soldinPRCChina,includingprepackagedandbulkfoods,specificallyregulatewords,symbols,numbers,patterns,pictures,orotherinformationprovidedbymanufacturersonlabelsand

instructionsforprepackagedfoods,anddescriptionsoncontainersandouterpackagingforbulkfoods,displayingfoodandmanufacturesand/oroperatorsinformationtoconsumers.These

Measuresalsostipulatehowtoprovideproperinformationtospecialfoodsandfoodssoldonline.

WhiletheseMeasuresfocusonclarificationonappearancesandlayoutsdisplayedonfood

BEGINTRANSLATION

FoodLabelingandMarkingSupervisionandManagementMeasuresChapter1GeneralProvisions

Article1TheseMeasuresareformulatedinaccordancewiththeFoodSafetyLawofthe

People’sRepublicofChina,theImplementationRegulationsoftheFoodSafetyLaw,andotherrelevantlawsandregulations,inordertostandardizelabelingandmarkingonfoods,strengthenitssupervisionandmanagement,andprotectthelegitimaterightsandinterestsofconsumers.

Article2TheseMeasuresapplytothelabelingandmarkingandthesupervisionand

managementoffoodsandfoodadditives(hereinafterreferredtoas“foods”)producedorsoldinChina.

Article3“Foodlabelingandmarking”asreferredtointheseMeasuresmeansanytext,symbols,numbers,graphics,orotherdescriptionsusedtopresentinformationaboutfoodandits

manufactureroroperator,displayedonlabelsandinstructionmanualsofprepackagedfoods,oroncontainersandouterpackagingofbulkfoods.

Article4Foodlabelingandmarkingshallcomplywiththeprovisionsoflaws,regulations,rules,andnationalfoodsafetystandards.

Labelingandmarkingmustbeclear,prominent,andeasyforconsumerstorecognizeandread.

Article5Foodmanufacturersandoperatorsshallberesponsiblefortheauthenticity,accuracy,andlegalityofthelabelingandmarkingtheyprovideandshalldesignatespecificinstitutionsorpersonneltoreviewandverifythelabelingandmarkingonfoods.

Manufacturersandoperatorsareencouragedtoengagethird-partyprofessionalinstitutionsortechnicalpersonneltoconductcomplianceevaluationsoftheirfoodlabelingandmarking.

Article6TheStateAdministrationforMarketRegulationisresponsiblefororganizingandsupervisingfoodlabelingandmarkingnationwide.

Localmarketregulationdepartmentsatthecountyleveloraboveareresponsibleforsupervisionandmanagementoffoodlabelingandmarkingwithintheirjurisdictions.

Article7Foodlabelingandmarkingmustnotincludeanyofthefollowings:

(1)Claimsrelatingtothepreventionortreatmentofdiseases;

(2)Falsedescriptionsmadeinadeceptive,misleading,orexaggeratedmanner;

(3)Contentthatviolatesscientificknowledge,publicorder,goodcustoms,orpromotessuperstition;

(4)Claimssuchas“specialsupply,”“exclusivesupply,”or“internalsupply”forgovernmentormilitaryinstitutions;

(5)Othercontentprohibitedbylaws,regulations,rules,andnationalfoodsafetystandards.

Exceptforhealthfoods,otherfoodsshallnotclaimtohavehealthbenefits(functions)intheirlabelingandmarking.

Article8Withoutreferencefromlaws,regulations,rules,nationalfoodsafetystandards,or

industrystandards,foodlabelingandmarkingmustnotclaimsuitabilityforminorsormisleadordeceiveconsumers.

Chapter2GeneralProvisionsforPrepackagedFoodLabels

Article9LabelsofprepackagedfoodsshallindicatethemandatorylabelingitemsasstipulatedinArticle67oftheFoodSafetyLawandrelevantnationalfoodsafetystandardsinChina.

LabelsandinstructionmanualsforfoodadditivesshallindicatethemandatorylabelingitemsspecifiedinArticle70oftheFoodSafetyLawandrelevantnationalfoodsafetystandardsinChina.

Article10Mandatorylabelingitemsforprepackagedfoodsshallbemarkedontheouterpackagingofthesmallestsalesunit.

Ifthesmallestsalesunitcontainsmultipleindividuallypackageditemsormultiplelayersof

packaging,andiftheouterpackagingallowseasyopeningforreadingorthecontentsareclearlyvisiblethroughit,themandatorylabelingitemsontheinnerpackagingdonotneedtobe

repeatedontheouterpackaging.

