中華人民共和國(guó)食品安全法(2021修正)(中英文對(duì)照版)DocumentNumber:OrderNo.81ofthePresidentofthePeople'sRepublicofChinaDateIssued:04-29-2021FoodSafetyLawofthePeople'sRepublicofChina中華人民共和國(guó)食品安全法EleventhNationalPeople'sCongressonFebruary28,2009,and(2009年2月28日第十一屆全revisedatthe14thsessionoftheStandingCommitteeofthe國(guó)人民代表大會(huì)常務(wù)委員會(huì)第七TwelfthNationalPeople'sCongressofthePeople'sRepublicof次會(huì)議通過(guò)2015年4月24日ChinaonApril24,2015;amendedforthefaccordancewiththeDecisionoftheStandingCommitteeoftheNationalPeople'sCongresstoAme第十二屆全國(guó)人民代表大會(huì)常務(wù)委員會(huì)第十四次會(huì)議修訂根據(jù)2018年12月29日第十三屆全atthe7thsessionoftheStandingComm國(guó)人民代表大會(huì)常務(wù)委員會(huì)第七NationalPeople'sCongressonDec次會(huì)議《關(guān)于修改〈中華人民共和國(guó)產(chǎn)品質(zhì)量法〉等五部法律的theStandingCommitteeoftheNationalPeople'sCongressto決定》第一次修正根據(jù)2021年AmendEightLawsincludingtheRoadTrafficSafetyLawofthePeople'sRepublicofChina(includingtheFireProtection4月29日第十三屆全國(guó)人民代表大會(huì)常務(wù)委員會(huì)第二十八次會(huì)AdvertisingLaw,theGrasslandLaw,t議《關(guān)于修改〈中華人民共和國(guó)道路交通安全法〉等八部法律的oftheStandingCommitteeoftheThirteenthNationalPeople'sCongressofthePeople'sRepublicofChinaonApril29,2021.)決定》第二次修正)ChapterIGeneralProvisionsChapterIVFoodProductionandTradeSection2ProductionandTradeProcessContrChapterVIImportandExportofFoodChapterVIIHandlingofFoodSafetyAccidentsprotectthephysicalhealthandlifesafetyofthepublic.Article2ThoseengaginginthefolterritoryofthePeople'sRepublicofChinashallabidebythis(1)Foodproductionandprocessing(hereinafterreferredtoas“foodproduction”)andfoodsalesandcateringservices(hereinafterreferredtoas“foodtrade”).估第六章食品進(jìn)出口第一條為了保證食品安第二條在中華人民共和國(guó)境內(nèi)從事下列活動(dòng),應(yīng)當(dāng)遵守本(一)食品生產(chǎn)和加工(以下稱食品生產(chǎn)),食品銷售和餐飲服務(wù)(以下稱食品經(jīng)營(yíng));(2)Productionofandtradeinfoodadditives.(3)Productionofandtradeinpackingmaterials,containers,equipmentforfoodproductionandtrade(hereinafterreferredtoas“food-relatedproducts”).(4)Useoffoodadditivesandfooproducersandtraders.(5)Storageandtransportoffood.(6)Safetymanagementoffood,foodadditives,andfood-relatedproducts.Thequalityandsafetymanagementofedibleprimarysourcedfromagriculture(hereinafterreferredtoas“ediblefarmproduce”)shallbegovernedbytheFarmProduceQualityandSafetyLawofthePeople'sRepublicofChina.However,themarketingofediblefarmproduce,thedevelopmentofrelevantqualityandsafetystandards,thereleaseofrelevantsafetyinformation,and,asprovidedforbythisLaw,agriculturalinputs,shallbegovernedbytherelevantprovisionsofthisLaw.prevention,riskmanagementimplemented,thewholesocietyshallparticipate,and(二)食品添加劑的生產(chǎn)經(jīng)營(yíng);(三)用于食品的包裝材料、容器、洗滌劑、消毒劑和用于食品生產(chǎn)經(jīng)營(yíng)的工具、設(shè)備(以下稱食品相關(guān)產(chǎn)品)的生產(chǎn)經(jīng)營(yíng);(四)食品生產(chǎn)經(jīng)營(yíng)者使用食品添加劑、食品相關(guān)產(chǎn)品;(五)食品的貯存和運(yùn)輸;(六)對(duì)食品、食品添加劑、食品相關(guān)產(chǎn)品的安全管理。供食用的源于農(nóng)業(yè)的初級(jí)產(chǎn)品(以下稱食用農(nóng)產(chǎn)品)的質(zhì)量安全管理,遵守《中華人民共和國(guó)農(nóng)產(chǎn)品質(zhì)量安全法》的規(guī)定。但是,食用農(nóng)產(chǎn)品的市場(chǎng)銷售、有關(guān)質(zhì)量安全標(biāo)準(zhǔn)的制定、有關(guān)安全信息的公布和本法對(duì)農(nóng)業(yè)投入品作出規(guī)定的,應(yīng)當(dāng)遵守本法的第三條食品安全工作實(shí)行預(yù)防為主、風(fēng)險(xiǎn)管理、全程控制、社會(huì)共治,建立科學(xué)、嚴(yán)格的監(jiān)督管理制度。Article4Foodproducersandtradersshallberesponsiblefor第四條食品生產(chǎn)經(jīng)營(yíng)者對(duì)thesafetyofthefoodwhichtheyproduceordealin.其生產(chǎn)經(jīng)營(yíng)食品的安全負(fù)責(zé)。inaccordancewithlaws,regulations,andfoodsafetystandards,ensurefoodsafety,haveintegrityresponsibilitytothesocietyandthepublic,acceptfromthesociety,andassumesocialresponsibil食品生產(chǎn)經(jīng)營(yíng)者應(yīng)當(dāng)依照法律、法規(guī)和食品安全標(biāo)準(zhǔn)從事生產(chǎn)經(jīng)營(yíng)活動(dòng),保證食品安全,誠(chéng)信自律,對(duì)社會(huì)和公眾負(fù)責(zé),接受社會(huì)監(jiān)督,承擔(dān)社會(huì)責(zé)任。第五條國(guó)務(wù)院設(shè)立食品安全委員會(huì),其職責(zé)由國(guó)務(wù)院規(guī)ThefoodsafetysupervisionandadministrationdepartmentofitsfunctionsprescribedbytheStateCouncassessment,anddevelopandpublisTheotherrelevantdepartmentsoftheStateCouncilshallArticle6Thelocalpeople'sgovernmentsatandaboworkwithintheirrespectiveadministrativeregions,lead,regulatoryworkandtheworkonrespondingtofoodsafetyemergencies,andestablishandimprovethefull-prregulatorymechanismandtheinformationsharinginaccordancewiththisLawandtheprovisions,determinethefunctionsofthefoodsafetysupervisionandadministrationdepartment,thehealththesamelevel.Theaforesaiddepartmentsshallberesponsibleforthefoodsafetyregulatoryworkwithintheadministrativeregionaccordingtotheirrespectivefunctions.townshipsortownsorparticularareas.國(guó)務(wù)院食品安全監(jiān)督管理部門依照本法和國(guó)務(wù)院規(guī)定的職責(zé),對(duì)食品生產(chǎn)經(jīng)營(yíng)活動(dòng)實(shí)施監(jiān)督管國(guó)務(wù)院衛(wèi)生行政部門依照本法和國(guó)務(wù)院規(guī)定的職責(zé),組織開展食品安全風(fēng)險(xiǎn)監(jiān)測(cè)和風(fēng)險(xiǎn)評(píng)估,會(huì)同國(guó)務(wù)院食品安全監(jiān)督管理部門制定并公布食品安全國(guó)家標(biāo)準(zhǔn)。