1、合同書(shū)樣本海洋運(yùn)輸貨物保險(xiǎn)條款（附英文）一、責(zé)任范圍本保險(xiǎn)分為平安安險(xiǎn)、水漬險(xiǎn)險(xiǎn)及一切險(xiǎn)三三種。被保險(xiǎn)險(xiǎn)貨物遭受損損失時(shí)，本保保險(xiǎn)按照保險(xiǎn)險(xiǎn)單上訂明承承保險(xiǎn)別的條條款規(guī)定，負(fù)負(fù)賠償責(zé)任。（一）平安險(xiǎn)本保險(xiǎn)負(fù)責(zé)賠償償：1、被保險(xiǎn)貨物物在運(yùn)輸途中中由于惡劣氣氣候、雷電、海海嘯、地震、洪洪水自然災(zāi)害害造成整批貨貨物的全部損損失或推定全全損。當(dāng)被保保險(xiǎn)人要求賠賠付推定全損損時(shí)，須將受受損貨物及其其權(quán)利委付給給保險(xiǎn)公司。被被保險(xiǎn)貨物用用駁船運(yùn)往或或運(yùn)離海輪的的，每一駁船船所裝的貨物物可視作一個(gè)個(gè)整批。推定定全損是指被被保險(xiǎn)貨物的的實(shí)際全損已已經(jīng)不可避免免，或者恢復(fù)復(fù)、修復(fù)受損損貨物以及運(yùn)運(yùn)送貨物到原原訂

2、目的地的的費(fèi)用超過(guò)該該目的地的貨貨物價(jià)值。2、由于運(yùn)輸工工具遭受擱淺淺、觸礁、沉沉沒(méi)、互撞、與與流冰或其他他物體碰撞以以及失火、爆爆炸意外事故故造成貨物的的全部或部份份損失。3、在運(yùn)輸工具具已經(jīng)發(fā)生擱擱淺、觸礁、沉沉沒(méi)、焚毀意意外事故的情情況下，貨物物在此前后又又在海上遭受受惡劣氣候、雷雷電、海嘯等等自然災(zāi)害所所造成的部份份損失。4、在裝卸或轉(zhuǎn)轉(zhuǎn)運(yùn)時(shí)由于一一件或數(shù)件整整件貨物落海海造成的全部部或部份損失失。5、被保險(xiǎn)人對(duì)對(duì)遭受承保責(zé)責(zé)任內(nèi)危險(xiǎn)的的貨物采取搶搶救、防止或或減少貨損的的措施而支付付的合理費(fèi)用用，但以不超超過(guò)該批被救救貨物的保險(xiǎn)險(xiǎn)金額為限。6、運(yùn)輸工具遭遭遇海難后，在在避難港由于于卸

3、貨所引起起的損失以及及在中途港，避避難港由于卸卸貨，存?zhèn)}以以及運(yùn)送貨物物所產(chǎn)生的特特別費(fèi)用。7、共同海損的的犧牲、分?jǐn)倲偤途戎M(fèi)用用。8、運(yùn)輸契約訂訂有“船舶互撞責(zé)責(zé)任”條款，根據(jù)據(jù)該條款規(guī)定定應(yīng)由貨方償償還船方的損損失。（二）水漬險(xiǎn)除包括上列平安安險(xiǎn)的各項(xiàng)責(zé)責(zé)任外，本保保險(xiǎn)還負(fù)責(zé)被被保險(xiǎn)貨物由由于惡劣氣候候、雷電、海海嘯、地震、洪洪水自然災(zāi)害害所造成的部部份損失。（三）一切險(xiǎn)除包括上列平安安險(xiǎn)和水漬險(xiǎn)險(xiǎn)的各項(xiàng)責(zé)任任外，本保險(xiǎn)險(xiǎn)還負(fù)責(zé)被保保險(xiǎn)貨物在運(yùn)運(yùn)輸途中由于于外來(lái)原因所所致的全部或或部分損失。二、除外責(zé)任本保險(xiǎn)對(duì)下列損損失不負(fù)賠償償責(zé)任：（一）被保險(xiǎn)人人的故意行為為或過(guò)失所造造成的損失。（

4、二）屬于發(fā)貨貨人責(zé)任所引引起的損失。（三）在保險(xiǎn)責(zé)責(zé)任開(kāi)始前，被被保險(xiǎn)貨物已已存在的品質(zhì)質(zhì)不良或數(shù)量量短差所造成成的損失。（四）被保險(xiǎn)貨貨物的自然損損耗、本質(zhì)缺缺陷、特性以以及市價(jià)跌落落；運(yùn)輸遲延延所引起的損損失或費(fèi)用。（五）本公司海海洋運(yùn)輸貨物物戰(zhàn)爭(zhēng)險(xiǎn)條款款和貨物運(yùn)輸輸罷工險(xiǎn)條款款規(guī)定的責(zé)任任范圍和除外外責(zé)任。三、責(zé)任起訖（一）本保險(xiǎn)負(fù)負(fù)“倉(cāng)至倉(cāng)”責(zé)任，自被被保險(xiǎn)貨物運(yùn)運(yùn)離保險(xiǎn)單所所載明的起運(yùn)運(yùn)地倉(cāng)庫(kù)或儲(chǔ)儲(chǔ)存處所開(kāi)始始運(yùn)輸時(shí)生效效，包括正常常運(yùn)輸過(guò)程中中的海上、陸陸上、內(nèi)河和和駁船運(yùn)輸在在內(nèi)，直至該該項(xiàng)貨物到達(dá)達(dá)保險(xiǎn)單所載載明目的地收收貨人的最后后倉(cāng)庫(kù)或儲(chǔ)存存處所或被保保險(xiǎn)人用作分分配、分派

