iorvaluewithrespecttothoseexpected,thereimbursementwillbeastandardofvalueequaltothedifference.如果在發(fā)團(tuán)之后，無論任何原因，組織者發(fā)現(xiàn)無法提供書面合同所約定的主要服務(wù)部分，必須在不增加當(dāng)事方費(fèi)用的條件下提出變更方案。如果提供的服務(wù)價(jià)值將低于預(yù)期的話，應(yīng)給予差價(jià)補(bǔ)償。Ifthereotheralternativesolutionsarenotpossible,oriftheproposedsolutionbytheorganizerisrefusedbytheconsumerforseriousandjustifiedreasons,theorganizerwillprovidewithoutadditionalchargesameansoftransportationequivalenttothemeansoftransportationoriginallyexpectedforthereturntothelocationofdepartureortoadifferentlocationeventuallyagreeduponcompatiblywiththeavailabilityofthegivenmeansoftransportandavailableseating/spaceandtheywillberefundedforthedifferenceofthecostoftheservicesprovidedandthoseoftheservicescarriedoutfromthemomentofadvancedre-entry如果其他變更的方案不可行，或者因嚴(yán)重和正當(dāng)?shù)脑虮幌M(fèi)者所拒絕，組織者應(yīng)以原先所預(yù)期的交通方式將消費(fèi)者送回出發(fā)地點(diǎn)，或者最終協(xié)商的其他地點(diǎn)，為其提供交通方式和座位/艙位，并返還消費(fèi)者已經(jīng)支付的服務(wù)費(fèi)用與返回時(shí)已給予了的服務(wù)所用費(fèi)用之間的差價(jià)。11.SUBSTITUTIONS合同當(dāng)事方的替代人Therenouncingclientcanbesubstitutedbyanotherpersonprovidedthat:明示放棄合同的當(dāng)事方可以由其他人替代。只要替代人符合以下條件：a.)Theorganizerisinformedinwritingatleast4workingdaysbeforethefixeddateofdeparture,receivingcontextuallycommunicationregardingthegeneralitiesofthetransfereeassignee;組織者在約定啟程前至少提前4個(gè)工作日得到書面通知，并接到有關(guān)受讓方的的一般情況的常規(guī)通報(bào)。b.)Thes?ubstitutesatisfiesalltheconditionsforthefruitionoftheservice(exart.89Cod.Cons.)andinparticulartheprerequisitesrelativetopassport,visaandhealthcertificates;替代方應(yīng)符合接受服務(wù)的條件，如：消費(fèi)者法第89條(art.89Cod.Cons.)之規(guī)定，特別是有必需的護(hù)照、簽證和健康證明。12.OBLIGATIONSOFTHEPARTICIPANTS參團(tuán)人員的義務(wù)Theparticipantsmusthavean(individualorpersonal)passportorotherdocumentationvalidforallthecountriesinthecontentsoftheitinerary,aswellasavisaoftransportationandhealthcertificatesthatwillberequested.TheparticipantsmustadheretotherulesofprudenceandcautionandtothoserulesthelawsenforcedwithintheItalianterritory,toalltheinformationprovidedtothembytheorganizer,andtotherulesandadministrativeandlegislativeprovisionsrelativetothetourismpackage.參團(tuán)人員必須持有個(gè)人護(hù)照或旅行路線上各個(gè)國家都有效的其他證件，以及旅行簽證和必需的健康證明。參團(tuán)人員必須審慎遵守規(guī)定，遵守意大利境內(nèi)實(shí)施的法律法規(guī)，依從組織者提供給他們的所有信息以及涉及團(tuán)隊(duì)旅游的規(guī)章、行政法令和其他立法。13.HOTELCLASSIFICATION酒店的等級TheofficialclassificationofthehotelsareprovidedbytheprogramwithinformativematerialbasedontheexplicitandformalindicationsbycompetentauthorityoftheProvinceofArezzo.Theorganizerreservestherighttoprovideintheprogramortouristbrochureapersonaldescriptionoftheaccommodationstructure,sotopermitanevaluationandconsequentacceptanceonbehalfoftheconsumer.