Article11Textsusedformandatorylabelingitemsonprepackagedfoodlabelsshallbein

standardChinesecharacters.TraditionalChinesecharacters,Pinyin,andforeignlanguagesthat

correspondtothelabeledcontentmayalsobeused,buttheirfontsizemustnotexceedthatofthestandardChinesecharacters.Theuseofminoritylanguagesshallcomplywithrelevantnationalregulations.

Article12Mandatorylabelingitemsonprepackagedfoodlabelsshallusetext,symbols,

numbers,andgraphicsthatcontrastclearlywiththebackgroundcolor.Productiondateandshelf-

lifeexpirationdateshallbemarkedinhigh-contrastformatssuchasblacktextonawhitebackgroundtoensureclarity.

Article13Mandatorylabelingitemsonprepackagedfoodlabelsshallusetext,symbols,andnumberswithafontheightnosmallerthan1.8mm,andtheheight-to-widthratioofthefontshallnotexceed3.

Forpackagingwithamaximumsurfaceareagreaterthan150cm2,theheightoftexts,symbols,andnumbers(excludingthenutritioninformationtable)shallbenotsmallerthan2.0mm;for

packaginglargerthan400cm2,theheightoftexts,symbols,andnumbersshouldbenotsmallerthan2.5mm.

Forthedateofmanufactureandshelf-lifeexpirationdate,fontheightmustbenotsmallerthan3.0mm,exceptforpackagingsmallerthan35cm2,whereitshouldbenotsmaller2.0mm.

Article14Dateofmanufactureandshelf-lifeexpirationdateofprepackagedfoodsmustbe

markedinadedicatedareaonthepackagingandnotbepronetofallingoff.Ifthisareaisnotonthemaindisplaypage,themainpagemustclearlystate“See[specificpart]ofpackaging,”andtheareashowingtheactualdatemustbeeasytolocateandread.

Article15Thedateofmanufactureoftheprepackagedfoodsshallbedeterminedbasedonthecompletionoftheproductionprocess.Ifthesmallestsalesunitissingle-layerpackaging,the

productiondateisthedatewhenthepackagingprocessiscompleted.Ifthesmallestsalesunit

hasmultilayerpackaging,theproductiondateisthedatewhenthepackagingprocessforfood

contactinglayeriscompleted.Ifsterilization,fermentation,orsimilarprocessesareneededafterpackaging,theproductiondateisthecompletiondatewhentherelevantprocessescompleted.

Ifthesmallestsalesunitcontainsmultipleindividuallypackageditems,theshelf-lifeexpirationdateshouldreflecttheearliestexpiringdate,oreachitemshouldbelabeledseparatelyforthe

expirationdate.

Article16Thelabelsofprepackagedfoodsmustincludenamesthatreflectthetruenatureofthefoodsandmustnotmisleadordeceiveconsumers.

Inthefollowingcases,foodnamesshouldbelabeledinaccordancewithrelevantrequirements:

(1)Forfoodsmadefromanimal-derivedfoodingredients,ifthenamereflectslivestockand

poultrymeatoranimalaquaticproductingredients,thoseingredientsshouldbethemain

ingredients.Ifthenameonlyreflectsonetypeofingredient,alltheingredientsusedshouldcomefromthelivestockandpoultrymeatoranimalaquaticproduct;ifthenamereflects

morethantwotypesofingredients,theingredientsusedshouldbesortedinthenamefromhightolowaccordingtotheamountadded.

(2)Forsimulatedanimal-derivedfoodsmadefromplant-derivedfoodingredients,thewords“imitation”,“vegetarian”,or“certainplant”shallbeinthename;

(3)Forfoodsthatdonotaddcertainingredientsbutonlyusefoodflavorsandspicestoblendtheflavoroftheingredient,whentheflavoroftheingredientisinthefoodname,thewords

“certaintaste”or“certainflavor”shallbeaddedinthename.

Article17Thenameandaddressofthemanufacturersonthelabelsofprepackagedfoodsmustthesamenameandaddressonthefoodproductionlicense.Thecontactinformationmustberealandvalid.

Ifthefoodisproducedbyabranchorfacilitythatcannotlegallybearresponsibility

independently,thenameandaddressofthelegalentitythatcanbearlegalresponsibilityshallbemarkedonthelabels.

Whenmultiplemanufacturersaremarkedonthelabelsoftheprepackagedfoods,theactualmanufacturermustbeeasytoidentify.