國(guó)務(wù)院其他有關(guān)部門依照本法和國(guó)務(wù)院規(guī)定的職責(zé),承擔(dān)有關(guān)食第六條縣級(jí)以上地方人民政府對(duì)本行政區(qū)域的食品安全監(jiān)督管理工作負(fù)責(zé),統(tǒng)一領(lǐng)導(dǎo)、組織、協(xié)調(diào)本行政區(qū)域的食品安全監(jiān)督管理工作以及食品安全突發(fā)事件應(yīng)對(duì)工作,建立健全食品安全全程監(jiān)督管理工作機(jī)制和信息縣級(jí)以上地方人民政府依照本法和國(guó)務(wù)院的規(guī)定,確定本級(jí)食品安全監(jiān)督管理、衛(wèi)生行政部門和其他有關(guān)部門的職責(zé)。有關(guān)部門在各自職責(zé)范圍內(nèi)負(fù)責(zé)本行政區(qū)域的食品安全監(jiān)督管理工作??h級(jí)人民政府食品安全監(jiān)督管理部門可以在鄉(xiāng)鎮(zhèn)或者特定區(qū)域設(shè)Article7Thelocalpe第七條縣級(jí)以上地方人民政府實(shí)行食品安全監(jiān)督管理責(zé)任safetysupervisionand制。上級(jí)人民政府負(fù)責(zé)對(duì)下一級(jí)人民政府的食品安全監(jiān)督管理工safetyregulatoryworkofthepeople'sg作進(jìn)行評(píng)議、考核??h級(jí)以上地foodsafetysupervisionandadministrationdepartmenta方人民政府負(fù)責(zé)對(duì)本級(jí)食品安全監(jiān)督管理部門和其他有關(guān)部門的workfundinginitsfiscalbudgets,strengthenthebuildingoffoodsafetyregulatorycapability,andprovidesafeguardsfortheotherrelevantdepartmentsofapeople'sgovernmentatorabovecooperatewitheachother,andexercisepoweresponsibilityaccordingtothedivisionoffunctions.self-regulation,establishandimproveindustrynormsandpunishmentandrewardmechanrespectivearticlesofassociation,providefoodsupervisefoodproducersandtradersipublicizeanddisseminatefoodsafetyknowledge.Consumers'associationsandotherconsumers'organizationsshall,accordingtothelaw,conductsocialsupervisionagainstandinterestsofconsumers.foodsafetyknowledge,encouragesocialgroups,basic-leveltodisseminatefoodsafetylaws,regulations,standards,andknowledge,advocatehealthydietstyles,andenhanceNewsmediashallpublicizefoodsafetylaws,regulations,standards,andknowledgefpublicopinion,conductsupervisioninrespectofillegalactivitiesrelatedtofoodsafety.Newsreports食品安全監(jiān)督管理工作進(jìn)行評(píng)應(yīng)當(dāng)將食品安全工作納入本級(jí)國(guó)民經(jīng)濟(jì)和社會(huì)發(fā)展規(guī)劃,將食品預(yù)算,加強(qiáng)食品安全監(jiān)督管理能力建設(shè),為食品安全工作提供保縣級(jí)以上人民政府食品安全監(jiān)督管理部門和其他有關(guān)部門應(yīng)當(dāng)加強(qiáng)溝通、密切配合,按照各自職責(zé)分工,依法行使職權(quán),承擔(dān)責(zé)第九條食品行業(yè)協(xié)會(huì)應(yīng)當(dāng)加強(qiáng)行業(yè)自律,按照章程建立健全行業(yè)規(guī)范和獎(jiǎng)懲機(jī)制,提供食品安全信息、技術(shù)等服務(wù),引導(dǎo)和督促食品生產(chǎn)經(jīng)營(yíng)者依法生產(chǎn)經(jīng)營(yíng),推動(dòng)行業(yè)誠(chéng)信建設(shè),宣違反本法規(guī)定,損害消費(fèi)者合法權(quán)益的行為,依法進(jìn)行社會(huì)監(jiān)第十條各級(jí)人民政府應(yīng)當(dāng)加強(qiáng)食品安全的宣傳教育,普及食品安全知識(shí),鼓勵(lì)社會(huì)組織、基層群眾性自治組織、食品生產(chǎn)經(jīng)營(yíng)者開展食品安全法律、法規(guī)以及食品安全標(biāo)準(zhǔn)和知識(shí)的普及工作,倡導(dǎo)健康的飲食方式,增強(qiáng)消費(fèi)者食品安全意識(shí)和自我保新聞媒體應(yīng)當(dāng)開展食品安全法律、法規(guī)以及食品安全標(biāo)準(zhǔn)和知識(shí)的公益宣傳,并對(duì)食品安全違法行為進(jìn)行輿論監(jiān)督。