二、雇傭內容及工作時間

三、報酬及其他福利

試用期過后，甲方為乙方提供住房補助￥元/月（伍千元人民幣每月），甲方憑乙方出具的租房發(fā)票報銷，報銷時間在每月的8號。如遇節(jié)假日或休息日，應提前到最近的工作日支付，如因特殊原因延期支付報酬的，甲方應在五個工作日內向乙方說明原因。

Aftertheprobation,PartyAshallprovidePartyBwithamonthlyhousingallowanceofRMB5,.PartyAshallprovidetheinvoiceofrentpaymentforreimbursement.Themonthlydateforreimbursementisonthe8thdayofeachmonth.Ifthe8thdayofthemonthfallsintheweekendorholiday,thepaymentshallbebroughtforwardtothenearestweekday.PartyAshallinformPartyBandexplainthedetailedreasonwithin5workdaysincasePartyAfailstopaythesalaryduetospecialreasons.

甲方應于每月8號以貨幣或轉帳形式足額支付乙方上述報酬。如遇節(jié)假日或休息日，應提前到最近的工作日支付，如因特殊原因延期支付報酬的，甲方應在五個工作日內向乙方說明原因。

甲方可根據(jù)生產(chǎn)經(jīng)營的狀況或乙方任務量和工作表現(xiàn)，適時調整乙方的報酬。

當乙方的工作任務發(fā)生變化時，甲方可按規(guī)定調整其相應的報酬。乙方接受新的工作任務后，即視作接受甲方按照該工作任務重新確定的報酬。

乙方應遵守國家及地方的稅法制度，自行繳納其個人收入的個人所得稅，甲方無義務為其代繳。

乙方在合同期內享受中國法律規(guī)定的節(jié)日，公休假日，另外公司每年為其提供5天的帶薪休假。

PartyBisentitledwithalllegalholidaysinaccordancewiththestate’sregulations,Inaddition,PartyBenjoysapaidleaveof5dayseachyear.

四、雇傭合同的解除和終止

ⅣContractCancellationandTermination

合同期滿雙方不再續(xù)簽或者雙方約定的合同終止條件出現(xiàn)時，雇傭合同即終止。

Thiscontractshallbeterminatedonceitexpiresandbothpartiesdonotextendthecontract.

經(jīng)合同雙方當事人協(xié)商一致，本合同可以解除。

Thecontractmaybecanceledbasedonbothparties’mutualnegotiation.

乙方應遵守中國的法律、法規(guī)及有關規(guī)定，乙方如違反上述規(guī)定，甲方有權即時解除合同；乙方因健康原因，經(jīng)醫(yī)生證明連續(xù)病休15工作日后仍不能繼續(xù)工作，甲方有權提前終止合同。

PartyBshouldabidebyChinalaws,decreesandrelatedregulationsandPartyA’sworkingsystems.Duringtheduration,PartyAisentitledtocancelthecontractincasePartyBviolatesChinalawsanddecrees,andterminatethecontractbeforeexpirationincasePartyBcannotresumehisorherworkforhealthreasonsafterthemedicalcertificationofcontinuoussickrestfor15workingdays.

乙方因歸國或其他私人原因未正常出勤且超過十天且未向甲方做出書面說明的，本合同自動終止。ThecontractwillautomaticallyterminateincasePartyBisabsentforover10dayswithoutwrittenexplanationduetohomecomingorotherprivatereasons.

乙方被證明無法完成本合同項下的工作任務，甲方有權隨時解除本合同。

IncasePartyBisprovedtobenotcompetentfortheworkunderthecontract,PartyAisentitledtocancelthecontractatanytime.

乙方應嚴格遵守甲方的工作規(guī)定以及規(guī)章制度，盡職盡責，否則，甲方有權隨時解除合同并追究因此而造成的經(jīng)濟損失，并有權對所造成的經(jīng)濟損失在乙方的報酬中作相應扣除。

PartyBshouldabidebyPartyA’sworkingsystems,rulesandregulations.Otherwise,PartyAisentitledtocancelthecontractandclaimacorrespondingcompensationofanyeconomiclossfromPartyB’spayment.

乙方有權提前30日以書面形式通知甲方解除本合同，在試用期內提前3日通知甲方即可解除。

PartyBshouldinformPartyAinwrittenform30daysinadvanceforcancelingthecontract,and3daysinadvanceduringtheprobationperiod.

五、其他事項

ⅤOthers

其他未盡事宜，雙方可參照甲方公司內部的相關規(guī)章制度執(zhí)行。

OtheritemsnotstipulatedbythetwopartiescanbeimplementedaccordingtotheinternalrulesandregulationsofPartyA.

甲乙雙方均應遵守本合同之約定，任何一方違約，非違約方均有權要求違約方承擔相應的損失。

Thetwopartiesshouldabidebythecontract.Incaseonepartytearsupthecontract,theotherpartyhastherighttorequirethedefaultingpartytoundertakecorrespondingloss.

甲乙雙方在本合同的執(zhí)行中如有爭議，可協(xié)商解決。

本合同分為中英兩種文本，每種文本具有相同的法律效力；如兩種文本產(chǎn)生沖突，則中文文本為作準文本。

ThecontracthastwoversionsinChineseandinEnglish.Thetwocopiesareequallyauthentic.Incaseanydisputehappens,theChineseversionshallprevail.

本合同一式兩份，甲、乙雙方各執(zhí)一份，每份具有同等法律效力。本合同經(jīng)甲、乙雙方簽字蓋章后生效。
