1注2:物權(quán)法律關(guān)系的客體即是物。是指凡是存在于人身之外,能夠為人力所支配和控制,能夠滿足人們某種需要2擔(dān)保物權(quán)人在債務(wù)人不履行到期債務(wù)或者發(fā)生當(dāng)事人約定的實現(xiàn)擔(dān)保物權(quán)的情形,依法享有就已經(jīng)竣工和正在使用中的各類建筑物、構(gòu)筑物及附屬設(shè)備、配套設(shè)施、相關(guān)場地等組成的房地產(chǎn)注2:在物業(yè)管理中具備業(yè)主身份的情況一般有三種:房屋不動產(chǎn)權(quán)屬證書持有人;具備不動產(chǎn)登記條件,待領(lǐng)房業(yè)主的建筑物區(qū)分所有權(quán)ownerspartitionedownershipof由特定的業(yè)主擁有獨立產(chǎn)權(quán)的,建筑物房屋所有權(quán)證書記載的套內(nèi)面積的所有部分以及專有設(shè)備3不動產(chǎn)的相鄰各方在行使所有權(quán)或其他物權(quán)時因相互間應(yīng)當(dāng)給與方便或接受限制而發(fā)生的權(quán)利義注:業(yè)主對建筑物專有部分以外的共有部分,享有權(quán)利,承擔(dān)義務(wù),建筑物管理的多種模式multiplemodesofbuildin);4泛指一切為了維持房屋建筑的物理機能和正常發(fā)揮其經(jīng)濟、社會功能而對其所進行的一切管理活業(yè)主通過選聘物業(yè)服務(wù)企業(yè),由業(yè)主和物業(yè)服務(wù)企業(yè)按照物業(yè)服務(wù)合同約定,對房屋及配套的設(shè)注2:特指區(qū)分所有建筑物業(yè)主(區(qū)分所有權(quán)人)對物業(yè)實現(xiàn)共同管理(成員)權(quán)和履行管理義務(wù)的一種社會化、制定《管理規(guī)約》對物業(yè)實行自治管理并依法選聘物業(yè)服務(wù)企業(yè),委托并監(jiān)督其按照法律法規(guī)和物業(yè)服務(wù)合物業(yè)管理服務(wù)propertymanageme物業(yè)服務(wù)企業(yè)受業(yè)主的委托,按照相關(guān)法規(guī)以及《管理規(guī)約》和物業(yè)服務(wù)合同的約定,在物業(yè)管理物業(yè)服務(wù)企業(yè)propertyservice物業(yè)服務(wù)專業(yè)供應(yīng)商professionalpropertyserv物業(yè)服務(wù)合同propertyservice物業(yè)服務(wù)企業(yè)與業(yè)主(或業(yè)主大會授權(quán)的業(yè)主委員會)之間就物業(yè)管理服務(wù)及相關(guān)的物業(yè)管理活動5物業(yè)管理區(qū)域propertymanage物業(yè)管理招標(biāo)callforbids物業(yè)管理投標(biāo)propertymanage注:主要包括業(yè)主與業(yè)主、業(yè)主與建設(shè)單位、業(yè)主與物業(yè)服務(wù)企業(yè)以及物6首次業(yè)主大會會議籌備組committeeforpreparationforthefirsttime業(yè)主大會會議conferenceofown由業(yè)主委員會按照業(yè)主大會議事規(guī)則組織業(yè)主大會全體成員召開的會議,分為定期會議和臨時會業(yè)主大會議事規(guī)則rulesofpro7注:管理規(guī)約是規(guī)定業(yè)主和物業(yè)使用人及物業(yè)管理服務(wù)機構(gòu)共同遵守的臨時管理規(guī)約temporarymanag行業(yè)自律self-disciplineofpropert物業(yè)管理聯(lián)席會議jointconferenceonpropert——街道辦事處物業(yè)管理聯(lián)席會議由街道辦事處根據(jù)物業(yè)管理工作實際,組織轄區(qū)城管、規(guī)劃土地監(jiān)察、公安、安監(jiān)、維穩(wěn)、信訪、環(huán)境保護、社區(qū)工作站等部門、機構(gòu)召開,依法協(xié)調(diào)處理8前期物業(yè)管理propertymanagementpriortotheappointmentbyow竣工驗收completionand工程建設(shè)項目竣工后,由建設(shè)單位組織相關(guān)單位會同政府主管部門,對該項目是否符合規(guī)劃設(shè)計物業(yè)承接查驗propertydelivery物業(yè)交接查驗propertydelivery物業(yè)管理服務(wù)權(quán)的移交transferofpropertymanagement9業(yè)主(住戶)手冊owners’(tenant房屋及設(shè)備設(shè)施管理buildingsequipment&facilit專有設(shè)備設(shè)施proprietaryequipme嚴重損壞房seriouslydamag物業(yè)管理用房premisesofproperty為降低故障率或防止房屋及設(shè)備設(shè)施性能劣化,按事先規(guī)定的修理計劃和技術(shù)要求進行的維修活物業(yè)項目編碼propertypro設(shè)備設(shè)施編碼equipment&facil建筑物外共有部位清潔commonareasandstructuresclean物業(yè)公共秩序管理服務(wù)propertypublicordermanageme物業(yè)服務(wù)企業(yè)依法履行安全生產(chǎn)責(zé)任