinsuredingood

faithunderabindingcontract

4.7lossdamageorexpensedirectlyorindirectlycausedbyorarisingfromtheuseofany

weaponordeviceemployingatomicornuclearfissionand/orfusionorotherlikereactionorradioactiveforceormatter.

55.1Innocaseshallthisinsurancecoverlossdamageorexpensearisingfrom

5.1.1.unseaworthinessofvesselorcraftorunfitnessofvesselorcraftforthesafecarriageof

thesubject-matterinsured,wheretheAssuredareprivytosuchunseaworthinessorunfitness,atthetimethesubject-matterinsuredisloadedtherein

5.1.2.unfitnessofcontainerorconveyanceforthesafecarriageofthesubject-matterinsured,whereloadingthereinorthereoniscarriedoutpriortoattachmentofthis

insuranceorbytheAssuredortheiremployeesandtheyareprivytosuchunfitnessatthetimeofloading.

5.2Exclusion5.1.1aboveshallnotapplywherethecontractofinsurancehasbeenassignedtothepartyclaiminghereunderwhohasboughtoragreedtobuythesubject-matterinsuredingoodfaithunderabindingcontract.

5.3TheInsurerswaiveanybreachoftheimpliedwarrantiesofseaworthinessoftheshipandfitnessoftheshiptocarrythesubject-matterinsuredtodestination.

6Innocaseshallthisinsurancecoverlossdamageorexpensecausedby

6.1warcivilwarrevolutionrebellioninsurrection,orcivilstrifearisingtherefrom,oranyhostileactbyoragainstabelligerentpower

6.2captureseizurearrestrestraintordetainment(piracyexcepted),andtheconsequencesthereoforanyattemptthereat

6.3derelictminestorpedoesbombsorotherderelictweaponsofwar.

7Innocaseshallthisinsurancecoverlossdamageorexpense

7.1causedbystrikers,locked-outworkmen,orpersonstakingpartinlabourdisturbances,riotsorcivilcommotions

7.2resultingfromstrikes,lock-outs,labourdisturbances,riotsorcivilcommotions

7.3causedbyanyactofterrorismbeinganactofanypersonactingonbehalfof,orinconnectionwith,anyorganisationwhichcarriesoutactivitiesdirectedtowardsthe

overthrowingorinfluencing,byforceorviolence,ofanygovernmentwhetherornotlegallyconstituted

7.4causedbyanypersonactingfromapolitical,ideologicalorreligiousmotive.

DURATION

TransitClause

88.1SubjecttoClause11below,thisinsuranceattachesfromthetimethesubject-matterinsuredisfirstmovedinthewarehouseorattheplaceofstorage(attheplacenamedinthecontractof

insurance)forthepurposeoftheimmediateloadingintoorontothecarryingvehicleorother

conveyanceforthecommencementoftransit,continuesduringtheordinarycourseoftransitandterminateseither

8.1.1oncompletionofunloadingfromthecarryingvehicleorotherconveyanceinoratthefinalwarehouseorplaceofstorageatthedestinationnamedinthecontractofinsurance,

8.1.2oncompletionofunloadingfromthecarryingvehicleorotherconveyanceinoratanyotherwarehouseorplaceofstorage,whetherpriortooratthedestinationnamedinthecontractof

insurance,whichtheAssuredortheiremployeeselecttouseeitherforstorageotherthanintheordinarycourseoftransitorforallocationordistribution,or

8.1.3whentheAssuredortheiremployeeselecttouseanycarryingvehicleorotherconveyanceoranycontainerforstorageotherthanintheordinarycourseoftransitor

8.1.4ontheexpiryof60daysaftercompletionofdischargeoversideofthesubject-matterinsuredfromtheoverseavesselatthefinalportofdischarge,whichevershallfirstoccur.

8.2If,afterdischargeoversidefromtheoverseavesselatthefinalportofdischarge,butpriortoterminationofthisinsurance,thesubject-matterinsuredistobeforwardedtoadestinationotherthanthattowhichitisinsured,thisinsurance,whilstremainingsubjecttoterminationas

providedinClauses8.1.1to8.1.4,shallnotextendbeyondthetimethesubject-matterinsuredisfirstmovedforthepurposeofthecommencementoftransittosuchother

destination.

8.3Thisinsuranceshallremaininforce(subjecttoterminationasprovidedforinClauses8.1.1to

8.1.4aboveandtotheprovisionsofClause9below)duringdelaybeyondthecontrolofthe

Assured,anydeviation,forceddischarge,reshipmentortranshipmentandduringanyvariationoftheadventurearisingfromtheexerciseofalibertygrantedtocarriersunderthecontractof

carriage.

