4、合同附表。若進(jìn)度有調(diào)整，以甲方確認(rèn)的實(shí)際進(jìn)度為準(zhǔn)。refertoappendix1forprojectschedule.incaseofanychanges,clientshalladvisethefinalschedule.2.1階段一藝術(shù)概念+創(chuàng)意phaseiartconcept+development初期的討論將由甲方和設(shè)計(jì)師建立明確的藝術(shù)品的需求范圍。指明設(shè)計(jì)藝術(shù)品的類型、質(zhì)量和藝術(shù)品的總體方向的要求。甲方和設(shè)計(jì)師提供設(shè)計(jì)的進(jìn)度表和工程進(jìn)度以使藝術(shù)品顧問能夠及時跟進(jìn)。preliminaryconferenceshallbeheldwiththeclientandinteriordesi

6、置，描繪藝術(shù)品/文物的基本概念和印象提供給甲方批準(zhǔn)。uponreviewingandanalyzingtheinteriorfloorplans,elevations,moodboards,perspectivetogetherwithbrieffromtheinteriordesigner,theartconsultantwillprepareschematicfloorplans(2setsandalsoindigitalformat)showingtheproposedlocations.conceptualimagesoftheartworks/artifactsrepresentin

7、gthebasicconceptwillbepresentedforclientsapproval.2.2階段二藝術(shù)品選擇+規(guī)格phaseiiartselection當(dāng)?shù)趇階段的工作被批準(zhǔn)和接受并支付完成后，藝術(shù)顧問將演示各個不同區(qū)域總體藝術(shù)品/文物概念，完成日程計(jì)劃和藝術(shù)品安放位置，在這個階段將展示圖片樣本、主題、材質(zhì)和尺寸的方案。藝術(shù)品顧問將提供有關(guān)圖紙和電子文件。根據(jù)藝術(shù)品工作的日程計(jì)劃將提出一個估價，這個藝術(shù)品/文物估價只是指導(dǎo)性的用來作為成本控制。到甲方簽字批準(zhǔn)才進(jìn)入下一階段。afterreceiptofwrittenapprovalandpaymentfromtheclientfo

8、rphaseiwork,withconsultationwiththeclient/interiordesigner,theartconsultantwillpresentanoverallartworks/artifactsconceptforthevariousareascompletewithscheduleofartworks,locationplansanddimensionsoftheartworks/artifacts.imagereference,samplestoindicatestyle,subjectandmediumwillbepresentedatthisphase.

9、basedonthisartworksschedule,abudgetestimatewillbesubmitted.theartworks/artifactsbudgetestimateisonlyguidanceforbudgetcontrol.clientistosignoffartproposalbeforeproceedingtothenextphase.artconsultanttoproviderelevantdrawingsanddigitaldocuments.第2頁共7頁2.3階段三預(yù)算phaseiiibudgeting藝術(shù)顧問將準(zhǔn)備必要的藝術(shù)品/文物供貨和安裝文件（包括電

10、子文件）。如果需要，藝術(shù)顧問將在甲方確認(rèn)后合理的調(diào)整文件以符合預(yù)算要求。theartconsultantwillpreparenecessarydocumentsforthesupplyandinstallationofartworks/artifacts(indigitalformat)ifnecessary,artconsultantshallmakereasonableadjustmentstodocumentsinordertomeetthebudget.2.4階段四協(xié)調(diào)+監(jiān)督在這個階段藝術(shù)顧問須訪問確定的供應(yīng)商使其了解藝術(shù)顧問的意圖。然而藝術(shù)顧問將不對藝術(shù)品供應(yīng)商的執(zhí)行和完成能力負(fù)有

11、責(zé)任。若甲方要求藝術(shù)顧問訪問甲方推薦的供應(yīng)商，則該訪問的所有費(fèi)用包括：機(jī)票、住宿、餐費(fèi)和交通費(fèi)等將由甲方支付。duringthisstage,theartconsultantshallmakefactory/studiovisitstoensurethattheworksofthemakersareconsistentwiththeintentoftheartconsultant.however,theartconsultantshallnotbeheldliableforthecompetenceinproperexecutionandperformanceoftheworkwhichare

