2、中華人民共和國(guó)勞動(dòng)法以下簡(jiǎn)稱勞動(dòng)法、中華人民共和國(guó)勞動(dòng)合同法以下簡(jiǎn)稱勞動(dòng)合同法、深圳市員工工資支付條例以下簡(jiǎn)稱工資支付條例等有關(guān)法律法規(guī)的規(guī)定,甲乙雙方遵循合法、公平、平等自愿、協(xié)商一致、老實(shí)信譽(yù)的原那么,簽訂本勞動(dòng)合同,共同遵守本勞動(dòng)合同所列條款。The contract is hereby concluded by both parties in accordance with Labor Law of the People"s Republic of China, Labor Contract Law of the People s Republic of China ,and

3、Regulations of the Shenzhen Municipality on the Wage PaymenttoEmployees, in the principlesoffairness, legitimacy,equality,voluntariness,consensusthrough negotiation and good faith.一、勞動(dòng)合同期限Article1、Term of the Employment Contract一甲乙雙方同意按以下第種方式確定本勞動(dòng)合同期限。The type and term of the Employment Contract sha

5、 崗位或工種 )。Party B shall engage in the job (post or Type of work)of乙方的工作地點(diǎn)。The workplace is 三、工作時(shí)間和休息休假Article3 、Working Hours, Rest and Leave Entitlements一甲乙雙方同意按以下第種方式確定乙方的工作時(shí)間。The working hours shall be determined as set forth in Itembelow. 1、標(biāo)準(zhǔn)工時(shí)制, 即每日工作小時(shí)不超過 8 小時(shí),每周工作小時(shí)不超過 40 小時(shí),每周至少休息一日。The norm

6、al working hour system shall be implemented.Party B shall work no more thanhours a day (no morethan 8), andhours a week (no more than 40), and shall have at least one day s rest each week. 二不定時(shí)工作制,即經(jīng)人力資保障勞動(dòng)部門批準(zhǔn),乙方所在崗位實(shí)行不定時(shí)工作制。Anon-fi_edworkinghoursystemshallbeimplementedwiththenecessaryapprovalfromt

7、herelevantlaboradministration authorities. 三綜合計(jì)算工時(shí)工作制,即經(jīng)人力資保障勞動(dòng)部門批準(zhǔn),乙方所在崗位實(shí)行綜合計(jì)算工時(shí)工作制。Cumulative working hour s systemapproved by the labor and social security department and theCalculation periodis. 二甲方由于消費(fèi)經(jīng)營(yíng)需要延長(zhǎng)工作時(shí)間的,按勞動(dòng)法 第四十一條執(zhí)行。Due to its operational needs, Party may e_tend Party B s work overti

8、me on weekendssedfortyba-first Labor Lawof the People"s Republic of China.三乙方依法享有法定節(jié)假日、年休假、婚假、產(chǎn)假、喪假等假期。Party B shall have public holiday, Annual leave, Marriage leave, Maternity leave and passionate leave accordingto the National Law. 四乙方的其他休息休假安排。Other holidays B arrangement四、勞動(dòng)報(bào)酬Article4Worki

9、ng Remuneration一甲方依法制定工資分配制度,并告知乙方。甲方支付給乙方的工資不得低于市政府公布的當(dāng)年度最低工資。Party A is entitle to adjust salary of Party B.But will not below the municipal government minimum wage standards. 二甲方經(jīng)與乙方協(xié)商,同意按以下第種方式支付乙方的工資。The working pay shall be determined as set forth in Itembelow.1、乙方每月正常工作時(shí)間工資元;試用期內(nèi)每月正常工作時(shí)間工資元。P

10、arty B will receive a monthly remuneration of RMBgross during the probation period and RMBgross afterthe probation period month. 2、雙方約定以確定乙方工資。The monthly remuneration for Party B shall be RMB三甲方每月日發(fā)放工資。甲方至少每月以貨幣形式向乙方支付一次工資。Party A shall pay preta_ salary of last month to Party B in currency on the_

11、ofmonth. 四乙方加班工資、假期工資及特殊情況下的工資支付按有關(guān)法律、法規(guī)的規(guī)定執(zhí)行。The Employee shall be entitled to legal holidays, annual leave, and other paid leaves of absence in accordance withapplicable law and the pany s work rules, which are in force from time to time. 五、社會(huì)保險(xiǎn)和福利待遇Article 5Social Insurance and Welfare一甲乙雙方按照國(guó)家和省

