廠房混凝土澆筑施工合同CONTRACCTOFCONCRRETEPPOURINNGPROOJECT簽署日期DateeofSSignatture甲方：（發(fā)包方方）PartyyA:(Emplloyer))乙方：（承包方方）PartyyB;((Conttractoor)鑒于甲方將廠房房混凝土澆筑筑施工項(xiàng)目工工程的施工委委托給有能力力的承包商完完成；鑒于乙方系有工工程建設(shè)資質(zhì)質(zhì)的承包商，愿愿意依照本合合同條款的約約定完成該項(xiàng)項(xiàng)目的施工；；為順利完成廠房房混凝土澆筑筑施工項(xiàng)目工工程施工，經(jīng)經(jīng)雙方協(xié)商一一致，就乙方方承包本項(xiàng)目目的施工事宜宜簽訂本合同同。WHEREASSparttyAwwillmmakecconsiggnatioonofconsttructiionoffconccretepouriingprrojecttforthebbuildiingofffacttoryttotheecomppetenttconttractoorforraccoomplisshmentt;anddWHEREASSparttyBiistheecomppetenttconttractoorwitththeeauthhorizaationofprrojecttconsstructt,anddlikeetoccompleetethhisprrojecttundeertheeprovvisionnsofthiscontrract.Fortheepurpposeoofsucccessffulacccompllishmeentofftheexecuutionofcooncrettepouuringprojeectfoortheebuilldingoffaactoryy,thiisconntracttiscconcluudedaandenntereddintoobyaandthhroughhmutuualneegotiaationbetweeenparrtiesheretto,NOWTHEEREFORRETHIISCONNTRACTTWITNNESSESSthattitiisherrebyaagreeddbyaandbeetweennthepartiiesheeretoasfoollowss:一、工程名稱：：ProjeectNaame二、施工地點(diǎn)：：ProjeectPllace三、承包工作內(nèi)內(nèi)容：ProojectConteents按國(guó)家規(guī)范要求求和甲方的施施工方案施工工，包括基礎(chǔ)及主主體結(jié)構(gòu)（包包括后澆管道道井頂板、后后澆洞、預(yù)制制過梁、地溝溝及蓋板、屋屋面墻及構(gòu)架架等）等混凝凝土澆搗、操操平、養(yǎng)護(hù)、操操作臺(tái)搭拆，成成品及半成品品保護(hù)措施，混混凝土機(jī)械安安裝；零星混混凝土現(xiàn)場(chǎng)拌拌制；泵送系系統(tǒng)堵管時(shí)的的管道檢修以以及混凝土缺陷的的修補(bǔ)。UndertaakethheexeecutioonasStatee’sreggulatiionsaandpaartyAA’sproogrammmeinccludinngconncreteepourring/vvibrattion,levelling,curinngofconcrretefforthhefouundatiionanndmaiinstrructurreconnsistiingoffposttpourringppipesshaftroof,,posttpourringhhole,precaastliintel,,trennchanndcovver,wwallaandrooofsttructuure；andeerectiionanndremmovalofopperatiionpllatforrm,prrotecttionooffinnisheddprodductaandseemi-fiinisheedprooduct,,insttallattionoofmacchinerry,tempporaryyconccreteon-siite,ppiperrepairrforblockkingppipeoofpummpingsysteem,innaddiitiontoreepairofcooncrettedeffect.其具體項(xiàng)目如下下：PartticulaarsoffProjjectaasfolllows混凝土泵就位，搭搭泵管架及接接泵管等；Locatioonofconcrreteppump,instaallatiionoffpipeerackksanddconnnectioonofpipeandootherworkssconccernedd.凝土的下料和振振搗密實(shí)及混混凝土澆水養(yǎng)養(yǎng)護(hù)；Materiaalsoffconccrete,,vibrrationncomppactinnganddwateercurring.混凝土的初步找找平；Prrimaryyleveeling對(duì)相應(yīng)混凝土材材料的質(zhì)量負(fù)負(fù)責(zé)；Liaablefforthhequaalityofreelateddmateerialssuseddforconcrrete.