32、人民共和國(guó)海上交通安全法、中華人民共和國(guó)海洋環(huán)境保護(hù)法、中華人民共和國(guó)船舶交通管理系統(tǒng)安全監(jiān)督管理規(guī)則等有關(guān)法律、規(guī)章，制定本細(xì)則。第二條 本細(xì)則適用于在瓊州海峽船舶交通管理系統(tǒng)管理水域（以下簡(jiǎn)稱QZVTS管理水域）內(nèi)航行、停泊和作業(yè)的船舶、設(shè)施（以下簡(jiǎn)稱船舶）及其所有人、經(jīng)營(yíng)人和代理人。外國(guó)籍非軍用船舶通過瓊州海峽時(shí)，除遵守外國(guó)籍非軍用船舶通過瓊州海峽管理規(guī)則外，還應(yīng)遵守本細(xì)則。第三條 中華人民共和國(guó)海南海事局是監(jiān)督實(shí)施本細(xì)則的主管機(jī)關(guān)。海南海事局設(shè)置的瓊州海峽船舶交通管理中心（以下簡(jiǎn)稱交管中心）依據(jù)本細(xì)則負(fù)責(zé)具體實(shí)施船舶交通管理。第二章 船舶報(bào)告第四條 船舶在下列情況下，應(yīng)通過甚高頻無線電

33、話（以下簡(jiǎn)稱VHF）向交管中心報(bào)告：1、在進(jìn)入QZVTS管理水域抵達(dá)東口或西口報(bào)告線時(shí)；2、在駛離?？诟?、新港、新海港、馬村港、海安港、鋪前港和三墩港抵達(dá)航道1號(hào)浮標(biāo)時(shí)；3、在駛離錨地和港區(qū)水域抵達(dá)?？诨蚝０矆?bào)告線時(shí)。船舶報(bào)告內(nèi)容：船名、國(guó)籍、呼號(hào)、船籍港、船舶總長(zhǎng)、最大吃水、裝載情況、航行意圖、特別航行要求（包括試航、測(cè)速、調(diào)試羅經(jīng)、疏浚、打撈等）以及交管中心需要了解的其它情況。拖帶船舶還應(yīng)報(bào)告其拖帶長(zhǎng)度及航行意圖。第五條 船舶在QZVTS管理水域內(nèi)發(fā)生交通事故、污染事故、船員或旅客出現(xiàn)意外等緊急情況或發(fā)現(xiàn)其他船舶發(fā)生上述情況時(shí)，應(yīng)立即報(bào)告。第六條 船舶發(fā)現(xiàn)在QZVTS管理水域內(nèi)的助航標(biāo)志或

34、導(dǎo)航設(shè)施移位、滅失、損壞、失?；蛴械K航行安全的障礙物、漂浮物及其它妨礙航行安全的異常情況，應(yīng)立即報(bào)告。第七條 交管中心的VHF工作頻道為08頻道和25頻道，其中08頻道為船舶報(bào)告頻道，25頻道為業(yè)務(wù)通話頻道。第八條 在QZVTS管理水域內(nèi)航行、停泊和作業(yè)的船舶，應(yīng)在VHF08或16頻道上保持守聽，并及時(shí)回答交管中心的詢問。第三章 船舶航行與錨泊第九條 交管中心對(duì)QZVTS管理水域內(nèi)的船舶交通秩序及交通安全實(shí)行監(jiān)控和管理。第十條 船舶在中水道航行時(shí)，只要安全可行，應(yīng)盡量靠近其右舷的該水道的浮標(biāo)行駛。第十一條 船舶在北水道航行時(shí)，北上航行的船舶應(yīng)在以北水道17號(hào)浮標(biāo)的連線以東的水域行駛；南下航行的

