1、房屋租賃 / 商品房預(yù)租 合Lease Agreement本合同雙方當(dāng)事人:Two Parties of this agreement:出租方(甲方):Lessor (party A):承租方(乙方):Lessee (party B):根據(jù)中華人民共和國合同法、上海市房屋租賃條例(以下簡稱:條例) 的規(guī)定,甲、乙雙方在平等、自愿、公平和誠實信用的基礎(chǔ)上,經(jīng)協(xié)商一致,就乙 方承租甲方可依法 出租 的 房屋 事宜,訂立本合同。Accordi ng to The Con tract Law of People Republic of Chi na, and the Regulati on of Sh

2、an ghai mun icipality on lease of Urba n House (here in after referred to as: Regulati on), Party A and Part B through n egotiati on, have executed this Con tract in the matters of leas ing the Premises legally owned by Party A to Party B. This Con tract is based upon the principles of equality will

3、ingness, equity and good faith.一、出租或預(yù)租房屋情況One、The situation of leasing or pre-leasing Premises:1- 1甲方出租給乙方的房屋座落在本市水城路 16弄8號樓 如2室。該房屋出 租(【出租】實測)建筑面積為平方米,土地用途為 居住,房屋類型為、結(jié)構(gòu)為。該房屋的平面圖見本合同附件(一)。1- 1 The Premises leased to Party B by Party A locate at Room302 , Building 8 , Lane 16 Shui Cheng Road , Shangh

4、ai .The building area of the Premises (leasing) actual measure issquare meters, the usage of the land is for residential purposes,the type of the Premises is, the con struct ion is The floor pla n of thePremises is attached have as appe ndix (on e).1- 2甲方作為該房屋的 與乙方建立租賃關(guān)系。簽定本合同前,甲方已告知乙方該房屋設(shè)定抵押。1- 2 P

5、arty A regards as builds up the relati on ship of leas ing with PartyB. Before sig ning the con tract Party A has already in formed Party B the Premises_ set collateralize.1-3該房屋的公用或合用部位的使用范圍、條件和要求;現(xiàn)有裝修、附屬設(shè)施、設(shè)備狀況和甲方同意乙方自行裝修和增設(shè)附屬設(shè)施的內(nèi)容、標(biāo)準及需約定的有關(guān)事 宜,由甲、乙雙方分別在本合同附件(二)、(三)中加以列明。甲、乙雙方同意該附件 作為甲方向乙方交付該房屋和本合

Party A and Party B both agree that this appe ndixes shall be con sidered as the in specti on record whe n Party A hands over the Premises to Party B and when Party B returns the Premises to Party A upon completi on of this leas ing term in acco

8、rda nce with this Con tract.二、租賃用途Two、Usage of The Premises2- 1乙方向甲方承諾,租賃該房屋作為居住 使用,并遵守國家和本市有關(guān)房屋使用和物業(yè)管理的規(guī)定。2- 1 Party B promises to Party A that the Premises is only for residential purposes , and shall obey the releva nt state and local regulati ons about use and the man ageme nt of the hous ing.2-

9、 2乙方保證,在租賃期內(nèi)未征得甲方書面同意以及按規(guī)定須經(jīng)有關(guān)部門審批而未核準前,不擅自改變上述約定的使用用途2- 2 Party B promises that it shall not change the usage of the Premises without getting the written consent of Party A and the approval of the related department accord ing to the terms here in duri ng the Leas ing term.三、交付日期和租賃期限Three、Delivery

10、 date and leasing term3- 1甲乙雙方約定,甲方于年月日前且合同補充條款第一條規(guī)定的首月租金和保證金到達甲方指定賬戶后向乙方交付該房屋?!境鲎狻糠课葑赓U期自年月日起至年月日止。甲方需在房屋交付日前做好各項整修及 清潔工作。3- 1 Both Parties agree that Party A shall hand over the Premises to Party B before after Party A received the first monthly rental and deposit. All maintenances and cleaning works have to befini shed before the Check- in Day.3- 2租賃期滿,甲方有權(quán)收回該房屋,乙方應(yīng)如期返還。乙方需繼續(xù)承租該房 屋的,則應(yīng)于租賃期滿前兩 個月,向甲方提出續(xù)租書面要求,經(jīng)甲方同意后簽訂租賃合同。3- 2 Party A shall have the right to take back the Premises from Party B and Party B shall return the Premises to Party A on ti

