第一章定義和常用縮略語

一、定義

1.Cleargrounds:evidencethattheship,itsequipment,oritscrewdoesnot

correspondsubstantiallywiththerequirementsoftherelevantconventionsorthat

themasterorcrewmembersarenotfamiliarwithessentialshipboardprocedures

relatingtothesafetyofshipsorthepreventionofpollution.

明顯依據(jù):船舶及其設備或其船員實質上不符合有關公約的要求的證據(jù),或船長或船員

不熟悉有關船舶安全或防止污染的船上基本程序的證據(jù)。

2.Deficiency:Aconditionfoundnottobeincompliancewiththerequirements

oftherelevantconvention.

缺陷:發(fā)現(xiàn)的不符合有關公約要求的一種狀況

3.Detention:InterventionactiontakenbytheportStatewhenthecondition

oftheshiporitscrewdoesnotcorrespondsubstantiallywiththeapplicable

conventionstoensurethattheshipwillnotsailuntilitcanproceedtoseawithout

presentingadangertotheshiporpersonsonboard,orwithoutpresentingan

unreasonablethreatofharmtothemarineenvironment.

滯留:當船舶或船員實質上不符合適用公約要求時,港口國為保證該船舶只有在不會對

船舶或船上人員構成危險或不會對海上環(huán)境造成損害威脅時方可開航所采取的干涉行動。

7.Stoppageofanoperation:Formalprohibitionagainstashiptocontinuean

operationduetoidentifieddeficiencies,whichsinglyortogether,renderthe

continuationofsuchoperationhazardous.

停止作業(yè):由于船舶具有一個或幾個被識別缺陷會使船舶繼續(xù)進行某些操作產生危險,

8.Substandardship:Ashipwhosehull,machinery,equipment,oroperational

第二章港口國監(jiān)督檢查概述

12.General

概要

PortStateControl(PSC)istheinspectionofforeignshipsinnationalports

forthepurposeofverifyingthattheconditionoftheshipanditsequipmentcomply

withtherequirementsofinternationalconventionsandthattheshipismannedand

operatedincompliancewithapplicableinternationallaws.Theprimary

responsibilityforensuringthatashipmaintainsastandardatleastequivalent

tothatspecifiedininternationalconventionsrestswiththeflagStateandif

allflagStatesperformedtheirdutiessatisfactorilytherewouldbenoneedfor

portStatecontrol.Unfortunatelythisisnotthecaseasevidencedbythemany

marineaccidentsaroundtheworld-hencetheneedforadditionalcontrol.

港口國監(jiān)督是港口國當局對抵港的外國籍船舶實施的,以確保船舶及其設備符合國際公

約要求、船舶的配員與操作符合適用的國際規(guī)范為目的的一種檢查。確保船舶保持國際公

約中規(guī)定的標準是船旗國的首要責任,如果所有的船旗國都能令人滿意地履行他們的職責,

那么港口國監(jiān)督就沒有必要存在,不幸的是,實際情況卻并非如此,世界范圍內發(fā)生的諸

多海難事故已證明了這一點,因此這種額外監(jiān)控也就成為必然。

TheauthorityforexercisingPSCisthenationallawbasedonrelevant

conventions.ItisthereforenecessaryforaportStatetobePartytothose

conventionsandtohavepromulgatedthenecessarylegislationbeforeexercising

PSC.Inaccordancewiththeprovisionsoftheapplicableconventions,Partiesmay

conductinspectionsofforeignshipsintheirportsthroughPortStateControl

Officers(PSCOs).

港口國監(jiān)督的實施是通過基于相關國際公約的國內法所授權的。因此,港口國必須是這

些公約締約國,而且,在實施港口國監(jiān)督之前要頒布起立法。根據(jù)所適用公約的條款規(guī)定,

13.ProvisionsofportStatecontrol

港口國監(jiān)督條款

IMOconventionsplacetheresponsibilityfortechnicallyandenvironmentally

safeshipsprimarilyontheflagState.However,itisrecognizedthataportState

canmakeausefulcontributiontotheseaimsandmanyconventions,therefore,

containprovisionsthatpermitportStatecontrol.Theseinclude:

14.ExistingregionalagreementsonportStatecontrol

現(xiàn)有港口國監(jiān)督區(qū)域協(xié)定

WhilenationalportStatecontrolalonewillalreadyenhancethesafetyofships

andtheprotectionofthemarineenvironment,onlyaregionalapproachwillensure

thatsubstandardshipsandsubstandardoperatorshavefewerplaceslefttohide.

Unlessaregionalapproachisadopted,operatorswilljustdiverttheirshipsto

portsintheregionwherenoorlessstringentPSCinspectionsareconducted.This

mayseriouslyhampertheeconomicalsituationoftheportsofthosecountriesthat

doconductproperinspections.Toremedythisandtogenerallyimprovethe

effectivenessofinspections,manyregionsoftheworldhavealreadyorare

beginningtoenterintoregionalagreementsonPSC.

雖然國家性的港口國監(jiān)督已加強船舶的安全和環(huán)境保護,而惟有通過區(qū)域性的協(xié)作才能

15.PSC-thefuture

Theestablishmentofworldwideregionalportstatecontrolisonlyabeginning

Theprospectofglobalportstatecontrol,withexchangeofinformationand

harmonizationofproceduresandtraining,hasevenmoreexcitingimplications,As

moreandmorestatisticsanddataaregatheredandexchangedbythedifferentPSC

Secretariats,thiswillresultinahugeincreaseinknowledgeaboutsubstandard

shipping,Thisknowledgeisnotonlyusefulinitself,itwillalsoprovidethe

maritimecommunitywiththeopportunitytobetteranalyzethecausesofincidents

andcasualtiesandascertain.,moreaccuratelythaneverbefore,howtheycanbe

preventedfromoccurringagain.

