2014版安全生產(chǎn)法深度解讀一、明確了立法目的和調(diào)整范圍1、明確立法目的:明確規(guī)定為了加強(qiáng)安全生產(chǎn)工作?預(yù)防和減少生產(chǎn)安全事故?保障人民群眾生命健康和財(cái)產(chǎn)安全?促進(jìn)經(jīng)濟(jì)社會(huì)和諧發(fā)展?根據(jù)憲法?制定本法。2、調(diào)整范圍:,1,刪除了有關(guān)法律、行政法規(guī)對(duì)消防安全和道路交通安全、鐵路交通安全、水上交通安全、民用航空安全另有規(guī)定的?適用其規(guī)定的內(nèi)容。,2,規(guī)定學(xué)校、幼兒園、醫(yī)院、公園等公益性單位的安全生產(chǎn)?參照本法的規(guī)定執(zhí)行。二、完善安全工作方針和機(jī)制1、 關(guān)于安全生產(chǎn)工作方針:將現(xiàn)行法規(guī)定的“安全生產(chǎn)管理?堅(jiān)持安全第一、預(yù)防為主的方針”?修改為如下:安全生產(chǎn)應(yīng)當(dāng)以人為本?堅(jiān)持安全第一、預(yù)防為主、綜合治理的方針?建立政府領(lǐng)導(dǎo)、部門(mén)監(jiān)管、單位負(fù)責(zé)、群眾參與、社會(huì)監(jiān)督的工作機(jī)制。2、 規(guī)范了建設(shè)項(xiàng)目安全設(shè)施設(shè)計(jì)審查的程序規(guī)定高危建設(shè)項(xiàng)目的安全設(shè)施設(shè)計(jì)應(yīng)當(dāng)報(bào)安全生產(chǎn)監(jiān)督管理部門(mén)或者有關(guān)部門(mén)審查同意后方可開(kāi)始施工。審查部門(mén)及其負(fù)責(zé)審查的人員對(duì)審查結(jié)果負(fù)責(zé)。負(fù)責(zé)審查的安全生產(chǎn)監(jiān)督管理部門(mén)或者有關(guān)部門(mén)應(yīng)當(dāng)自收到安全設(shè)施設(shè)計(jì)后四十五日內(nèi)作出審查意見(jiàn)書(shū)?并書(shū)面通知建設(shè)單位。審查不得收取任何費(fèi)用。安全風(fēng)險(xiǎn)較大的建設(shè)項(xiàng)目的安全設(shè)施設(shè)計(jì)應(yīng)當(dāng)報(bào)安全生產(chǎn)監(jiān)督管理部門(mén)或者有關(guān)部門(mén)備案?安全生產(chǎn)監(jiān)督管理部門(mén)或者有關(guān)部門(mén)應(yīng)當(dāng)進(jìn)行抽查。4、 新增了監(jiān)理單位的責(zé)任規(guī)定工程監(jiān)理單位對(duì)高危建設(shè)項(xiàng)目應(yīng)當(dāng)審查施工組織設(shè)計(jì)中的安全技術(shù)措施或者專(zhuān)項(xiàng)施工方案是否符合相關(guān)標(biāo)準(zhǔn)?并對(duì)建設(shè)工程安全生產(chǎn)承擔(dān)監(jiān)理責(zé)任。6、 加強(qiáng)生產(chǎn)經(jīng)營(yíng)單位安全文化建設(shè)生產(chǎn)經(jīng)營(yíng)單位應(yīng)當(dāng)加強(qiáng)安全文化建設(shè)?建立完善安全生產(chǎn)績(jī)效考核獎(jiǎng)懲制度?促進(jìn)從業(yè)人員遵章守紀(jì)。生產(chǎn)經(jīng)營(yíng)單位應(yīng)當(dāng)組織從業(yè)人員每月至少開(kāi)展一次安全生產(chǎn)知識(shí)方面的宣傳教育活動(dòng)?培養(yǎng)從業(yè)人員安全生產(chǎn)意識(shí)、習(xí)慣和技能。