1、中國(guó)人民財(cái)產(chǎn)保險(xiǎn)股份有限公司海洋運(yùn)輸貨物保險(xiǎn)條款( 2009 版)一、責(zé)任范圍本保險(xiǎn)分為平安險(xiǎn)、水漬險(xiǎn)及一切險(xiǎn)三種。被保險(xiǎn)貨物遭受損失時(shí),本保險(xiǎn)按照保險(xiǎn)單上訂明 承保險(xiǎn)別的條款規(guī)定,負(fù)賠償責(zé)任。( 一 ) 平安險(xiǎn)本保險(xiǎn)負(fù)責(zé)賠償:1、貨物在運(yùn)輸途中由于惡劣氣候、雷電、海嘯、地震、洪水自然災(zāi)害造成整批貨物的全部損 失或推定全損。當(dāng)被保險(xiǎn)人要求賠付推定全損時(shí),須將受損貨物及其權(quán)利委付給保險(xiǎn)人。被保險(xiǎn)貨 物用駁船運(yùn)往或運(yùn)離海輪的,每一駁船所裝的貨物可視作一個(gè)整批。推定全損是指被保險(xiǎn)貨物的實(shí) 際全損已經(jīng)不可避免,或者恢復(fù)、修復(fù)受損貨物以及運(yùn)送貨物到原訂目的地的費(fèi)用超過(guò)該目的地的 貨物價(jià)值。2、由于運(yùn)輸工
2、具遭受擱淺、觸礁、沉沒(méi)、互撞、與流冰或其他物體碰撞以及失火、爆炸意外 事故造成貨物的全部或部分損失。3、在運(yùn)輸工具已經(jīng)發(fā)生擱淺、觸礁、沉沒(méi)、焚毀意外事故的情況下,貨物在此前后又在海上 遭受惡劣氣候、雷電、海嘯等自然災(zāi)害所造成的部分損失。4、在裝卸或轉(zhuǎn)運(yùn)時(shí)由于一件或數(shù)件整件貨物落海造成的全部或部分損失。5、被保險(xiǎn)人對(duì)遭受承保責(zé)任內(nèi)危險(xiǎn)的貨物采取搶救、防止或減少貨損的措施而支付的合理費(fèi) 用,但以不超過(guò)該批被救貨物的保險(xiǎn)金額為限。6、運(yùn)輸工具遭遇海難后,在避難港由于卸貨所引起的損失以及在中途港、避難港由于卸貨、 存?zhèn)}以及運(yùn)送貨物所產(chǎn)生的特別費(fèi)用。7、共同海損的犧牲、分?jǐn)偤途戎M(fèi)用。8、運(yùn)輸契約訂有“
3、船舶互撞責(zé)任”條款,根據(jù)該條款規(guī)定應(yīng)由貨方償還船方的損失。( 二 ) 水漬險(xiǎn)除包括上列平安險(xiǎn)的各項(xiàng)責(zé)任外, 本保險(xiǎn)還負(fù)責(zé)被保險(xiǎn)貨物由于惡劣氣候、 雷電、 海嘯、地震、 洪水自然災(zāi)害所造成的部分損失。( 三 ) 一切險(xiǎn) 除包括上列平安險(xiǎn)和水漬險(xiǎn)的各項(xiàng)責(zé)任外,本保險(xiǎn)還負(fù)責(zé)被保險(xiǎn)貨物在運(yùn)輸途中由于外來(lái)原因 所致的全部或部分損失。二、除外責(zé)任本保險(xiǎn)對(duì)下列損失不負(fù)賠償責(zé)任:( 一 ) 被保險(xiǎn)人的故意行為或過(guò)失所造成的損失。(二)屬于發(fā)貨人責(zé)任所引起的損失。(三)在保險(xiǎn)責(zé)任開(kāi)始前,被保險(xiǎn)貨物已存在的品質(zhì)不良或數(shù)量短差所造成的損失。(四)被保險(xiǎn)貨物的自然損耗、本質(zhì)缺陷、特性以及市價(jià)跌落、運(yùn)輸延遲所引起的損失
4、或費(fèi)用。(五)本公司海洋運(yùn)輸貨物戰(zhàn)爭(zhēng)險(xiǎn)條款和貨物運(yùn)輸罷工險(xiǎn)條款規(guī)定的責(zé)任范圍和除外責(zé)任。三、責(zé)任起訖(一)本保險(xiǎn)負(fù)“倉(cāng)至倉(cāng)”責(zé)任,自被保險(xiǎn)貨物運(yùn)離保險(xiǎn)單所載明的起運(yùn)地倉(cāng)庫(kù)或儲(chǔ)存處所開(kāi)始 運(yùn)輸時(shí)生效,包括正常運(yùn)輸過(guò)程中的海上、陸上、內(nèi)河和駁船運(yùn)輸在內(nèi),直至該項(xiàng)貨物到達(dá)保險(xiǎn)單 所載明目的地收貨人的最后倉(cāng)庫(kù)或儲(chǔ)存處所或被保險(xiǎn)人用作分配、分派或非正常運(yùn)輸?shù)钠渌麅?chǔ)存處 所為止。如未抵達(dá)上述倉(cāng)庫(kù)或儲(chǔ)存處所,則以被保險(xiǎn)貨物在最后卸載港全部卸離海輪后滿六十天為 止。如在上述六十天內(nèi)被保險(xiǎn)貨物需轉(zhuǎn)運(yùn)到非保險(xiǎn)單所載明的目的地時(shí),則以該項(xiàng)貨物開(kāi)始轉(zhuǎn)運(yùn)時(shí) 終止。(二)由于被保險(xiǎn)人無(wú)法控制的運(yùn)輸延遲、繞道、被迫卸貨、重
5、新裝載、轉(zhuǎn)載或承運(yùn)人運(yùn)用運(yùn)輸 契約賦予的權(quán)限所作的任何航海上的變更或終止運(yùn)輸契約,致使被保險(xiǎn)貨物運(yùn)到非保險(xiǎn)單所載明目 的地時(shí),在被保險(xiǎn)人及時(shí)將獲知的情況通知保險(xiǎn)人,并在必要時(shí)加交保險(xiǎn)費(fèi)的情況下,本保險(xiǎn)仍繼 續(xù)有效,保險(xiǎn)責(zé)任按下列規(guī)定終止。1、被保險(xiǎn)貨物如在非保險(xiǎn)單所載明的目的地出售,保險(xiǎn)責(zé)任至交貨時(shí)為止,但不論任何情況, 均以被保險(xiǎn)貨物在卸載港全部卸離海輪后滿六十天為止。2、被保險(xiǎn)貨物如在上述六十天期限內(nèi)繼續(xù)運(yùn)往保險(xiǎn)單所載原目的地或其他目的地時(shí),保險(xiǎn)責(zé) 任仍按上述第 (一 )款的規(guī)定終止。(一)當(dāng)被保險(xiǎn)貨物運(yùn)抵保險(xiǎn)單所載明的目的港(地) 以后,被保險(xiǎn)人應(yīng)及時(shí)提貨,當(dāng)發(fā)現(xiàn)被保險(xiǎn)貨物遭受任何損失,
6、應(yīng)即向保險(xiǎn)單上所載明的檢驗(yàn)、理賠代理人申請(qǐng)檢驗(yàn),如發(fā)現(xiàn)被保險(xiǎn)貨物整件 短少或有明顯殘損痕跡應(yīng)即向承運(yùn)人、受托人或有關(guān)當(dāng)局 ( 海關(guān)、港務(wù)當(dāng)局等 )索取貨損貨差證明。 如果貨損貨差是由于承運(yùn)人、受托人或其他有關(guān)方面的責(zé)任所造成,并應(yīng)以書(shū)面方式向他們提出索 賠,必要時(shí)還須取得延長(zhǎng)時(shí)效的認(rèn)證。 如未履行上述規(guī)定義務(wù), 保險(xiǎn)人對(duì)有關(guān)損失不負(fù)責(zé)賠償責(zé)任。(二)對(duì)遭受承保責(zé)任內(nèi)危險(xiǎn)的貨物,被保險(xiǎn)人和保險(xiǎn)人都可迅速采取合理的搶救措施,防止或 減少貨物的損失,被保險(xiǎn)人采取此項(xiàng)措施,不應(yīng)視為放棄委付的表示,保險(xiǎn)人采取此項(xiàng)措施,也不 得視為接受委付的表示。對(duì)由于被保險(xiǎn)人未履行上述義務(wù)造成的擴(kuò)大的損失,保險(xiǎn)人不負(fù)賠
