(3)theconstructionspeedupclaims,itistopointtotheconstructionsitecontractconstructionunitrequirementsthanthestipulationofthecontractperiodahead,orbecauseoftheprecedingstageconstructionperiodbecauseoftheconstructionunitofthecausestimedelay,requestastageaftertheconstructioninthepreviousstageforthedelaytime,makewholeconstructionperiodofthetimelimitprescribedbythecontractfinish.Contractconstructionunitcanforconstructionperiodacceleration,costmorethantheoriginalplanconstructioncostandputforwardaclaimforcompensation.Theclaimshouldbeconsideredoverworksalary,hireadditionallabor,useextraequipment,changetheconstructionmethod,andotherfactors.

(4)theadverseconditionsinthefieldclaim,adverseconditionsinthefieldistopointtocontractandclaimtheconstructiondrawingsandtechnicalstandardanddescribedtheconditionandtheactualsituationofsubstanceisdifferent,orifthecontractnotdescribe,contractconstructionunitunexpected,suchasundergroundhydrological,geologicalconditionsofsomehiddenthegroundconditionoftheunknown,theadverseconditionsinthefieldoftheconstructionunitshallassume.

4,accordingtothecontractclaimclassification,thepurposeoftheclaimforcompensationforlossofchargeandextension,thebasisisintheprovisionsofclauseinthecontract,thecontractbasiscanbedividedintocontractinclaims,contractandmoralclaimtheclaim.

(1)contractinclaims,fromnowonclaimisbasedonthetermsofthecontract,thecontractshallbespecifiedintheclaim.Iftimedelay,engineeringchange,theconstructionunitnotpaymentbondisstipulatedinthecontract,theclaimiscalledthecontractintheclaim.

(2)thecontractclaims,thisclaimishardtodirectlyfromthetermsofthecontractaccordingtofindaclaim,butcanfromthetermsofthecontractthatthereasonableorotherrelevanttermsofconnected,demonstratesthattheclaimisthecontractoftheclaim.Iftheweatherforthelossofinfluencebythecontractingunitshimburden,sospecialabnormalclimateconditions,suchastheworstfloodinginyears,youcanusethetermsofthecontractclaimcompensation.

Four,engineeringconstructionhowshallclaim

Todowellclaim,notonlyhavetogoodatfindingandgraspclaimopportunity,moreimportantistodealwiththeproblemofclaims.

1,submitaclaimletterofintent,foundthatclaimorconsciousnesstoexistclaimopportunity,contractconstructionunitsshalltimelysubmitaclaiminwrittenformofintent.Letterofintenttosubmitaclaimshallincludethefollowingcontents:

(1)thetimingofevents,andconditionsofthesimpledescription;

(2)isthebasisofthecontracttermsandreason;

(3)lawsuitproviderelevantinformation,includingrecordsandprovideeventsdevelopmenttendency;

2,evidencematerialpreparation,claimsuccessdependslargelyonpowerfulproofmaterials,sotoclaimthecontractingunitstomaterialisveryimportant,shouldbereadytothefollowinginformation:

3,writeclaimdocumentmaterial

Writingaclaim:(1)thebasicrequirementsofdocuments,first,mustexplaintheclaimaccordingtothecontract,accordingtoacertainprovisionsofthecontract.

(2)thepreparationoftheclaimdocumentmustbeaccurate

(1)responsibilityshouldbeclearandaccurateanalysis;

(2)thevaluecalculationbasistoclaimrightandthecalculationresultisaccurate.
