tlyforbiddentomaketheoperationbyviolatingtherules.3、甲方應(yīng)當(dāng)建立、健全職業(yè)病防治責(zé)任制度，加強(qiáng)對(duì)職業(yè)病防治的管理，進(jìn)步職業(yè)病防治程度。partyashallsetupandoptimizetheoccupationaldiseasecureresponsibilitysystem,enforcethemanagementovertheoccupationaldiseaseandpromotethecureleveloftheoccupationaldisease.八、教育與培訓(xùn)cationandtraining甲方應(yīng)當(dāng)根據(jù)國(guó)家有關(guān)職業(yè)教育與就業(yè)準(zhǔn)入的有關(guān)規(guī)定以及本單位的實(shí)際情況，為乙方提供職業(yè)教育和技能培訓(xùn)。乙方參加培訓(xùn)應(yīng)按規(guī)定與甲方另行簽訂培訓(xùn)協(xié)議。partyashallprovidepartybwiththeoccupationaleducationandskilltrainingaccordingtotheactualconditionofthepanyandrelevantrulesofthecountryontheoccupationaleducationandpostpermit.partybshallenterintothetrainingagreementwithpartyaadditionallyforthetrainingtaken.九、勞動(dòng)合同的解除、變更、終止ix.revocation,modificationandterminationofthelaborcontract1、甲乙雙方解除、變更、終止、續(xù)訂勞動(dòng)合同應(yīng)當(dāng)按照《勞動(dòng)合同法》和國(guó)家及省、市等有關(guān)規(guī)定執(zhí)行。ifthepartiesrevoke,modify,terminateandextentthelaborcontract,theyshallperformthemaccordingtotherelevantrulesofthelaborcontractlawandthecountry,provinceandcityetc.3、經(jīng)甲乙雙方協(xié)商一致，可變更合同相關(guān)內(nèi)容，變更勞動(dòng)合同，應(yīng)當(dāng)采用書(shū)面形式。afterthemutualconsultationsoftheparties,thecontractmaybemodifiedinwriting.4、乙方符合《勞動(dòng)合同法》第三十九條情形之一者，甲方有權(quán)解除勞動(dòng)合同。ifpartybhasoneofthecircumstancesunderarticle39ofthelaborcontract,partyaisentitledtorevokethelaborcontract.5、乙方要求解除勞動(dòng)合同，應(yīng)當(dāng)提早三十日(試用期內(nèi)提早三日、專(zhuān)業(yè)人員提早六個(gè)月)以書(shū)面形式通知甲方，可以解除勞動(dòng)合同。ifpartybrequirestorevokethelaborcontract,theyshallinformpartyainwritingwiththirty(30)daypre-notice(thepersonunderprobationneedsapre-noticeofthree(3)daysandtheprofessionalpeoplewiththepre-noticeofsixmonths).6、甲方應(yīng)在解除或者終止勞動(dòng)合同時(shí)，為乙方出具解除或者終止勞動(dòng)合同的證明，并在15日內(nèi)為勞動(dòng)者辦理相關(guān)手續(xù)。乙方應(yīng)在甲方出具解除或者終止勞動(dòng)合同的證明后10日內(nèi)辦理工作移交，如涉及經(jīng)濟(jì)補(bǔ)償?shù)陌磭?guó)家有關(guān)規(guī)定在辦結(jié)工作交接時(shí)支付。upontherevocationorterminationofthelaborcontract,partyashallissuethecertificationforrevocationorterminationofthelaborcontracttopartybanddealwiththerelevantformalitiesforthelaborerwithinfifteen(15)days.partybshallmaketheworkhandoverwithinten(10)daysafterissuancebypartyaofthecertificateofrevocationorterminationofthelaborcontract.regardinganyeconomicpensation,theyshallbepaiduponthehandoveroftheworkaccordingtotherulesofthecountry.十、違背勞動(dòng)合同的責(zé)任x.responsibilitiesforviolatingthelaborcontract1、本合同一經(jīng)簽訂，甲乙雙方應(yīng)嚴(yán)格執(zhí)行。