allowance,…according tointernationalrules)relatetoparticipationofXXand/orConsultant inAppendix4oftheContract.承包商須在合同生效日后，立即按照合同附件4的時(shí)間進(jìn)度要求開(kāi)始工作。TimeforCompletion 竣工時(shí)間WithoutprejudicetoGC26.2oftheGeneralConditionsVolume1Biddingdocument,theContractorshallproceedwiththeWorksinaccordancewiththetimeschedulespecifiedinAppendix4(ProjectImplementationSchedule)heretoandshallattainProvisionalAcceptanceoftheMMCoal-firedThermalPowerPlantwithin36monthsforUnitNo.1and42monthsforUnitNo.2andthewholePlantfromtheEffectiveDateofContract.在不違背招標(biāo)文件第1卷的GC26.2的規(guī)定的前提下，承包商應(yīng)該根據(jù)附件4(項(xiàng)目實(shí)施進(jìn)度表)的規(guī)定，在合同生效之日起36個(gè)月獲得MM燃煤火電廠1號(hào)機(jī)組的臨時(shí)驗(yàn)收，在合同生效之日起 42個(gè)月獲得MM燃煤火電廠2號(hào)機(jī)組和整個(gè)電廠的臨時(shí)驗(yàn)收。TimeforPossession 進(jìn)場(chǎng)時(shí)間XXshallgivefullpossessionofandaccordallrightsofaccess totheSiteandrightstoallotherareasforimplementation ofContractonorbeforethedate(s)ofContractEffectiveDate.XX在合同生效之日或者之前，給承包商進(jìn)入和占用現(xiàn)場(chǎng)各部分實(shí)施合同的權(quán)禾.LiquidatedDamagesforDelay工期延遲約定損害賠償金IftheContractorfailstoattainProvisionalAcceptanceoftheMMCoal-firedThermalPowerPlantoranypartthereofwithintheTimeforCompletionSpecifiedinArticle5.2(TimeforCompletion)aboveorwithinsuchextendedtimetowhichtheContractorshallbeentitledunderGC39(ExtensionofTimeforCompletion)oftheGeneralConditions/Volume1-ITB,theContractorshallpaytoXXUSD120,000/dayxtotaldaysofdelayforeachUnitpursuanttoGC26.2oftheGeneralConditions.Suchamountshallbepaidasliquidateddamagesandnotexceedtenpercents(10%)ofContractPrice.如果承包商未能按照條款 5.2(竣工時(shí)間)的規(guī)定時(shí)間獲得MM燃煤火電廠的臨時(shí)驗(yàn)收，或者根據(jù)第1卷(ITB)的GC39(竣工時(shí)間的延長(zhǎng))的規(guī)定，在延長(zhǎng)后的擔(dān)?？⒐ぶ杖晕传@得 MM燃煤火電廠的臨時(shí)驗(yàn)收，那么根據(jù)GC26.2的規(guī)定，從規(guī)定竣工之日起開(kāi)始計(jì)算，承包商應(yīng)該向XX支付的工期延遲違約賠償金為每臺(tái)機(jī)組 120,000USD/天，作為延遲違約賠償金支付的金額不得超過(guò)合同總價(jià)格的 10%。GuaranteePeriod保證期TheGuaranteePeriodforthePlantshallbenotlessthan24monthseffectivefromthedateofProvisionalAcceptanceUnitissuedbyXXandinaccordancewithGC27根據(jù)GC27的規(guī)定，電廠的保證期是從XX對(duì)機(jī)組臨時(shí)驗(yàn)收起的二十四(24)個(gè)月Insurance條款6:保險(xiǎn)TheinsurancetobetakenoutandmaintainedbytheContractorpursuanttoGC34(Insurance)oftheGeneralConditionsVolume1 -BiddingDocumentshallbeasspecifiedinAppendix3(InsuranceRequirements)hereto.承包商的保險(xiǎn)根據(jù)招標(biāo)文件第1卷的GC34(保險(xiǎn))的和附錄3(保險(xiǎn)要求)的規(guī)定執(zhí)行PerformanceGuaranteesandLiquidatedDamages條款7:性能保證和違約賠償金PerformanceGuarantees性能保證TheContractorguaranteestheattainmentofthePerformanceGuaranteesspecifiedinPerformanceGuarantees(Appendix8)heretoinaccordancewithGC28(PerformanceGuarantees)oftheGeneralConditions/Volume1 -ITB,subjecttoandupontheconditionsspecifiedinPerformanceGuarantees(Appendix8)hereto.承包商承諾達(dá)到附錄8(性能擔(dān)保)規(guī)定的性能擔(dān)保值，并符合第1卷(ITB)GC28的規(guī)定。LiquidatedDamagesforFailuretoAttainPerformanceGuarantees未能達(dá)到性能保證要求的違約賠償金IftheContractorfailstoattainthePerformanceGuaranteesspecifiedinPerformanceGuarantees(Appendix8)heretotheContractorshallpaytoXXliquidateddamagesassetoutinAppendix14oftheContractAgreement(PerformanceGuaranteesandPenaltyforfailuretomeetPerformanceGuarantees)hereto.TheContractor'spaymentforfailurenottoaiinPerformanceGuaranteesshallnotexceedtwentypercents(20%)ofContractprice.如果承包商未能達(dá)到附件8(性能保證)的要求，承包商應(yīng)該按照附件14(性能保證和未能達(dá)到性能保證要求的違約賠償金)中的規(guī)定，向XX支付違約賠償金，未能達(dá)到性能保證的違約賠償金不超過(guò)合同總價(jià)格的20%。Bonds條款8:保函AdvancePaymentBond
