1、WORKING PROCEDURE備用信用證操作流程I. VIA SWIFT PRE-ADVICE MT799/ MT760 SBLC PROCEDURE FACE VALUE （ Max 30,000,000.00 Usd/ Euro）. 三千萬美元、歐元以下的備用信用證操作流程。1. The provider will send the Issuing account coordinate to allow receiving bank check the interbank credit availability. 開證方提供開證銀行坐標(biāo)給接證方查詢同業(yè)額度是否有。2. Client P

2、rovide CIS including: Company Registration, Signatory Passport Copy, Latest Bank Statement copy, Full Bank Account Coordinates, Bank Approved Verbiage and Bank letter if available.接證方提供資料包括：商業(yè)登記證， 法人護照復(fù)印件，銀行坐標(biāo)，接證銀行 760 版本 （銀行蓋上章 ），有可能的話額度函。3. Provider within 24 hours issue DOA Draft and complete, 開證

3、方在 24 個銀行小時內(nèi)提供已經(jīng)填好的合同包括開證方基本 資料：商業(yè)登記證， 法人護照，開證銀行坐標(biāo)。4. Buyer in 24 hours complete DOA, sign, stamp and send to Provider, 接證方（買方）在 24 個銀行小時內(nèi)填好合同并且簽字，蓋章返 回給開證方 .5. Provider in 48 hours Sign, stamp and send back the signed DOA for Buyer filling.開證方在 48 小時內(nèi)簽字蓋章再返回給接證方（買家）做備案6. Receiver will Deposit 1% of

The lawyer firm will prepare and sign 3 parties escrow service agreement. 接證方，開證方，與指定律師事務(wù)所（可由接證方指定律所）簽 署三方托管賬戶協(xié)議。接證方和開證方同時打票面額 1%至律師 事務(wù)所的托管賬戶作為開證保證金。7. Provider Bank Issue Pre-advice Via SWIFT MT799 within 5 banking days according to Receiving bank

5、approved Verbiage. The Provider should send the Swift Copy to Receiver via it ' s Agent.開證方在 5 個銀行工作日內(nèi)根據(jù)接證銀行版本通過 MT799 開出 預(yù)開證。開證方通過代理商提供給接證方 MT799 報文。8. Within 72 Banking Hours upon receipt of MT799, Receiving should reply to Sending Bank Via MT799. If Receiving within 72 banking hours fails to

6、reply, Receiver must pay in RMB equivalent 100,000.00 Euro to Provider as compensation. The lawyer should deduct for the deposit amount. 接證方收到預(yù)開證后在 72 小時內(nèi)通過銀行 SWIFT MT799 回復(fù)開 證方。如果接證銀行在 72 小時內(nèi)未能回復(fù)， 接證方應(yīng)該支付人 民幣等金額的十萬歐元。律師事務(wù)所直接從已經(jīng)鎖定的 1%里扣 除。s bank.9. 7、Banking Hours upon Receipt of Reply from Receiving Bank, according to buyer bank approved verbiage. Provider shall send the stamped swift copy including answer back sheet to Receiver as proof of successful delivery of the instrument. The receiver should not for any reason claim the instrument is not

Provider shall not be reliable for any internal issues between receiver and it收到接證方回復(fù)在 72 小時內(nèi)開證方通過 SWIFT開 出 MT760 根據(jù) 接證銀行確認(rèn)的版本 , 開證方提供報文包括自動回復(fù)函作為開證 成功依據(jù)。接證方不能以任何為由說證沒收到。開證方不負(fù)責(zé)接 證方與其銀行相關(guān)問題造成的問題。10. The lawyer firm will release the security deposit( 1% offace value ) to provider designated

9、account upon receipt, confirmation and authenticate of the SBLC MT760. 接證方收到，確認(rèn)，驗證 Swift MT760 之后律師事務(wù)所支付托管 賬戶保證金(票面的 1%)到開證方指定賬戶。1. If provider within 10 banking days fail to issue MT799 or MT760, provider agent shall pay RMB to Receiveras compensation.如果開證方在 10 個工作日未能開出 MT799 或 MT760 ，應(yīng)該支 付人民幣給接證方賠償。11. Buyer within 5 to 7 banking days make the payment of balance due including all consulting fees.接證方在 5 到 7 個銀行工作日內(nèi)支付余款以及所有傭金12. The Original hard copy may be send to buyer within 7 days at buyer request