TerminationofContractofCarriage

9.IfowingtocircumstancesbeyondthecontroloftheAssuredeitherthecontractofcarriageis

terminatedataportorplaceotherthanthedestinationnamedthereinorthetransitisotherwise

terminatedbeforeunloadingofthesubject-matterinsuredasprovidedforinClause8above,thenthisinsuranceshallalsoterminateunlesspromptnoticeisgiventotheInsurersand

continuationofcoverisrequestedwhenthisinsuranceshallremaininforce,subjecttoanadditionalpremiumifrequiredbytheInsurers,either

9.1untilthesubject-matterinsuredissoldanddeliveredatsuchportorplace,or,unlessotherwisespeciallyagreed,untiltheexpiryof60daysafterarrivalofthesubject-matterinsuredatsuchportorplace,whichevershallfirstoccur,or

9.2ifthesubject-matterinsuredisforwardedwithinthesaidperiodof60days(oranyagreed

extensionthereof)tothedestinationnamedinthecontractofinsuranceortoanyotherdestination,untilterminatedinaccordancewiththeprovisionsofClause8above.

ChangeofVoyage

10.10.1Where,afterattachmentofthisinsurance,thedestinationischangedbytheAssured,thismustbenotifiedpromptlytoInsurersforratesandtermstobeagreed.Shouldalossoccurpriortosuchagreementbeingobtainedcovermaybeprovidedbutonlyifcoverwouldhavebeenavailableatareasonablecommercialmarketrateonreasonablemarketterms.

10.2Wherethesubject-matterinsuredcommencesthetransitcontemplatedbythisinsurance(inaccordancewithClause8.1),but,withouttheknowledgeoftheAssuredortheiremployeestheshipsailsforanotherdestination,thisinsurancewillneverthelessbedeemedtohaveattachedatcommencementofsuchtransit.

CLAIMS

InsurableInterest

11.11.1InordertorecoverunderthisinsurancetheAssuredmusthaveaninsurableinterestinthesubject-matterinsuredatthetimeoftheloss.

11.2SubjecttoClause11.1above,theAssuredshallbeentitledtorecoverforinsuredloss

occurringduringtheperiodcoveredbythisinsurance,notwithstandingthatthelossoccurred

beforethecontractofinsurancewasconcluded,unlesstheAssuredwereawareofthelossandtheInsurerswerenot.

ForwardingCharges

12.Where,asaresultoftheoperationofariskcoveredbythisinsurance,theinsuredtransitisterminatedataportorplaceotherthanthattowhichthesubject-matterinsurediscoveredunderthisinsurance,theInsurerswillreimbursetheAssuredforanyextrachargesproperlyand

reasonablyincurredinunloadingstoringandforwardingthesubject-matterinsuredtothe

destinationtowhichitisinsured.ThisClause12,whichdoesnotapplytogeneralaverageorsalvagecharges,shallbesubjecttotheexclusionscontainedinClauses4,5,6and7above,andshallnotincludechargesarisingfromthefaultnegligenceinsolvencyorfinancial

defaultoftheAssuredortheiremployees.

ConstructiveTotalLoss

13.NoclaimforConstructiveTotalLossshallberecoverablehereunderunlessthesubject-matterinsuredisreasonablyabandonedeitheronaccountofitsactualtotallossappearingtobe

unavoidableorbecausethecostofrecovering,reconditioningandforwardingthesubject-matterinsuredtothedestinationtowhichitisinsuredwouldexceeditsvalueonarrival.

IncreasedValue

14.14.1IfanyIncreasedValueinsuranceiseffectedbytheAssuredonthesubject-matterinsuredunderthisinsurancetheagreedvalueofthesubject-matterinsuredshallbedeemedtobeincreasedtothetotalamountinsuredunderthisinsuranceandallIncreasedValueinsurancescoveringthe

loss,andliabilityunderthisinsuranceshallbeinsuchproportionasthesuminsuredunderthisinsurancebearstosuchtotalamountinsured.IntheeventofclaimtheAssuredshall

providetheInsurerswithevidenceoftheamountsinsuredunderallotherinsurances.

14.2WherethisinsuranceisonIncreasedValuethefollowingclauseshallapply:

Theagreedvalueofthesubject-matterinsuredshallbedeemedtobeequaltothetotalamount

insuredundertheprimaryinsuranceandallIncreasedValueinsurancescoveringthelossand

effectedonthesubject-matterinsuredbytheAssured,andliabilityunderthisinsuranceshallbeinsuchproportionasthesuminsuredunderthisinsurancebearstosuchtotalamount

insured.

