1、聘(雇)用契約書(以下簡稱甲方)為應(yīng)業(yè)務(wù)需要,聘(雇)用 先生(女士) (以下簡稱 乙方)為約聘(雇)人員,雙方訂立契約條款如下:一、聘(雇)用期間:自 年月日起至 年月日止。二、聘(雇)用報酬:甲方按月支給乙方報酬 薪點(diǎn)( 元)。三、工作容(具體敘明) : 。四、受聘(雇)責(zé)任: 乙方受聘(雇)后須確保甲方公務(wù),有期限者從其規(guī)定,無期限者自離職日起 年為限(解聘(雇)者亦同) 。乙方不得有不法行為或違背約定義務(wù),如有違背者,除涉及民、 刑事責(zé)任,由甲方依法追究外,并得隨時解聘(雇) 。在聘(雇) 用期間,乙方愿接受與甲方約定之工作上的指派調(diào)遣,并遵守此工作上之相關(guān)規(guī) 定。若乙方違背上述相關(guān)規(guī)
2、定確屬情節(jié)重大, 甲方得隨時終止契約;甲、乙雙方如因特別事 故須提前終止契約時,應(yīng)于一個月前提出預(yù)告,經(jīng)甲、乙雙方協(xié)議后乙方始得離職。乙方離 職時, 應(yīng)先依照規(guī)定辦妥離職手續(xù)。 如有損害公物,或侵權(quán)情事(或違反甲方智能財產(chǎn)權(quán)規(guī) 定),應(yīng)負(fù)責(zé)賠償。五、乙方在受聘(雇)用期間,除應(yīng)遵守甲方一切行政法規(guī)之規(guī)定外,其假期、離職儲金給 與、勞工保險及全民健保等,依左列約定: 假期核給:依 辦理。離職儲金之扣繳及給與依 規(guī)定辦理, 按月扣繳儲存生息, 并于離職時依規(guī)定發(fā)給。按乙方每月支報酬之百分之 提存儲金,其中百分之 由乙方于每月報酬中扣繳作為自提儲金,另百分之 由甲方提撥作為公提儲金,并由甲方在金融機(jī)
3、構(gòu)開立專戶儲存孳息,列帳管理。乙方因契約期滿離職、 或經(jīng)甲方同意于契約期限屆滿前離職、 或在職因公、 因病或意外死亡 者,發(fā)給公、自提儲金本息。乙方因違反契約所定義務(wù)而經(jīng)甲方予以解聘,或未經(jīng)甲方同意而于契約期限屆滿前離職者, 僅發(fā)給自提儲金之本息。其余未盡事宜請參考 有關(guān)規(guī)定。乙方受聘(雇)用期間,甲方應(yīng)善盡投保勞工保險及全民健康保險之義務(wù)。六、乙方于受聘 (雇) 期間之著作或工作成果, 如系于甲方企劃下, 或法定工作期間完成者, 其所有權(quán)歸屬甲方。因前開著作或工作成果所生之智能財產(chǎn)權(quán),應(yīng)依本院之相關(guān)規(guī)定辦理。七、本契約期間屆滿當(dāng)然失效,如因業(yè)務(wù)需要須續(xù)聘時,另行簽訂新契約。八、本契約未訂定事
4、項(xiàng),悉依聘用人員聘用條例及 相關(guān)規(guī)定辦理。九、本契約以中文本為準(zhǔn)。如中、英文二本互相歧異或抵觸時,以中文本為準(zhǔn)。 十、本契約法律糾紛以 法院為第一審管轄法院。十一、本契約乙式參份,除一份由甲方報院備查外,另由雙方各執(zhí)乙份。 甲方(簽章) : 乙方(簽章) : 年 月日 年月日 附件This Agreement is made and entered into on the day of by and between ( Institute or Preparatory Office ), Academia Sinica ( hereinafter referred to as A ) and(
5、 hereinafter B ).Whereas, A is willing to offer B employment, and B is willing to accept suchemployment subject to the following terms and conditions :1. Term of EmploymentThe parties agree that the term of this agreement shall be commencing from this day of , to theday of2. RemunerationA shall pay
6、B a salary of N.T. per month.3. Bs duties ( in specific description )Bs duties shall include .4. Bs Obligations and Termination4.1 B shall handle in a confidential manner all matters relating to As business. This confidentiality obligation shall remain effective during the period specified in the re
7、gulations or working rules concerned. In case that no time period isspecified , it remains effective for successive years terms after Bstermination of this employment. In the event that B violates any law or regulation , or breaches this Agreement or working rules concerned, A may in its discretionr
8、eprimand B or terminate this Agreement. A also reserves the right to institute suit against B for civil compensation or to impose criminal liability.4.2 During the term of this Agreement, B shall comply with the directions andinstructions of his/her supervisors , perform his/her duties in accordance
9、 with all regulations and relevant working rules. Where B violates any obligation specifiedin this paragraph and the case is considered to be serious in nature , A may in its discretion terminate this Agreement. If at any time the parties intend to terminatethis Agreement due to causes beyond the re
10、asonable control of such party, eithershall give thirty (30) days notice of cancellation to the other party prior to the intended termination date. B shall vacate his/her office under and pursuant to the stipulations agreed upon by both parties. B shall submit to the proceedings in prescribed manner
11、 as to be vacated of his/her office.In case of any one of the following conditions which is due to Bs fault , B shall be responsible for compensation : (1) Where B inflicts damage to or excessively abuses machinery,equipment , tools , raw materials , products or other article belonging to Academia S
