2024版勞動合同模板勞動合同Preamble:ThisLaborContract(hereinafterreferredtoas"theContract")isestablishedinaccordancewiththeLaborContractLawofthePeople'sRepublicofChina,aimingtodefinetherightsandobligationsoftheEmployerandtheEmployee.Article1:DefinitionsForthepurposesofthisContract,thefollowingtermshavethemeaningssetoutbelow:"Employer"means_______,acompanydulyregisteredandexistingunderthelawsof_______."Employee"means_______,whoisapartytothisContractandprovideslabortotheEmployer."CommencementDate"meansthedateonwhichtheEmployeestartsworkingfortheEmployer,whichis_______."TerminationDate"meansthedateonwhichthisContractisterminatedinaccordancewithitsterms.Article2:TypeofContractThisContractisa_______(selectone:fixed-term,open-ended,orforaspecifictask)laborcontract.Article3:PositionandWorkContentTheEmployeeisemployedbytheEmployerinthepositionof_______.TheEmployee'sworkcontentincludesbutisnotlimitedto_______.Article4:WorkLocationTheEmployee'sprincipalplaceofworkis_______.Article5:WorkingHoursTheEmployeeisrequiredtowork_______hoursperdayand_______hoursperweek,inaccordancewiththeEmployer'sworkschedule.TheEmployeeisentitledtorestandleaveasstipulatedbythelaborlawsofthePeople'sRepublicofChina.Article6:RemunerationTheEmployee'smonthlysalaryis_______.TheEmployershallpaytheEmployee'ssalaryonthe_______dayofeachmonth.Article7:SocialInsuranceandBenefitsTheEmployershallenrolltheEmployeeinthesocialinsuranceschemesasrequiredbylaw,includingbutnotlimitedtopension,medical,unemployment,work-relatedinjury,andmaternityinsurance.TheEmployeeisentitledtobenefitsaspertheEmployer'spolicyandapplicablelaws.Article8:LaborProtectionandWorkingConditionsTheEmployershallprovideasafeandhealthyworkingenvironmentandnecessarylaborprotectionasrequiredbylaw.Article9:LaborDisciplineandRulesTheEmployeeshallcomplywiththeEmployer'srulesandregulations.TheEmployeeshallperformtheirdutiesdiligentlyandfaithfully.Article10:ProbationPeriodTheprobationperiodfortheEmployeeis_______months,startingfromtheCommencementDate.Duringtheprobationperiod,eitherpartymayterminatetheContractwith_______days'notice.Article11:ContractTerminationEitherpartymayterminatethisContractinaccordancewiththeLaborContractLawofthePeople'sRepublicofChina.TheEmployermayterminatetheContractwithoutnoticeiftheEmployeemateriallybreachestheContractortheEmployer'srulesandregulations.Article12:ContractExpirationandRenewalThisContractexpiresonthe_______(insertexpirationdateorcondition).TheContractmayberenewedbymutualagreementofbothparties.Article13:ConfidentialityTheEmployeeshallkeepconfidentialallbusinesssecretsoftheEmployerandshallnotdisclosethemtoanythirdparty.Article14:IntellectualPropertyAllintellectualpropertyrightscreatedbytheEmployeeduringthetermofthisContractinthecourseoftheirworkshallbelongtotheEmployer.Article15:Non-CompetitionTheEmployeeshallnotengageinanycompetitivebusinessactivitieswiththeEmployerforaperiodof_______afterterminationofthisContract.Article16:DisputeResolutionAnydisputesarisingfromtheperformanceofthisContractshallberesolvedthroughnegotiation.Ifnegotiationfails,eitherpartymayapplyforarbitrationorfilealawsuitinthepeople'scourt.Article17:ApplicableLawThisContractshallbegovernedbyandconstruedinaccordancewiththelawsofthePeople'sRepublicofChina.Article18:AmendmentstotheContractThisContractmaybeamendedonlyinwritingandwiththeconsentofbothparties.Article19:EntireAgreementThisContractconstitutestheentireagreementbetweenthepartiesandsupersedesallpriornegotiations,understandings,andagreements.Article20:SignaturesThisContractisexecutedintwocounterparts,eachofwhichshallbedeemedanoriginal.Employer(Stamp):__________________LegalRepresentative(Signature):__________________Date:____year____month____dayEmployee(Signature):__________________Date:____year____month____dayArticle21:NoticeProvisionsAllnotices,requests,demands,andothercommunicationsunderthisContractshallbeinwritinganddeemeddulygivenwhendeliveredtotheaddressesspecifiedinthisContract.Article22:WaiverThewaiverbyeitherpartyofanybreachordefaultshallnotbedeemedawaiverofanysubsequentbreachordefault.Article23:AssignmentTheEmployeemaynotassignortransferanyrightsorobligationsunderthisContractwithoutthepriorwrittenconsentoftheEmployer.Article24:ForceMajeureNeitherpartyshallbeliableforanyfailureordelayinperformingitsobligationsunderthisContracttotheextentthatsuchfailureordelayiscausedbyforcemajeure.Article25:Third-PartyBeneficiaryExceptasotherwiseprovidedinthisContract,therearenothird-partybeneficiariestothisContract.Article26:SeverabilityIfanyprovisionofthisContractisheldtobeinvalidorunenforceable,suchprovisionshallbestruck,andtheremainingprovisionsshallremaininforce.Article27:GoverningLanguageTheofficiallanguageofthisContractis_______,andanytranslationsareforconvenienceonly.Article28:ExecutioninCounterpartsThisContractmaybeexecutedincounterparts,eachofw