12、me upon the expiration of leasing term. Party B shall apply for exte nsion in writi ng to Party A two (2) mon ths before the expirati on if Party B intends to con ti nue the lease, the new lease con tract shall be sig ned after gett ing Party A ' s approval.四、租金、支付方式和期限Four、Rent, Payment Method

13、and term4- 1甲、乙雙方約定,該房屋每日每平方米建筑面積租金為(/幣)。【出租】月租金總計為(人民 幣)元(大寫: /_萬丄仟丄佰丄拾元角整)O4- 1 The two Parties agree that the rent of one square meter for one day is ( / )/_. Leasing the monthly rent is ( RMB ) .該房屋租金 丄年內(nèi)不變。自第2年起,雙方可協(xié)商對租金進行調(diào)整。有關(guān)調(diào) 整事宜由甲、乙雙方在補充條款中約定.The rent shall not be cha nged with in one years

14、. The rent should be in creased or decreased from the second year. The releva nt matters on adjust ing shall be specified in the suppleme ntary clause by both parties.4- 2乙方應(yīng)于每月_J5日前向甲方支付租金。逾期支付的,每逾期一日,則乙 方需按月租金的0.5%支付違約金。4- 2 Party B shall pay the rent before the 15th day of each month to Party A.

15、Party B shall pay the overdue payme nt fine equivale nt to 0.5 % of the mon thly rent, payable for each day from the date on which the amount was due until the fulfillment of the payment.4- 3乙方支付租金的方式如下:詳見補充條款。4- 3 The payment method of the rent is as follows: Refer to Appendix.五、保證金和其他費用Five、Securi

16、ty Deposit and other Fees5- 1甲乙雙方約定,甲方交付該房屋時,乙方應(yīng)向甲方支付房屋租賃保證金,保證金為貳個月的租金,即(人民幣)元5- 1Both Parties agree that Party B shall pay Party A security deposit whe n Party A handing over Premises. The security deposit is two(2) mon ths rent ( RMB ).5- 2租賃期間,使用該房屋所發(fā)生的水、電、天然氣、通訊、 / 等費用由 乙 方承擔(dān)。5- 2 During the le

17、as ing term, Party B shall be resp on sible for the full payme nt of the Premises of the costs water, electricity, n atural gas and com muni catio n.5- 3乙方 負責(zé)支付的上述費用,計算或分攤辦法,支付方式和時間:詳見補充條款。5- 3 The count, way of the share, payme nt method and date of the paid fee are: Refer to Appe ndix.六、房屋使用要求的維修責(zé)

18、任Six、The responsibilities on Repair of the Premises6- 1租賃期間,乙方發(fā)現(xiàn)該房屋及其附屬設(shè)施有損壞時,應(yīng)及時通知甲方修復(fù);甲方應(yīng)在接到乙方通知后_巻_日內(nèi)進行維修。逾期不維修的,乙方可代為維修,費 用由甲方承擔(dān)。6- 1 During the leas ing term, Party B shall inform Party A to repair in the eve nt that the damage to the Premises or facilities is occurred. Party A shall repair it

19、withinthree(3) day after receiving the notice. In Case Party A fails to repair the damage on time, Party B can repair it in stead of Party A and the Party A shall be resp on sible for the fees.6- 2租賃期間,乙方應(yīng)合理使用并愛護該房屋及其附屬設(shè)施。因乙方使用不當(dāng) 或不合理使用,致使該房屋及其附屬設(shè)施損壞或發(fā)生故障的,乙方應(yīng)負責(zé)維修。乙 方拒不維修,費用由乙方承擔(dān)。6- 2 Party B shall

20、take good care of and reas on ably use the Premises and attached facilities during the leasing team. Party B shall be responsible for the immediate repair or compensation for the damage to the Premises or facilities due to Party's improper use6- 3租賃期間,甲方督促物業(yè)管理公司保證該房屋及附屬設(shè)施處于正常的使用 和安全的狀態(tài)。甲方對該房屋進行檢

