5、表國(guó)家之使館能有效執(zhí)行職務(wù)。Affirming that the rules of customary international law should continue to govern questions not expressly regulated by the provisions of the present Convention,重申凡未經(jīng)本公約明文規(guī)定之問(wèn)題應(yīng)繼續(xù)適用國(guó)際習(xí)慣法之規(guī)例,Have agreed as follows:爰議定條款如下: Article 1For the purpose of the present Convention, the following

6、 expressions shall have the meanings hereunder assigned to them:就適用本公約而言,下列名稱之意義,應(yīng)依下列規(guī)定:The head of the mission is the person charged by the sending State with the duty of acting in that capacity; 稱“使館館長(zhǎng)”者,謂派遣國(guó)責(zé)成擔(dān)任此項(xiàng)職位之人;The members of the mission are the head of the mission and the members of the s

7、taff of the mission; 稱“使館人員”者,謂使館館長(zhǎng)及使館職員;The members of the staff of the mission are the members of the diplomatic staff, of the administrative and technical staff and of the service staff of the mission;稱“使館職員”者,謂使館外交職員、行政及技術(shù)職員,及事務(wù)職員;The members of the diplomatic staff are the members of the staff

8、of the mission having diplomatic rank;稱“外交職員”者,謂具有外交官級(jí)位之使館職員;(e) A diplomatic agent is the head of the mission or a member of the diplomatic staff of the mission; 稱“外交代表”者,謂使館館長(zhǎng)或使館外交職員;(f) The members of the administrative and technical staff are the members of the staff of the mission employed in t

9、he administrative and technical service of the mission;稱“行政及技術(shù)職員”者,謂承辦使館行政及技術(shù)事務(wù)之使館職員;(h) A private servant is a person who is in the domestic service of a member of the mission and who is not an employee of the sending State; 稱“私人仆役”者,謂充使館人員傭仆而非為派遣國(guó)雇用之人;(i) The premises of the mission are the buildi

10、ngs or parts of buildings and the land ancillary thereto, irrespective of ownership, used for the purposes of the mission including the residence of the head of the mission. 稱“使館館舍”者,謂供使館使用及供使館館長(zhǎng)寓邸之用之建筑物或建筑物之各部分,以及其所附屬之土地,至所有權(quán)誰(shuí)屬,則在所不問(wèn)。Article 2The establishment of diplomatic relations between States

11、, and of permanent diplomatic missions, takes place by mutual consent.國(guó)與國(guó)間外交關(guān)系及常設(shè)使館之建立,以協(xié)議為之。Article 31. The functions of a diplomatic mission consist, inter alia, in: 除其他事項(xiàng)外,使館之職務(wù)如下:(a) Representing the sending State in the receiving State; 在接受國(guó)中代表派遣國(guó);(b) Protecting in the receiving State the inter

12、ests of the sending State and of its nationals, within the limits permitted by international law; 于國(guó)際法許可之限度內(nèi),在接受國(guó)中保護(hù)派遣國(guó)及其國(guó)民之利益;(c) Negotiating with the Government of the receiving State; 與接受國(guó)政府辦理交涉;(d) Ascertaining by all lawful means conditions and developments in the receiving State, and reporting

13、 thereon to the Government of the sending State; 以一切合法手段調(diào)查接受國(guó)之狀況及發(fā)展情形,向派遣國(guó)政府具報(bào);(e) Promoting friendly relations between the sending State and the receiving State, and developing their economic, cultural and scientific relations; 促進(jìn)派遣國(guó)與接受國(guó)間之友好關(guān)系,及發(fā)展兩國(guó)間之經(jīng)濟(jì)、文化與科學(xué)關(guān)系。2. Nothing in the present Convention

14、shall be construed as preventing the performance of consular functions by a diplomatic mission. 本公約任何規(guī)定不得解釋為禁止使館執(zhí)行領(lǐng)事職務(wù)。Article 41. The sending State must make certain that the agreement of the receiving State has been given for the person it proposes to accredit as head of the mission to that State.

