2024版勞動(dòng)合同法全文2024LaborContractLawFullTextPreamble:ThisLaborContract(hereinafterreferredtoas"theContract")isestablishedinaccordancewiththeLaborContractLawofthePeople'sRepublicofChina,aimingtodefinetherightsandobligationsoftheEmployerandtheEmployee.Article1:PurposeandBasisThepurposeofthisContractistoregulatethelaborrelationshipbetweentheEmployerandtheEmployee,toprotectthelegitimaterightsandinterestsofbothparties,andtopromoteharmoniousandstablelaborrelations.Article2:ScopeThisContractappliestotheEmployerandtheEmployeewithintheterritorygovernedbythePeople'sRepublicofChina.Article3:PrinciplesTheconclusionofthisContractshallbebasedontheprinciplesoflegality,fairness,equality,voluntariness,andhonestyandcredibility.Article4:TypesofLaborContractsThetypesoflaborcontractsincludefixed-termlaborcontracts,open-endedlaborcontracts,andlaborcontractsforspecifictasks.Article5:Employer'sObligationsTheEmployershallprovideasafeandhealthyworkingenvironment,clearlydefinejobresponsibilities,andensuretheEmployee'slegalrightsandinterests.Article6:Employee'sObligationsTheEmployeeshallcompletethetasksassignedbytheEmployer,complywiththeEmployer'srulesandregulations,andmaintainconfidentialityregardingtheEmployer'sbusinesssecrets.Article7:LaborContractConcludingProceduresTheEmployerandtheEmployeeshallsignthelaborcontractinwrittenform.Thelaborcontractshallcomeintoeffectuponsignaturebybothparties.Article8:LaborContractContentThelaborcontractshallincludethefollowingcontent:NameandaddressoftheEmployer;Name,address,andidentitynumberoftheEmployee;Jobpositionandworkcontent;Worklocation;Workinghoursandrestandleave;Laborremuneration;Socialinsurance;Laborprotectionandworkingconditions;Jobtraining;Thetermofthelaborcontract;Probationperiod;Legalresponsibilities.Article9:Fixed-TermLaborContractsAfixed-termlaborcontractisalaborcontractwithapredeterminedtermofvalidity.Article10:Open-EndedLaborContractsAnopen-endedlaborcontractisalaborcontractwithoutapredeterminedtermofvalidity.Article11:LaborContractsforSpecificTasksAlaborcontractforspecifictasksisalaborcontractconcludedforthecompletionofaspecifictask.Article12:ProbationPeriodThelaborcontractmayincludeaprobationperiod,whichshallnotexceedsixmonths.Article13:WorkingHoursTheEmployershallimplementastandardworkinghourssystem,ensuringthattheEmployeeworksnomorethaneighthoursadayandnomorethan40hoursperweek.Article14:RestandLeaveTheEmployeeisentitledtorestdaysandstatutoryholidaysinaccordancewiththelaw.Article15:LaborRemunerationTheEmployershallpaytheEmployee'slaborremunerationinfullandontime,andthelaborremunerationshallnotbelowerthanthelocalminimumwagestandard.Article16:SocialInsuranceTheEmployershallpaysocialinsurancepremiumsfortheEmployeeinaccordancewiththelaw.Article17:LaborProtectionandWorkingConditionsTheEmployermustprovidenecessarylaborprotectionandaworkingenvironmentthatmeetsnationalsafetyandhealthstandards.Article18:JobTrainingTheEmployershallprovidenecessarytrainingtotheEmployeetoimprovetheirprofessionalskillsandworkability.Article19:LegalLiabilitiesBothpartiesmustperformthelaborcontractingoodfaith.Anybreachofcontractshallbearthecorrespondinglegalresponsibilities.Article20:ContractAmendmentAnyamendmentstothelaborcontractmustbemadeinwritingandagreeduponbybothparties.Article21:ContractTerminationThelaborcontractmaybeterminatedinaccordancewiththeprovisionsofthisContractandtheLaborContractLaw.Article22:ContractExpirationThelaborcontractshallexpireuponthecompletionofthetermorthespecifictask.Article23:ContractRenewalThelaborcontractmayberenewedupontheexpirationofthetermbymutualagreementofbothparties.Article24:ContractTransferTheEmployee'srightsandobligationsunderthisContractmaynotbetransferredtoathirdpartywithouttheEmployer'swrittenconsent.Article25:ContractDisputeResolutionAnydisputesarisingfromtheperformanceofthisContractshallberesolvedthroughnegotiation,mediation,arbitration,orlitigation.Article26:ApplicableLawThisContractshallbegovernedbyandconstruedinaccordancewiththelawsofthePeople'sRepublicofChina.Article27:EffectivenessoftheContractThisContractiseffectiveuponsignaturebybothpartiesandisvaliduntilthecompletionofthetermorthespecifictask.Article28:SignaturesTheEmployerandtheEmployeeeachholdonecopyoftheContract,andbothcopiesareequallyvalid.Employer(Stamp):__________________LegalRepresentative(Signature):__________________Date:____year____month____dayEmployee(Signature):__________________Date:____year____month____dayArticle29:Non-CompeteClauseTheEmployeeshallnotengageinanyactivitiesthatcompetewiththeEmployer'sbusinessduringthetermoftheContractandforaperiodof_______aftertermination.Article30:ConfidentialityAgreementTheEmployeemustkeepallbusinessinformationoftheEmployerconfidentialandnotdiscloseittoanythirdparty.Article31:IntellectualPropertyRightsAllintellectualpropertyrightscreatedbytheEmployeeduringthetermoftheContractshallbelongtotheEmployer.Article32:SeverabilityIfanyprovisionofthisContractisfoundtobeinvalidorunenforceable,itshallbeseveredfromtheContract,andtheremainingprovisionsshallcontinueinfullforceandeffect.Article33:EntireAgreementThisContractconstitutestheentireagreementbetweenthepartiesandsupersedesallpriornegotiations,understandings,andagreements.Article34:NoticesAllnoticesorcommunicationsrequiredorpermittedbythisContractshallbeinwritingandshallbedeemedgivenwhendeliveredpersonallyorbyemail.Article35:WaiverThefailureofeitherpartytoenforceanyprovisionsofthisContractshallnotbeconstruedasawaiverorlimitationofthatparty'srighttosubsequentlyenforceandcompelstrictcompliancewitheveryprovisionofthisContract.Article36:AssignmentTheEmployeemaynotassignanyrightsordelegateanydutiesunderthisContractwithoutthepriorwrittenconsentoftheEmployer.Article37:ForceMajeureNeitherpartyshallbeliableforanyfailureordelayinperformingitsobligationsunderthisContracttotheextentthatsuchfailureordelayiscausedbyeventsbeyondthereasonablecontrolofthatparty.Article38:Third-PartyBeneficiaryExceptasotherwiseprovidedinthisContract,therearenothird-partybeneficiariestothisContract.Article39:GoverningLanguageTheofficiallanguageofthisContractis_______,andanytranslationsareprovidedforconvenienceonly.Article40:CounterpartsThisContractmaybeexecutedincounterparts,eachofwhichshallbedeemedanoriginal,andallofwhichtogethershallconstituteoneandthesameinstrument.Attachments:JobDescriptionNon-CompeteAgreementConfidentialityAgreementIntellectualPropertyRightsAssignmentFormPerformanceEvaluationCriteriaBreachofContractandDetermination:Breachofcontractincludesbutisnotlimitedtofailuretopaywagesontime,non-compliancewiththenon-competeclause,anddisclosureofconfidentialinformation.BreachisdeterminedbytheviolationofanytermsofthisContractandmayresultinpenaltiesorlegalactionasprovidedbylaw.LegalTermsandInterpretations:Legaltermssuchas"Employer,""Employee,""non-compete,""confidentiality,"and"intellectualpropertyrights"aredefinedinaccordancewiththeLaborCont