21、查、養(yǎng)護,應(yīng)提前壹日通知乙方。檢查養(yǎng)護時,乙方應(yīng)予以配合。甲方應(yīng)減少對乙方使用該房屋的影響。6- 3 Party A shall guara ntee that the Premises shall be un der the con diti on of usable and safety duri ng the leas ing term. Party A shall no tice Party B one (1) day in adva nee while repairing maintenancePremises. Party B shall assist or cooperate w

22、ith Party A . Party A shall reduce the in flue nee of Party B' s using of the Premises.6-4除本合同附件(三)外,乙方另需裝修或者增設(shè)附屬設(shè)施和設(shè)備的,應(yīng)事先 征得甲方的書面同意,按規(guī)定須向有關(guān)部門審批的,則還應(yīng)由甲方委托乙方 報請有關(guān)部門批準后,方可進行。乙方增設(shè)的附屬設(shè)施和設(shè)備歸屬及其維修責(zé)任由甲、 乙雙方另行書面約定.6-4 If Party B intends to make renovations or changes to the original facilities apart fr

23、om the appe ndix (3) of this con tract, Party B shall do so only after obta ining the writte n consent of Party A. Party B shall be able to carry out the said project only after going through the application formalities to the related department in accordance with the releva nt regulati ons. The own

24、 ership and resp on sibilities of repairi ng the accessory equipment shall be stipulated at some other time by Party A and Party B.七、房屋返還時的狀態(tài)Seven The state of the returned Premises7- 1除甲方同意乙方續(xù)租外,乙方應(yīng)在本合同的租期滿后的 當(dāng)日內(nèi)返還該房 屋,未經(jīng)甲方同意逾期返還房屋的,每逾期一日,乙方應(yīng)按丄元/平方米(/幣) 向甲方支付該房屋占用費。(詳見補充條款)7- 1 Except that Party A

25、agrees Party B exte nds this con tract, Party B shall retur n the Premises at the expiration of the leasing term. In case Party B fails to do, so Party B shall pay / per day per meter square meter for the occupation fee of the Premises.(Refer to Appe ndix.)7- 2乙方返還該房屋應(yīng)當(dāng)符合正常使用后的狀態(tài)。返還時,應(yīng)經(jīng)甲方驗收認可, 并相互結(jié)清

26、各自應(yīng)當(dāng)承擔(dān)的費用。7- 2 The Premises shall be in the no rmal stateme nt. While returni ng, the Premises shall be checked for accepta nce and the two parties shall pay up the charges ought to be borne by each other.八、轉(zhuǎn)租、轉(zhuǎn)讓和交換Eight、Subletting, transfer and exchange8- 1除甲方已在本合同補充條款中同意乙方轉(zhuǎn)租外,乙方在租賃期內(nèi),需事先 征得甲方的書面同意

27、,方可將該房屋部分或全部轉(zhuǎn)讓給他人。但同一間居住房屋, 乙方不得部分或同時轉(zhuǎn)租給二個或二個以上的承租人。8- 1 Party B shall be allowed to sublet the premises in part or in whole to third Party on ly after gett ing Party A's writte n consent duri ng the leas ing term uni ess Party A authorizes Party B to sublet the Premises in the Suppleme ntary Ag

28、reeme nt made by Party A and Party B. Party B shall not sublet the same Premises in part or sublet the Premises to more tha n two other Pers ons.8- 2乙方轉(zhuǎn)租該房屋,應(yīng)按規(guī)定與受租方訂立書面合同的轉(zhuǎn)租合同并按規(guī)定向 該房屋所在區(qū)、縣房地產(chǎn)交易中心或農(nóng)場系統(tǒng)受理處辦理,登記備案。8- 2 When Party B sublets the Premises, Party B shall con clude writte n subleas ing Co

29、n tract with the sub lessee and register in the premises tran sacti on cen ter of district/country or acceptanee bureau of farm system where the premises locate in accorda nee with regulati ons.8-3在租賃期內(nèi),乙方將該房屋轉(zhuǎn)讓給他人承租或與他人承擔(dān)的房屋進行交換, 必須事先征得甲方書面同意。轉(zhuǎn)讓或交換后,該房屋承租權(quán)的受讓人或交換人應(yīng)與 甲方簽定租賃主體變更合同并繼續(xù)履行本合同。8-3 During