7、償責(zé)任。(三)如遇航程變更或發(fā)現(xiàn)保險(xiǎn)單所載明的貨物、船名或航程有遺漏或錯(cuò)誤時(shí),被保險(xiǎn)人應(yīng)在獲 悉后立即通知保險(xiǎn)人并在必要時(shí)加交保險(xiǎn)費(fèi),本保險(xiǎn)才繼續(xù)有效。(四)在向保險(xiǎn)人索賠時(shí),必須提供下列單證:保險(xiǎn)單正本、提單、發(fā)票、裝箱單、磅碼單、貨 損貨差證明、檢驗(yàn)報(bào)告及索賠清單。如涉及第三者責(zé)任,還須提供向責(zé)任方追償?shù)挠嘘P(guān)函電及其他 必要單證或文件。被保險(xiǎn)人未履行前款約定的單證提供義務(wù),導(dǎo)致保險(xiǎn)人無(wú)法核實(shí)損失情況的,保險(xiǎn)人對(duì)無(wú)法核 實(shí)的部分不承擔(dān)賠償責(zé)任。( 五 ) 在獲悉有關(guān)運(yùn)輸契約中“船舶互撞責(zé)任”條款的實(shí)際責(zé)任后,應(yīng)及時(shí)通知保險(xiǎn)人。否則,保險(xiǎn)人對(duì)有關(guān)損失不負(fù)賠償責(zé)任。五、賠償處理 保險(xiǎn)人收到被保險(xiǎn)
8、人的賠償請(qǐng)求后,應(yīng)當(dāng)及時(shí)就是否屬于保險(xiǎn)責(zé)任作出核定,并將核定結(jié)果通 知被保險(xiǎn)人。情況復(fù)雜的,保險(xiǎn)人在收到被保險(xiǎn)人的賠償請(qǐng)求并提供理賠所需資料后三十日內(nèi)未能 核定保險(xiǎn)責(zé)任的,保險(xiǎn)人與被保險(xiǎn)人根據(jù)實(shí)際情形商議合理期間,保險(xiǎn)人在商定的期間內(nèi)作出核定 結(jié)果并通知被保險(xiǎn)人。對(duì)屬于保險(xiǎn)責(zé)任的,在與被保險(xiǎn)人達(dá)成有關(guān)賠償金額的協(xié)議后十日內(nèi),履行 賠償義務(wù)。六、索賠期限 本保險(xiǎn)索賠時(shí)效,從保險(xiǎn)事故發(fā)生之日起起算,最多不超過(guò)二年。PICC PROPERTY AND CASUALTY COMPANY LIMITED OCEAN MARINE CARGO CLAUSES(2009)I. Scope of CoverT
9、his insurance is classified into the following three Conditions-Free from Particular Average (F.P.A.), With Average (W.A.) and All Risks. Where the goods insured hereunder sustain loss or damage, the Insurer shall undertake to indemnify therefore according to the Insured Condition specified in the P
10、olicy and the Provisions of these Clauses:1. Free From Particular Average (F.P.A.)This insurance covers:(1) Total or Constructive Total Loss of the whole consignment hereby insured caused in the course of transit by natural calamities heavy weather, lightning, tsunami, earthquake and flood. In case
11、a constructive total loss is claimed for, the Insured shall abandon to the Company the damaged goods and all his rights and title pertaining thereto. The goods on each lighter to or from the seagoing vessel shall be deemed a separate risk.“Constructive Total Loss ” refers to the loss where an actual
12、 total loss appears to be unavoidable or the cost to be incurred in recovering or reconditioning the goods together with the forwarding cost to the destination named in the Policy would exceed their value on arrival.(2) Total or Partial Loss caused by accidents the carrying conveyance being grounded
13、, stranded, sunk or in collision with floating ice or other objects as fire or explosion.(3) Partial loss of theinsured goods attributable to heavy weather, lightning and/ortsunami, where the conveyance has been grounded, stranded, sunk or burnt, irrespective of whether the event or events took plac
14、e before or after such accidents.(4) Partial or total loss consequent on falling of entire package or packages into sea during loading, transhipment or discharge.(5) Reasonable cost incurred by the Insured in salvaging the goods or averting or minimizing a loss recoverable under the Policy, provided
15、 that such cost shall not exceed the sum insured of the consignment so saved(6) Losses attributable to discharge of the insured goods at a port of distress following a sea peril as well as special charges arising from loading, warehousing and forwarding of the goods at an intermediate port of call o
