B、無固定期限的勞動(dòng)合同 年 月 日起至 年 月 日止,其中試用期自 年 月 日起至 年 月 日止。Open-ended: From _ to_; the probationary period commencing on _ and ending on _.C、以完成 工作任務(wù)為勞動(dòng)合同期限,自 年 月 日起至完成本項(xiàng)目工作任務(wù)之日即為勞動(dòng)合同終止日。Project-based: From _ to the date when finish the duties of this project work, its the termination date of this contract.二、工作內(nèi)容和工作地點(diǎn)Article 2 Job Description and Workplace Location (一)乙方根據(jù)甲方要求,經(jīng)過協(xié)商,從事 工作。 甲方可根據(jù)工作需要和對乙方業(yè)績的考核結(jié)果,按照合理誠信原則,經(jīng)與乙方協(xié)商,可以變動(dòng)乙方的工作崗位。 2.1 According to the requirements of Party A, after consultations,Party B shall work as . After consultation, Part A can change the job of Party B on the basis of the working requirment and performance evaluation results, in accordance with reasonable and honest principle. (二)甲方安排乙方所從事的工作內(nèi)容及要求,應(yīng)當(dāng)符合國家規(guī)定的勞動(dòng)基準(zhǔn)和甲方依法制定的并已公式的規(guī)章制度。乙方應(yīng)當(dāng)按照甲方安排的工作內(nèi)容及要求履行勞動(dòng)義務(wù). 2.2 Party Bs job content and requirement should comply with provisions of the labor standards, rules and regulations established legally by Party A,which is known to the public. Party B shall fulfill labor obligations in accordance with the job content and requirement of Party A. (三)乙方的工作地點(diǎn): 2.3 Workplace of Party B should be at 三、工作時(shí)間和休假時(shí)間 Article 3 Working Hours, Rest Days and Holiday (一)乙方所在崗位執(zhí)行下列工作時(shí)制度 (A、B、C選其中之一) 3.1 Party B shall perform the standard working hour rules (choose one of A, B, C through consultations) A甲方安排乙方的工作崗位屬于實(shí)行標(biāo)準(zhǔn)工時(shí)制的崗位。 Party Bs job belongs to standard working hour system. B甲方安排乙方的工作崗位,經(jīng)批準(zhǔn)屬于實(shí)行不定時(shí)工作制的崗位,雙方依法執(zhí)行不定時(shí)工作制度。 Party Bs job should comply with irregular working hour sysem. C甲方安排乙方的工作崗位,經(jīng)批準(zhǔn)屬于實(shí)行綜合計(jì)算工時(shí)制的崗位,雙方依法執(zhí)行綜合計(jì)算工時(shí)工作制規(guī)定。 Party Bs job should comply with the comprehensive calculation working hour system. (二)甲方嚴(yán)格遵守法定的工作時(shí)間,控制加班加點(diǎn),保證乙方的休息與身心健康,甲方因工作需要必須安排乙方加班加點(diǎn)的,應(yīng)與工會(huì)與乙方協(xié)商同意,并依法給予乙方補(bǔ)休或支付加班加點(diǎn)工資。3.2 Party A should strictly comply with the legal working hours, making sure the rest and health for Party B, Party A may extend working hour due to the requirements of its production or business after consultation with the trade union and laborers, and provide Party B time off or overtime wages.(3) 甲方依法為乙方安排帶薪年休假,具體休假時(shí)間與乙方協(xié)商決定。 3.3 Party A shall provide paid annual leave, details should consult with Party B. 四、勞動(dòng)報(bào)酬 Article 4 Labor Remuneration甲方應(yīng)當(dāng)每月至少一次以貨幣形式支付乙方工資,不得克扣或者無故拖欠乙方的工資。乙方在法定工作時(shí)間或依法簽訂勞動(dòng)合同約定的工作時(shí)間內(nèi)提供了正常勞動(dòng),甲方向乙方支付的工資不得低于當(dāng)?shù)刈畹凸べY標(biāo)準(zhǔn)。Party A shall pay the wages in crash to Party B at least once a month.Party B shall provide the normal work within legal working time.Wages paid to Party B by Party A shall not be lower than the local minimum wages standard. (一)甲方每月 日為發(fā)薪日。4.1 Party A pats Party Bs wage before (Date) cash monthly. (二)乙方在試用期內(nèi)的工資為每月 元。 4.2 Party B in probationary periods wage standard is RMB . (三)經(jīng)甲乙雙方協(xié)商一致,對乙方的工資報(bào)酬按下列 條款執(zhí)行; 4.3 Afer both parties agreement, Party Bs salary and remunerations shall be governed by the following scheme(A/B/C/D)A、 根據(jù)乙方的工作崗位確定其每月工資為 元。 Party Bs salary is RMB comply with its job. B、甲方對乙方實(shí)行基本工資和績效工資相結(jié)合的內(nèi)部工資分配辦法,乙方的基本工資確定為每月 元,以后根據(jù)內(nèi)部工資分配辦法調(diào)整其工資;績效工資根據(jù)乙方的工作業(yè)績、勞動(dòng)成果和實(shí)際貢獻(xiàn)按照內(nèi)部分配辦法考核確認(rèn)。