的同時,在物業(yè)管理注:一般包括公共安全防范管理、消防管理、突發(fā)事件應(yīng)急管理、小區(qū)施的使用秩序管理、業(yè)主和物業(yè)使用人對建筑物不當(dāng)使用行為和活妨害行為管理等服務(wù)以及協(xié)助和配合建設(shè)規(guī)劃、環(huán)境衛(wèi)公共安全防范管理publicsafetyprecautio系統(tǒng)設(shè)備的運行維護和管理,施工現(xiàn)場管理,配合基層政府組織物業(yè)綠化養(yǎng)護propertyafforestation物業(yè)資產(chǎn)管理propertyasset物業(yè)專項維修資金propertyspecialmainten主要由建設(shè)單位首期按照建筑物建設(shè)造價的一定比例一次性歸集和業(yè)主按月繳納的兩部分資金組物業(yè)管理費propertymanage注:其主要構(gòu)成主要包括該物業(yè)項目人員費用、綠化養(yǎng)護費、清潔衛(wèi)生費包干制計費方式contract-systemaccounting酬金制計費方式commission-systemaccou物業(yè)管理檔案propertymanage綠色物業(yè)管理greenpropert合同能源管理energyperformanc能單位提供必要的服務(wù),用能單位依據(jù)節(jié)能效益支付節(jié)能服務(wù)公司的投入及其合理利潤的節(jié)能服務(wù)機注2:分項計量是管理節(jié)能的重要手段,也是節(jié)能物業(yè)服務(wù)業(yè)主滿意度ownersatisfactionsur物業(yè)管理第三方機構(gòu)thethirdpartiesofproperty物業(yè)管理信用體系propertymanagementcred以相關(guān)法律法規(guī)、《管理規(guī)約》和物業(yè)服務(wù)合號號B包干制計費方式....................................................................6.5.6保潔服務(wù)..........................................................................6.2.1C承重結(jié)構(gòu)............................................................................5.5酬金制計費方式....................................................................6.5.7D大修工程.........................................................................6.1.16擔(dān)保物權(quán)............................................................................2.5電子投票............................................................獨立產(chǎn)權(quán)業(yè)主.......................................................................2.31F房屋................................................................................2.7房屋管理...........................................................................2.18房屋及設(shè)備設(shè)施管理................................................................6.1房屋修繕..........................................................................6.1.2分項計量............................................................................7.3G公共安全防范管理.................................................................公眾責(zé)任保險......................................................................6共有設(shè)備...........................................................................2.15共有設(shè)施...........................................................................2.16共有部分...........................................................................2.13共有產(chǎn)權(quán)業(yè)主.......................................................................2.32管道疏通服務(wù).................