四、承包單價(jià)與與工程量計(jì)算算方法：CoontracctingUnitPriceeandCalcuulate±0.00及以以下與屋面以以上按元/立方米計(jì)價(jià)價(jià)結(jié)算，其工工程量按施工工圖或設(shè)計(jì)變變更計(jì)算，標(biāo)標(biāo)準(zhǔn)層按承包包包干單價(jià)：：元/㎡，以建筑筑面積結(jié)算；；±0.00aandbeelowiinaddditionntottherooofabboveaareseettleddaccoountsasYuuan/m3;theequanntityhereoofareecalcculateedasperddrawinngsorrdesiignallterattion;standdardffloorreferrredttotheeconttractiingunnitprrice,viz.Yuan/m3onbbasisofcoonstruuctionnareaa.五、工程質(zhì)量要要求：QualiityoffProjject1、施工質(zhì)量必必須達(dá)到國(guó)家家現(xiàn)行《施工工質(zhì)量驗(yàn)收規(guī)規(guī)范》（GB503300-20001系列）標(biāo)準(zhǔn)準(zhǔn)的要求。ExecutiionquualityyshouuldbeesatiisfacttoryttotheerequuiremeentoffStatte’sexiistinggCODEEFORCONSTTRUCTIIONQUUALITYYACCEEPTANCCE(GB503300-20001).2、凡未達(dá)到施施工質(zhì)量要求求的工程部位位，乙方必須須無條件的返返工，其返工工的各項(xiàng)費(fèi)用用由乙方自行行負(fù)責(zé)，并賠賠償甲方的各各項(xiàng)損失（材材料、工期、質(zhì)質(zhì)量等損失）。Respecttingttoanyyparttofpprojecctwhiichfaailtoosatiisfytthereequireementssofpprojecctquaality,,parttyBsshoulddrewoorkunncondiitionaallyaandunndertaakethhefeeesanddcosttstheereofforiitsowwnacccount,,inaadditiiontoocomppensattionoofparrtyA’’slosssandddamaageoffvariiouskkindsincluudingthellossoofmatterialls,woorksttermaandquualityyandsoonn.六、施工工期要要求：ProojectTerm1、根據(jù)現(xiàn)場(chǎng)施施工總進(jìn)度要要求：本分項(xiàng)項(xiàng)工程的施工工工期為按周周進(jìn)度計(jì)劃的的要求進(jìn)行；；Executiionteermoffthisssubjjectsshall,,purssuanttothhereqquiremmentoofgenneralprogrressoon-sitt,becarriiedouutonthebbasisofScchedulleofWeek’’sProogresss.2、為確保施工工工期，甲方方根據(jù)總工期期（總工期以以簽定的合同同工期為準(zhǔn)）的的要求，以周周計(jì)劃進(jìn)行工工期進(jìn)度的安安排，乙方必必須嚴(yán)格按照照甲方制定的的周進(jìn)度計(jì)劃劃安排工作并并確保其完成成。IntheexpecctatioonofensurringttermoofproojectpartyyAwiill,ppursuaanttootherequiiremenntofgenerralteermwhhichbbesubbjecttothheterrmwhiichissstippulateedherrein,makeprepaaratioonofprogrresswwithwweeklyyscheedulewithwhichhparttyBsshoulddbeiinstrrictaaccorddance,,andensurreitssaccoomplisshmentttherreof.七、安全施工要要求：SafettyExeecutioonOn--site乙方人員必須做做到安全施工，材材料堆碼有序序，工完場(chǎng)清清料盡，必須須服從甲方管管理，遵守各各項(xiàng)管理制度度。PartyBB’sperrsonneelonsiteshoullddosafettyexeecutioon,maateriaalstaackinggordeerly,workendaandmaateriaalcleear,aandshhouldobeythemmanageementbypaartyAA,abiidebyythemanaggementtrulees.八、材料管理：：MaterrialsManaggementt材料進(jìn)場(chǎng)由乙方方項(xiàng)目部驗(yàn)收收，甲方派人參與與工程材料的的驗(yàn)收并簽字字確認(rèn)材料的的進(jìn)場(chǎng)數(shù)量、質(zhì)質(zhì)量。ProjecttmateerialssenteeringthessitewwillbbecheeckedandaaccepttedbyyparttyB’sProojectDeparrtmentt,anddparttyAwwillddispattchpeersonnneltoopartticipaatethhejoiintaccceptaanceoofproojectmaterrialsandmmakecconfirrmatioonbysignaatureofquuantittyanddquallityoofmatteriallsentteringgthesite..