1、LABOUR CONTRACT 勞動(dòng)合同 Echo Network CO., LTD 廣州市眾飛信息科技有限公司 AND * 與 人名) INDEX目錄 1. POSITION 由于發(fā)生自然災(zāi)害、事故或其它危及該員工生命、健康、財(cái)產(chǎn)及 安全的事件,必須采取緊急措施; b. Urgent repair which must be carried out in case of breaking down of operation equipment, communication, transportation and other facilities which will endanger COM

2、PANY business or public interest; 由于運(yùn)營設(shè)備、通訊設(shè)備、運(yùn)輸設(shè)備及其它設(shè)備發(fā)生故障,危害 到本公司的業(yè)務(wù)或公共利益,必須進(jìn)行緊急維修; c. Continuous of the operation or business of the COMPANY which shall not be interrupted on stipulated holidays and rest days. 由于無法因?yàn)榉ǘㄐ菁俸碗p休日而中斷本公司持續(xù)開展的經(jīng)營運(yùn) 作或業(yè)務(wù); d. Overhaul and maintenance of the equipment which s

3、hall only be made on stipulated holidays and rest days; and 只能在法定休假和雙休日進(jìn)行的設(shè)備檢修與維護(hù); e. Emergency operation assignment concerning national defenee. 由于國防原因需要采取緊急措施。 ARTICLE 9: DISCIPLINE 第九條:勞動(dòng)紀(jì)律 9.1 Apart from the provisio ns of this CONTRACT the EMPLO YEE must respect all releva nt laws and regulatio

4、 ns of the People regulati ons of the COMPAN Y and provisi ons of any releva nt collective labour con tract. 除本合同所規(guī)定之條款外,該員工還須遵守中華人民共和國相關(guān)法 律法規(guī)、本公司制定的規(guī)章制度,以及其它勞動(dòng)合同方面的相關(guān)規(guī) 定O 9.2 The EMPLO YEE must respect and execute any and all formal in structi ons give n to him/her regard ing the duties and resp on

5、 sibilities of his/her tasks of work. 該員工須遵守并執(zhí)行一切與其工作職責(zé)有關(guān)的正式指令。 9.3 In cases of an offen ce, gross misc on duct, and or any violati on of labour discipli ne the COMPAN Y will no rmally carry out the followi ng procedure: 若該員工出現(xiàn)過錯(cuò)、嚴(yán)重過失及/或其它違反勞動(dòng)紀(jì)律的行為,本公 司一般依照以下程序?qū)υ搯T工進(jìn)行處罰: 1 -Oral warni n口頭警告 2 -First

6、writte n warnin第 一次書面警告 3 -Fi nal written warnin第 二次書面警告 4 -Dismissal除 9.4 However the COMPAN Y reserves the right to omit any of these stages as the case may be. 然而,本公司有權(quán)根據(jù)實(shí)際情況對上述某些步驟進(jìn)行調(diào)整。 9.5 The EMPLO YEE has the right to appeal aga inst writte n war nings or dismissal to the Labour Dispute Commi

7、ttee if any. 該員工有權(quán)針對其受到的書面警告或開除決定向勞動(dòng)爭議委員會(huì)提 出申訴(如需)。 ARTICLE 10: SICKNESS and 本公司無須向該員工支付本合同第 5條規(guī)定的年終獎(jiǎng)金; b. The EMPLOYEE shall refund to the COMPANY all the expenses and costs for the training provided to the EMPLOYEE according to Article 7 hereto. 該員工應(yīng)按照本合同第7條的規(guī)定退還本公司為其提供培訓(xùn)投入 的所有費(fèi)用。 ARTICLE 18: AMEN

8、DMENT OF THE CONTRACT 第十八章:合同修訂 18.1 This CONTRACT may be revised upo n agreeme nt of both PARTIES. Any ame ndme nt to this CONTRACT shall come into force on ly after a writte n agreeme nt has bee n sig ned by both PARTIES. 18 本合同經(jīng)合同雙方同意可作修訂。本合同任何修訂內(nèi)容須經(jīng)合同雙 方簽署書面協(xié)議后方能生效。 ARTICLE 19: APPLICABLE LAW 第十

9、九條:適用法律 19.1 The formatio n, validity, and performa nee of this CONTRACT and disputes there on shall be gover ned by the laws of the Peoples Republic of China. 本合同的格式、有效期、履行、以及對本合同的爭議應(yīng)遵照中華人 民共和國法律法規(guī)執(zhí)行。 ARTICLE 20: SETTLEMENT OF DISPUTES 第二十條:爭議的處理及解決 20.1 Any disputes aris ing from the performa nee

10、of or in conn eeti on with this CONTRACT shall be settled through frie ndly eon sultati ons between the PARTIES. 任何因履行本合同或由本合同相關(guān)事宜引發(fā)的爭議,應(yīng)由合同雙方 友好協(xié)商解決。 20.2 In case no settlement can be reached through eonsultations the PARTIES can apply for mediation to the labour dispute eoneiliation committee esta

11、blished by the COMPA NY, if any. 若無法協(xié)商解決,合同雙方可根據(jù)需要向本公司組建的勞動(dòng)爭議管 理委員會(huì)申請調(diào)解。 20.3 If mediation can not be reached the PARTIES may apply to arbitration to the releva nt labour dispute arbitratio n committee. 若無法實(shí)現(xiàn)調(diào)解,合同雙方可向相關(guān)勞動(dòng)爭議仲裁委員會(huì)申請仲 裁。 If a PART Y disagrees with the arbitrage award ren dered by such

12、committee this PART Y may file a suit in the Guan gzhou Tiantect People s Court fifteen (15) days of being notified the said arbitrage award. 若合同任何一方對上述勞動(dòng)爭議仲裁委員會(huì)給予的仲裁結(jié)果持有異 議,該合同方可于接到仲裁結(jié)果后十五日內(nèi)向廣州市天河區(qū)人民法 院提起訴訟。 ARTICLE 21: MISCELLANEOUS 第二一條:其它事宜 21.1 This CONTRACT shall be written in Chinese and English versions. In a case of discrepa ncy of in terpretati on betwee n the Chin ese and En glish vers ions the Chin ese vers ion shall prevail. 英文兩種語言書寫,若出現(xiàn)中、英文翻譯上的差異,