30、leas ing term, Party B shall not sublease the premises to third Party or excha nge it with third Party uni ess a writte n consent from Party A has be gran ted. After subletti ng, the successor of the lease right of the Premises shall execute a prin cipal part alterati on con tract with Party A and c

31、on ti nue to fulfill this con tract.8-4在租賃期內(nèi),甲方如需出售該房屋,應(yīng)提前三個月通知乙方。乙方放棄優(yōu) 先購買權(quán)。轉(zhuǎn)讓后,甲方應(yīng)保證受讓人與乙方簽定租賃主體變更合同并繼續(xù)履行本 合同。8- 4 During leas ing term, Party A shall inform Party B three(3) mon ths in adva nee , Party B gives up the right of preemption. After property transaction, Party A shall guara ntee the su

32、ccessor of the property shall execute a prin cipal part alter nati on con tract with Party B and continue to fulfill this con tract九、解除本合同的條件Nine、 conditions to terminate the Contract9- 1甲、乙雙方同意在租賃期內(nèi),有下列之一的,本合同終止,雙方互不承擔(dān)9- 1 During the leas ing term, the con tract shall be termi nated whe n any of th

33、e following condition occurs and two parties shall not be responsible for each other.(一)該房屋占用范圍內(nèi)的土地使用權(quán)依法提前收回的;(a) The right to the use of land on which the Premises locate be legally takenback in adva nee;(二)該房屋因社會公共利益或城市建設(shè)需要被依法征用的;(b) The Premises be taken back for the need of public interest or th

34、e city' scon structio n;(二)該房屋毀損、火失或者被鑒定為危險房屋的;(c) The Premises be damaged, missing or be authenticated as dangerousPremises;9- 2甲、乙雙方同意,有下列情形之一的,一方可書面通知另一方解除本合 同。違反本合同的一方,應(yīng)向另一方按月租金的兩 倍支付違約金;給對方造成損失的,支付的違約金不足抵付一方損失的,還應(yīng)賠償造成的損失與違約金的差額部 分:9- 2 The both sides agree that One Party shall inform the ot

35、her Party in written to termin ate the Con tract un der the follow ing con diti ons. The default ing Party shall pay to the other Party the liquidated damages equivale nt to two(2) times of the mon thly ren t. If the financial losses incurred to the other Party exceed the amount of the liquidated da

36、mages, the default ing Party shall compe nsate the deficie ncy.(一) 甲方未按時交付該房屋,經(jīng)乙方催告后 拾伍 日內(nèi)仍未交付的;(a) Party A fails to deliver the Premises on schedule and fails to do so within fifteen(15) days after receptio n of Party B' s sum mon exhortatio n(二) 甲方交付的該房屋不符合本合同的約定,致使不能實現(xiàn)租賃目的的; 或 甲方交付的房屋存在缺陷,危及乙

37、方安全的。(b) The Premises Party A delivered be not in accorda nee with the agreeme nt ofCon tract which leads to fail to fulfill the aim of the rent. Or the Premises be defective to endan ger the safety of Party B.(三) 乙方未征得甲方書面同意改變房屋用途,致使房屋損壞的;(c) Party B tran sforms the usage of the Premises without th

38、e writte n agreeme nt of Party A which damaged the Premises;(四) 因乙方原因造成房屋主體結(jié)構(gòu)損壞的;(d) The damage of main structure of the Property caused by Party B;(五) 乙方擅自轉(zhuǎn)租該房屋、轉(zhuǎn)讓該房屋承租權(quán)或與他人交換各自承租的房屋的;(e) Party B sublets the Premises or the right of the tenancy or exchange the Premises with others without Party A s

