five.In1978Congresspassednewlegislationthatraisedthelegalmandatoryretirement

agetoseventyformostemployees.Underthenewlaw.employerscannotrequirea

workertoretire15eforctheageofseventy,althoughworkersofcoursemaystillretire

beforethatageiftheywish.Theobjectiontomandatoryretirementisthatitthrows

peopleoutoftheirjobsatapurelyarbitraryage,withoutregardfortheirindividual

abilities.Thereisnoevidencetosuggestthatmostpeopleovertheageofsixty-fiveor

seventyareincapableofworking;attheturnofthecentury,infact,70percentofmen

oversixty-fivewereactiveinthelaborforce.Mandatoryretirementabsurdlyimpliesthat

peoplearecapableofproductivelaboruntilthedaybeforetheirseventiethbirthday,then

abruptlybecomephysicallyormentallyincapableofperformingtheirjobs.Italsoimplies

thatwetreatallmembersofthesameagegroupasthoughtheyhadidenticalcompetence

orincompetenceattheirjobs-when,infact,thementalandphysicalabilitiesofany

growolder.Whydoesenforcedretirementexist,andwhydoemployerstrytopersuade

theiremployeestoretireattheageofsixty-five?Thereasonisthatmandatoryretirement

isanadministrativeconveniencefortheemployers.Inihepast,whenmostworkers

producedtheirowngoodsorweretheirownbosses,theyworkeduntiltheyeitherdiedor

chosetostopwork.Thisisstillthecasetodaywithself-employedworkers,suchas

artists,ownersofbusinesses,orlawyers.Butfully80percentofAmericanstodayarc

employedbyotherpeopleororganizations-primarilylargecorporationsandfederal,

state,orlocalgovernmeniagencies.Theseorganizationsfacetheproblemoffinding

someorderlywayofphasingout(淘汰)theirolderemployeeswhomighthavebecome

unproductive.Itisfarmoreconvenientfortheemployerstoachievethisbyanarbitrary