有關(guān)食品relatedbasicresearchandapplicationresearch,andencourageandsupporttheadoptionofadvancedtechnologiesandadvancedmanagementnormsbyfThestateshallapplyrigidmanagementrulestotheuseofpesticides,acceleratetheeliminationofextreme-toxic,high-toxic,andhigh-persistentpesticides,promotetheresearch,development,andapplicationofsubstituteproducts,andencouragetheuseofefficient,low-toxic,andlow-persistentpesticides.safetyinformationfromtherelevantdepartmentsfoodsafetyregulatorywork.rewardedinaccordancewiththerelevantstateprovisions.monitoringsystemtomonitorfood-bornediseases,foodinconjunctionwiththefoodsafetysuadministrationdepartmentandtheotherrelevariskmonitoringplan.安全的宣傳報(bào)道應(yīng)當(dāng)真實(shí)、公第十一條國(guó)家鼓勵(lì)和支持開展與食品安全有關(guān)的基礎(chǔ)研究、應(yīng)用研究,鼓勵(lì)和支持食品生產(chǎn)經(jīng)營(yíng)者為提高食品安全水平采用先進(jìn)技術(shù)和先進(jìn)管理規(guī)范。國(guó)家對(duì)農(nóng)藥的使用實(shí)行嚴(yán)格的管理制度,加快淘汰劇毒、高毒、高殘留農(nóng)藥,推動(dòng)替代產(chǎn)品的研發(fā)和應(yīng)用,鼓勵(lì)使用高效低毒低第十二條任何組織或者個(gè)人有權(quán)舉報(bào)食品安全違法行為,依法向有關(guān)部門了解食品安全信息,對(duì)食品安全監(jiān)督管理工作提第十三條對(duì)在食品安全工作中做出突出貢獻(xiàn)的單位和個(gè)人,按照國(guó)家有關(guān)規(guī)定給予表彰、獎(jiǎng)勵(lì)。第二章食品安全風(fēng)險(xiǎn)監(jiān)測(cè)和評(píng)估第十四條國(guó)家建立食品安全風(fēng)險(xiǎn)監(jiān)測(cè)制度,對(duì)食源性疾病、食品污染以及食品中的有害國(guó)務(wù)院衛(wèi)生行政部門會(huì)同國(guó)務(wù)院食品安全監(jiān)督管理等部門,制定、實(shí)施國(guó)家食品安全風(fēng)險(xiǎn)監(jiān)測(cè)Afterobtainingtherelevantfoodsafetyriskinformation,the國(guó)務(wù)院食品安全監(jiān)督管理部門和foodsafetysupervisionandadministrationdepa其他有關(guān)部門獲知有關(guān)食品安全otherrelevantdepartmentoftheStateCouncil風(fēng)險(xiǎn)信息后,應(yīng)當(dāng)立即核實(shí)并向immediatelyverifyitandnotifythehealthadministrative國(guó)務(wù)院衛(wèi)生行政部門通報(bào)。對(duì)有關(guān)部門通報(bào)的食品安全風(fēng)險(xiǎn)信息informationinthenotificationfromtherelevantdepartments以及醫(yī)療機(jī)構(gòu)報(bào)告的食源性疾病andtheinformationreportedbymedicalinstitutionsonfood-等有關(guān)疾病信息,國(guó)務(wù)院衛(wèi)生行borneandotherdiseases,thehealthadministrativedepartment政部門應(yīng)當(dāng)會(huì)同國(guó)務(wù)院有關(guān)部門分析研究,認(rèn)為必要的,及時(shí)調(diào)conjunctionwiththerelevantdepartmentsoftheStatemonitoringplaninatimelymanner.整國(guó)家食品安全風(fēng)險(xiǎn)監(jiān)測(cè)計(jì)劃。