1、勞動(dòng)安全衛(wèi)生專項(xiàng)集體合同范本所謂專項(xiàng)集體合同, 是指用人單位與勞動(dòng)者根據(jù)法律、法規(guī)、規(guī)章的規(guī)定,就集體協(xié)商的某項(xiàng)內(nèi)容簽訂的專項(xiàng)書面協(xié)議。整理了“勞動(dòng)安全衛(wèi)生專項(xiàng)集體合同范本”僅供參考, 希望能幫助到大家!勞動(dòng)安全衛(wèi)生專項(xiàng)集體合同范本(勞動(dòng)安全衛(wèi)生專項(xiàng)集體合同一般應(yīng)在建筑、化工、交通、冶金、礦山等危險(xiǎn)程度較高、職業(yè)危害嚴(yán)重、事故多發(fā)行 業(yè)的企業(yè)簽訂)(Collective Contract on Labor Safety and Hygiene commonly appliesto the enterprises with high criticality,severe occupational
2、 hazard andfrequentaccident,such asconstruction,chemical,transportation,metallurgy,mine field,and so on.第一條 本合同由_(單位) 與_工會(huì)根據(jù)勞動(dòng)法、安全生產(chǎn)法、職業(yè)病防治法等法律法規(guī)以及省、市有關(guān)條例規(guī)定, 結(jié)合本企業(yè)實(shí)際情況, 經(jīng)企業(yè)代表和職工代表協(xié)商致簽訂。Article 1 The contract is established between and theTrade Union of _ in accordancewith“Labor Law”, “Safe Productio
3、n Law”, “OccupationalDisease Prevention and Cure Law”and related provincial andmunicipal regulations,based onthe actualsituation and subject to the equalconsultationbetween Companys representative andemployeesrepresentative.1.企業(yè)依照國(guó)家有關(guān)法律法規(guī), 加強(qiáng)安全生產(chǎn)管理。建立健全安全生產(chǎn)責(zé)任制, 勞動(dòng)安全衛(wèi)生制度;組織編制安全生 產(chǎn)規(guī)章制度、安全操作規(guī)程及崗位操作規(guī)程,
4、組織制定實(shí)施安全 生產(chǎn)事故應(yīng)急救援預(yù)案。Company must strengthen the production safetymanagement according to relevant laws and regulations. Companyshould set up the system of job responsibility and the system of safeproduction and hygiene,organizeto work out internal rules and regulation,operational instructions,post o
5、peration rules as well as the emergency solution for productionaccident.2.企業(yè)應(yīng)不斷改善勞動(dòng)條件。 有計(jì)劃地進(jìn)行安全設(shè)施 的更新改造,提供資金保證,確保??顚S谩ompany should gradually improve the workingenvironment. It should designedly modify the facilities for safeproduction and hygiene,afford fund and insureits special use.3.企業(yè)應(yīng)對(duì)職工進(jìn)行勞動(dòng)安
6、全衛(wèi)生教育和培訓(xùn), 未經(jīng) 培訓(xùn)合格不得上崗作業(yè)。 特殊工種作業(yè)人員必須經(jīng)過國(guó)家有關(guān)部 門培訓(xùn),取得相應(yīng)資格操作證后,方可安排其從事作業(yè)。Company should organize education and training on safeproduction and hygiene while people who fail or have not attended thesafety training are not allowed for operation. Operators designed tospecial positions can start work only aft
7、er obtaining the relatedqualification.4.企業(yè)根據(jù)各工種的崗位需要,為職工提供符合國(guó)家標(biāo)準(zhǔn)及行業(yè)標(biāo)準(zhǔn)的勞動(dòng)保護(hù)用品。 對(duì)不按規(guī)定穿戴和不正確使用勞動(dòng)保護(hù)用品和違反操作規(guī)程的職工,有權(quán)查處。Company should provide personal protective equipment ofnational and industry standards,accordingto different position requirements. Company is entitled to give opinionsand investigate the
8、 liabilities of the employees who dont dress or usethe protective equipment according to the requirements.5.企業(yè)對(duì)直接從事有毒有害崗位的職工, 進(jìn)行上崗前、離崗時(shí)的健康檢查, 每年定期進(jìn)行健康檢查, 并建立職業(yè)衛(wèi)生健康檔案。 對(duì)其他崗位的職工, 也應(yīng)定期進(jìn)行體檢。 并及時(shí)向工會(huì) 通報(bào)職業(yè)病檢查情況。Company should organize the employees directly engagedin toxic and hazardous operations to take
9、the health checkup beforeand after the related work,andindividual health files are archived for operators of this nature.Scheduled health checkup should also be carried out for the employeesof other positions. The result of occupational disease checkup shouldbe announced to trade union.6.企業(yè)依法按國(guó)家、 省、