IntheeventofclaimtheAssuredshallprovidetheInsurerswithevidenceoftheamountsinsuredunderallotherinsurances.

BENEFITOFINSURANCE

15.Thisinsurance

15.1coverstheAssuredwhichincludesthepersonclaimingindemnityeitherasthepersonbyoronwhosebehalfthecontractofinsurancewaseffectedorasanassignee,

15.2shallnotextendtoorotherwisebenefitthecarrierorotherbailee.

MINIMISINGLOSSES

DutyofAssured

16.ItisthedutyoftheAssuredandtheiremployeesandagentsinrespectoflossrecoverablehereunder

16.1totakesuchmeasuresasmaybereasonableforthepurposeofavertingorminimisingsuchloss,and

16.2toensurethatallrightsagainstcarriers,baileesorotherthirdpartiesareproperlypreservedandexercised

andtheInsurerswill,inadditiontoanylossrecoverablehereunder,reimbursetheAssuredforanychargesproperlyandreasonablyincurredinpursuanceoftheseduties.

Waiver

17.MeasurestakenbytheAssuredortheInsurerswiththeobjectofsaving,protectingorrecoveringthesubject-matterinsuredshallnotbeconsideredasawaiveroracceptanceofabandonmentorotherwiseprejudicetherightsofeitherparty.

AVOIDANCEOFDELAY

18.ItisaconditionofthisinsurancethattheAssuredshallactwithreasonabledespatchinallcircumstanceswithintheircontrol.

LAWANDPRACTICE

19.ThisinsuranceissubjecttoEnglishlawandpractice.

NOTE:-WhereacontinuationofcoverisrequestedunderClause9,orachangeofdestinationisnotifiedunderClause10,thereisanobligationtogivepromptnoticetotheInsurersandtherighttosuchcoverisdependentuponcompliancewiththisobligation.

2.Thisinsurancecoversgeneralaverageandsalvagecharges,adjustedordeterminedaccordingtothecontractofcarriageand/orthegoverninglawandpractice,incurredtoavoidorinconnectionwiththeavoidanceoflossfromanycauseexceptthoseexcludedinClauses4,5,6and7below.

3.ThisinsuranceindemnifiestheAssured,inrespectofanyriskinsuredherein,againstliability

incurredunderanyBothtoBlameCollisionClauseinthecontractofcarriage.IntheeventofanyclaimbycarriersunderthesaidClause,theAssuredagreetonotifytheInsurerswhoshallhavetheright,attheirowncostandexpense,todefendtheAssuredagainstsuchclaim.

4.Innocaseshallthisinsurancecover

4.1.lossdamageorexpenseattributabletowilfulmisconductoftheAssured

4.7.deliberatedamagetoordeliberatedestructionofthesubject-matterinsuredoranypartthereofbythewrongfulactofanypersonorpersons

4.8.lossdamageorexpensedirectlyorindirectlycausedbyorarisingfromtheuseofany

weaponordeviceemployingatomicornuclearfissionand/orfusionorotherlikereactionorradioactiveforceormatter.

5.5.1Innocaseshallthisinsurancecoverlossdamageorexpensearisingfrom

5.1.1unseaworthinessofvesselorcraftorunfitnessofvesselorcraftforthesafecarriageofthesubject-matterinsured,wheretheAssuredareprivytosuchunseaworthinessor

unfitness,atthetimethesubject-matterinsuredisloadedtherein

5.1.2unfitnessofcontainerorconveyanceforthesafecarriageofthesubject-matterinsured,whereloadingthereinorthereoniscarriedoutpriortoattachmentofthisinsuranceorby

theAssuredortheiremployeesandtheyareprivytosuchunfitnessatthetimeofloading.

5.2Exclusion5.1.1aboveshallnotapplywherethecontractofinsurancehasbeenassignedtothepartyclaiminghereunderwhohasboughtoragreedtobuythesubject-matterinsuredingoodfaithunderabindingcontract.

5.3TheInsurerswaiveanybreachoftheimpliedwarrantiesofseaworthinessoftheshipandfitnessoftheshiptocarrythesubject-matterinsuredtodestination.

6.Innocaseshallthisinsurancecoverlossdamageorexpensecausedby

6.1warcivilwarrevolutionrebellioninsurrection,orcivilstrifearisingtherefrom,oranyhostileactbyoragainstabelligerentpower

6.2captureseizurearrestrestraintordetainment,andtheconsequencesthereoforanyattemptthereat

6.3derelictminestorpedoesbombsorotherderelictweaponsofwar.