12、、市有關(guān)規(guī)定, 參加社會(huì)保險(xiǎn), 繳納社會(huì)保險(xiǎn)費(fèi)。Party a andParty B mustparticipatein socialinsuranceandpay social insurancepremiumsona monthlybasis inaccordance with the national and provincial law. 二乙方患病或非因工負(fù)傷,甲方應(yīng)按國(guó)家和省、市的有關(guān)規(guī)定給予乙方享受醫(yī)療期和醫(yī)療期待遇。Where Party B has contracted an illness or sustained a non-work-related injury, Pa

13、rty A should give Party B medicaltreatment and medical leave accordance with National or provincial regulation.三乙方患職業(yè)病、因工負(fù)傷的, 甲方按中華人民共和國(guó)職業(yè)病防治法、 工傷保險(xiǎn)條例等有關(guān)法律法規(guī)的 規(guī)定執(zhí)行。Where Party B has contracted an occupational diseases or industrial injury, party A have to implement related provisions according to th

14、e “occupation disease prevention law”, industrial injury insurance regulations& and other relevant laws and regulations.四甲方為乙方提供以下福利待遇party A provides the followingbenefits for party B。四、勞動(dòng)保護(hù)、勞動(dòng)條件和職業(yè)危害防護(hù)Article 6Labor Protection, Working Conditions and Protections against Occupational Hazards一甲方

15、按照國(guó)家和省、市有關(guān)勞動(dòng)保護(hù)規(guī)定, 提供符合國(guó)家平安衛(wèi)生標(biāo)準(zhǔn)的勞動(dòng)作業(yè)場(chǎng)所和必要的勞動(dòng)防護(hù)用品,實(shí)在保護(hù)乙方在消費(fèi)工作中的平安和安康。Party A shall give Party B education and training programs relating to labor safety, professional skills and labordisciplines etc.Accordingto the requirements ofstatelaborprotection andsafe-production,PartyA shallprovide necessary wo

16、rking condition to ensure Party B s safety and health.二甲方按照國(guó)家和省、市有關(guān)規(guī)定, 做好女員工和未成年工的特殊勞動(dòng)保護(hù)工作。Party A must conscientiously carry out relevant provisions formulated by the state for the protection of female and under-aged employees.三乙方從事作業(yè),可能產(chǎn)生職業(yè)危害,甲方應(yīng)采取防護(hù)措施,且按照國(guó)務(wù)院衛(wèi)生行政部門的規(guī)定組織上崗前、在崗期間和離崗時(shí)的職業(yè)安康檢查,并將檢查結(jié)果如實(shí)

17、告知乙方。職業(yè)安康檢查費(fèi)用由用人單位承當(dāng)。The Employee is engaged in the, possible occupation hazard, Employer should takeprotective measures, andin accordancewiththehealthadministrativedepartmentoftheState Councilshall organizejoboccupationhealthe_amination before,during and post time, and the inspection results shall

18、truthfully inform the Employee.Occupationhealth inspection fees shall be borne by the employer.四乙方有權(quán)回絕甲方的違章指揮和強(qiáng)令冒險(xiǎn)作業(yè);對(duì)甲方危害生命平安和身體安康的行為,乙方有權(quán)要求改正或向有關(guān)部門舉報(bào)。The Employee must strictly abide by rules of safe operations during working process, and has the right to refusepeccant mand and the right to demand

19、 correction or report to the relevant departments. 七、規(guī)章制度Article 7Regulation and Rules一甲方依法制定的規(guī)章制度,應(yīng)當(dāng)告知乙方。Party A draw the regulation and rules up accordance to law and shall inform Party B. 二乙方應(yīng)遵守國(guó)家和省、市有關(guān)法律法規(guī)和甲方依法制定的規(guī)章制度,按時(shí)完成工作任務(wù),進(jìn)步職業(yè)技能,遵守平安操作規(guī)程和職業(yè)道德。Party B shall obey the related Law and the Regul

20、ation which is draw up by Party A; to plete task on time, ply with thesafety rules and occupation moral.三乙方自覺遵守國(guó)家和省、市方案生育的有關(guān)規(guī)定。Party B shall ply with the Family Planning regulation accordance to the Law. 八、勞動(dòng)合同變更Article 8Alternation of Contract甲乙雙方經(jīng)協(xié)商一致,可以變更勞動(dòng)合同。變更勞動(dòng)合同應(yīng)采用書面形式。變更后的勞動(dòng)合同文本雙方各執(zhí)一份。Both o

21、f Party A and Party B reach a consensus on alteration of contract, which shall be in written form.Both partiesshall keep a copy of revised contract.九、勞動(dòng)合同解除和終止Article 9Dissolution and Termination of Contract 一甲乙雙方協(xié)商一致,可以解除勞動(dòng)合同。Where Party A and Party B reach a consensus, the contract can be terminat