10、市規(guī)定要求和時(shí)限為職工辦 理工傷保險(xiǎn),并按時(shí)足額繳納工傷保險(xiǎn)費(fèi)用。職工因患職業(yè)病或 因工受傷的工資和醫(yī)療費(fèi),按國(guó)家和省、市有關(guān)規(guī)定執(zhí)行。Company should cover the employees with industrialinjury insurance in accordance with the law by national,provincial andmunicipal requirements and time limits,as well in full and on time paythe cost of industrial injury insurance. M
11、edical expenses and wages forworkers suffering from occupational diseases or work-related injuriesshould be paid according to the national,provincial and municipalimplementation of the relevant provisions.7.在生產(chǎn)過程中發(fā)生工傷事故和嚴(yán)重職業(yè)危害時(shí), 企 業(yè)應(yīng)及時(shí)報(bào)告工會(huì),工會(huì)有權(quán)依法參加事故調(diào)查,提出處理意見 并要求追究有關(guān)人員的責(zé)任。The occurrence of industria
12、l injury and serious occupationalhazard during production process should bereported timely to Trade Union to inquire into the case and giveopinions,and furthermore investigate the liabilities of people incharge.8.企業(yè)在研究制定和修改勞動(dòng)安全衛(wèi)生規(guī)章制度、 安 全技術(shù)措施時(shí),工會(huì)應(yīng)參加,涉及職工勞動(dòng)安全衛(wèi)生健康的重大 問題,須經(jīng)職工代表大會(huì)(職工大會(huì))討論審議通過。The Trade
13、Union should take pert in the studying andamending rules and regulations on labor health and safe production,as well as safety techniques;any major issues concerning employeessafety and health should be consulted and approved by theEmployees Representative Convention.9.工會(huì)支持企業(yè)加強(qiáng)安全生產(chǎn)管理, 積極協(xié)助行政落 實(shí)企業(yè)安全衛(wèi)
14、生規(guī)章制度,監(jiān)督國(guó)家勞動(dòng)安全衛(wèi)生法規(guī)的執(zhí)行。 工會(huì)有責(zé)任教育職工嚴(yán)格遵守企業(yè)的各項(xiàng)安全生產(chǎn)規(guī)章制度和 操作規(guī)程,教育和組織職工接受安全技術(shù)培訓(xùn)和管理。Trade Union should support the Company to;Trade Union is entitledstrengthen production safety managemen,t actively assist theCompany in the implementation of health and safe production rules andregulation. Trade union has the
15、 responsibility of educating workers tostrictly abide by the rules and regulations related to industrial safety,the responsibility of educating and organizing employees to receivesafety techniques training and management.10.工會(huì)有權(quán)糾正違章指揮, 對(duì)強(qiáng)令工人冒險(xiǎn)作業(yè)行為或當(dāng)發(fā)現(xiàn)明顯事故隱患和職業(yè)危害時(shí), 有權(quán)停止作業(yè)并提出解決的建議, 行政應(yīng)當(dāng)及時(shí)研究答復(fù); 當(dāng)發(fā)現(xiàn)危及職工
16、生命安全的情況時(shí),有權(quán)組織職工撤離危險(xiǎn)場(chǎng)所。Trade Union is entitled to correct improper instruction andstop the operation and proposes the solutions when workers take therisk or apparent danger or occupational hazards are observed;theCompanyshould make the decision and action thereafter. Trade Unionis authorized to evacu
17、ate employees out of the dangerous places whentheir lives are expected to the hazard.11.其他由企業(yè)、職工提出要求協(xié)商的與勞動(dòng)安全衛(wèi)生有關(guān)的問題。Other issues regard to health and labor safety put forwardby Company and employees for further consulting.第二條 本合同由集體合同監(jiān)督檢查小組負(fù)責(zé)監(jiān)督, 企業(yè)應(yīng)每年不少于一次向職工代表大會(huì) (職工大會(huì)) 報(bào)告勞動(dòng)安全衛(wèi)生協(xié)議履行情況。Article 2 The
18、supervision group of the collective contract isresponsible for superintending the execution of the present contract.Company should report the implementation of the contract to theEmployees Representative Convention at least once every year.第 三 條 本合同 有效 期 為 年 ,自 年 月 日 起 至年 月 日止,并于期滿前三個(gè)月內(nèi)進(jìn)行下一輪勞動(dòng)安全衛(wèi)生 集體協(xié)商。Artic