15、 派遣國(guó)對(duì)于擬派駐接受國(guó)之使館館長(zhǎng)人選務(wù)須查明其確已獲得接受國(guó)之同意。2. The receiving State is not obliged to give reasons to the sending State for a refusal of agreement.接受國(guó)無(wú)須向派遣國(guó)說(shuō)明不予同意之理由。Article 51. The sending State may, after it has given due notification to the receiving States concerned, accredit a head of mission or assign a

16、ny member of the diplomatic staff, as the case may be, to more than one State, unless there is express objection by any of the receiving States. 派遣國(guó)向有關(guān)接受國(guó)妥為通知后,得酌派任一使館館長(zhǎng)或外交職員兼駐一個(gè)以上國(guó)家,但任何接受國(guó)明示反對(duì)者,不在此限。2. If the sending State accredits a head of mission to one or more other States it may establish a d

17、iplomatic mission headed by a charg?daffaires ad interim in each State where the head of mission has not his permanent seat. 派遣國(guó)委派使館館長(zhǎng)兼駐另一國(guó)或數(shù)國(guó)者,得在該館長(zhǎng)不常川駐節(jié)之國(guó)內(nèi),設(shè)立以臨時(shí)代辦為館長(zhǎng)之使館。3. A head of mission or any member of the diplomatic staff of the mission may act as representative of the sending State to any

18、international organization. 使館館長(zhǎng)或使館任何外交職員得兼任派遣國(guó)駐國(guó)際組織之代表。Article 6Two or more States may accredit the same person as head of mission to another State, unless objection is offered by the receiving State.兩個(gè)以上國(guó)家得合派同一人為駐另一國(guó)之使館館長(zhǎng),但接受國(guó)表示反對(duì)者不在此限。Article 7Subject to the provisions of articles 5, 8, 9 and 11,

19、 the sending State may freely appoint the members of the staff of the mission. In the case of military, naval or air attaches, the receiving State may require their names to be submitted beforehand, for its approval.除第五條、第八條、第九條及第十一條另有規(guī)定外,派遣國(guó)得自由委派使館職員。關(guān)于陸、海、空軍武官,接受國(guó)得要求先行提名,征求該國(guó)同意。Article 81. Members

20、 of the diplomatic staff of the mission should in principle be of the nationality of the sending State. 使館外交職員原則上應(yīng)屬派遣國(guó)國(guó)籍。2. Members of the diplomatic staff of the mission may not be appointed from among persons having the nationality of the receiving State, except with the consent of that State whic

21、h may be withdrawn at any time. 委派屬接受國(guó)國(guó)籍之人為使館外交職員,非經(jīng)接受國(guó)同意,不得為之;此項(xiàng)同意得隨時(shí)撤銷之。3. The receiving State may reserve the same right with regard to nationals of a third State who are not also nationals of the sending State. 接受國(guó)對(duì)于第三國(guó)國(guó)民之亦非為派遣國(guó)國(guó)民者,得保留同樣之權(quán)利。Article 91. The receiving State may at any time and wit

22、hout having to explain its decision, notify the sending State that the head of the mission or any member of the diplomatic staff of the mission is persona non grata or that any other member of the staff of the mission is not acceptable. In any such case, the sending State shall, as appropriate, eith

23、er recall the person concerned or terminate his functions with the mission. A person may be declared non grata or not acceptable before arriving in the territory of the receiving State. 接受國(guó)得隨時(shí)不具解釋通知派遣國(guó)宣告使館館長(zhǎng)或使館任何外交職員為不受歡迎人員或使館任何其他職員為不能接受。遇此情形,派遣國(guó)應(yīng)斟酌情況召回該員或終止其在使館中之職務(wù)。任何人員得于其到達(dá)接受國(guó)國(guó)境前,被宣告為不受歡迎或不能接受。2.

24、If the sending State refuses or fails within a reasonable period to carry out its obligations under paragraph 1 of this article, the receiving State may refuse to recognize the person concerned as a member of the mission. 如派遣國(guó)拒絕或不在相當(dāng)期間內(nèi)履行其依本條第一項(xiàng)規(guī)定所負(fù)義務(wù),接受國(guó)得拒絕承認(rèn)該員為使館人員。Article 101. The Ministry for Fo

25、reign Affairs of the receiving State, or such other ministry as may be agreed, shall be notified of: 下列事項(xiàng)應(yīng)通知接受國(guó)外交部或另經(jīng)商定之其他部:(a) The appointment of members of the mission, their arrival and their final departure or the termination of their functions with the mission; 使館人員之委派,其到達(dá)及最后離境或其在使館中職務(wù)之終止;(b) T