22、ed. 二乙方提早三十日以書面形式通知甲方,可以解除勞動(dòng)合同;乙方試用期內(nèi)提早三日通知甲方,可以解除勞動(dòng)合同。To terminate the contract, Party B shall inform Party A in written notice in a thirty days advance.Party B in threedays advance notice to Party A in probation period. 三甲方有以下情形之一的,乙方可以通知甲方解除勞動(dòng)同:In any of the following circumstances, Party B may n

23、otifyParty A to terminate this contract4、 未按照勞動(dòng)合同約定提供勞動(dòng)保護(hù)或者勞動(dòng)條件的; Failure on the part of Party Ato provide working conditions as agreed upon this contract. 5、未及時(shí)足額支付勞動(dòng)報(bào)酬的;Failure on the part of Party A to pay labour remuneration. 6、未依法為乙方繳納社會(huì)保險(xiǎn)費(fèi),經(jīng)乙方要求甲方繳納,超過一個(gè)月仍未繳納的;Party B shall pay social insuranc

24、e premiums fall short of legal provisions, Party B request Party A to pay, not pay morethan a month;7、規(guī)章制度違背法律、法規(guī)的規(guī)定,損害乙方權(quán)益的;Bylaw violates the legal provisions & regulations, damage to Party B"s rights and interests;8、以欺詐、脅迫的手段或者乘人之危,使乙方在違犯真實(shí)意思的情況下訂立或者變更本勞動(dòng)合同,致使勞動(dòng)合同無效的;By means of fraud an

25、d intimidation or position of vulnerability, so that Party B concludeor change the labor contractin violation of the true meaning of the case, the labor contract is invalid;6、免除自己的法定責(zé)任、排除乙方權(quán)利,致使勞動(dòng)合同無效的;Escaping their own legal responsibilities and eliminating Party B s rights lead to the labor contr

26、act invalid; 7、違背法律、行政法規(guī)強(qiáng)迫性規(guī)定,致使勞動(dòng)合同無效的;In violation of laws, administrative regulations of the mandatory provisions,the labor contract is invalid;8、法律、行政法規(guī)規(guī)定乙方可以解除勞動(dòng)合同的其他情形。Legal and administrative regulations, Party B may terminate the labor contract situation. 四甲方以暴力、威脅或者非法限制人身自由的手段強(qiáng)迫乙方勞動(dòng)的,或者甲方違章

27、指揮、強(qiáng)令冒險(xiǎn)作業(yè)危及乙方人身平安的,乙方可以立即解除勞動(dòng)合同,不需事先告知甲方。Party A forces Party B to work by violence, threat or illegal limitations of Party Bto work by means of force, threat or illegal restriction of personal freedom.the contract at any time.sfreedom or Party A forces Party BParty B may notify Party A of terminati

28、ng五乙方有以下情形之一的,甲方可以解除勞動(dòng)合同:The pany may dismiss the Employee at any time without further notice if the Employee:1、在試用期間被證明不符合錄用條件的;Is proven to be inpetent for the employing requirement during his/her period of probation;2、嚴(yán)重違背甲方的規(guī)章制度的;Seriously breach labor disciplines or regulations as stipulated by

29、 the pany3、嚴(yán)重瀆職,營(yíng)私舞弊,給甲方造成重大損害的;Seriously neglects his duty and engages in malpractices for selfish ends, thuscausing significant harm to the interests of the pany. 4、同時(shí)與其他用人單位建立勞動(dòng)關(guān)系,對(duì)完本錢單位的工作任務(wù)造成嚴(yán)重影響,或者經(jīng)甲方提出,拒不改正的;Party B holds another job without the permit of Party A, which seriously affects thep

30、letionofPartyAs worktask, or Party B refuses to correct the error after Party As warning;5、以欺詐、脅迫的手段或者乘人之危,使甲方在違犯真實(shí)意思的情況下訂立或者變更本勞動(dòng)合同,致使勞動(dòng)合同無效的;By means of fraud and intimidation or position of vulnerability, so that Party A concludeor change the laborcontract in violation of the true meaning of the

31、case, the labor contract is invalid; 6、被依法追究刑事責(zé)任的。Is found guilty according to the laws of P.R.C.六有以下情形之一的, 甲方提早三十日以書面形式通知乙方或者額外支付乙 方一個(gè)月工資后,可以解除勞動(dòng)合同,勞動(dòng)合同法第四十二條規(guī)定的情形除外:In any of the following circumstances, Party A may terminate this Contract upon prior written notice of thirty (30) days toParty B or