Thehealthadministrativedepartmentofthepeople'sgovernmentofaprovince,autonomousregion,ormunicipality省、自治區(qū)、直轄市人民政府衛(wèi)生行政部門會(huì)同同級(jí)食品安全監(jiān)督管理等部門,根據(jù)國(guó)家食品安andotherrelevantdepartmentsatt全風(fēng)險(xiǎn)監(jiān)測(cè)計(jì)劃,結(jié)合本行政區(qū)adjustthefoodsafetyriskmonitoringplanfort域的具體情況,制定、調(diào)整本行administrativeregioninviewofthespecificcircumstancesof政區(qū)域的食品安全風(fēng)險(xiǎn)監(jiān)測(cè)方theadministrativeregion,andreporttheplant案,報(bào)國(guó)務(wù)院衛(wèi)生行政部門備案administrativedepartmentoftheStateCouncilforbeforeimplementation.Article15Technicalinstitutionsundertakingfoodsafetyriskmonitoringworkshallconductothefoodsafet ,對(duì)食品安全國(guó)家標(biāo)準(zhǔn)草案的科學(xué)性和實(shí)用性等第二十九條對(duì)地方特色食品,沒(méi)有食品安全國(guó)家標(biāo)準(zhǔn)的,省、自治區(qū)、直轄市人民政府衛(wèi)生行政部門可以制定并公布食品安全地方標(biāo)準(zhǔn),報(bào)國(guó)務(wù)院衛(wèi)生行政部門備案。食品安全國(guó)家標(biāo)準(zhǔn)制定后,該地方標(biāo)準(zhǔn)即行廢止。第三十條國(guó)家鼓勵(lì)食品生產(chǎn)企業(yè)制定嚴(yán)于食品安全國(guó)家標(biāo)準(zhǔn)或者地方標(biāo)準(zhǔn)的企業(yè)標(biāo)準(zhǔn),在本企業(yè)適用,并報(bào)省、自治區(qū)、直轄市人民政府衛(wèi)生行政部門備第三十一條省級(jí)以上人民政府衛(wèi)生行政部門應(yīng)當(dāng)在其網(wǎng)站上公布制定和備案的食品安全國(guó)家標(biāo)準(zhǔn)、地方標(biāo)準(zhǔn)和企業(yè)標(biāo)準(zhǔn),對(duì)食品安全標(biāo)準(zhǔn)執(zhí)行過(guò)程中的問(wèn)題,縣級(jí)以上人民政府衛(wèi)生行政部門應(yīng)當(dāng)會(huì)同有關(guān)部門及時(shí)給予Article32Thehealthadministrativedgovernmentatoradministration,agricultural,andotheradministrative第三十二條省級(jí)以上人民政府衛(wèi)生行政部門應(yīng)當(dāng)會(huì)同同級(jí)食品安全監(jiān)督管理、農(nóng)業(yè)行政等部門,分別對(duì)食品安全國(guó)家標(biāo)準(zhǔn)foodsafetystandardsrespectivelyand,onthebasisoftheevaluationresults,revisefoodsafetystandardsinatimelymanner.和地方標(biāo)準(zhǔn)的執(zhí)行情況進(jìn)行跟蹤評(píng)價(jià),并根據(jù)評(píng)價(jià)結(jié)果及時(shí)修訂Thefoodsafetysupervisionandadministration,agricuandotheradministrativedepartmentsissuesexistingiand,inatimelymanner,notifythehealthadministrativedepartmentatthesamelevelofsuchissues.immediatelyreportissuesdiscoveredintheimplemprocessing,packaging,andstorage,amongothers,suitableforthevarietiesandquantitiesofthefoodwhichitproducesordealsin,keeptheenvironmentoftheseplacestidyandclean,toxicandhazardoussitesandotherpollutionssuitableforthevarietiesandquantitiesofthefoodwhichitfacilitiesfordisinfection,changingillumination,ventilation,anti-corrosion,anti-dust,anti-fly,ratproof,mothproof,washing,disposalofwastewater,andstorageofgarbageandwaste.省級(jí)以上人民政府食品安全監(jiān)督管理、農(nóng)業(yè)行政等部門應(yīng)當(dāng)對(duì)食品安全標(biāo)準(zhǔn)執(zhí)行中存在的問(wèn)題進(jìn)行收集、匯總,并及時(shí)向同級(jí)衛(wèi)生行政部門通報(bào)。