26、he arrival and final departure of a person belonging to the family of a member of the mission and, where appropriate, the fact that a person becomes or ceases to be a member of the family of a member of the mission; 使館人員家屬到達(dá)及最后離境;遇有任何人成為或不復(fù)為使館人員家屬時(shí),亦宜酌量通知(c) The arrival and final departure of privat

27、e servants in the employ of persons referred to in sub-paragraph (a) of this paragraph and, where appropriate, the fact that they are leaving the employ of such persons; 本項(xiàng)(a)款所稱人員雇用之私人仆役到達(dá)及最后離境;遇有私人仆役不復(fù)受此等人員雇用時(shí),亦宜酌量通知;(d) The engagement and discharge of persons resident in the receiving State as me

Where possible, prior notification of arrival and final departure shall also be given. 到達(dá)及最后離境,于可能范圍內(nèi),亦應(yīng)事先通知。Article 111. In the absence of specific agreement as to the size of the

29、 mission, the receiving State may require that the size of a mission be kept within limits considered by it to be reasonable and normal, having regard to circumstances and conditions in the receiving State and to the needs of the particular mission. 關(guān)于使館之構(gòu)成人數(shù)如另無(wú)協(xié)議,接受國(guó)得酌量本國(guó)環(huán)境與情況及特定使館之需要,要求使館構(gòu)成人數(shù)不超過(guò)該國(guó)

The receiving State may equally, within similar bounds and on a non-discriminatory basis, refuse to accept officials of a particular category. 接受國(guó)亦得在同樣范圍內(nèi)并在無(wú)差別待遇之基礎(chǔ)上,拒絕接受某一類之官員。Article 12The sending State may not, without the prior express consent of the receiving State, establish offi

31、ces forming part of the mission in localities other than those in which the mission itself is established.派遣國(guó)非經(jīng)接受國(guó)事先明示同意,不得在使館本身所在地以外之地點(diǎn)設(shè)立辦事處,作為使館之一部分。Article 131. The head of the mission is considered as having taken up his functions in the receiving State either when he has presented his credentia

32、ls or when he has notified his arrival and a true copy of his credentials has been presented to the Ministry for Foreign Affairs of the receiving State, or such other ministry as may be agreed, in accordance with the practice prevailing in the receiving State which shall be applied in a uniform mann

33、er. 使館館長(zhǎng)依照接受應(yīng)予劃一適用之通行慣例。在呈遞國(guó)書(shū)后或在向接受國(guó)外交部或另經(jīng)商定之其他部通知到達(dá)并將所奉國(guó)書(shū)正式副本送交后,即視為已在接受國(guó)內(nèi)開(kāi)始執(zhí)行職務(wù)。2. The order of presentation of credentials or of a true copy thereof will be determined by the date and time of the arrival of the head of the mission. 呈遞國(guó)書(shū)或遞送國(guó)書(shū)正式副本之次第依使館館長(zhǎng)到達(dá)之日期及時(shí)間先后定之。Article 141. Heads of mission a

34、re divided into three classes - namely: 使館館長(zhǎng)分為如下三級(jí):(a) That of ambassadors or nuncios accredited to Heads of State, and other heads of mission of equivalent rank; 向國(guó)家元首派遣之大使或教廷大使,及其他同等級(jí)位之使館館長(zhǎng);(b) That of envoys, ministers and internuncios accredited to Heads of State: 向國(guó)家元首派遣之使節(jié)、公使及教廷公使;(c) That of

35、charges d affaires accredited to Ministers for Foreign Affairs. 向外交部長(zhǎng)派遣之代辦。2. Except as concerns precedence and etiquette, there shall be no differentiation between heads of mission by reason of their class. 除關(guān)于優(yōu)先地位及禮儀之事項(xiàng)外,各使館館長(zhǎng)不應(yīng)因其所屬等級(jí)而有任何差別。Article 15The class to which the heads of their missions

36、are to be assigned shall be agreed between States.使館館長(zhǎng)所屬之等級(jí)應(yīng)由關(guān)系國(guó)家商定之。Article 161. Heads of mission shall take precedence in their respective classes in the order of the date and time of taking up their functions in accordance with article 13. 使館館長(zhǎng)在其各別等級(jí)中之優(yōu)先地位應(yīng)按照其依第十三條規(guī)定開(kāi)始執(zhí)行職務(wù)之日期及時(shí)間先后定之。2. Alteration