32、 one month salary in lieu of the notice,e_pect forty-secondLabor Law of the People"s Republic of China :1、乙方患病或者非因工負(fù)傷,在規(guī)定的醫(yī)療期滿后不能從事原工作,也不能從事由甲方另行安排的工作的;Party B, due to sickness or injury inflicted off the job, can not resume his or her work or do the other job reassigned byParty A after specifi

33、ed period of medical treatment;2、乙方不能勝任工作,經(jīng)過培訓(xùn)或者調(diào)整工作崗位,仍不能勝任工作的; Party B is unqualified, even after a training or job adjustment. 3、勞動(dòng)合同訂立時(shí)所根據(jù)的客觀情況發(fā)生重大變化,致使勞動(dòng)合同無法履行,經(jīng)甲乙雙方協(xié)商,未能就變更勞動(dòng)合同內(nèi)容達(dá)成協(xié)議的。The objective conditions on which the contract is based have materially changed to the e_tent that it is impos

34、sibleto perform the contract while both parties cannot reach an agreement to amend the contract to reflect the changedconditions. 七有以下情形之一,甲方需要裁減人員二十人以上或者裁減缺乏二十人但占甲方職工總數(shù)百分之十以上的,甲方應(yīng)提早三十日向工會(huì)或者全體職工說明情況,在聽取工會(huì)或者職工的意見,并將裁減人員方案向人力資保障勞動(dòng)部門報(bào)告后,可以裁減人員, 勞動(dòng)合同法第四十二條規(guī)定的情形除外:Oneofthefollowingcircumstances, PartyA w

35、ouldrequirereductionsin staffof20 peopleormorereduction of less than 20 but accounts for more than 10 per cent of the total number of Party workers, PartyA shall be thirty days in advance to the trade union or all the workers to e_plain the situation.After listeningto the opinions of the trade union

36、 or employees, and will cut staff plan to the guarantee of human resources(labour) Department report, you can reduce the number of personnel, e_pect forty-secondLabor Law ofthe People"s Republic of China: 1、按照企業(yè)破產(chǎn)法規(guī)定進(jìn)展重整的;Party A is declared bankruptcy legally;2、消費(fèi)經(jīng)營(yíng)發(fā)生嚴(yán)重困難的;In case Party A is f

37、ace bad business situation;3、企業(yè)轉(zhuǎn)產(chǎn)、重大技術(shù)革新或者經(jīng)營(yíng)方式調(diào)整,經(jīng)變更勞動(dòng)合同后,仍需裁減人員的;Enterprise transformation,Major technological innovation or Operation mode adjustment.After amendment of employment contracts , still needs to reduce its workforce;4、其他因勞動(dòng)合同訂立時(shí)所根據(jù)的客觀經(jīng)濟(jì)情況發(fā)生重大變化,致使勞動(dòng)合同無法履行的。The basis for the conclusion

38、of the contract has greatly changed so that the contract can no longer be carried out,while both parties cannot reach an agreement on modifying the contract by mutual negotiation.八有以下情形之一的,勞動(dòng)合同終止:The contract will terminate in case any of the following occurs:1 、勞動(dòng)合同期滿的;The labor contract e_pires;十、

39、乙方到達(dá)法定退休年齡的;Party B shall reach the statutory retirement age;3、乙方死亡,或者被人民法院宣告死亡或者宣告失蹤的;Party B is dead, pronounced dead or pronounced missing by the people"s court;七甲方被依法宣告破產(chǎn)的;Party A is declared bankruptcy legally;八甲方被撤消營(yíng)業(yè)執(zhí)照、責(zé)令關(guān)閉、撤銷或者甲方?jīng)Q定提早解散的;Party A sbusiness license is revoked; Party A is p

40、elled to close down or dissolve; or Party A decides to dissolve inadvance九法律、行政法規(guī)規(guī)定的其他情形。Other situations stipulated in laws and administrative provisions 九經(jīng)濟(jì)補(bǔ)償Article 10:Economic pensation 四符合以下情形之一的,甲方應(yīng)當(dāng)向乙方支付經(jīng)濟(jì)補(bǔ)償:Party A shall pay economic pensation to Party B in follow case;1、甲方根據(jù)本勞動(dòng)合同第九條第一項(xiàng)規(guī)定向乙方