第三章港口國監(jiān)督檢查程序

A.882(21)andregionalagreements,whicharesummarizedinthefollowing:

港口國監(jiān)督檢查程序在IMO的A.882(21)決議以及各區(qū)域協(xié)定里都有詳細的闡述,現(xiàn)將

其概述如下:

16.Selectionofshipstobeinspected

選擇受檢查船舶

ThePortStateControlOfficer(PSCO),beforevisitingtheport,selectaship

orshipstobeinspected,takingintoaccountthecriteriafortheselectionof

shipstipulatedintheMOU.Shipssuchastankersandbulkcarriers,andshipswith

previousrecordsofdetention,etc.Indoingso,PSCOsearchpreviousPSCdatafrom

regionalornationaldatabankonshipsthePSCOintendstovisit.

船舶到達港口之前,檢查官會根據(jù)備忘錄里規(guī)定的選船標準選擇受檢查船舶。優(yōu)先檢查

的船舶包括第一次掛靠該港口的船舶、油船和散貨船等敏感型船舶、有滯留記錄的船舶,

等等。在選船的時候,檢查官會從該國家或該區(qū)域的數(shù)據(jù)庫中就以前的港口國監(jiān)督數(shù)據(jù)對

待檢船舶進行調查。

17.Initialinspection

初檢

PSCOfirstchecksthecertificatesandotherdocumentscarriedonboardto

ascertainthattheyarevalidandinorder.Healsocheckthegeneralcondition

oftheshipinordertosatisfyhimselfthattheshipcomplieswiththeprovisions

oftherelevantinstruments.Ifeverythingisinorder,theinspectioniscompleted

andtheshipisallowedtosail.

檢查官首先檢查船舶配備的證書及其他相關文件,以確人其有效性和正確性。同時,他

們也檢查船舶總體狀況,確認該船舶是否符合相關條約的條款要求,以使自己滿意。如果

所有情況良好,檢查即告結束,船舶被允許開航。

18.Detailedinspection

詳細檢查

If,however,PSCOfindsthatthecertificatesarenotinorder,or,aftergeneral

inspection,considersthattherearecleargroundsforbelievingthattheshipdoes

notsubstantiallycomplywiththeprovisionsoftherelevantinstruments,thenhe

carriesoutdetailedinspections.ResolutionA.787(19)definesthecleargrounds

anddescribehowtocarryoutdetailedinspection.

然而,如果檢查官發(fā)現(xiàn)證書不符合要求,或者,初次檢查后有明顯依據(jù)認為該船實質上

并不符合相關公約條款的要求,檢查官就會對該船實施詳細檢查。A.787(19)決議定義了明

顯依據(jù)并對如何實施詳細檢查進行了闡述。

19.Detention

滯留

IfPSCO,asaresultofdetailedinspections,hasfounddeficiencies,heorders

torectifysuchdeficiencies.Ifthedeficienciesareveryserious,theshipis

detainedandwillnotbeallowedtosailuntilthedeficienciesarerectified.In

suchcased,theflagStateadministrationandclassificationsocietyinvolvedare

notified.ResolutionA.787(19)providesforthedefinitionofdetainable

deficienciesandprocedurestobefollowedinthecaseofdetention.

如果檢查官在詳細檢查中發(fā)現(xiàn)有缺陷,通常會令船方糾正。如果發(fā)現(xiàn)的缺陷非常嚴重,

船舶將會被滯留,直到缺陷被糾正才允許船舶開航。在這種情況下,檢查官會通知船旗國

主管機關及相應的船級社機構。A.787(19)決議提供了可滯留的定義以及滯留所應遵循的

程序。

Ifthedeficienciescannotberectifiedattheportofinspection,PSCOmayallow

theshiptoproceedtothenearestrepairyard.ResolutionA.787(19)andPSCManual

containprocedurestobefollowedinsuchcase.如果缺陷不能在檢查港糾正,檢查官

可允許船舶駛往最近的修船廠。A.787(19)決議以及港口國監(jiān)督手冊中包含了該種情

20.Reporting

報告

Afterinspection,theshipisprovidedwithFormAoftheportStateinspection,

andinthecaseofdeficiencies,FormsBaswell.Inthecaseofdetention,Forms

AandBaretransmittedtotheflagState.PSCOalsosendtheresultsofinspection

toregionaldatabase,suchasSIRENACinSt.Malo,France,undertheParisMOUand

APCISinVladivostok,theRussianFederation,undertheTokyoMOU.

檢查完畢后,將會給船舶提供一份港口國監(jiān)督檢查的A表,當發(fā)現(xiàn)缺陷時還有B表。如

果船舶被滯留,A表和B表會被傳送給船旗國。檢查官也會把檢查結果送往區(qū)域數(shù)據(jù)庫中心,

例如巴黎備忘錄位于法國圣馬洛的SIRENAC、東京備忘錄位于俄羅斯海參蕨的APCISo

TheportStateregularlysubmittoIMOrecordsforthedetentionofships.IMO

publishedtheannualdetentionlist.FlagStatesareobligedtosubmittoIMOreports

ontheactiontakenfordetainedships.ManyportStatesandtheParisandTokyo

MOUspublishdetentionlistmonthlyintheirInternetwebsites.港口國定期把滯

留船舶的記錄呈送到國際海事組織(IM0)o然后,IM0發(fā)布年度滯留單。船旗國必須把被滯

留船舶所采取的措施上報IMOo許多港口國、巴黎備忘錄以及東京備忘錄都在他們的國際互

聯(lián)網(wǎng)網(wǎng)址上每月發(fā)布船舶滯留單。