12、entrustedtotheprofessionalartsupplier.forclientnominatedsuppliers,alltravelexpensesincludingairfare,accommodation,meals,transportation,etcshallbebornebytheclient.2.5階段五交貨+安裝完成第四階段的工作后，藝術(shù)顧問將會同甲方進(jìn)行最后的工地檢查，設(shè)計(jì)師和甲方將根據(jù)招標(biāo)文件和產(chǎn)品說明書檢驗(yàn)合同的完成情況。最終結(jié)果以甲方簽字確認(rèn)為準(zhǔn)。若在以上工作完成后甲方再委托藝術(shù)顧問附加大量的藝術(shù)品和/或文物設(shè)計(jì)，則必要時雙方可另行協(xié)商相關(guān)費(fèi)用。upon

13、completionofphaseivandreceiptofpayment,theartconsultantshallconductafinalsitereviewinspectionwiththeclient,interiordesignerandtheawardedartsuppliertoverifythattheworkiscompletedinaccordancetothetenderdocumentationandspecifications.thefinalreviewshallbecompletedwhentheclientcertifiestheapproval.shoul

16、0usd3,000總計(jì)算usd60,0003.3合同總金額，不包括發(fā)票、稅務(wù)、報關(guān)代理費(fèi)用。銀行手續(xù)費(fèi)由乙方自行負(fù)責(zé)。本合同屬于不含稅的境外勞務(wù)合同，根據(jù)相關(guān)稅法規(guī)定及稅務(wù)機(jī)關(guān)的要求，需在合同簽訂后報稅務(wù)機(jī)關(guān)核批，按筆代扣代繳相關(guān)稅費(fèi)后，甲方方可付款。本合同未約定的相關(guān)情況，應(yīng)以相關(guān)部門的法律法規(guī)規(guī)章等規(guī)定為準(zhǔn)。thetotalcontractvalueexcludesofficialreceipts,usetaxes,customcharges.eachpartiesbankchargeswillbebornebythemselves.3.4合同總金額中包括6次到#33全部的差旅費(fèi)(留宿一晚

17、)。6tripstositeareinclusiveinthiscontractincludingalltravelexpense.3.6於本合同有效期之內(nèi)，如工程需附加出差次數(shù)到工地，費(fèi)用由甲方支付。按實(shí)報實(shí)銷原則，藝術(shù)顧問可獲償還機(jī)票費(fèi)用及所有暫墊費(fèi)用包括酒店(留宿一晚,國際五星級酒店)、膳食和交通費(fèi)費(fèi)用。additiontripstositeasrequiredbytheprojectwouldbebornebytheclient.artconsultantistobereimbursedairticketandalsoalloutofpocketexpensesincludingacc

18、ommodation(onenightoverstayininternationalfivestarhotel),mealsandtransportationforthedurationofvalidityofthecontract.3.7乙方完成各階段工作、并經(jīng)甲方書面確認(rèn)后，出具相應(yīng)的發(fā)票經(jīng)甲方確認(rèn)后予以支付，其余在收到有效發(fā)票之日起三十日（30）內(nèi)支付，甲方逾期付款每天按應(yīng)支付費(fèi)用0.3%向乙方支付違約金。支付乙方的款項(xiàng)應(yīng)以人民幣，并以電匯方式匯入指定的帳戶.uponcompletionofeachphaseandwithwrittenconfirmationfromtheclient,

20、港元)/328-18-07699-4(美元)銀行代碼swiftcode:scbkhkhh4.規(guī)定generalprovisions:以下條款,雙方同意并履行:thefollowingresponsibilitiesareagreedto:4.1甲方或設(shè)計(jì)師需提供給乙方相關(guān)的全套設(shè)計(jì)/運(yùn)作要求、項(xiàng)目進(jìn)度、項(xiàng)目預(yù)算明細(xì)等,以便乙方進(jìn)行設(shè)計(jì)深化。theclientand/orinteriordesignershallfurnishtotheartconsultantfullinformationastotheirdesign/operationaldirections/requirements,pr

