1、合同編號(hào): _聘(雇)用契約書甲方: _乙方: _簽訂日期: _年_月_日第1頁(yè)共11頁(yè)聘(雇)用契約書_(以下簡(jiǎn)稱甲方)為應(yīng)業(yè)務(wù)需要,聘(雇)用_先生(女士)(以下簡(jiǎn)稱乙方)為約聘(雇)人員,雙方訂立契約條款如下:一、聘(雇)用期間:自_年_月_日起至 _年_月 _日止。二、聘(雇)用報(bào)酬:甲方按月支給乙方報(bào)酬_薪點(diǎn)( _元)。三、工作內(nèi)容(具體敘明) : _。四、受聘(雇)責(zé)任:乙方受聘(雇)后須確保甲方公務(wù)機(jī)密,有保密期限者從其規(guī)定,無保密期限者自離職日起 _年為限(解聘(雇)者亦同) 。乙方不得有不法行為或違背約定義務(wù), 如有違背者, 除涉及民、刑事責(zé)任,由甲方依法追究外,并得隨時(shí)解聘

2、(雇) 。在聘(雇)用期間,乙方愿接受與甲方約定之工作上的指派調(diào)遣,并遵守此工作上之相關(guān)規(guī)定。若乙方違背上述相關(guān)規(guī)定確屬情節(jié)重大,甲方得隨時(shí)終止契約;甲、乙雙方如因特別事故須提前終止契約時(shí),應(yīng)于一個(gè)月前提出預(yù)告,經(jīng)甲、乙雙方協(xié)議后乙方始得離職。乙方離職時(shí),應(yīng)先依照規(guī)定辦妥離職手續(xù)。如有損害公物,或侵權(quán)情事(或違反甲方智能財(cái)產(chǎn)權(quán)規(guī)定),應(yīng)負(fù)責(zé)賠償。五、乙方在受聘(雇)用期間,除應(yīng)遵守甲方一切行政法規(guī)之規(guī)定外,其假期、離職儲(chǔ)金給與、 勞工保險(xiǎn)及全民健保等,依左列約定:假期核給:依 _辦理。離職儲(chǔ)金之扣繳及給與依 _規(guī)定辦理,按月扣繳儲(chǔ)存生息,并于離職時(shí)依規(guī)定發(fā)給。第2頁(yè)共11頁(yè)按乙方每月支報(bào)酬之百

3、分之 _提存儲(chǔ)金, 其中百分之 _由乙方于每月報(bào)酬中扣繳作為自提儲(chǔ)金,另百分之 _由甲方提撥作為公提儲(chǔ)金,并由甲方在金融機(jī)構(gòu)開立專戶儲(chǔ)存孳息,列帳管理。乙方因契約期滿離職、或經(jīng)甲方同意于契約期限屆滿前離職、或在職因公、因病或意外死亡者,發(fā)給公、自提儲(chǔ)金本息。乙方因違反契約所定義務(wù)而經(jīng)甲方予以解聘, 或未經(jīng)甲方同意而于契約期限屆滿前離職者,僅發(fā)給自提儲(chǔ)金之本息。其余未盡事宜請(qǐng)參考 _有關(guān)規(guī)定。乙方受聘(雇)用期間,甲方應(yīng)善盡投保勞工保險(xiǎn)及全民健康保險(xiǎn)之義務(wù)。六、乙方于受聘 (雇)期間之著作或工作成果, 如系于甲方企劃下,或法定工作期間完成者,其所有權(quán)歸屬甲方。因前開著作或工作成果所生之智能財(cái)產(chǎn)權(quán)

4、,應(yīng)依本院之相關(guān)規(guī)定辦理。七、本契約期間屆滿當(dāng)然失效,如因業(yè)務(wù)需要須續(xù)聘時(shí),另行簽訂新契約。八、本契約未訂定事項(xiàng),悉依聘用人員聘用條例及 _相關(guān)規(guī)定辦理。九、本契約以中文本為準(zhǔn)。如中、英文二本互相歧異或抵觸時(shí),以中文本為準(zhǔn)。十、本契約法律糾紛以_法院為第一審管轄法院。十一、本契約乙式參份,除一份由甲方報(bào)院備查外,另由雙方各執(zhí)乙份。第3頁(yè)共11頁(yè)甲方(簽章): _乙方(簽章): _年_月_日_年_月 _日附件This Agreement is made and entered intoon the _dayof_ ,_byand between_(InstituteorPreparatoryOf

