1、租賃合同lease contract出租方:(以下簡(jiǎn)稱甲方):lessor (hereinafter referred to as party a):承租方:(以下簡(jiǎn)稱乙方):tenant (hereinafter referred to as party b):甲、乙雙方經(jīng)過(guò)友好協(xié)商一致訂立本合同,以資共同遵守。party a and party b , having had friendly discussion, hereby agree to enter into the following contract to be abided by both parties 一、物業(yè)地址:甲方

3、s 三、租賃期限:租賃期自 年一月一日起至 年一月 日止為期 年一個(gè)月。甲方應(yīng)于 年一月一日以前將房屋騰空交給乙方使用。lease terms :the lease term shall be from(mouth) (day) (year), to(month) (day) (year). and party a should vacate the house and turn it over to party b for use before.(month) (day) (year).四、定金1、乙方應(yīng)付的定金為 元整,乙方于年月 日以前支付給甲方定金共計(jì) 元整。2、在本合同簽泄之后至租期

6、l translate intoautomatically.五、租金1、數(shù)額:雙方議定租金為每月 元整,乙方以 形式支付給甲方。匯率按支付當(dāng)日中國(guó)人民銀行公布之外匯官方牌價(jià)中間價(jià)計(jì)。2、租金調(diào)整約定:-3、支付方式:租金按 個(gè)月為壹期支付,第一期租金于 年 月 日以前付清,以后每期租金于 的 日前繳納,先付后住(若乙方以劃帳形式支付租金,則匯出日為支付日,匯費(fèi)由匯出方承擔(dān)),甲方收到租金后應(yīng)予以書(shū)而簽收。4、如乙方逾期支付租金,則須支付每天相當(dāng)于月租金百分之一的滯納金;若逾期且在經(jīng)甲 方正 式通知后仍未付租金總計(jì)超過(guò)拾個(gè)工作日,則視為乙方自劫退租,構(gòu)成違約,甲方有權(quán)收回房 屋,并追究乙方違約責(zé)

10、ty a, if party b still delays in the excess of ten working days, it shall deemed as automatically quitting tenancy, which shall constitute of contract 六、保證金1、為確保房屋及其附屬設(shè)施之安全與完好及租賃內(nèi)相關(guān)費(fèi)用之如期結(jié)算,乙方同意于一年 月 日之前支付給甲方 元整。作為乙方確保合同之保證金。甲方在收到保證金后應(yīng)予以書(shū)而簽收。2、除合同另有約左之外,甲方應(yīng)于租賃關(guān)系消除且乙方遷空、點(diǎn)清、并付清所有應(yīng)付費(fèi)用后, 當(dāng)天將保證金全額無(wú)息退還乙方。3

11、、因乙方違反本合同的規(guī)定,而產(chǎn)生的違約金、損害賠償以及應(yīng)付租金及相關(guān)費(fèi)用,甲方可在 保證金扣抵,不足部分乙方必須在接到甲方付款通知后十天內(nèi)補(bǔ)足。deposit of security:lto ensure that the house and its accessory facilities are safe and in good condition and that accounts of relevant fees are settled on schedule during the term of lease, party b agrees to pay to party a befo

13、b has vacated the house , left everything in the house intact and paid up all expenses due 4 、 any penalty for breach of contract, compensation for damage and rental and other relevant fees payable arising from party b s violation of the provisions of the contract may be made up for by party b withi

14、n ten days of the receipt of the notice of payment issued by party a 七、其他費(fèi)用1 .乙方應(yīng)承擔(dān)租賃期內(nèi)的水費(fèi)、電費(fèi)、煤氣費(fèi)、通訊費(fèi)和其他由乙方實(shí)際使用而產(chǎn)生的費(fèi)用, 并按單如期繳納。2、地租、房產(chǎn)稅、租賃所得稅、房屋維修費(fèi)、物業(yè)管理費(fèi)等原由甲方支付的費(fèi)用,仍由甲方承 擔(dān)。other fee:1、party b should bear the water, electricity, gas and communication fees and all other fees incurred by party b in act

15、ual use and pay the bills on schedule during the term of lease 2 、 the land rent, house tax, income tax and house maintenance fee, management fees that were originally payable by party a shall continue to be paid by party a.八、甲方的義務(wù):1、甲方須按時(shí)將房屋及附屬設(shè)施交付乙方使用。2、房屋設(shè)施如因質(zhì)疑原因,自然損耗或?yàn)?zāi)害而受到損壞時(shí),甲方有修繕的責(zé)任并承擔(dān)有關(guān)的費(fèi) 用。3

16、、甲方應(yīng)確保所出租的房屋享有出租的權(quán)利,如在租賃期內(nèi),該房屋發(fā)生所有權(quán)全部或部分的 轉(zhuǎn)移、設(shè)泄他項(xiàng)物權(quán)或英他影響乙方權(quán)益的事情時(shí),甲方應(yīng)保證所有權(quán)人,他項(xiàng)權(quán)利人或 其他影響乙方權(quán)益的第三者能繼續(xù)遵守本合同所有條款,反之如乙方權(quán)益因此而遭受損 害,甲方應(yīng)負(fù)賠償責(zé)任。obligations of party a:1 、 party a shall turn over the house and accessory facilities (see the appendix for detail) on schedule to party b for use 2 、 party a shall be