7.Innocaseshallthisinsurancecoverlossdamageorexpense

7.1causedbystrikers,locked-outworkmen,orpersonstakingpartinlabourdisturbances,riotsorcivilcommotions

7.2resultingfromstrikes,lock-outs,labourdisturbances,riotsorcivilcommotions

7.3causedbyanyactofterrorismbeinganactofanypersonactingonbehalfof,orinconnectionwith,anyorganisationwhichcarriesoutactivitiesdirectedtowardsthe

overthrowingorinfluencing,byforceorviolence,ofanygovernmentwhetherornotlegallyconstituted

7.4causedbyanypersonactingfromapolitical,ideologicalorreligiousmotive.

DURATION

TransitClause

8.8.1SubjecttoClause11below,thisinsuranceattachesfromthetimethesubject-matterinsuredisfirstmovedinthewarehouseorattheplaceofstorage(attheplacenamedinthecontractof

insurance)forthepurposeoftheimmediateloadingintoorontothecarryingvehicleorother

conveyanceforthecommencementoftransit,continuesduringtheordinarycourseoftransitandterminateseither

8.1.1oncompletionofunloadingfromthecarryingvehicleorotherconveyanceinoratthefinalwarehouseorplaceofstorageatthedestinationnamedinthecontractofinsurance,

8.1.2oncompletionofunloadingfromthecarryingvehicleorotherconveyanceinoratanyotherwarehouseorplaceofstorage,whetherpriortooratthedestinationnamedinthecontractof

insurance,whichtheAssuredortheiremployeeselecttouseeitherforstorageotherthanintheordinarycourseoftransitorforallocationordistribution,or

8.1.3whentheAssuredortheiremployeeselecttouseanycarryingvehicleorotherconveyanceoranycontainerforstorageotherthanintheordinarycourseoftransitor

8.1.4ontheexpiryof60daysaftercompletionofdischargeoversideofthesubject-matterinsuredfromtheoverseavesselatthefinalportofdischarge,

whichevershallfirstoccur.

8.2If,afterdischargeoversidefromtheoverseavesselatthefinalportofdischarge,butpriortoterminationofthisinsurance,thesubject-matterinsuredistobeforwardedtoadestinationotherthanthattowhichitisinsured,thisinsurance,whilstremainingsubjecttoterminationas

providedinClauses8.1.1to8.1.4,shallnotextendbeyondthetimethesubject-matterinsuredisfirstmovedforthepurposeofthecommencementoftransittosuchother

destination.

8.3Thisinsuranceshallremaininforce(subjecttoterminationasprovidedforinClauses8.1.1to

8.1.4aboveandtotheprovisionsofClause9below)duringdelaybeyondthecontrolofthe

Assured,anydeviation,forceddischarge,reshipmentortranshipmentandduringanyvariationoftheadventurearisingfromtheexerciseofalibertygrantedtocarriersunderthecontractof

carriage.TerminationofContractofCarriage.

9.IfowingtocircumstancesbeyondthecontroloftheAssuredeitherthecontractofcarriageis

terminatedataportorplaceotherthanthedestinationnamedthereinorthetransitisotherwise

terminatedbeforeunloadingofthesubject-matterinsuredasprovidedforinClause8above,thenthisinsuranceshallalsoterminateunlesspromptnoticeisgiventotheInsurersand

continuationofcoverisrequestedwhenthisinsuranceshallremaininforce,subjecttoanadditionalpremiumifrequiredbytheInsurers,either

9.1untilthesubject-matterinsuredissoldanddeliveredatsuchportorplace,or,unlessotherwisespeciallyagreed,untiltheexpiryof60daysafterarrivalofthesubject-matterinsuredatsuchportorplace,whichevershallfirstoccur,or

9.2ifthesubject-matterinsuredisforwardedwithinthesaidperiodof60days(oranyagreed

extensionthereof)tothedestinationnamedinthecontractofinsuranceortoanyotherdestination,untilterminatedinaccordancewiththeprovisionsofClause8above.

ChangeofVoyage

10.10.1Where,afterattachmentofthisinsurance,thedestinationischangedbytheAssured,thismustbenotifiedpromptlytoInsurersforratesandtermstobeagreed.Shouldalossoccurpriortosuchagreementbeingobtainedcovermaybeprovidedbutonlyifcoverwouldhavebeenavailableatareasonablecommercialmarketrateonreasonablemarketterms.