Party A exercises Part Bs salary distribution method that combines basic salary and performance salary. Part Bs basic salary is determined as RMB per month and it will be adjusted according to internal salary distribution methods; Performance salary will be confirmed by internal salary distribution methods according to Party Bs Job performance, work results and actual contribution. C、甲方實(shí)行計(jì)件工資制,確定乙方的勞動(dòng)定額應(yīng)當(dāng)是本單位同崗位百分之九十以上勞動(dòng)者在約定工作時(shí)間內(nèi)能夠完成的,乙方在法定工作時(shí)間內(nèi)按質(zhì)完成甲方定額,甲方按照約定的定額和計(jì)件單價(jià),根據(jù)乙方的業(yè)績,按時(shí)足額支付乙方的工資報(bào)酬。Party A exercises piecework accumulated wages method, Party A must guarantee the determined work quota could be accomplished by more than 90% laborers similar to Party Bs position within the legal working time. Part B shall finish the work quota as required quality, Part A shall pay Party B full amount wages in time in acordance with the agreed quota and piece price. D、其他形式 Other salary distribution method is specified as follows (4) 甲方根據(jù)企業(yè)經(jīng)營效益、當(dāng)?shù)卣嫉墓べY指導(dǎo)線、工資指導(dǎo)價(jià)位或本單位工資集體合同規(guī)定,每年合理提高乙方工資。 4.4 Party A shall make a proper increase on salary based on the company profitability level,guideline published by local goverment or provisions of the companys collective wage contract. (5) 乙方加班加點(diǎn)的工資,按不低于本條第(三)項(xiàng)約定的工資標(biāo)準(zhǔn)為基數(shù)計(jì)算。 4.5 Party Bs overtime wage cant be calculated not less than the wage standard agreed by article 3 of this section. (6) 甲方可根據(jù)實(shí)際經(jīng)營狀況,內(nèi)部規(guī)章制度對乙方的考核結(jié)果,以及乙方的工作年限、獎(jiǎng)罰記錄、崗位和工作內(nèi)容變化等,在于乙方協(xié)商后,調(diào)整乙方的工資水平。 4.6 Part A can adjust Part Bs wage standard after consultation in accordance with its actual operating conditions, evaluation results of Party B caused by internal rules and regulations, as well as Party Bs working life, reward and punishment records, job content and job changes etc. 五、社會(huì)保險(xiǎn)和福利 Chapter 5 Social Insurance and Welfare (一)雙方依法參加社會(huì)保險(xiǎn),按時(shí)足額繳納各項(xiàng)社會(huì)保險(xiǎn)費(fèi),其中依法應(yīng)由乙方繳納的部分,由甲方從乙方工資報(bào)酬中代扣代繳。 5.1 Both parties shall participate in social insurance according to the law, those that shall paid by Party B shall be withheld by Party A from Party Bs salary and remitted by Party A on Party Bs behalf. (二)甲方應(yīng)當(dāng)每年向職工公布本單位全年社會(huì)保險(xiǎn)費(fèi)繳納情況,接受職工監(jiān)督。 5.2 Party A shall show the situation of annual social insurance premium to the public, accept the oversight of the employees. (三)乙方發(fā)生工傷事故或患職業(yè)病的,甲方應(yīng)負(fù)責(zé)及時(shí)救治,或提供可能的幫助,并在規(guī)定時(shí)間內(nèi),向勞動(dòng)保障行政部門提出工傷認(rèn)定申請,為乙方依法辦理勞動(dòng)能力鑒定,并為享受工傷保險(xiǎn)待遇履行必要的義務(wù)。 If Party B suffers from work-related injury or occupational disease, Party A shall take the responsibility of timely rescue or assist the possible aid, Party A shall also, within specified time period, apply for work-related injury authentication to the labor security department, and a necessary obligation shall be performed for Party Bs deserved work-related injury medical benefits. 六、勞動(dòng)保護(hù)、勞動(dòng)條件和職業(yè)病危害防護(hù) Article 6 Labor Protection,Labor Conditions and Occupational Prevention (一)甲方對可能產(chǎn)生職業(yè)病危害的崗位,應(yīng)當(dāng)向乙方履行如實(shí)告知的義務(wù),并對乙方進(jìn)行勞動(dòng)安全衛(wèi)生教育,防止勞動(dòng)過程中的傷亡事故,減少職業(yè)危害。 6.1 For the position of possible occupational hazards, Party A shall fulfill the obligation to truthfully inform, and provide the occupational safety and health education, to prevent the accidents during the process of work, to reduce occupational hazards. (二)甲方必須為乙方提供符合國家規(guī)定的勞動(dòng)安全衛(wèi)生條件和必要的勞動(dòng)防護(hù)用品,安排乙方從事有職業(yè)危害作業(yè)的,應(yīng)定期為乙方進(jìn)行健康檢查,并在乙方離職前進(jìn)行健康檢查。 