食品生產(chǎn)經(jīng)營(yíng)者、食品行業(yè)協(xié)會(huì)發(fā)現(xiàn)食品安全標(biāo)準(zhǔn)在執(zhí)行中存在問(wèn)題的,應(yīng)當(dāng)立即向衛(wèi)生行政部第四章食品生產(chǎn)經(jīng)營(yíng)第一節(jié)一般規(guī)定第三十三條食品生產(chǎn)經(jīng)營(yíng)應(yīng)當(dāng)符合食品安全標(biāo)準(zhǔn),并符合(一)具有與生產(chǎn)經(jīng)營(yíng)的食品品種、數(shù)量相適應(yīng)的食品原料處理和食品加工、包裝、貯存等場(chǎng)所,保持該場(chǎng)所環(huán)境整潔,并與有毒、有害場(chǎng)所以及其他污染源(二)具有與生產(chǎn)經(jīng)營(yíng)的食品品種、數(shù)量相適應(yīng)的生產(chǎn)經(jīng)營(yíng)設(shè)備或者設(shè)施,有相應(yīng)的消毒、更衣、盥洗、采光、照明、通風(fēng)、防腐、防塵、防蠅、防鼠、防蟲、洗滌以及處理廢水、存放垃(三)有專職或者兼職的食品安全專業(yè)技術(shù)人員、食品安全管理人員和保證食品安全的規(guī)章制(四)具有合理的設(shè)備布局和工flowcharttopreventcrosspollutionbetweenthefoodtobe藝流程,防止待加工食品與直接processedandready-to-eatfoodandbetweenrawmaterialsand入口食品、原料與成品交叉污染,避免食品接觸有毒物、不潔substancesoruncleanitems.(5)Cutlery,drinkingsets,andcontainersforread(五)餐具、飲具和盛放直接入shallbewashedcleananddisinfectedpriortouse,and口食品的容器,使用前應(yīng)當(dāng)洗凈、消毒,炊具、用具用后應(yīng)當(dāng)keptclean.(六)貯存、運(yùn)輸和裝卸食品的(6)Containers,tools,andeq容器、工具和設(shè)備應(yīng)當(dāng)安全、無(wú)loading,andunloadingfoodshallbesafe,innocuous,andkepttemperature,moisture,andotherspecialrequirementsforfoodharmfulitems.并符合保證食品安全所需的溫度、濕度等特殊要求,不得將食(7)Innocuousandcleanpackingmaterials,cutlery,drinkingsets,andcontainersshallbeusedforready(七)直接入口的食品應(yīng)當(dāng)使用(八)食品生產(chǎn)經(jīng)營(yíng)人員應(yīng)當(dāng)保maintainpersonalhygiene,washtheirhandsclean,andwearcleanworkclothesandhatsintheprocessofproductionorandequipmentinthesaleofunpackedready-to-eatfood.應(yīng)當(dāng)將手洗凈,穿戴清潔的工作衣、帽等;銷售無(wú)包裝的直接入口食品時(shí),應(yīng)當(dāng)使用無(wú)毒、清潔(9)Thewaterusedshallbeincompliancewiththehygiene(九)用水應(yīng)當(dāng)符合國(guó)家規(guī)定的standardsfordrinkingwaterofthestate.(10)Thedetergentsanddisinf(11)Otherrequirementsasprescribedbyanylaworregulation.(十)使用的洗滌劑、消毒劑應(yīng)(十一)法律、法規(guī)規(guī)定的其他transportation,loading,andunloadingoffoodshallcomplywiththeprovisionofitem(6)oftheprecedingparagraph.Article34Thefollowingfood,foodadditives,andfood-relatedproductsshallbeprohibitedfromproductionandtrade:(1)Foodproducedwithnon-foodrawmaterials,foodtowhichanynon-foodadditivechemicalorotherhazardoustohumanhealthisadded,orfoodproducedwithrecycledfoodasrawmaterials.(2)Food,foodadditives,andfood-relatedproductsinwhichpathogenicmicroorganisms,pollutantssuchaspesticideresidues,veterinarymedicineresidues,biotoxins,andheavymetals,andothersubstan(4)Foodusingfoodadditivesbeyondtheapprovedscopeorotherparticulargroupsofpeopleinwhichthenutrientspoiledbyrancidoilorfat,moldy,contaminatedanddirty,mixedwithforeignobjects,adulteratedandimpure,orabnormalin非食品生產(chǎn)經(jīng)營(yíng)者從事食品貯存、運(yùn)輸和裝卸的,應(yīng)當(dāng)符合前第三十四條禁止生產(chǎn)經(jīng)營(yíng)下列食品、食品添加劑、食品相(一)用非食品原料