21、ojectschedule,projectbudgetbreakdownandallsuchinformation,whichshallbepertinenttothecreationandcarryingoftheartconsultancy.4.2甲方或設(shè)計(jì)師需提供一套復(fù)印和光盤autocad室內(nèi)設(shè)計(jì)建筑施工圖和彩色效果圖予乙方，所有圖紙需按比例繪制。theclientand/orinteriordesignershallprovideasetofhardandsoftcopyoftoscalerelevantdrawingsaswellascolorrenderingsandsample

22、ofspecialeffectinteriorfittingoutmaterials.4.3乙方不能控制，不賠償和不負(fù)責(zé)任何與項(xiàng)目有關(guān)的施工方法、技術(shù)、程序、裝配、供貨期或安全措施，以及沒有按照裝飾畫及藝術(shù)品圖紙安裝所產(chǎn)生的后果。theartconsultantshallnothavecontrolorchargeofthemeans,methods,techniques,sequences,orproceduresoffabrication,procurement,shipment,deliveryorinstallationorforsafetyprecautionsandprograms

23、inconnectionwiththework,fortheactsoromissionsofthesupplierorforthefailuretocarryouttheworkinaccordancewiththeartworkandartifactsdocuments.4.4項(xiàng)目完成后，如乙方將此項(xiàng)目中現(xiàn)有的照片、圖片，作為乙方的廣告宣傳材料使用的，須事先征得甲方的同意。itisexpresslyagreedbetweenthepartiesheretothattheclientuponcompletionprovidetheartconsultantwithphotographsoft

24、heprojectandallowtheartconsultantaccesstothesiteaftercompletionandhavetherightinperpetuitytouseprojectphotographsandadvertisingcopyforuseinadvertising,publicrelations,andpressmaterialssupportingtheartconsultant.第5頁共7頁4.5本合同未經(jīng)雙方協(xié)商一致不得任意終止。任何一方如在沒有合理理由的情況下要求終止本合同，應(yīng)提前30天通過書面形式通知對方。bothpartiescannotterm

25、inatecontractwithoutmutualagreement.thisappointmentmaybeterminatedbyeitherpartyupona30-daynoticeinwritingtotheother.howeveronepartyhastherighttorequestcontinuationofcontracttotheother.4.6當(dāng)甲方非因乙方原因提前終止本合同時，甲方將支付乙方已完成部分工作的費(fèi)用。intheeventofearlyterminationnotcausedbytheartworkconsultant,theclientshallpay

26、uptotheworkcompleteduponsuchearlytermination.4.7雙方均應(yīng)遵守本合同約定，切實(shí)履行合同義務(wù)。任何一方如有違約行為，應(yīng)承擔(dān)相應(yīng)的違約責(zé)任。bothpartiesshallcarryoutthedutiesinthiscontract.ifanypartiesintendtoviolatethecontractinanymeans,he/sheshallbearanyliabilitiescaused,4.8乙方應(yīng)按本合同附表的工作進(jìn)度、配合其他設(shè)計(jì)/工程進(jìn)度、逐步完成各階段的設(shè)計(jì)，若延遲，則乙方應(yīng)向甲方支付按該延遲部分的設(shè)計(jì)費(fèi)用、以每逾期一天支付0.3%的利率計(jì)算的違約金；若延遲三十（3）天以上，則甲方有權(quán)單方解除本合約，乙方除退還甲方已付費(fèi)用外，且乙方應(yīng)按本項(xiàng)目合同總金額的10向甲方支付違約金。theartconsultantwillcarryoutworkaccordingtotheprojectscheduleasstatedatappendix1.ifartconsultantworkisdelayedbymorethan30days