6.2 Party A shall provide Party B with complied national occupational safety and health conditions and necessary labor protection articles, if Party A arrange Party B to engage in occupational hazards, periodic health checks and final health check is compulsory for Party B before he/she leave his /her job. (三)因乙方從事的工作崗位有職業(yè)危害可能,在甲方的監(jiān)督下,乙方必須采取以下防護(hù)措施: ,乙方在勞動(dòng)過程中必須嚴(yán)格遵守安全操作規(guī)程。乙方對甲方管理人員違章指揮、強(qiáng)令冒險(xiǎn)作業(yè),有權(quán)拒絕執(zhí)行。 6.3 If Party Bs job has the possibility of occupational hazard, under Party As supervision, Party B must take the following measures: . Party Bshould strictly abide by the rules of safe operation in the process of their work. Party B shall have the right to refuse to operate if the management personal of Party A command the operation in violation of rules and regulations or force Party B to run risk in operation. (四)甲方按照國家關(guān)于女職工、未成年工得特殊保護(hù)規(guī)定,對乙方提供保護(hù)。6.4 Party A shall provide female workers and juvenile workers with special protection in accordance with the applicable laws of P.R.C. (五)乙方在工作期間患病或非因工負(fù)傷的,甲方按照國家關(guān)于醫(yī)療期的規(guī)定執(zhí)行。6.5 If Party B falls sick or suffers non-work-related injuries during the term of employment, Party A shall solve it according to the national rules. 七、雙方協(xié)商一致,約定下列 條款 Article 7 Party A and Party B may conclude the matters as following upon reaching a negotiated consensus .A、因乙方工作涉及甲方商業(yè)秘密和知識產(chǎn)權(quán)先關(guān)的保密事項(xiàng),甲方可以事前與乙方依法協(xié)商約定保守商業(yè)秘密或競業(yè)限制的事項(xiàng),并簽訂保守商業(yè)秘密協(xié)議或競業(yè)限制協(xié)議,作為本合同的附件。If Party Bs job bearing on the confidentiality matters relating to maintaining the confidentiality of the business secrets and intellectual property of Party A, Party A may agree with Party B advance on maintaining the confidentiality of the business secrets or competition restriction provisions, and sign an agreement specify to keep business secrets or intellectual property confidentially as this contracts attachment.B、由甲方出資對乙方進(jìn)行專業(yè)技術(shù)培訓(xùn),并要求乙方履行服務(wù)期的,應(yīng)當(dāng)事前征得乙方同意,并簽訂協(xié)議,明確雙方權(quán)利義務(wù),協(xié)議作為本合同的附件。If Party A provides speial funding for Party Bs training and gives him/her professional technical training, and also requires Party B to perform service term, Party A shall obtain the agreement from Party B and sign on an agreement specified both Partys obligations.The agreement is deemed as this contracts attachment.C、甲乙雙方需要約定的其它事項(xiàng): Other matters requires to be stipulated by both Parties 八、勞動(dòng)爭議處理Resolution of Labor Dispute (一)甲乙雙方因履行本合同發(fā)生勞動(dòng)爭議,可以協(xié)商解決。不愿協(xié)商或者協(xié)商不成的,可以向本單位勞動(dòng)爭議調(diào)解委員會(huì)申請調(diào)解;調(diào)解不成的,可以向勞動(dòng)爭議仲裁委員會(huì)申請仲裁。甲乙雙方也可以直接向勞動(dòng)爭議仲裁委員提出書面申請,對仲裁裁決不服且符合起訴條件的,可以自收到仲裁裁決書之日起十五內(nèi)向人民法院提出訴訟。 8.1 Where a dispute between Party A and Party B arises from the implementation of this contract, the Parties may seek for a settlement through negotation. If no settlement can be reached through negotiation by the parties concerned, the dispute may be submitted to the internal labor dispute mediation committee of the employer for mediation;If fails, the Parties involved may apply to the labor dispute arbitration committee for arbitration.Either party can also directly file a written application to the labor dispute arbitration committee for arbitration.Any party that is unsatisfied with the adjudication of arbitration may bring a lawsuit to a peoples court within statutory limitation days from the date of receiving the adjudication. (二)甲方違反勞動(dòng)保障法律、法規(guī)和規(guī)章,損害乙方合法權(quán)益的,乙方有權(quán)向勞動(dòng)保障行政部門和有關(guān)部門投訴。 8.2 If an employer violates labor laws or statutes or breaches the rules and regulations, harms the lawful rights and interests of Party B, Party B is entitled to complain and report the violations to the Labor Security