九、工程量驗(yàn)收收方法和期限限：MetthodaandTiimeliimiteddofQQuantiityAccceptaance1、記件工程量量以每個(gè)單項(xiàng)項(xiàng)工程為一個(gè)個(gè)結(jié)算單位，分分為基礎(chǔ)工程至至六層樓面結(jié)結(jié)構(gòu)為首次，六六層樓面結(jié)構(gòu)構(gòu)以后每月一一次，工程竣竣工一次，工工程竣工3個(gè)月后一次次。記日工每月驗(yàn)驗(yàn)收一次；Inresppectoofquaantityyofppiecewwork,eachindivviduallprojjectwwillbbedeeemedaasauunitoofacccount,,whicchdivvidedintothatinitiialtiimeoffaccoountiisfouundatiionprrojectttotthesiixflooorsttructuure;oonceaccouuntmoonthlyyafteertheesixfloorrstruucturee;oneeaccoountuuponccompleetionofprrojectt,oneeaccoountoonthrreemoonthsfolloowingcomplletionn.Quaantityyofddayworrkwilllbeaccepptedoonceaamontth.2、根據(jù)乙方完完成的工程量量和合同規(guī)定的付款條條件，由甲方方項(xiàng)目經(jīng)理審審批付款；Paymenttofpprojecctcosstwilll,puursuannttotheaaccompplishmmentqquantiitybyyparttyBaandpaaymenttcondditionnsherreof,beefffecteedontheeexaminnationnandapproovaloofparrtyA’’sproojectmanagger.十一、乙方職責(zé)責(zé)：ParttyB’sRessponsiibilitties1、乙方根據(jù)施施工需要、工工程進(jìn)度、安安全及質(zhì)量要要求，安排有施工經(jīng)經(jīng)驗(yàn)、單項(xiàng)技技術(shù)全面的技技術(shù)工人承擔(dān)擔(dān)該項(xiàng)施工任任務(wù)。PartyBBshalll,puursuannttonecesssityofexxecutiion,pprojecctproogresss,saffetyaandquualityyrequuiremeent,ddispattchthhecommpetennttecchnicaalworrkerwwitheexperiienceandffullsskillsstouunderttakessuchttask.2、乙方施工中中使用的手工工工具、電動(dòng)動(dòng)工具，施工工電纜電線及及燈具自行解解決。PartyBBshouuldprrepareeoniitsowwnacccountthehhandttools,,elecctricaaltoools,ccable//wireusedforeexecuttionaandliightinnglammp.3、如果乙方施施工不能滿足足甲方進(jìn)度、質(zhì)質(zhì)量的要求，甲方方可隨時(shí)安排排其它承包商進(jìn)進(jìn)場(chǎng)完成，由此產(chǎn)生的費(fèi)費(fèi)用由乙方承承擔(dān)，而且必要時(shí)時(shí)甲方有權(quán)提提前解除協(xié)議議并另選施工工承包商。ProvideedthaatiftheeexecuttionoofparrtyBfailtosaatisfyyparttyA’sreqquiremmentoofproogresssandqualiity,ppartyAcannataanytiimeprrepareeotheerconntracttorennteriintotthesiitefooracccompliishinggworkks,foorwhiichthhecosstariisingthereefromshalllbeaassumeedbypartyyB,aandinnneceessaryy,parrtyAisenntitleetoddischaargetthisccontraactinnadvaanceaandseelectotherrconttractoorforrdoinngworrks.十二、甲方職責(zé)責(zé)：ParttyA’sRessponsiibilitties1、甲方負(fù)責(zé)對(duì)對(duì)乙方進(jìn)場(chǎng)作作好施工前的的安全、質(zhì)量量、施工技術(shù)術(shù)交底。PartyAAislliableefortechnnicalclariificattionoofsaffety,qualiityanndexeecutioonbefforeppartyBentteringgintoothesiteforcconstrructioon.3、負(fù)責(zé)對(duì)乙方方安排工程進(jìn)進(jìn)度，簽發(fā)施施工任務(wù)書，督督促限期完成成。LiableforppreparrationnofppartyB’sproogresss,isssueprrojecttassiignmenntanddurgiingcoomplettionoofworrksonnthedeadlline.4、負(fù)責(zé)對(duì)乙方方完成工作量量的工程驗(yàn)收收及結(jié)算工程程款。LiableforaaccepttanceofpaartyBB’scommpletiionoffworkksanddmakeesetttlemenntofprojeectcoost.