39、 consent;(六) 乙方逾期不支付租金累計超過壹 個月的;(f) Party B fails to pay the rent on schedule for Ion ger than one(1) mon th;十、違約責(zé)任Ten、Liabilities for Breach of contract10- 1該房屋交付時存在缺陷的,甲方應(yīng)自交付之日起的 拾日內(nèi)進行修復(fù),逾 期不修復(fù)的,甲方同意減少租金并變更有關(guān)租金條款。10- 1 if the Premises has defect when delivering, Party A shall repair the Premises w

40、ithin ten(10) days. If Party A fails to repair it, Party A agree to reduce the rent and change the related items of the rent clause.10- 2因甲方未在本合同中告知乙方,該房屋出租前已抵押或產(chǎn)權(quán)轉(zhuǎn)移已受到限 制,造成乙方損失的,甲方應(yīng)負責(zé)賠償。10- 2 Party A shall be fully resp on sible for any damages or losses to Party B if Party A has not in formed Par

41、ty B the Premises had bee n pledged or the tran sfer of the property right had bee n limited in the con tract.10-3租賃期間,甲方不及時履行本合同約定的維修、養(yǎng)護責(zé)任,致使房屋損壞, 造成乙方財產(chǎn)損失或人身傷害的,甲方應(yīng)承擔(dān)賠償責(zé)任。10-3 during leasing term, Part A shall pay for the loss or any bodily harm to party B caused by the damage of the Premises resu

42、lting from Party A failing to perform the resp on sibilities for repair and maintenance stipulated in the con tract.10-4租賃期間,非合同的情況甲方擅自解除本合同,提前收回該房屋的,甲方應(yīng)按提前收回天數(shù)租金的恵倍向乙方支付違約金。若支付的違約金不足抵付乙方 損失的,甲方還應(yīng)負責(zé)賠償。10-4 If Party A term in ates the con tract and takes back the Premises in adva nce for causes other

43、 tha n con tract duri ng leas ing term, party A shall pay the liquidated damages equivale nt to two(2) times of the daily ren tal left of the Premises to Party B. should the liquidated damages not to be eno ugh to pay for Party B's loss, Party A shall be resp on sible for the deficie ncy.10-5乙方未

44、征得甲方書面同意或者超出甲方書面同意的范圍和要求裝修房屋 增設(shè)附屬設(shè)施的,甲方可以要求乙方恢復(fù)房屋原狀。10-5 If Party B reno vates and in stalls additi onal facilities in the leased Premises without the approval of Party A, Party A has the right to request Party B to restore the Premises to its orig inal state.10-6租賃期間,非本合同規(guī)定的情況,乙方中途擅自退租的,甲方可沒收乙方的保證金

45、,不足抵付甲方損失的,乙方還負責(zé)賠償。10- 6 If Party B term in ates the con tract and gives back the Premises in adva nce for causes other tha n Con tract duri ng leas ing term, Party A shall seizure the security deposit and if the security deposit not to be eno ugh to pay for Party A's loss, Party B shall be resp

46、 on sible for the deficie ncy.十一、其他條款Eleven、Others terms11- 1租賃期間,甲方需抵押該房屋,應(yīng)當(dāng)書面告知乙方。11- 1 During leasing term, if Party A needs to mortgage the Premises, Part A shall inform Party B with written notice.11- 2本合同未盡事宜,經(jīng)甲、乙雙方協(xié)商一致,可訂立補充條款。本合同補充 條款及附件均為本合同不可分割的一部分,本合同及其補充條款和附件內(nèi)空格部分 填寫的文字與鉛印文字具有同等效力。11- 2

47、Party A and B shall make the suppleme ntary agreeme nts for the un acco un ted term of this agreeme nt through n egotiati on betwee n Party A and B. all suppleme ntary terms in the agreeme nt and attachme nt shall be in tegral parts of the con tract the writte n words filled in the bla nk of supplem

48、e ntary terms and attachme nts in the con tract shall be of equally authe ntic with the prin ted words of the origi nal lease con tract.11-3甲、乙雙方在簽署本合同時,對各自的權(quán)利、義務(wù)、責(zé)任清楚明白,并愿 按本合同規(guī)定索賠。如一方違反本合同,另一方有權(quán)按本合同規(guī)定索賠。11-3 Party A and B shall be totally aware of his rights, duties, and responsibilities whe n sig