16、r refuge.(7) Sacrifice in and Contribution to General Average and Salvage Charges.(8) Such proportion of losses sustained by the ship-owners as is to be reimbursed by the Cargo Owner under the Contract of Affreightment“Both to Blame Collision ” Clause.2. With Average (W.A.)Aside from the risks cover
17、ed under F.P.A. condition as above, this insurance also covers partial losses of the insured goods caused by heavy weather, lightning, tsunami, earthquake and/or flood.3. All RisksAside from the risks covered under the F.P.A.and W.A. conditions as above, this insurancealso covers all risks of loss o
18、f or damage to the insured goods whether partial or total, arising from external causes in the course of transit.II. ExclusionsThis insurance does not cover:1、 Loss or damage caused by the intentional act or fault of the Insured.2、Loss or damage falling under the liability of the consignor.3、Loss or
19、 damage arising from the inferior quality or shortage of the insured goods prior to the attachment of this insurance.4、Loss or damage arising from normal loss, inherent vice or nature of the insured goods, loss of market and/or delay in transit and any expenses arising therefrom.5、Risks and liabilit
20、ies covered and excluded by the Ocean Marine Cargo War Risks Clauses and Strike, Riot and Civil Commotion Clauses of this Company.III. Commencement and Termination of Cover1、 Warehouse to Warehouse Clause:This insurance attaches from the time the goods hereby insured leave the warehouse or place of
21、storage named in the Policy for the commencement of the transit and continues in force in the ordinary course of transit including sea, land and inland waterway transits and transit in lighter until the insured goods are delivered to the consignee' s finalwarehouse or place of storage at the des
22、tination named in the Policy orto any other placeused by the Insured for allocation or distribution of the goods or for storage other than in the ordinary course of transit. This insurance shall, however, be limited to sixty (60) days after completion of discharge of the insured goods from the seago
23、ing vessel at the final port of discharge before they reach the above mentioned warehouse or place of storage. If prior to the expiry of the above mentioned sixty (60) days, the insured goods are to be forwarded to a destination other than that named in the Policy, this insurance shall terminate at
24、the commencement of such transit.2、 If owing to delay, deviation, forced discharge, reshipment or transhipment beyond the control of the Insured or any change or termination of the voyage arising from the exercise of a liberty granted to the ship-owners under the contract of affreightment, the insur
25、ed goods arrive at a port or place other than that named in the Policy, subject to immediate notice being given to the Companyby the Insured and an additional premium being paid, if required, this insurance shall remain in force and shall terminate as hereunder:(1)If the insured goods are sold at po