十三、工程款的的結(jié)算與支付付：SetttlemenntanddPaymmentoofProojectCost1、 基礎(chǔ)工程程至六層樓面面結(jié)構(gòu)完成，開開始支付工程程款，支付的的額度為已經(jīng)完成工程程的70%，以后根據(jù)施工進(jìn)度度，按上個(gè)月完成的工程量的70%支付。Initiallpaymmentoofproojectwillbeefffecteedupoontheecomppletioonofbaseconsttructiionanndtosixthhflooorstrructurre,thheamoountoofpayymentis700%ofthevvalueofcoomplettedwoorksaandthhereaffter,pursuuantttotheeproggressofprrojectt,eacchpayymentwillbeefffecteedon70%ooflasstmonnth’scommpleteedworrkquaantityy.2、工程主體完完成，付工程程款的90%，剩余10%的工程款待待工程竣工后后3月內(nèi)付清。90%ofprojeectcoostwiillbeeeffeectedupontheccompleetionofprrojecttmainnstruucturee,anddremaainingg10%%ofpprojecctcosstwilllbepaidoffwwithinnthreeemonnthsaafterprojeectcoomplettion.十四、爭(zhēng)議解決決Unlessotherrwiseagreeedtobythheparrties,,anydispuutearrisinggoutoforrincconnecctionwiththettransaactionnconttemplaatedbbytheeparttieshhereunndersshallbesuubmitttedtooandresollvedbbyChiinaInnternaationaalEcoonomiccandTradeeArbiitratiionCoommittteefoorarbbitrattioniinacccordanncewiiththhearbbitrattionrrulestheninfoorce.Theaarbitrralawwardsshallbefiinalaandbiindingguponnbothhpartties.與本條款項(xiàng)下交交易相關(guān)的或或由其引起的的一切爭(zhēng)議應(yīng)應(yīng)當(dāng)提交中國(guó)國(guó)國(guó)際經(jīng)濟(jì)貿(mào)貿(mào)易仲裁委員員會(huì)依據(jù)其現(xiàn)現(xiàn)行仲裁規(guī)則則裁決，雙方方另有約定的的除外。仲裁裁裁決為最終終裁決，對(duì)雙雙方具有約束束力。十五、違約責(zé)任任：BreaachLiiabiliities1、如果乙方未未在合同規(guī)定定時(shí)間完工，應(yīng)應(yīng)承擔(dān)所承包包范圍內(nèi)工程程總額的20％的違約金金。PartyBBshouuld,wwherefailuureoffcomppletioonofworksswithhinthhetimmelimmitedwhichhstippulateedincontrract,assummebreeachppenalttyof20%ttotalamounntofcontrracteddprojject.2、如果乙方施施工質(zhì)量不能能滿足現(xiàn)行施施工質(zhì)量驗(yàn)收收規(guī)范和甲方方對(duì)工程質(zhì)量量的具體要求求的，甲方有有權(quán)與乙方中中途任何時(shí)候候終止本施工工合同。ProvideedthaatifpartyyB’sexeecutioonquaalityfailtosaatisfyythecurreentcoodefooraccceptannceanndparrtyA’’sspeecificcrequuiremeentfoorproojectqualiity,ppartyAisentittletootermminateethissconttract..3、在施工期間間所發(fā)生的工工傷、質(zhì)量、安安全、管線、設(shè)設(shè)備、火災(zāi)及及其它事故，均均由造成事故故的乙方負(fù)責(zé)責(zé)。PartyBBshouuldasssumefullrespoonsibiilitieesanddliabbilitiiesfoorworrk’sinjjury,qualiity,ssafetyy,pippelinee,equuipmennt,fiireanndothheracccidenntsduuringitseexecuttionoofprooject..十六、不可抗力力如果合同一方由由于不可抗力力因素而不能能履行合同，比比如地震、臺(tái)臺(tái)風(fēng)、洪水、火火災(zāi)、戰(zhàn)爭(zhēng)及及其他無法預(yù)預(yù)見的事件，其其發(fā)生和后果果也無法阻止止、無法避免免的，該方應(yīng)應(yīng)立刻以電報(bào)報(bào)通知對(duì)方，并并在其后十五五天內(nèi)提交公公證機(jī)關(guān)出具具的詳細(xì)的事事件描述及有有效文件，用用以解釋其無無法履行合同同全部或部分分條款的原因因。雙方應(yīng)通通過協(xié)商，根根據(jù)事件對(duì)履履行合同的影影響程度，確確定是終止合合同或是免除除履行合同的的責(zé)任，或延延長(zhǎng)合同的履履行。