Forcontract-manufacturedfoods,thelabelmustalsolistthename,address,andcontactinformationofboththeentrustingandentrustedparties,prefixedwith“EntrustingParty,EntrustedParty”or“EntrustingUnit/EntrustedUnit”.

Article18Theingredientlistshalluse“Ingredients”or“IngredientList”asguidinglanguagesonthelabelsoftheprepackagedfoods.Ifingredientsusedhavechangedintoothercomponentsduringprocessing,“rawmaterials”or“rawandauxiliarymaterials”canbeusedinstead.

Repackagedfoodsshouldbemarkedwiththeword“repackaged,”anditsingredientlistshouldincludetheingredientlistinformationoftherepackagedfoods.

Article19NetcontentonlabelsofquantitativeprepackagedfoodsmustcomplywiththeMeasuresfortheSupervisionandAdministrationofQuantitativePackagingCommodities.

Liquid,semi-solid,orviscousfoodsshouldbelabeledinunitsofvolumeormass;solidfoods

shouldbelabeledinunitsofmass;foodsthatarenotsuitableforlabelinginunitsofmassand

volumecanbelabeledinunitsoflength.Forfoodscontainingsolidandliquidphases,whenthesolidphaseisthemainfoodingredients,inadditiontothenetcontent,thedrainedmatter(solids)contentshouldalsobelabeledintheformofmassormassfraction.

Ifthenetcontentcannotbemarkedfornon-quantitativeprepackagedfoodssoldbymeasurement,thewords“measurementbyweight”shallbemarked.

Article20Ifthesameprepackagedfoodcontainsmultiplepiecesofquantitativelypackaged

food,thespecificationsshallbelabeled.Ifthequantitativelypackagedfoodisofthesametype,thenetcontentofeachpieceandthetotalnumberofpiecesshallbelabeled,orthetotalnet

contentshallbelabeled;ifthequantitativelypackagedfoodisofdifferenttypes,thenetcontentofeachpieceandthecorrespondingnumberofpiecesofeachdifferentquantitativelypackagedfoodshallbelabeled,orthetotalnetcontentofeachdifferentquantitativelypackagedfoodshallbelabeled.

Article21Theproductstandardcodeonthelabelshouldincludethestandardnumber,sequencenumber,andyearofissuance.Onlythestandardnumberandsequencenumbermaybeshown,aslongastheycorrespondtothevalidversionineffectatthetimeofproduction.

Theimportedprepackagedfoodsmaynotmarktheproductstandardcode.

Article22Theproductionlicensenumberonthelabelmustbethenumberlistedontheactualproducer’sfoodproductionlicense.

Importedprepackagedfoodsmayomitthelicensenumber.

Article23Storageconditions,warninglabels,cautionarystatements,orothernoticesmarkedonlabelsofprepackagedfoods,mustcomplywithlaws,regulations,andnationalfoodsafety

standards.

Article24IfQRcodesorotherdigitalmethodsareusedtopresentfoodlabelingcontent,the

informationmustcomplywiththeseMeasuresandmustbeconsistentwiththephysicallabelinginformationonthefoodpackaging.

Chapter3SpecialFoodLabelingProvisions

Article25Thecontentoflabelsandinstructionmanualsforspecialfoodsmustbeconsistentwiththosesubmittedforregistrationorfiling.

Ifthelabelfullyincludesallcontentoftheinstructionmanual,aseparatemanualisnotrequired.

Article26LabelsandinstructionmanualsforhealthfoodsshallindicatetheitemsspecifiedinArticles67andArticle78oftheFoodSafetyLawofthePeople’sRepublicofChina.

Inadditiontotheabove,theymustalsoclearlymarkthehealthfoodlogo,registrationorfiling

number,awarningstatementareathatdisplaysrequiredwarninglanguages.Nutrientsupplementsproductsmustalsoindicatetheterm“NutrientSupplement.”

Forsalesunitsofhealthfoodwithamaximumsurfacearealessthan35cm2,thelabelmustatminimumdisplaytheregistrationorfilinginformation,healthfoodlogo,nameofthe

manufacturer,productionlicensenumber,dateofmanufacture,andshelf-lifeexpirationdate,warningstatement,etc.

Article27Informationsuchasthehealthfoodlogo,productname,registrationorfilingnumber,warningareaandwarninglanguages,netcontentandspecificationsmustbegroupedinthesameareaonthelabelofthesmallestsalesunit.