酒店的等級是在日程中根據(jù)Arezzo省主管當(dāng)局的明文正式規(guī)定在通報(bào)資料中提供的。組織者有權(quán)在日程中或者旅游宣傳冊中做自己的描述，因此也允許代表消費(fèi)者做評估和接受。14.SYSTEMOFRESPONSIBILITY責(zé)任劃分Theorganizerisresponsiblefordamagescausedtotheconsumerduetopartialortotalnon-fulfilmentofthecontractualservicesdue,bothifthesearecausedbyhimorbythirdpartyserviceproviders,unlessprovedbytheconsumer(therewithinitiativeindependentlytakenuponthemselvesinthecourseofthetouristservices)orbyextraneouscircumstancestotheservicesprovidedinthecontract,afortuitousevent,circumstancesbeyondone’scontrolorcircumstancesthattheorganizercouldnot,inaccordancewithstandardprofessionalism,reasonablyforeseeorresolve.組織者要對由于自己未能部分或者全部履行合同服務(wù)而給消費(fèi)者造成的傷害負(fù)責(zé)，包括這些傷害是組織者或者第三方服務(wù)提供者的責(zé)任，除非能夠證明是消費(fèi)者在旅游過程中自己造成的，或者是合同履行過程中外來因素、偶然事件、無法控制的因素、或者是由于組織者無法根據(jù)職業(yè)規(guī)范標(biāo)準(zhǔn)合理預(yù)見和解決的原因造成的。Thevendoratthelocationofwherethereservationwasmadeofthetourismpackageisnotresponsibleinanycaseoftheobligationsthatarisefromtheorganizationofthetrip,butisresponsibleexclusivelyfortheobligationsthatariseregardingtheintermediary’squalitiesandwithinthelimitsofresponsibilityoftheregulationsinforceonthesubject.在旅游團(tuán)隊(duì)所預(yù)定的場所的客戶不對旅途中組織所發(fā)生的任何事件負(fù)責(zé)，但要對組織質(zhì)量承擔(dān)完全義務(wù)，其責(zé)任限于對該事件的強(qiáng)制性規(guī)定。15.LIMITSOFCOMPENSATION賠償標(biāo)準(zhǔn)CompensationfordamagestothepersoncannotexceedtheforeseenlimitsbytheinternationalconventionsforwhichItalyandtheEuropeanUnionarepartofwithreferencetotheserviceswhoseperformancehasdeterminedtheresponsability.Inanycasethecompensationlimitcannotexceedtheamountof50,000Eurofordamagestopeople,2,000Eurofordamagestoobjects,5000Euroforanyotherdamage.對人身的傷害賠償，根據(jù)意大利和歐盟所參與的國際公約，不超過可預(yù)見的范圍，參照服務(wù)的履行而定責(zé)任。無論任何情況下，對人身的傷害賠償不超過5萬歐元；對財(cái)物的損失不超過2千歐元；其他賠償不超過5千歐元。16.OBLIGATIONSOFASSISTENCE組織者的協(xié)助義務(wù)Theorganizerisresponsibletoprovidethemeasureofassistancetotheconsumerthatisimposedbythecriteriaoftheprofessionalstandardexclusivelyinreferencetotheobligationsofhis/herjobundertheprovisionsofthelaworcontract.Theorganizerandthevendorareexoneratedfromtherespectiveresponsibilities.(art.14and15oftheseGeneralConditions)whenthemissingorinexactcarryingoutofthecontractischargeabletotheconsumerorisdependentonathirdpartyinanunforeseeableorinevitableway,orinthecaseoffortuitouseventorcircumstancesbeyondone’scontrol.組織者應(yīng)根據(jù)法律和合同所規(guī)定的職責(zé)，按照