Shouldeitheeroftheppartieestotheccontraactbeeprevventeddfrommexeccutinggthecontrractbbyforrcemaajeuree,succhasearthhquakee,typphoon,,floood,fiireanndwarrandotherrunfooreseeeneveentsaandthheirhhappenningaandcoonsequuencessareunpreeventaableaandunnavoiddable,,thepreveentedpartyyshalll,bbycabble,nnotifyytheotherrparttywitthoutanyddelay,,andshalll,wiithin15daaysthhereaffter,proviidethhedettaileddinfoormatiionofftheeventtsanddavaalidddocumeentfooreviidenceeissuuedbyytherelevvantppubliccnotaaryorrganizzationnforexplaaininggthereasoonofitsiinabillityttoexeecuteordeelayttheexxecutiionoffallorpaartoffthecontrract.Theppartieestotheccontraactshhall,throuughcoonsulttationns,innaccoordanccewitththeeeffeectsooftheeevenntsonntheperfoormancceoftheccontraact,ddecideewhettherttoterrminattetheeconttractortooexemmptthheparrtofobliggationnsforrimpllementtationnoftthecoontracctorwhethhertoodelaaytheeexeccutionnoftthecoontracct.十七、其他事項(xiàng)項(xiàng)：Misccellanneous1、本合同附件件為：混凝土土工程施工技技術(shù)方案。ThiscoontracctisaccommpanieedbyanapppendixxofTeechniccalApppendiixofConcrretecconstrructioon2、本合同一式式三份，乙方方執(zhí)一份、甲甲方執(zhí)二份。其其他未盡事項(xiàng)項(xiàng)，雙方協(xié)商商解決。ThiscoontracctismadethreeecopiiesfoorparrtyBholdiingonneanddparttyAhholdinngtwoocopiies.AAnyouutstanndingissueehereeinwiillbeesetttledtthrougghconnsultaationbetweeenpaartiesshereeto.INWITNNESSWWHEREOOF,eaachoffthePartiiesheeretohasccauseddthissconttracttobeeexeccutedbyittsdullyautthorizzedreepreseentatiiveonnthedatefirsttsetforthhabovve.雙方正式授權(quán)代代表已于文首首所載日期簽簽署本合同，以以資證明。甲方（蓋章）：：PartyyA(Seal)乙方（蓋章章）：ParrtyB(Seaal)法人代表或委托托人：法人代表委委托人：LegalRRepressentattiveoorDepputyfforPaartyAALegaalReppresenntativveorDeputtyforrParttyB附件：Appeendix::混凝土澆筑工程程施工技術(shù)方方案TechhnicallScheemeoffConccretePouriing1、混凝土施工工基本要求GeneeralRRequirrementtofCConcreete混凝土的配合比比統(tǒng)一由試驗(yàn)驗(yàn)室根據(jù)混凝凝土的強(qiáng)度等等級(jí)，結(jié)合現(xiàn)現(xiàn)場(chǎng)氣溫、施施工部位、澆澆筑方式、運(yùn)運(yùn)輸距離及砂砂石料含水率率等各種因素素的影響而進(jìn)進(jìn)行設(shè)計(jì)?；旎炷翝仓^過程中，試驗(yàn)驗(yàn)室按規(guī)定到到現(xiàn)場(chǎng)取試件件進(jìn)行28天抗壓強(qiáng)強(qiáng)度試驗(yàn)，對(duì)對(duì)混凝土質(zhì)量量進(jìn)行嚴(yán)格的的控制。Mixtureeratiioofconcrretewwillbbemattchedbyteestrooombaasedoontheestreengthofcooncrette,siiteteemperaature,,consstructtionppositiion,pporingg,traansporrtatioon,mooisturreconntentratioo.Whiilepoouringgtheconcrrete,thessampleeshalllbefetchhedattsiteebyTTestRRoom,the228dayyscommpresssivesstrenggthfoortheesamppleshhallbbedonne,anndquaalityofcooncretteshaallbeestriictcoontrollled.2、混凝土施工工難點(diǎn)：Diifficuultiessofcconcreetecoonstruuctionn:本工程設(shè)計(jì)地下下室混凝土為為S8級(