37、s in the credentials of a head of mission not involving any change of class shall not affect his precedence. 使館館長(zhǎng)之國(guó)書(shū)如有變更而對(duì)其所屬等級(jí)并無(wú)更動(dòng)時(shí),其優(yōu)先地位不受影響。3. This article is without prejudice to any practice accepted by the receiving State regarding the precedence of the representative of the Holy See. 本條規(guī)定不妨礙接

38、受國(guó)所采行關(guān)于教廷代表優(yōu)先地位之任何辦法。Article 17The precedence of the members of the diplomatic staff of the mission shall be notified by the head of the mission to the Ministry for Foreign Affairs or such other ministry as may be agreed.使館外交職員之優(yōu)先順序應(yīng)由使館館長(zhǎng)通知外交部或另經(jīng)商定之其他部。Article 18The procedure to be observed in each

39、State for the reception of heads of mission shall be uniform in respect of each class.各國(guó)接待使館館長(zhǎng),對(duì)于同一等級(jí)之館長(zhǎng)應(yīng)適用劃一程序。Article 191. If the post of head of the mission is vacant, or if the head of the mission is unable to perform his functions a charg?daffaires ad interim shall act provisionally as head of

The name of the charg?daffaires ad interim shall be notified, either by the head of the mission or in case he is unable to do so, by the Ministry for Foreign Affairs of the sending State to the Ministry for Foreign Affairs of the receiving State or such other ministry as may be agreed.

In cases where no member of the diplomatic staff of the mission is present in the receiving State, a member of the administrative and technical staff may, with the consent of the receiving State, be designated by the s

42、ending State to be in charge of the current administrative affairs of the mission. 使館如在接受國(guó)內(nèi)并無(wú)外交職員時(shí),派遣國(guó)得于征得接受國(guó)同意后,指派行政或技術(shù)職員一人,主持使館日常行政事務(wù)。Article 20The mission and its head shall have the right to use the flag and emblem of the sending State on the premises of the mission, including the residence of t

43、he head of the mission, and on his means of transport.使館及其館長(zhǎng)有權(quán)在使館館舍,及在使館館長(zhǎng)寓邸與交通工具上使用派遣國(guó)之國(guó)旗或國(guó)徽。Article 211. The receiving State shall either facilitate the acquisition on its territory, in accordance with its laws, by the sending State of premises necessary for its mission or assist the latter in obt

44、aining accommodation in some other way. 接受國(guó)應(yīng)便利派遣國(guó)依照接受國(guó)法律在其境內(nèi)置備派遣國(guó)使館所需之館舍,或協(xié)助派遣國(guó)以其他方法獲得房舍。2. It shall also, where necessary, assist missions in obtaining suitable accommodation for their members. 接受國(guó)遇必要時(shí),并應(yīng)協(xié)助使館為其人員獲得適當(dāng)之房舍。Article 221. The premises of the mission shall be inviolable. The agents of the

45、 receiving State may not enter them, except with the consent of the head of the mission. 使館館舍不得侵犯。接受國(guó)官吏非經(jīng)使館館長(zhǎng)許可,不得進(jìn)入使館館舍。2. The receiving State is under a special duty to take all appropriate steps to protect the premises of the mission against any intrusion or damage and to prevent any disturbance

46、of the peace of the mission or impairment of its dignity. 接受國(guó)負(fù)有特殊責(zé)任,采取一切適當(dāng)步驟保護(hù)使館館舍免受侵入或損害,并防止一切擾亂使館安寧或有損使館尊嚴(yán)之情事。3. The premises of the mission, their furnishings and other property thereon and the means of transport of the mission shall be immune from search, requisition, attachment or execution. 使館

The sending State and the head of the mission shall be exempt from all national, regional or municipal dues and taxes in respect of the premises of the mission, whether owned or leased, other than such as represent payment for specific services rend

The exemption from taxation referred to in this article shall not apply to such dues and taxes payable under the law of the receiving State by persons contracting with the sending State or the head of the mission. 本條所稱之免稅,對(duì)于與派遣國(guó)或使館館長(zhǎng)訂

