華泰財(cái)險(xiǎn)附加外國(guó)實(shí)體損失條款（CB-H版）

1、對(duì)于每一項(xiàng)承保損失，在其價(jià)值已向保險(xiǎn)人申報(bào)且相應(yīng)的保險(xiǎn)a）等于外國(guó)實(shí)體損失（如果發(fā)生外國(guó)實(shí)體損失時(shí)，所有者權(quán)益是控制性權(quán)益或b）受限于下文第2條的規(guī)定，如果發(fā)生外國(guó)實(shí)2、如果在損失發(fā)生之日存在符合下述條件的情形（以下簡(jiǎn)稱“義務(wù)”），且第一記名被或記名被保險(xiǎn)人或其相關(guān)的子公司有責(zé)任為該財(cái)產(chǎn)購(gòu)b）雖然第一記名被保險(xiǎn)人有所有者權(quán)益但非控制性權(quán)益，但是第一記名被保險(xiǎn)人3、保險(xiǎn)人將把外國(guó)實(shí)體損失視為第一被保險(xiǎn)人遭受的損失，按照本保險(xiǎn)合同的所有條款和條件來(lái)處理外國(guó)實(shí)體損失，包括但不限于本保險(xiǎn)合同中的除外責(zé)任和其他限制規(guī)4、本擴(kuò)展條款下，外國(guó)實(shí)體知曉的信息資料應(yīng)視為第一被保險(xiǎn)人亦知曉。c）授權(quán)保險(xiǎn)人可以全面獲取前述損失理算員做出的任何記錄；及d）獲得對(duì)外國(guó)實(shí)體損失進(jìn)行調(diào)查、理算、抗辯及和解的控制權(quán)，包括獲取賬簿、6、第一被保險(xiǎn)人應(yīng)當(dāng)盡全力確保外國(guó)實(shí)體在其應(yīng)遵守的法律和法償款項(xiàng)，第一被保險(xiǎn)人應(yīng)當(dāng)立即按照該等款項(xiàng)的金額向保險(xiǎn)人進(jìn)行支“控制性權(quán)益”是指符合下述條件之一的所有者權(quán)益i）股權(quán)比例超過(guò)50%的所有者“第一記名被保險(xiǎn)人”是指保險(xiǎn)單上列明的第一個(gè)被保險(xiǎn)人。“外國(guó)實(shí)體”是指下述實(shí)體（位于保險(xiǎn)人依法不能向其提供保險(xiǎn)的國(guó)家或地區(qū)即“外國(guó)實(shí)體損失”是指外國(guó)實(shí)體發(fā)生或支付的根據(jù)本于所有責(zé)任免除和限制規(guī)定）屬于保險(xiǎn)責(zé)任范“承保損失”是指由于外國(guó)實(shí)體損失導(dǎo)致第一記名被保險(xiǎn)人在外國(guó)實(shí)體的經(jīng)濟(jì)利益發(fā)生“所有者權(quán)益”是指第一記名被保險(xiǎn)人直接或通過(guò)相關(guān)的子公司持有的外國(guó)實(shí)體所有者ForeignEntityLossCNotwithstandinganythingcontainedhereintothecontrary:surerwillindemnifytheFirstNamedInsuredforafwhichisconclusivelyagreedandshallbea)theForeignEntityLoss(whereatthetimeofOwnershipInterestisaControllib)subjectto2below,whereatthetimeoftheForeignEntityLosstheOwnershipprovidedthatthevalueshavebeea)theFirstNamedInsureddoesInsuredoraninterveningsubsidiaryisrespi)forreimbursingtheForeignEntityfortheForii)forobtainingpropertyinsurancefortheForeignEnformofresponsibilitysubsidiaryhasinrelationtotheproperty;orb)theFirstNamedInsuredhasanOwnershipforobtainingpropertyinsurancefortheForeignEntity,Loss,thevalueofwhichisaForeignEntityLosstotheextentthattheFirstNamedInsuredhasanpay.3.TheInsurerwilltreatanyForeignEntityLossinaccordaninthisPolicy,asiftheForeignEntityLossoccurredto4.InformationmaterialtothisinsuranceknowntotheForeignEntityshallbetobeknowntotheFirstNamedInsure5.TheFirstNamedInsuredshall,whendirectedbytheInsurer:adjuster”),authorisedinthejurisdictioninwhichtheForeignEntityLossoccurredandapprovedbytheInsurer,toadjusttheForeigb)wherepermittedbyapplicabwithsuchlossadjuster;c)granttheInsurerfullaccesstoanyrecordsproducedbysuchlofaForeignEntityLoss,includingaccesstobvouchersandotherinformation.6.TheFirstNamedInsuredshallmakebestendeavorstoensurethattheForeignEntityshall,totheextentpermittedbythelawsand/oasmaybenecessaryorreasonablyrequiredbytheInsurerfanyrightsandremedies,orofobtaiotherpartiesineachcaseinprioritywritten.IntheeventanysuchrecoveryissubsequentlyreceivedbyrelationtotheForeignEntityLoss,theFirstNamedInsuredsasumequivalenttosuchpaymenForthepurposesofthisextension:-“ControllingInterest”meansanOwnershipInterestwhichiseither(i)greaterthan50per“FirstNamedInsured”shallmeantheInsurednamedfirstintheSchedule.“ForeignEntity”shallmeaisnotlawfullypermiteconomicinterestasaresulteitherofbenefitingfinanciallyfromthecontinuedoperationoftheForeignEntityorofbeingprejudicedbylossordamagetoorliabilityofaForeign“ForeignEntityLoss”shallmeananylossincurredorpaidbytheForeignconsideredacoveredlossundefthisPolicy,includingbutnotlimitedtoallexclusionsandlimitations.“InsuredLoss”shallmeanthedecreaseinthevalueoftheeconomicinterestoftheFirstNamedInsured