35、船舶沿該連線以西的水域行駛。第十二條 船舶禁止在QZVTS管理水域內(nèi)錨泊。如有特殊情況需要在QZVTS管理水域錨泊者，必須報(bào)經(jīng)交管中心同意并在指定地點(diǎn)錨泊。緊急情況下，船舶在拋錨后，應(yīng)立即報(bào)告，并接受管理。第十三條 為避免危及人命財(cái)產(chǎn)安全或環(huán)境污染，船長(zhǎng)和引航員在船舶航行中采取緊急措施時(shí)，應(yīng)及時(shí)報(bào)告。第四章 交通服務(wù)第十四條 交管中心在固定的時(shí)間或認(rèn)為必要的任何時(shí)間播送他船動(dòng)態(tài)、助航標(biāo)志狀況、水文氣象、航行警（通）告和其他重要安全信息。第十五條 應(yīng)船舶請(qǐng)求或交管中心認(rèn)為有必要協(xié)助航行時(shí)，交管中心可向船舶提供有關(guān)安全航行的咨詢意見或建議。船舶不再需要助航時(shí)，應(yīng)及時(shí)通知交管中心。第十六條 為避免船

36、舶發(fā)生緊迫局面和船舶交通事故，交管中心可向船舶提出建議或發(fā)出危險(xiǎn)警告。第十七條 在QZVTS管理水域內(nèi)發(fā)生船舶交通事故，交管中心可采取應(yīng)急措施并協(xié)助進(jìn)行救助工作，支持各類聯(lián)合行動(dòng)。第十八條 應(yīng)船舶所有人、經(jīng)營(yíng)人或代理人的請(qǐng)求，交管中心可為其傳遞有關(guān)救助、打撈或污染清除等信息。第五章 法律責(zé)任第十九條 本細(xì)則的實(shí)施，不免除船長(zhǎng)對(duì)本船安全航行的責(zé)任，也不免除引航員安全引領(lǐng)船舶的責(zé)任。第二十條 本細(xì)則的實(shí)施，不免除船長(zhǎng)或引航員遵守其他法律、法規(guī)的責(zé)任。第二十一條 對(duì)違反本細(xì)則的，主管機(jī)關(guān)可依據(jù)有關(guān)法律、法規(guī)和規(guī)章給予相應(yīng)的處罰。第六章 附 則第二十二條 本細(xì)則中下列用語(yǔ)的含義是：“船舶交通管理系統(tǒng)”

37、系指由主管機(jī)關(guān)設(shè)置的對(duì)船舶交通實(shí)施監(jiān)督、管理和控制并提供咨詢服務(wù)的系統(tǒng)。“船舶”系指按有關(guān)國(guó)際公約和國(guó)內(nèi)規(guī)范規(guī)定應(yīng)配備通信設(shè)備及主管機(jī)關(guān)要求加入VTS系統(tǒng)的船舶。“瓊州海峽東口報(bào)告線”由三條線段組成，線段的確定方法是：端點(diǎn)20°2539N、110°3059E和端點(diǎn)20°2539N、111°0418E的聯(lián)線；端點(diǎn)20°2539N、111°0418E和端點(diǎn)20°0057N、111°0418E的聯(lián)線；端點(diǎn)20°0057N、111°0418E和端點(diǎn)20°0057N、110°5539E

38、的聯(lián)線。“瓊州海峽西口報(bào)告線”由端點(diǎn)20°0036N、109°4242E和端點(diǎn)20°1330N、109°5512E的聯(lián)線組成?！昂？趫?bào)告線”系指端點(diǎn)20°0648N、110°0248E和端點(diǎn)20°0648N、110°2000E的聯(lián)線。“海安報(bào)告線”系指端點(diǎn)20°1206N、110°0524E和端點(diǎn)20°1448N、110°1654E的聯(lián)線?！碍傊莺{船舶交通管理系統(tǒng)管理水域”系指瓊州海峽東、西口報(bào)告線以內(nèi)，除去瓊州海峽內(nèi)所有已建成使用的港口、錨地水域和進(jìn)出港航道等之外的船舶可

40、 Peoples Republic of China and the Safety Management Regulations Of Vessel Traffic Service Of the Peoples Republic of China , for the purpose of strengthening the traffic control of Qiongzhou Strait, ensuring the safety navigation, promoting the traffic efficiency and protecting the environment.ARTI

41、CLE 2 These rules are applicable to all vessels and installations (hereinafter referred to as the Vessels ) which are navigating, berthing, and operating within the Qiongzhou Strait Vessel Traffic Service (hereinafter referred to as the VTS) management water area, including their owners, operators a