安全生產(chǎn)活動(dòng)情況應(yīng)當(dāng)記錄備查。生產(chǎn)經(jīng)營(yíng)單位的車(chē)間,區(qū)隊(duì),應(yīng)當(dāng)每周至少召開(kāi)一次安全會(huì)?分析安全生產(chǎn)情況,班組應(yīng)當(dāng)每日召開(kāi)一次班前會(huì)?并對(duì)所轄作業(yè)區(qū)域至少進(jìn)行一次安全巡查?查明作業(yè)場(chǎng)所和工作崗位可能存在的重大危險(xiǎn)和事故隱患?提出防范和整改措施。車(chē)間,區(qū)隊(duì),安全會(huì)、班組安全巡查情況應(yīng)當(dāng)記錄備查。3、 建立全國(guó)統(tǒng)一的生產(chǎn)安全事故應(yīng)急救援信息系統(tǒng)國(guó)務(wù)院安全生產(chǎn)監(jiān)督管理部門(mén)應(yīng)當(dāng)建立全國(guó)統(tǒng)一的生產(chǎn)安全事故應(yīng)急救援信息系統(tǒng)?國(guó)務(wù)院有關(guān)部門(mén)應(yīng)當(dāng)建立健全相關(guān)專(zhuān)業(yè)的生產(chǎn)安全事故應(yīng)急救援信息系統(tǒng)。縣級(jí)以上地方各級(jí)人民政府應(yīng)當(dāng)建立或者確定本行政區(qū)域統(tǒng)一的生產(chǎn)安全事故應(yīng)急救援信息系統(tǒng)。生產(chǎn)安全事故應(yīng)急救援信息系統(tǒng)應(yīng)當(dāng)與各級(jí)人民政府建立的突發(fā)事件信息系統(tǒng)實(shí)現(xiàn)互聯(lián)互通、信息共享。2、 國(guó)家加強(qiáng)應(yīng)急能力建設(shè)國(guó)家建立礦山、危險(xiǎn)物品、公路交通、鐵路運(yùn)輸、水上搜救、油氣田事故應(yīng)急救援基地和應(yīng)急救援隊(duì)伍?？h級(jí)以上地方各級(jí)人民政府應(yīng)當(dāng)根據(jù)本地區(qū)安全生產(chǎn)的特點(diǎn)?建立或者確定相應(yīng)的專(zhuān)業(yè)應(yīng)急救援隊(duì)伍?并配備必要的設(shè)備、設(shè)施和器材。3、 增設(shè)了生產(chǎn)經(jīng)營(yíng)單位主要負(fù)責(zé)人安全職責(zé)的內(nèi)容生產(chǎn)經(jīng)營(yíng)單位主要負(fù)責(zé)人負(fù)有確定符合條件的分管安全生產(chǎn)的負(fù)責(zé)人、技術(shù)負(fù)責(zé)人?組織開(kāi)展本單位的安全生產(chǎn)教育培訓(xùn)和應(yīng)急演練工作?組織開(kāi)展安全生產(chǎn)標(biāo)準(zhǔn)化建設(shè)?實(shí)施本單位的職業(yè)危害預(yù)防工作?保障從業(yè)人員的職業(yè)健康等職責(zé)?并且應(yīng)當(dāng)每年向職工代表大會(huì)、職工大會(huì)、股東大會(huì)報(bào)告?接受監(jiān)督。2、 新增高危企業(yè)安全生產(chǎn)管理人員資格準(zhǔn)入制度礦山、冶金、軌道交通運(yùn)營(yíng)、道路交通運(yùn)營(yíng)、建筑施工單位?危險(xiǎn)物品的生產(chǎn)、經(jīng)營(yíng)、儲(chǔ)存單位和使用危險(xiǎn)物品從事生產(chǎn)并且使用量達(dá)到規(guī)定數(shù)量的單位的專(zhuān)職安全生產(chǎn)管理人員應(yīng)當(dāng)具有注冊(cè)安全工程師資格和三年以上相應(yīng)工作經(jīng)歷。3、