10.2Wherethesubject-matterinsuredcommencesthetransitcontemplatedbythisinsurance(inaccordancewithClause8.1),but,withouttheknowledgeoftheAssuredortheiremployeestheshipsailsforanotherdestination,thisinsurancewillneverthelessbedeemedtohaveattachedatcommencementofsuchtransit.

CLAIMS

InsurableInterest

11.11.1InordertorecoverunderthisinsurancetheAssuredmusthaveaninsurableinterestinthesubjectmatterinsuredatthetimeoftheloss.

11.2SubjecttoClause11.1above,theAssuredshallbeentitledtorecoverforinsuredloss

occurringduringtheperiodcoveredbythisinsurance,notwithstandingthatthelossoccurred

beforethecontractofinsurancewasconcluded,unlesstheAssuredwereawareofthelossandtheInsurerswerenot.

ForwardingCharges

12.Where,asaresultoftheoperationofariskcoveredbythisinsurance,theinsuredtransitisterminatedataportorplaceotherthanthattowhichthesubject-matterinsurediscoveredunderthisinsurance,theInsurerswillreimbursetheAssuredforanyextrachargesproperlyand

reasonablyincurredinunloadingstoringandforwardingthesubject-matterinsuredtothedestinationtowhichitisinsured.

ThisClause12,whichdoesnotapplytogeneralaverageorsalvagecharges,shallbesubjecttotheexclusionscontainedinClauses4,5,6and7above,andshallnotincludecharges

arisingfromthefaultnegligenceinsolvencyorfinancialdefaultoftheAssuredortheiremployees.

ConstructiveTotalLoss

13.NoclaimforConstructiveTotalLossshallberecoverablehereunderunlessthesubject-matterinsuredisreasonablyabandonedeitheronaccountofitsactualtotallossappearingtobeunavoidableorbecausethecostofrecovering,reconditioningandforwardingthesubject-matterinsuredtothedestinationtowhichitisinsuredwouldexceeditsvalueonarrival.

IncreasedValue

14.14.1IfanyIncreasedValueinsuranceiseffectedbytheAssuredonthesubject-matterinsuredunderthisinsurancetheagreedvalueofthesubject-matterinsuredshallbedeemedtobeincreasedtothetotalamountinsuredunderthisinsuranceandallIncreasedValueinsurancescoveringthe

loss,andliabilityunderthisinsuranceshallbeinsuchproportionasthesuminsuredunderthisinsurancebearstosuchtotalamountinsured.

IntheeventofclaimtheAssuredshallprovidetheInsurerswithevidenceoftheamountsinsuredunderallotherinsurances.

14.2WherethisinsuranceisonIncreasedValuethefollowingclauseshallapply:

Theagreedvalueofthesubject-matterinsuredshallbedeemedtobeequaltothetotalamountinsuredundertheprimaryinsuranceandallIncreasedValueinsurancescoveringthelossand

effectedonthesubject-matterinsuredbytheAssured,andliabilityunderthisinsuranceshallbe

insuchproportionasthesuminsuredunderthisinsurancebearstosuchtotalamountinsured.

IntheeventofclaimtheAssuredshallprovidetheInsurerswithevidenceoftheamountsinsuredunderallotherinsurances.

BENEFITOFINSURANCE

15.Thisinsurance

15.1coverstheAssuredwhichincludesthepersonclaimingindemnityeitherasthepersonbyoronwhosebehalfthecontractofinsurancewaseffectedorasanassignee,

15.2shallnotextendtoorotherwisebenefitthecarrierorotherbailee.

MINIMISINGLOSSES

DutyofAssured

16.ItisthedutyoftheAssuredandtheiremployeesandagentsinrespectoflossrecoverablehereunder

16.1totakesuchmeasuresasmaybereasonableforthepurposeofavertingorminimisingsuchloss,and

16.2toensurethatallrightsagainstcarriers,baileesorotherthirdpartiesareproperlypreservedandexercised

andtheInsurerswill,inadditiontoanylossrecoverablehereunder,reimbursetheAssuredforanychargesproperlyandreasonablyincurredinpursuanceoftheseduties.

Waiver

17.MeasurestakenbytheAssuredortheInsurerswiththeobjectofsaving,protectingorrecoveringthesubject-matterinsuredshallnotbeconsideredasawaiveroracceptanceofabandonmentorotherwiseprejudicetherightsofeitherparty.

AVOIDANCEOFDELAY

18.ItisaconditionofthisinsurancethattheAssuredshallactwithreasonabledespatchinallcircumstanceswithintheircontrol.