Ifthesmallestsalesunithasmultipleindividualpackagesormulti-layerpackaging,theouter

packagingmustcomplywithlabelingrequirementsforthesmallestsalesunitintheseMeasures.Thepackagingfordirectcontactswiththefoodmustatleastincludeproductname,netcontentandspecifications,dateofmanufacturerandshelf-lifeexpirationdate,andconsumptionamountandmethod.Ifthepackagingcanbesoldseparatelyafterremovingtheouterpackaging,itmuststillmeetthelabelingrequirementsforthesmallestsalesunit.

Article28Thenameofahealthfoodmustmatchthenamesubmittedforregistrationorfiling.

Anytrademarkname,commonname,ordescriptivenameincludedintheproductnamemustnotbelabeledseparately,andmustbeinaconsistentforstyle,color,andsizeofthefont.

Whenusingatrademarkotherthanthetrademarkcorrespondingtothetrademarknameintheproductname,theareaofsuchtrademarkshallnotbelargerthanonequarteroftheareaoftheproductnameandsmallerthantheareaofthetrademarknameintheproductname.Itshallnot

beusedinconjunctionwiththeproductnameandshallnotmisleadpeopleintothinkingitispartoftheproductname.

Article29Thespecificationofhealthfoodshallrefertotheweightorvolumeofthesmallestpreparationunit.Thenetcontentshallrefertothetotalamountofproductinthesmallestsalesunit,orthesizeofthesmallestunitandthecorrespondingquantity

Article30Formulafoodsforinfantsages0–6monthsmustnotincludecontentclaimsor

functionalclaimsontheirlabels.Formulafoodsintendedforinfantsolderthan6months,contentclaimsandfunctionalclaimsarealsoprohibitedfornecessaryingredients.

Article31LabelsforFoodsforSpecialMedicalPurposes(FSMP)mustgroupthefollowing

itemsinthesameareaofthesmallestsalesunit:FSMPlogo,productname,registrationnumber,netcontent(specifications),intendedpopulation,andthewarningmessageof“Useunderthe

guidanceofadoctororclinicalnutritionist.”

Article32MattersnotspecifiedinthisChapter,shouldcomplywiththegeneralprovisionsfor

forprepackagedfoodlabelsintheseMeasuresandotherregulationsissuedbytheStateAdministrationforMarketRegulation.

Chapter4RequirementsofLabelingandMarkingforFoodSales

Article33Whensellingbulkfoods,thecontainerorouterpackagingmustbelabeledwiththe

nameofthefood,componentsoringredientlist,dateofmanufactureorbatchnumber,shelflife,andname,address,andcontactinformationofthemanufacturerandoperator.

Ifprepackagedfoodissoldbyweightafteritsouterpackaginghasbeenremoved,therelevantcontentsshallbemarkedinaccordancewiththeprovisionsoftheprecedingparagraph.Ifthe

individualinnerpackagingalreadycontainsalltherequiredinformationlistedabove,additionallabelingisnotrequired.

Article34Fortheprepackagedfoodssoldonline,informationsuchasfoodname,netcontent,componentsoringredientslist,shelflife,productstandardcode,storagecondition,nameandaddressofmanufacturers,registrationoffilinginformationforspecialfoods,etc.shouldbe

displayedprominentlyonthemainsalespage.

Exceptfordynamicinformationsuchasdateofmanufactureandexpirationdate,allother

labelinginformationdisplayedonlinemustmatchthatontheactualphysicalproductlabelforsales.

Article35Third-partyonlinefoodtradingplatformsprovidersmustestablishmonitoring

systemsforfoodlabelingandmarkinginformationpublishedbyvendorsontheplatform,setupadedicatedfoodsafetymanagementdepartment,ordesignatefull-timefoodsafetymanagementpersonneltomonitorandinspectfoodbusinessactivitiesandinformation.

Ifaplatformprovidersdiscoverlabelingandmarkinginformationisinviolationoflaws,regulations,rules,andnationalfoodsafetystandards,theymusttakenecessaryactionin

accordancewiththelaw,keeprelevantrecords,andreporttothemarketsupervisiondepartmentatorabovethecountylevelwheretheplatformislocated.

Article36Whensellingspecialfoods,retailersmustestablishadedicatedzoneordisplay

cabinetthatclearlyidentifiessalesforhealthfoods,foodsforspecialmedicalpurposes,orinfantformulafoods.

Healthfoodoperatorsshallmarkconsumerremindersuchas“Healthfoodisnotmedicineandcannotreplacemedicationfortreatingdiseases”inaprominentpositionatthephysicalbusinesspremisesandataprominentpositiononthemainpageofhealthfoodsonlinesales.

