PAGE2PAGE3法律英語(yǔ)課程教學(xué)大綱EnglishForLegalProfession學(xué)時(shí)數(shù)：32學(xué)分?jǐn)?shù)：2適用專(zhuān)業(yè)：法學(xué)本科I.NatureandObjectives（課程性質(zhì)與目的）LegalEnglishisanoptionalmoduleforstudentsmajoringinlaw.It’sintendedtofulfillthefollowingobjectives:ToenablethestudentstoapplyalltheskillsnecessaryinlanguagelearningtothestudyoflegalEnglish.ToenablethestudentstomasterthebasicvocabularyandspecialstructuresoflegalEnglishandapplytheminasimulatedcourt.Tohelpthestudentshaveanover-allideaofthecommonlawsystem.Todevelopthestudents’abilitytoanalyzesomelegalproblems.II.PrimaryTeachingContents(主要教學(xué)內(nèi)容）Thecontentsofthismodulemainlycoverthegenerallawsandjudicialproceduresundercommonlaw,particularlytheUSlaw.Theprimarycontentsinclude:1.IntroductionTointroducethelawunderAmericanfederalismandthecourtsystemsofUSandUK.TobrieflyintroducetheCommonLawLegalSystemandtheCivilLawLegalSystemandthedifferencesbetweenthem.2.CivilLitigationTolearnandunderstandthebasicprocessesinacivillawsuitundercommonlawandthemaintargetsofeachprocess;TomasterthetwoimportantsystemsinAmericanlaw:theadversarysystemandthejurysystem.3.ConstitutionalLawTolearntheinstitutionsofUSgovernmentandtheseparationofpowersamongthem;Tomasterthebasicrightsofthepeopleundertheconstitution.4.ContractLawTolearnabouttheDefinitionofcontractandthemainsourcesofcontractlaw;Tomastertheformation,performance,breachaofcontractandremediesforbreachofcontract;Tomemorizetheobjectionsofthesellerandthebuyer;tounderstandsomefrequentlyusedexpressionsandlongsentences.5.TortLawTounderstandandmastertheclassificationoftortsandthegeneralinformationaboutthem:intentionaltorts,negligenttortsandstrictliabilitytorts.6.PropertylawTolearnthecategoriesofproperty;Tomastertheownership,transferofownershipandco-ownershipofpersonalpropertyandrealproperty.7.CorporationLawTolearnabouttheformsofcompanies;Togetageneralideaoftheincorporationandmanagementofcompaniesandthemergerandterminationofcompanies.8CommercialpapersTolearnaboutthemainkindsofcommercialpapersfrequentlyusedincommerce;Tounderstandtherightsofholderinduecourse.III.Requirements（能力培養(yǎng)要求）Aftercompletionofthissubject,thestudentsareexpectedto:MasteraconsiderableamountoflegalEnglishvocabularyandthepatternsspecialinlegalEnglish.Improvereadingcomprehensionbymeansofreadingalotafterclass.ExpressideasandopinionsfreelyinEnglishincaseofargumentation.WritereportsandcaseanalysisinEnglish.Role-playjudgesandlawyersandusecourtEnglishfreely.IV.Assignments(習(xí)題)LegalEnglishisasubjectofknowledgeaswellasaskill.It’simportantforthestudentstopractisemoreinordertomastertheskillsandtheknowledge.Therefore,assignmentsforthiscoursewillmainlybeafter-classreadingtasks,case-analysis,translation,role-playsandgroupdiscussion.V.Allocationoftime（課時(shí)分配）序號(hào)內(nèi)容學(xué)時(shí)1Introduction42CivilLitigation63ConstitutionalLaw24ContractLaw45TortLaw46Propertylaw67CorporationLaw48Commercialpapers2合計(jì)32VI.References（教學(xué)參考書(shū)）[1]．董世忠，趙建.法律英語(yǔ)（第二版），法律出版社，2006.[2].何家弘：法律英語(yǔ)（第二版）.法律出版社，2003.[3].齊筠.法律英語(yǔ)教程.北京：高等教育出版社.2005，(4).[4].StephenJudge.BusinessLaw(2ndedn.).北京：法律出版社.2002.[5].David