49、立承辦契約者依接受國(guó)法律應(yīng)納之捐稅不適用之。Article 24The archives and documents of the mission shall be inviolable at any time and wherever they may be.使館檔案及文件無(wú)論何時(shí),亦不論位于何處,均屬不得侵犯。Article 25The receiving State shall accord full facilities for the performance of the functions of the mission.接受國(guó)應(yīng)給予使館執(zhí)行職務(wù)之充分便利。Article 26Sub

50、ject to its laws and regulations concerning zones entry into which is prohibited or regulated for reasons of national security, the receiving State shall ensure to all members of the mission freedom of movement and travel in its territory.除接受國(guó)為國(guó)家安全設(shè)定禁止或限制進(jìn)入?yún)^(qū)域另訂法律規(guī)章外,接受國(guó)應(yīng)確保所有使館人員在其境內(nèi)行動(dòng)及旅行之自由。Article

51、271. The receiving State shall permit and protect free communication on the part of the mission for all official purposes. In communicating with the Government and the other missions and consulates of the sending States, wherever situated, the mission may employ all appropriate means, including dipl

52、omatic couriers and messages in code or cipher. However, the mission may install and use a wireless transmitter only with the consent of the receiving State. 接受國(guó)應(yīng)允許使館為一切公務(wù)目的自由通訊,并予保護(hù)。使館與派遣國(guó)政府及無(wú)論何處之該國(guó)其他使館及領(lǐng)事館通訊時(shí),得采用一切適當(dāng)方法,包括外交信差及明密碼電信在內(nèi)。但使館非經(jīng)接受國(guó)同意,不得裝置并使用無(wú)線電發(fā)報(bào)機(jī)。2. The official correspondence of the m

53、ission shall be inviolable. Official correspondence means all correspondence relating to the mission and its functions. 使館之來(lái)往公文不得侵犯。來(lái)往公文指有關(guān)使館及其職務(wù)之一切來(lái)往文件。3. The diplomatic bag shall not be opened or detained. 外交郵袋不得予以開(kāi)拆或扣留。4. The packages constituting the diplomatic bag must bear visible external mar

54、ks of their character and may contain only diplomatic documents or articles intended for official use. 構(gòu)成外交郵袋之包裹須附有可資識(shí)別之外部標(biāo)記,以裝載外交文件或公務(wù)用品為限。5. The diplomatic courier, who shall be provided with an official document indicating his status and the number of packages constituting the diplomatic bag, sha

55、ll be protected by the receiving State in the performance of his functions. He shall enjoy personal inviolability and shall not be liable to any form of arrest or detention. 外交信差應(yīng)持有官方文件,載明其身分及構(gòu)成郵袋之包裹件數(shù);其于執(zhí)行職務(wù)時(shí),應(yīng)受接受國(guó)保護(hù)。外交信差享有人身不得侵犯權(quán),不受任何方式之逮捕或拘禁。6. The sending State or mission may designate diplomati

56、c couriers ad hoc. In such cases the provisions of paragraph 5 of this article shall also apply, except that the immunities therein mentioned shall cease to apply when such a courier has delivered to the consignee the diplomatic bag in his charge. 派遣國(guó)或使館得派特別外交信差。遇此情形,本條第五項(xiàng)之規(guī)定亦應(yīng)適用,但特別信差將其所負(fù)責(zé)攜帶之外交郵袋送交

57、收件人后,即不復(fù)享有該項(xiàng)所稱之豁免。7. A diplomatic bag may be entrusted to the captain of a commercial aircraft scheduled to land at an authorized port of entry. He shall be provided with an official document indicating the number of packages constituting the bag but he shall not be considered to be a diplomatic cou

The mission may send one of its members to take possession of the diplomatic bag directly and freely from the captain of the aircraft. 外交郵袋得托交預(yù)定在準(zhǔn)許入境地點(diǎn)降落之商營(yíng)飛機(jī)機(jī)長(zhǎng)轉(zhuǎn)遞。機(jī)長(zhǎng)應(yīng)持有官方文件載明構(gòu)成郵袋之郵包件數(shù),但機(jī)長(zhǎng)不得視為外交信差。使館得派館員一人徑向飛機(jī)機(jī)長(zhǎng)自由取得外交郵袋。Article 28The fees and charges levied by the mission in the course of its o