17、responsible for repairing any damage of the house due to poor quality, natural tear and wear or calamities and bear the expenses thereof 3、party a should ensure that the house let out is entitled, to the lease if all or part of the ownership of the house is transferred, other rights item are settled

18、, or any other happening affects the rights and interests of party b during the leasehold, party a should guarantee that the owner, person to the rights item or any other third party that affects the rights and interest of party b continue to abide by all the articles of the contract otherwise, part

19、y a shall be liable for compensating to loss to the rights and interests suffered by party btherefro m.九、乙方的義務(wù):1、乙方應(yīng)按合同的規(guī)左,按時(shí)支付租金、保證金及其他各項(xiàng)應(yīng)付費(fèi)用。2、乙方經(jīng)甲方同意,可在承租用房?jī)?nèi)進(jìn)行裝修及添垃設(shè)備。租賃期滿后,乙方可將添置的 可拆 動(dòng)的動(dòng)產(chǎn)部分自行拆運(yùn),并保證不影響房屋的完好及正常使用。3、未經(jīng)甲方同意,乙方不得將承租的房屋轉(zhuǎn)租或分租,并愛(ài)護(hù)使用租賃的房屋。如因乙方的過(guò) 失或過(guò)錯(cuò)致使房屋及設(shè)施受到損壞,乙方應(yīng)負(fù)賠償責(zé)任。4、乙方應(yīng)按本合同的約泄合法使用租

20、賃房屋,不得擅自改變使用性質(zhì),不應(yīng)存放危險(xiǎn)物品,如 因此發(fā)生損害,乙方應(yīng)承擔(dān)全部責(zé)任。obligations of party b:1 、 party b should pay the rental, deposit of security and other fees payable on schedule according to the provisions of the contract 2 、 party b may, upon approval by party a , fit up the rented house and add equipment therein during

21、 the leasehold upon expiration of the leased hold, party b may remove the added part of property that is removable, but it must ensure that the house is in good condition for normal use 3a party b must not transfer the lease of the house it has rented or sublet it without the approval by party a. pa

22、rty b should take good care of the house rented party b shall be liable for compensating for any damage caused to the house and facilities due to party b* s fault or misuse 4 、 party b should use the rented house lawfully according to the provisions of the contract it must to not change the nature o

23、f the use of the house without authorization. no hazardous materials and goods shall be allowed to be kept in the house if any damage is attributable to such use, party b shall fully liable 十、合同終止及解除的規(guī)定:1、乙方在租賃期滿后,乙方有優(yōu)先承租權(quán),如需續(xù)租,應(yīng)提前兩個(gè)月通知對(duì)方,由雙方另 行協(xié) 商續(xù)租事宜。2、租賃期滿后,乙方應(yīng)在 天內(nèi)將承租的房屋交還甲方,如有留宜的任何物品,在未取得甲方諒解之下,

24、均視為放棄,任憑甲方處置,乙方?jīng)Q無(wú)異議。3、本合同一經(jīng)雙方簽字后立即生效,未經(jīng)雙方同意,不得任意終止,如有未盡事宜,甲、乙雙 方可另行協(xié)商。termination and dissolution of the contract:1 if party b intends to renew the leased hold upon its expiration, it should notify party a of such intention two month in advance then, the two parties shall discuss matter over the ren

25、ewal of leasehold 2 upon the expiration of the leasehold, party b should turn the rented house back to partya within clays any belongings left behind in the house shall,without obtaining previous understanding of party a, be deemed as things given up by party b and shall be disposed of by party a at

26、 its discretion, to which party b shall raise no objection 3 - this contract shall go into effect the moment it is signed by both parties it must not be terminated at will without the approval of both parties anything not covered in the contract shall be discussed separately by party a and party b 十

27、一、違約處理:1、甲乙任何一方如未按合同的條款履行,導(dǎo)致中途終止合同,并且過(guò)錯(cuò)方在未征得對(duì)方諒解的情 況下,則視為違約,雙方同意違約金為 元整。若違約金不足彌補(bǔ)無(wú)過(guò)錯(cuò)方之損失,則違約方還需就不足部分支付賠償金。3、凡在執(zhí)行本合同或與本合同有關(guān)的事情時(shí)雙方發(fā)生爭(zhēng)議,應(yīng)首先友好協(xié)商,協(xié)商不成,可向 有管轄權(quán)的人民法院提起訴訟。handing of breach of contact:1、if failure of either party a or party b to fulfil the articles of the contract before its expiration, the p

28、arty at fault shall be deemed as violating the contract without obtaining the understanding of the other party the two parties agree that the penalty for breach of contract shall be in case such penalty is not sufticient to make up for the loss suffered by the faultless party the party that has violated the contract shall pay additional compensation.3 、