Chapter5SupervisionandAdministration

Article37Marketregulationdepartmentsshall,inaccordancewiththeirresponsibilitiesasdefinedbylawsandregulations,carryoutsupervisionandinspectionoffoodlabelingandmarking.

Article38Ifamarketregulationdepartmentdiscoversthatavendoronaplatformisengagingin

foodlabelingandmarkingviolationsandrequeststheplatformprovidertotakeactioninaccordancewiththelaw,theplatformprovidermustcooperate.

Article39Themarketsupervisionandmanagementdepartmentmaycomprehensivelyconsidertherelevanceofthelabelingandmarkingcontenttofoodsafety,thesubjectivefaultofthefoodmanufactureandoperator,theconsumer’sunderstandingforfoodsafetyandtheirchoices,andotherfactorstodeterminethedefectsoftheprepackagedfoodlabelsandinstructions.Ifapre-packagedfoodhasanyofthefollowingcircumstances,itcangenerallybedeterminedasalabelorinstructionmanualdefectasstipulatedinParagraph2ofArticle125oftheFoodSafetyLawofthePeople’sRepublicofChina:

(1)Fontsize,type,orheightfortexts,symbols,ornumbersarenotstandardized;typographicalerrors,extraormissingcharacters;useoftraditionalcharacters;inaccurateforeignlanguagetranslations;orforeigntextslargerthanChinesecharacters,etc;

(2)Improperformatormethodofexpressingnetcontentorspecifications;orfailuretolabelstorageconditionsaccordingtorequirementswhenfoodsdon’tneedspecialstorage

conditions;

(3)Improperuseofcolloquialorabbreviatednamesforfoods,foodadditives,oringredients;

(4)Impropermarkingoforder,values,orunitsusedinnutritioninformation(table)and

ingredientlists;incorrectroundingintervals,“0”thresholds,orunitformatsinnutritioninformationtable;

(5)Otherminorissuesthatdonotaffectfoodsafetyanddonotintentionallymisleadconsumers.

Chapter6LegalLiability

Article40Iflawsoradministrativeregulationsalreadyprovideforpenaltiesrelatedtofoodlabelingandmarkingviolations,thoseprovisionsshallapply.

Article41AnyviolationoftheprovisionsofItem1to3ofParagraph1ofArticle7,Article9,

Article16,Paragraph1ofArticle17,Paragraph1ofArticle22,andParagraph1ofArticle26oftheseMeasuresshallbepunishedbythemarketsupervisionandmanagementdepartmentsatorabovethecountylevelinaccordancewiththeprovisionsofParagraph1ofArticle125ofthe

FoodSafetyLaw.

Article42AnyviolationoftheprovisionsofItem4ofParagraph1ofArticle7ofthese

circumstancesareserious,afineofnotlessthanRMB30,000yuanbutnotmorethanRMB100,000yuanshallbeimposed.

Article43AnyviolationoftheprovisionsofParagraph2ofArticle7,Paragraph1ofArticle25oftheseMeasuresshallbepunishedbythemarketsupervisionandadministrationdepartmentsatorabovethecountylevelinaccordancewiththeprovisionsofArticle68oftheRegulationsfortheImplementationoftheFoodSafetyLawofthePeople’sRepublicofChina.

Article44AnyviolationoftheprovisionsofArticle8,Articles10toArticle14,Paragraph2to4ofArticle17,Article18,Paragraph2andParagraph3ofArticle26,Article27,andArticle28oftheseMeasuresshallbeorderedtocorrectbythemarketsupervisionandadministration

departmentsatorabovethecountylevelandmaybefinednotmorethanRMB30,000.

Article45AnyviolationoftheprovisionsofArticle15oftheseMeasuresbymarkingfalse

datesofmanufactureandshelf-lifeexpirationdatesshallbepunishedbythemarketsupervisionandadministrationdepartmentsatorabovethecountylevelinaccordancewiththeprovisionsofthefirstparagraphofArticle124oftheFoodSafetyLawofthePeople’sRepublicofChina.

Article46AnyviolationoftheprovisionsofParagraph1ofArticle19oftheseMeasuresshallbedealtwithinaccordancewiththerelevantprovisionsofthe“MeasurementSupervisionandManagementMeasuresforQuantitativePackagedGoods.”

AnyviolationoftheprovisionsofParagraph2andParagraph3ofArticle19,Article20andArticle29oftheseMeasures,wherethenetcontentandspecificationsarenotcorrectlyand

clearlymarked,shallbeorderedtobecorrectedbythemarketsupervision