49、 ning the con tract. If any party breaches the con tract, the other party shall have the right to claim for damages in accorda nce with the terms of this con tract.11-4甲、乙雙方就履行本合同發(fā)生糾紛,應(yīng)通過協(xié)商解決;協(xié)商解決不成的, 雙方同意選擇下列第(二)種方式解決:11-4 Any dispute aris ing out duri ng the performa nce of the con tract shall be

50、resolved by friendly consultations, if an amicable agreement cannot be reached, Party A and Party B agree to solve the dispute by the way (b).(一)、提交/仲裁委員會仲裁;(a). Submit the dispute to/Arbitrati on Commissio n(二)、依法向人民法院起訴。(b)Submit the dispute to People' s Court.11-6本合同連同附件一式二份。其中:甲方執(zhí)一份、乙方執(zhí)一份,一份

51、,均具有同等效力。11-6 this Con tract together with the attachme nt has three (3) origi nals among which each party keeps one or two,shall keep one. All the originals have the sameeffect.本合同自簽字生效。The con tract shall come into effect subject to sig ningAppendix1. 在本合同簽訂后的 £天內(nèi),乙方應(yīng)向甲方支付首月租金及相當(dāng)于貳 個月租金的保證金,合

52、計為 RMB (大寫:人民幣 )。其中保證金為 RMB (大寫:人民幣 元整);首月房屋租金RMB(大寫:人民幣_元整),包括雙人俱樂部卡,物業(yè)管理費,寬帶安裝費。在乙 方支付上述首月租金及保證金后,甲方向乙方交付該房屋。若上述首月租金及保 證金到達甲方指定賬戶時間遲于合同第3-1條規(guī)定的房屋交付時間的,甲方實際交付房屋時間為上述首月租金及保證金到達甲方指定賬戶后第二日。1. Within ten (10) days of the signing of this Formal Tenancy Agreement. Party B shallpay to Party A a security d

53、eposit equivale nt to an amount of two (2) mon ths ren tal and the first Rental, the total is RMB . The Security Deposit is RMB Only and the first Monthly Rental is RMB ; including Mgt. Fee, ADSL installation fee, couple club membership card. And Party A shall hand over the Premises to Party B after

54、 Party A received the first monthly rental and deposit. In case of delaying of above payments later than the date stated in Clause3-1, the actual date when the premises being handed over from Party A to Party B should be the second day after the payments being transferred to Party A' s designed

55、bank account.上述款項中保證金、首期租金,合計為 RMB (大寫:人民幣 整)支付到甲方指定的空房租金帳號。租金包含會所使用費,垃圾清運費,蟲害管理及其他相 關(guān)管理費用。Party B shall pay the security deposit,the first Monthly Rental in total of RMB120000 to House Rental Account. The rental should include club facility, trash management, pest con trol, and other man ageme nt f

56、ees.2. 乙方以人民幣方式支付該房屋租金。人民幣租金帳號收款人:人民幣帳號:開戶銀行:2. Party B shall pay the Rental to Party A in Ren Min Bi:In Favor of:RMB Account Number:Bank Name:乙方應(yīng)支付給甲方的上述保證金及租金,系為實際到達甲方帳戶的金額。甲方在收到乙方支付的上述保證金及房屋租金后應(yīng)于10日內(nèi)向乙方開具房屋保證金收據(jù)、空房租金、家具租賃費正式發(fā)票及甲方指定的物業(yè)管理公司開具的物 業(yè)管理費正式發(fā)票。The real sum paid by Party B's acco unt s

57、hould be same with the ren tal regulated in con tract.After Party A received the security deposit and the Ren tal from Party B, with in 10 daysParty A shall issue the security deposit receipt, House Rental invoice, the FurnitureRental invoice and the property management company designated by Party A

58、 shall issue the official Management Fee invoice and to Party B.3. 乙方在租賃期限內(nèi),房屋內(nèi)使用的水、電、天然氣及通訊等費用每月按實際使用帳單支付,按帳單規(guī)定的時間和地點支付給相對應(yīng)的部門或公司,或委托物業(yè)管 理公司代辦。Party B shall pay the Water, Electricity, Gas and Communication fee to related departme nt accordi ng to the bill.