5、或或非正常運(yùn)輸輸?shù)钠渌麅?chǔ)存存處所為止。如如末抵達(dá)上述述倉(cāng)庫(kù)或儲(chǔ)存存處所，則以以被保險(xiǎn)貨物物在最后卸載載港全部卸離離海輪后滿六六十天為止。如如在上述六十十天內(nèi)被保險(xiǎn)險(xiǎn)貨物需轉(zhuǎn)運(yùn)運(yùn)到非保險(xiǎn)單單所載 明的目的地地時(shí)，則以該該項(xiàng)貨物開(kāi)始始轉(zhuǎn)運(yùn)時(shí)終止止。（二）由于被保保險(xiǎn)人無(wú)法控控制的運(yùn)輸延延遲、繞道、被被迫卸貨、重重行裝載、轉(zhuǎn)轉(zhuǎn)載或承運(yùn)人人運(yùn)用運(yùn)輸契契約賦予的權(quán)權(quán)限所作的任任何航海上的的變更或終止止運(yùn)輸契約，致致使被保險(xiǎn)貨貨物運(yùn)到非保保險(xiǎn)單所載明明目的地時(shí)，在在被保險(xiǎn)人及及時(shí)將獲知的的情況通知保保險(xiǎn)人，并在在必要時(shí)加繳繳保險(xiǎn)費(fèi)的情情況下，本保保險(xiǎn)仍繼續(xù)有有效，保險(xiǎn)責(zé)責(zé)任按下列規(guī)規(guī)定終止。1、被保險(xiǎn)貨物

6、物如在非保險(xiǎn)險(xiǎn)單所載明的的目的地出售售，保險(xiǎn)責(zé)任任至交貨時(shí)為為止，但不論論任何情況下下，均以被保保險(xiǎn)貨物在卸卸載港全部卸卸離海輪后滿滿六十天為止止。2、被保險(xiǎn)貨物物如在上述六六十天期限內(nèi)內(nèi)繼續(xù)運(yùn)往保保險(xiǎn)單所載原原目的地或其其他目的地時(shí)時(shí)，保險(xiǎn)責(zé)任任仍按上述第第（一）款的的規(guī)定終止。四、被保險(xiǎn)人的的義務(wù)被保險(xiǎn)人應(yīng)按照照以下規(guī)定的的應(yīng)盡義務(wù)辦辦理有關(guān)事項(xiàng)項(xiàng)，如因未履履行規(guī)定的義義務(wù)而影響保保險(xiǎn)人利益時(shí)時(shí)，本公司對(duì)對(duì)有關(guān)損失，有有權(quán)拒絕賠償償。（一）當(dāng)被保險(xiǎn)險(xiǎn)貨物運(yùn)抵保保險(xiǎn)單所載明明的目的港（地地）以后，被被保險(xiǎn)人應(yīng)及及時(shí)提貨，當(dāng)當(dāng)發(fā)現(xiàn)被保險(xiǎn)險(xiǎn)貨物遭受任任何損失，應(yīng)應(yīng)即向保險(xiǎn)單單上所載明的的檢驗(yàn)、理

7、賠賠代理人申請(qǐng)請(qǐng)檢驗(yàn)，如發(fā)發(fā)現(xiàn)被保險(xiǎn)貨貨物整件短少少或有明顯殘殘損痕跡應(yīng)即即向承運(yùn)人、受受托人或有關(guān)關(guān)當(dāng)局（海關(guān)關(guān)、港務(wù)當(dāng)局局等）索取貨貨損貨差證明明。如果貨損損貨差是由于于承運(yùn)人、受受托人或其他他有關(guān)方面的的責(zé)任所造成成，并應(yīng)以書(shū)書(shū)面方式向他他們提出索賠賠，必要時(shí)還還須取得延長(zhǎng)長(zhǎng)時(shí)效的認(rèn)證證。（二）對(duì)遭受承承保責(zé)任內(nèi)危危險(xiǎn)的貨物，被被保險(xiǎn)人和本本公司都可迅迅速采取合理理的搶救措施施，防止或威威少貨物的損損失，被保險(xiǎn)險(xiǎn)人采取此項(xiàng)項(xiàng)措施，不應(yīng)應(yīng)視為放棄委委付的表示，本本公司采取此此項(xiàng)措施，也也不得視為接接受委付的表表示。（三）如遇航程程變更或發(fā)現(xiàn)現(xiàn)保險(xiǎn)單所載載明的貨物、船船名或航程有有遺漏或錯(cuò)誤

8、誤時(shí)，被深險(xiǎn)險(xiǎn)人應(yīng)在獲悉悉后立即通知知保險(xiǎn)人并在在必要時(shí)加繳繳保險(xiǎn)費(fèi)，本本保險(xiǎn)才繼續(xù)續(xù)有效。（四）在向保險(xiǎn)險(xiǎn)人索賠時(shí)，必必須提供下列列單證：保險(xiǎn)單正本、提提單、發(fā)票、裝裝箱單、磅碼碼單、貨損貨貨差證明、檢檢驗(yàn)報(bào)告及索索賠清單。如如涉及第三者者責(zé)任，還須須提供向責(zé)任任方追償?shù)挠杏嘘P(guān)函電及其其他必要單證證或文件。（五）在獲悉有有關(guān)運(yùn)輸契約約中“船舶互攜責(zé)責(zé)任”條款的實(shí)際際責(zé)任后，應(yīng)應(yīng)及時(shí)通知保保險(xiǎn)人。五、索賠期限本保險(xiǎn)索賠時(shí)效效，認(rèn)被保險(xiǎn)險(xiǎn)貨物在最后后卸裁港全部部卸離海輪后后起算，最多多不超過(guò)二年年。OCEAN MMARINEE CARGGO CLAAUSESI .