26、rt or place not namedin the Policy, this insurance shall terminate on delivery of the goods sold, but in no event shall this insurance extend beyond sixty (60) days after completion of discharge of the insured goods from the carrying vessel at such port or place.(2)If the insured goods are to be for
27、warded to the final destination named in the Policy or any other destination, this insurance shall terminate in accordance with Section 1 above.IV. Duty of the InsuredIt is the duty of the Insured to attend to all matters as specified hereunder:1、 The Insured shall take delivery of the insured goods
28、 in good time upon their arrival at the port of destination named in the Policy. In the event of any damage to the goods, the Insured shall immediately apply for survey to the survey and /or settling agent stipulated in the Policy. If the insured goods are found short in entire package or packages o
29、r to show apparent traces of damage, the Insured shall obtain from the carrier, bailee or other relevant authorities (Customs and Port Authorities etc.) certificate of loss or damage and /or shortlanded memo. Should the carrier, bailee or the other relevant authorities be responsible for such shorta
30、ge or damage, the Insured shall lodge a claim with them in writing and, if necessary, obtain their confirmation of an extension of the time limit of validity of such claim. If the Insured fails to fulfill theaforesaidobligations, the Insurer shall not be liable for the indemnity to the loss or damag
31、e attributable to such failure.2、 The Insured shall, and the Insurer may also, take reasonable measures immediately in salvaging the goods or preventing or minimizing a loss or damage thereto. The measures so taken by the Insured or by the Insurer shall not be considered respectively, as a waiver of
32、 abandonment hereunder, or as an acceptance thereof.The Insurer shall not be liable for the indemnity to the increased loss or damage attributable to the Insured' s failure to fulfill the aforesaid obligations.3、In case of a change of voyage or any omission or error in the description of the int
33、erest, the name of the vessel or voyage, this insurance shall remain in force only upon prompt notice to this Company when the Insured becomes aware of the same and payment of an additional premium if required.4、The following documents should accompany any claim hereunder made against this Company:O
34、riginal Policy, Bill of Lading, Invoice, Packing List, Tally Sheet, Weight Memo, Certificate of Loss or Damage and/or Shortlanded Memo, Survey Report, Statement of Claim.If any third party is involved, documents relative to pursuing of recovery from such party should also be included.If the Insured
35、fails to provide the aforesaid claim documents, the Insurer shall not be liable for the indemnity to the parts of the loss or damage which can not be verified due to such failure.5 、 Immediate notice should be given to the Company when the Cargo Owner' s actual respons ibility under the contract of affr eightment “ Both to Blame Collision” Clausebecomes known. Otherwise, the Insurer shall not be liable for the indemnit