41、提出解除勞動(dòng)合同并與乙方協(xié)商一致解除勞動(dòng)合同的;Party A to Party B in accordance with the labor contract in Article 9 ( a ) the provisions of proposed dissolution of the labor contract , and in consultation with the Party B agreed to terminate the labor contract;4、乙方根據(jù)本勞動(dòng)合同第九條第三項(xiàng)、第四項(xiàng)規(guī)定解除勞動(dòng)合同的;Party B in accordance with the

42、 labor contract in Article 9 (3) or paragraph (4) provides labor contract is terminated ;5、甲方根據(jù)本勞動(dòng)合同第九條第六項(xiàng)、第七項(xiàng)規(guī)定解除勞動(dòng)合同的;Party Aaccordingto thelaborcontractof article9 ( 6 ) , the provisionsofparagraph( 7) of the laborcontract isterminated ; 6、除甲方維持或者進(jìn)步勞動(dòng)合同約定條件續(xù)訂勞動(dòng)合同,乙方不同意續(xù)訂的情形外,根據(jù)本合同第九條第八項(xiàng)第1 目規(guī)定終止固定

43、期限勞動(dòng)合同的;In addition to party a to maintain or improve the condition of the labor contract renew the labor contract, Party Bdoes not agree to renew the situation,, Fi_ed term labor contract is terminated pursuant to this Agreement in Article 9( 8 ) of the first subparagraph; 5、根據(jù)本合同第九條第八項(xiàng)第4 目、第 5 目規(guī)定

44、終止勞動(dòng)合同的;on the basis of this contract Article ninth ( eight ) of fourth, fifth eyes required to terminate the labor contract;6、法律、行政法規(guī)規(guī)定的其他情形。Other situations stipulated in laws and administrative provisions. 二甲乙雙方解除或終止本勞動(dòng)合同的,經(jīng)濟(jì)補(bǔ)償?shù)陌l(fā)放標(biāo)準(zhǔn)應(yīng)按勞動(dòng)合同法以及國(guó)家和省、市有關(guān)規(guī)定執(zhí)行。甲方依法應(yīng)向乙方支付經(jīng)濟(jì)補(bǔ)償?shù)模瑧?yīng)在乙方辦結(jié)工作交接時(shí)支付。Both parties

46、le 10:The labor contract rescission and termination procedures 甲乙雙方解除或終止本勞動(dòng)合同的,乙方應(yīng)按雙方約定,辦理工作交接等手續(xù)。甲方應(yīng)當(dāng)在解除或者終止勞動(dòng)合同時(shí)出具解除或者終止勞動(dòng)合同的證明,并在十五日內(nèi)為乙方辦理檔案和社會(huì)保險(xiǎn)關(guān)系轉(zhuǎn)移手續(xù)。甲方出具的解除或者終止勞動(dòng)合同的證明,應(yīng)當(dāng)寫明勞動(dòng)合同期限、解除或者終止勞動(dòng)合同的日期、工作崗位、在本單位的工作年限。Both parties rescind or terminate the labor contract, Party B shall be agreed by both

47、parties, handle the handover procedures.Party A shall prove in dissolution or termination of labor contracts issued by the dissolution or terminationof the labor contract, and in fifteen days the transfer Party B"s archives and social insurance.Certificate issued by Party Ashall discharge or te

48、rmination of the labor contract, shall state the time limit, the lifting of the labor contract or termination of the labor contract date, job, working life in the unit. 十二、爭(zhēng)議處理Article 12: Settlement of Disputes甲乙雙方發(fā)生勞動(dòng)爭(zhēng)議的,應(yīng)先協(xié)商解決。協(xié)商不成的,可以向本單位工會(huì)尋求解決或向本單位勞動(dòng)爭(zhēng)議調(diào)解委員會(huì)申請(qǐng)調(diào)解;也可以直接向勞動(dòng)爭(zhēng)議仲裁委員會(huì)申請(qǐng)仲裁。If labor dispu

49、te occurs, both parties shall resolve it through consultation.In case of failing to reach an agreement,each party may submit the dispute to Labor Dispute Arbitration mittee having jurisdiction.If rejecting the award,each party can take a proceeding.The party applying for arbitration shall submit the

50、 arbitration application to LaborDispute Arbitration mittee . 十三、雙方認(rèn)為需要約定的其他事項(xiàng):Article 12: Other matters agreed upon by the parties consider necessary 十四、其它Article 14.Miscellaneous一本勞動(dòng)合同未盡事宜或勞動(dòng)合同條款與現(xiàn)行法律法規(guī)規(guī)定有抵觸的,按現(xiàn)行法律法規(guī)執(zhí)行。Other issues not mentioned herein shall be subject to the laws, statues and pro