12、inica ;(2) Where B commits torts ;(3) Where B violates As ownership of intellectual property rights.5. B shall comply with any administrative regulations and rules provided by A. In regard to the matters of absence on leave , pay-as-you-go contribution benefit , labor insurance and national health i
13、nsurance , the following terms and conditions shall be applicable.5.1 Absence on leave shall be operated pursuant to Regulation of Absence onleave for Personnel served in all Executive Yuan organizations under Civil Contractual Relationship.5.2 The deduction and grant of pay-as-you-go contribution b
14、enefit shall beoperated pursuant to Regulation of pay-as-you-go contribution benefit for Personnel served in all organizations and schools under Civil Contractual Relationship. Certain amount of salary shall be deducted per month and accrue on the financial institute over the term of this employment
15、.5.2.1 An amount equal to seven percent ( 7% ) of the monthly salary shall becontributed. Fifty percent ( 50% ) of the contribution shall be drawn from Bsmonthly salary. ( hereinafter called personal contribution benefit) A shall provide the other fifty percent ( 50%) of the contribution ( hereinaft
16、er calledpublic contribution benefit), and shall open a special account on financialinstitute as to accumulate and manage this contribution (personal plus public) .5.2.2 The total amount of the contribution benefits (personal plus public) shallbe granted to B, if at any time (a) B leaves the office
17、on the expiry of thisAgreement, (b)B vacates the office prior to the expiration date with the consentof A , and (c) B deceases due to undertaking of duty, illness or accident.5.2.3 The amount of personal contribution benefits accumulated shall be granted to B , if at any time (a) A terminates this A
18、greement inasmuch as B breaches anyobligation , and (b) B resigns from the office prior to the expiration date without the consent of A.5.2.4 Any matter or event not provided in the context of this Article shall beoperated pursuant to Regulation of pay-as-you-go contribution benefit for Personnel se
19、rved in all organizations and schools under Civil Contractual Relationship and relevant regulations.5.3 During the term of this Agreement , A shall insure B subject to the termsandconditions pursuant to labor insurance regulations and national health insurance regulations.6. Both parties agree that
20、A shall own proprietary right pertaining to the literary works or achievements completed by B under the projects initiated or coordinatedby A during the term of this Agreement. The ownership of intellectual property rights ( including but not limited to certain patents , trademarks , copyrights , te
21、chnical information and know-how ) accrued from the literary works or achievements herein contained is subject to the relevant regulations and rules provided by A.7. ExpirationAt the expiration of the term of this agreement , the employment relationship shall automatically terminate without any cond
22、ition. A new employment agreement shall be signed for the renewal and continuance of such relationship, if agreed to any byboth parties.8. Any matter or event not provided in the context of this Agreement shall begoverned by and interpreted in accordance with Employment Regulation for Personnel unde
23、r Civil Contractual Relationship (stipulated by Academia Sinica ) & Employment Regulation for Personnel served in all Executive Yuan organizations under Civil Contractual Relationship.9. Governing LanguageThe Chinese text of this Agreement shall be deemed the original. In the event of any dispute or misunderstanding as to the interp retation of the language or terms of this Agree