生產(chǎn)的食品或者添加食品添加劑以外的化學(xué)物質(zhì)和其他可能危害人體健康物質(zhì)的食品,或者用回收食品作為(二)致病性微生物,農(nóng)藥殘留、獸藥殘留、生物毒素、重金屬等污染物質(zhì)以及其他危害人體健康的物質(zhì)含量超過(guò)食品安全標(biāo)準(zhǔn)限量的食品、食品添加劑、食(三)用超過(guò)保質(zhì)期的食品原料、食品添加劑生產(chǎn)的食品、食(四)超范圍、超限量使用食品(五)營(yíng)養(yǎng)成分不符合食品安全標(biāo)準(zhǔn)的專供嬰幼兒和其他特定人(六)腐敗變質(zhì)、油脂酸敗、霉變生蟲、污穢不潔、混有異物、摻假摻雜或者感官性狀異常的食(7)Meatofpoultry,livestock,beasts,andaquaticanimalsthat(七)病死、毒死或者死因不明diedfromdisease,poisoning,orunknowncausesandthe的禽、畜、獸、水產(chǎn)動(dòng)物肉類及productsmadethereof.failedquarantineormea(八)未按規(guī)定進(jìn)行檢疫或者檢疫不合格的肉類,或者未經(jīng)檢驗(yàn)containers,ormeansoftransport.(10)Foodandfoodadditiveswitshelflifeorwhoseshelf-lifehasexpired.tradefordiseasepreventionandotherspecialneed(13)Otherfood,foodadditivproductionandtrade.Whoeverengagesinfoodproductionorwiththelaw.However,apermitisnotredibleagriculturalproductsandpdepartmentofthelocalpeople'sgovernmentatorabovethecountylevelforrecordaaccordancewiththeAdministrativeLicensingLawofthePeople'sRepublicofChina,examinetherelevantmaterialsArticle33ofthisLaw,andifnecessary,conductanon-siteinspectionoftheapplicant'splaceforproductionortrade.Iftheapplicantmeetstheprescribgranted;oriftheapplicantdoesnotmeettheprescribedthefoodsafetyrequirementsofthisLawsuitableforitsproductionortradescaleandconditions,andensurethatthefoodwhichitproducesordealsinishygienic,nontoxic,and(九)被包裝材料、容器、運(yùn)輸工具等污染的食品、食品添加(十)標(biāo)注虛假生產(chǎn)日期、保質(zhì)期或者超過(guò)保質(zhì)期的食品、食品(十一)無(wú)標(biāo)簽的預(yù)包裝食品、(十二)國(guó)家為防病等特殊需要(十三)其他不符合法律、法規(guī)或者食品安全標(biāo)準(zhǔn)的食品、食品第三十五條國(guó)家對(duì)食品生產(chǎn)經(jīng)營(yíng)實(shí)行許可制度。從事食品生產(chǎn)、食品銷售、餐飲服務(wù),應(yīng)當(dāng)依法取得許可。但是,銷售食用農(nóng)產(chǎn)品和僅銷售預(yù)包裝食品的,不需要取得許可。僅銷售預(yù)包裝食品的,應(yīng)當(dāng)報(bào)所在地縣級(jí)以上地方人民政府食品安全監(jiān)督縣級(jí)以上地方人民政府食品安全監(jiān)督管理部門應(yīng)當(dāng)依照《中華人民共和國(guó)行政許可法》的規(guī)定,審核申請(qǐng)人提交的本法第三十三條第一款第一項(xiàng)至第四項(xiàng)規(guī)定要求的相關(guān)資料,必要時(shí)對(duì)申請(qǐng)人的生產(chǎn)經(jīng)營(yíng)場(chǎng)所進(jìn)行現(xiàn)場(chǎng)核查;對(duì)符合規(guī)定條件的,準(zhǔn)予許可;對(duì)不符合規(guī)定條件的,不予許可第三十六條食品生產(chǎn)加工小作坊和食品攤販等從事食品生產(chǎn)經(jīng)營(yíng)活動(dòng),應(yīng)當(dāng)符合本法規(guī)定的與其生產(chǎn)經(jīng)營(yíng)規(guī)模、條件相適innocuous.Thefoodsafetysupervisionandofthem.shallputsmallfoodproductionorprocessingworkshopsandfoodvendorsundercomprehenandunifiedplanning,improvetheproductionandtradeenvironmentofthem,andencourageandsupporttheirimprovementofproductionandtradeconditionsawithinthespecifiedtemporarybusinessar