42、nd agents.Non-military vessel of foreign nationality passing through the Qiongzhou Strait must observe these rules in addition to the Rules For The Control Of Non-military Vessels Of Foreign Nationality Passing Through The Qiongzhou Strait.ARTICLE 3 The Hainan Maritime Safety Administration of the P

43、eoples Republic of China is the competent authority being responsible for the management of the enforcement of these rules. The Qiongzhou Strait Vessel Traffic Service Center of the Hainan Maritime Safety Administration (hereinafter referred to as the VTS Center) is the body to enforce these rules.

44、CHAPTER REPORTARTICLE 4 Vessels shall report to the VTS Center via the Very High Frequency radio telephone (hereinafter referred to as the VHF) in the following circumstances:1) while entering VTS management water area upon the arrival at the Eastern Report Line or Western Report Line;2) while leavi

45、ng Haikou port, Haikou Xingang port, Xinhai port, Macun port, Haian port, Puqian port and Sandun port upon the arrival at the fairway buoy No 1;3) while leaving anchorage and harbor water area, upon the arrival at the Haikou Report Line or Haian Report Line.The report shall include: ships name, nati

46、onality, call sign, port of registry, overall length, maximum draught, stowage of cargo on board, navigational intention, special navigational requirement (including trial voyages, survey speed, debug compass, dredge up, salvage etc.) and other information as required by the VTS Center. 48、shall promptly report to the VTS Center.ARTICLE 6 A vessel shall promptly report to the VTS Center upon finding aids to navigation or navigational facilities off-position, missing, damaged or abnormal, obstacles, floating objects or any other unusual situation which may impair safe navigation.ARTICL

49、E 7 The VTS Centers VHF working channels are channel 08 and 25. Channel 08 is used for calling, channel 25 is used for detailed information.ARTICLE 8 All vessels navigating, berthing and operating within the VTS management water area shall keep watch on the VHF channel 08 or 16 and respond to the re

50、quirements of the VTS Center in ample time.CHAPTER NAVIGATING AND ANCHORINGARTICLE 9 The VTS Center will take an overall surveillance on all vessels traffic safety and keep traffic in order in the VTS management water area.ARTICLE 10 Vessels proceeding along the Zhong Shuidao shall keep as near to t

51、he outer limit of the fairway which lies on her starboard side as it is safe and practicable.ARTICLE 11 While proceeding along the Bei Shuidao, northbound vessels shall navigate in the water which lies on the east of the line linking buoy No 1 and buoy No 7; southbound vessels shall navigate in the

52、water which lies on the west of the line linking buoy No1 and buoy No7.ARTICLE 12 Anchoring in the VTS management water area is prohibited. When forced to anchor by necessity, vessels shall apply the VTS Center for permission and anchor in the allocated position. In the case of emergency, vessels sh

53、all report to the VTS Center while anchoring and follow the instruction and direction made by the VTS Center.ARTICLE 13 While the master(s) or pilot(s) takes an emergency measure to avoid affecting the safety of life, property and/or environment, report shall be promptly made to the VTS Center.CHAPT

54、ER VESSEL TRAFFIC SERVICEARTICLE 14 The VTS Center may provide the vessel movements, conditions of aids to navigation, hydrology and meteorology data, navigational warning(notices) as well as other important information at a regular time or any time as necessary. ARTICLE 15 At time when requested by

55、 the vessel or the VTS Center deems it necessary to assist the navigation, the VTS Center may provide suggestions or recommendations for safe navigation. If the vessel no longer needs such service, it should promptly inform the VTS Center.ARTICLE 16 The VTS Center may give navigation instructions or

56、 warning in order to prevent any emergency situation or traffic accident.ARTICLE 17 Should there be a vessel traffic accident within the VTS management water area, the VTS Center may take emergency measures to assist the rescue action and to provide support to the allied activities.ARTICLE 18 At the request of the ship owners, operators or agents, the VTS Center may transfer information about rescue, salvage or pollutant-cleaning.CHAPTER