任何一方違背規(guī)定解除勞動(dòng)合同的，應(yīng)當(dāng)向?qū)Ψ劫r償因違約造成的經(jīng)濟(jì)損失。oncethecontractisenteredinto,thepartiesshallstrictlyperformit.regardinganypartywhoviolatethelaborcontractandraisetherevocation,theyshallpensatetheotherpartyfortheeconomiclossesarisen.6、乙方違約解除合同，在合同期間〔含轉(zhuǎn)崗〕由甲方出資進(jìn)展職業(yè)技術(shù)或提升培訓(xùn)的，按培訓(xùn)協(xié)議約定向甲方支付違約金；假設(shè)無(wú)培訓(xùn)協(xié)議，按國(guó)家有關(guān)規(guī)定執(zhí)行。regardingpartybwhoviolatesthecontracttorevokesthecontract,duringthecontractterm(includingtheposttransfer),ifpartyainvestsinpartyb’soccupationaltechnologyordevelopmenttraining,partybshallpaythepartybwiththepenaltyaccordingtotheagreement.ifthereisnotrainingagreement,itshallbesubjecttotherelevantrulesofthecountry.3、乙方因違章作業(yè)或?yàn)^職行為給甲方造成損失的，甲方有權(quán)追究乙方賠償責(zé)任，并按違紀(jì)行為給予處理。ifpartybcauseslossestopartyaduetotheoperationviolatingtheruleornegligencebehavior,partyaisentitledtorecoursepartybwiththepensationresponsibilitiesandpunishtheviolatingbehaviors.十一、勞動(dòng)爭(zhēng)議處理及其它xi.labordisputessettlementandmiscellaneous1、甲乙雙方在本合同履行中發(fā)生勞動(dòng)爭(zhēng)議，應(yīng)協(xié)商解決或由本單位工會(huì)組織調(diào)解解決；也可以向所在鎮(zhèn)勞動(dòng)爭(zhēng)議協(xié)調(diào)委員會(huì)申請(qǐng)調(diào)解，調(diào)解不成或不愿調(diào)解的，可向海鹽縣勞動(dòng)爭(zhēng)議仲裁委員會(huì)申請(qǐng)仲裁，對(duì)仲裁裁決不服的，可以向海鹽縣人民法院起訴。regardingthelabordisputesarisenofthepartiesduringtheperformanceofthecontract,theyshallbesolvedthroughconsultationsorintervenedbythetradeunionoftheunitorappliedforthemedicationfromthelabordisputecoordinationmitteeinthetown.regardingthosewhofailtoreachtheagreementorarenotwillingtobeintermediated,theymayfilethearbitrationfromthelabordisputearbitrationmitteefromhanyancountry.regardingthosewhodon’tagreewiththearbitration,theymayfilethelawsuitefromthepeople’scourt.7、乙方不得泄露甲方的商業(yè)和技術(shù)機(jī)密，不得利用甲方的技術(shù)或財(cái)物與別人研制產(chǎn)品。partybshallnotdisclosethemercialandtechnologysecretsofpartybandshallnottakeadvantageofpartya’stechnologyorassetstodeveloptheproductswithothers.3乙方承諾本合同乙方通訊地址為甲方向乙方寄送郵件信函的地址，甲方按該地址寄送的郵件信函如無(wú)法送達(dá)被退回即視為該郵件已送達(dá)乙方。\8、本合同依法訂立即具有法律效力，雙方必須嚴(yán)格履行。本合同未盡事宜或與今后國(guó)家、省有關(guān)規(guī)定相悖的，按有關(guān)規(guī)定執(zhí)行。thecontracthasthelawforceimmediatelyafterbeingexecutedandthepartiesshallperformitstrictlyaccordingly.regardingtheunsettledmattersofthecontractoranythingcontradictedwiththerulesofthecountryortheprovinceinfuture,theyshallbesubjecttotherelevantrules.5、本合同經(jīng)甲、乙雙方簽字或蓋章后生效，并一式二份。甲、乙雙方各執(zhí)一份。thecontractwilleintoforceaftersignatureorsealofthepartiesandbemadeinduplicatewitheachpartyholdingonecopy.甲方〔單位蓋章〕乙方簽