8、esany law or regulation, or breachesthisAgreement or working rules concerned , A may initsdiscretionreprimandB or terminatethisAgreement.A also reservestheright to institute suit against B for civil compensation orto impose criminal liability.4.2Duringtheterm ofthisAgreement, B shallcomply withthe d

9、irections and instructions of his/her supervisors,performhis/herdutiesinaccordance withallregulationsandrelevantworkingrules.Where Bviolatesanyobligationspecified inthis paragraph and thecase isconsidered tobeserious in nature, A may in its discretion terminate thisAgreement. Ifatany timethepartiesi

10、ntendtoterminatethisAgreement due tocauses beyond the reasonablecontrolofsuchparty,eithershallgivethirty(30)days'noticeofcancellationtotheotherpartypriortothe intendedtermination date. B shall vacate his/her office under andpursuant to the stipulations agreed upon by both parties. Bshall submit

11、to the proceedings in prescribed manner as tobe vacatedofhis/heroffice.Incaseofanyoneofthe第5頁(yè)共11頁(yè)following conditions which is due to B's fault,B shall beresponsibleforcompensation :(1)Where B inflictsdamage toor e cessively abuses machinery, equipment , tools, rawmaterials, productsor other art

12、iclebelonging to AcademiaSinica ; (2) Where B commits torts;(3) Where B violates A'sownership of intellectual property rights.5. B shall comply with any administrative regulations and rules provided by A. In regard to the matters of absence onleave ,"pay-as-you-go"contributionbenefit,l

13、aborinsuranceand nationalhealthinsurance, thefollowingtermsand conditions shall be applicable.5.1"Absenceonleave"shallbeoperatedpursuantto"Regulation of Absence on leave for Personnel served in allEecutiveYuanorganizationsunderCivilContractualRelationship".5.2The deductionand gra

14、ntof "pay-as-you-go"contributionbenefitshallbeoperatedpursuantto"Regulationof'pay-as-you-go'contributionbenefit for PersonnelservedinallorganizationsandschoolsunderCivilContractualRelationship".Certainamount ofsalaryshallbe deductedpermonth and accrueon thefinancialinstit

15、ute overthetermofthis employment.第6頁(yè)共11頁(yè)5.2.1 An amount equaltoseven percent(7) of the monthlysalary shall be contributed. Fifty percent ( 50 ) of thecontributionshallbedrawnfromB'smonthlysalary.( hereinaftercalled "personalcontributionbenefit")A shallprovide the other fifty percent (

16、50 ) of the contribution( hereinafter called "public contribution benefit"), andshall open a special account on financial institute as toaccumulateandmanage thiscontribution(personal pluspublic) .5.2.2Thetotalamountofthecontributionbenefits(personalplus public)shallbe grantedtoB, if atany

17、time(a) B leavestheofficeon the e piryofthis Agreement, (b)B vacates the office prior to the e piration date with theconsentof A, and(c)B deceases due toundertakingofduty ,illness or accident.5.2.3Theamountofpersonal contributionbenefitsaccumulated shall be granted to B, if at any time (a) Aterminat

18、esthisAgreementinasmuchasB breachesanyobligation, and (b) B resigns from the office prior to thee piration date without the consent of A.5.2.4Any matteroreventnotprovidedin the conte t ofthisArticleshallbeoperatedpursuantto"Regulationof第7頁(yè)共11頁(yè)'pay-as-you-go'contributionbenefitforPersonn

19、el served inallorganizationsandschoolsunderCivilContractualRelationship" and relevant regulations.5.3During the term of this Agreement, A shall insure Bsubjecttothetermsandconditionspursuanttolaborinsuranceregulationsandnationalhealthinsuranceregulations.6. Both parties agree that A shall own p

20、roprietary right pertaining to the literary works or achievements completedby B under the projectsinitiated or coordinated by A duringthe term of this Agreement. The ownership of intellectualpropertyrights(includingbutnotlimitedtocertainpatents ,trademarks,copyrights,technicalinformationandknow-how

21、) accrued from the literary works or achievements herein contained is subject to the relevant regulations and rules provided by A.7. E pirationAttheepirationofthetermofthisagreement ,theemploymentrelationshipshallautomaticallyterminatewithout any condition. A new employment agreement shall besigned
