3、ergencycontactphonenumber:第三條本協(xié)議自2011年10_月01日起至2012年09月3a曰止。Thiscompactapplyduringtheperiodcommencingonthedateof2011-10-1andendingonthedateof2012-9-30.第四條根據(jù)甲方工作需要及任職要求，乙方同意以兼職形式為甲方提供如下服務：Baseontheneedsandrequirementoffirstparty,secondpartyprovidepart-timeserviceasfollows:1,與甲方指定客戶進行約見和面談，依甲方要求、協(xié)助甲方處

4、理相關事宜；meetappointedcostumers,accordingtotherequirementfromfirstparty,providecorrelativeassistance.2, 根據(jù)甲方要求協(xié)助甲方處理緊急事件；Baseontheneedsoffirstparty,provideassistanceonemergency.3, 作為培訓講師，為甲方培訓提供培訓支持工作。Astrainer,provideassistanceontraining.第五條甲方每月8日（公歷，遇節(jié)假日順延）支付乙方上月服務報酬，乙方服務報酬（稅前）為:人民幣1000元/次*天;大寫：人民幣10

5、00元/次*天。如服務時間不足半天服務費用以125元/小時計算。Bythe8thdayofeachmonth（theGregoriancalendar,postponeinthecaseofholidays）第六條甲方制定的勞動紀律和規(guī)章制度應當符合法律、法規(guī)的規(guī)定，并向乙方公示，乙方應當在確認后遵照執(zhí)行。Labordisciplinesandregulationswhichmadebyfirstpartyshouldfulfillthelegalandregulatoryrequirement,andpublicnoticesecondpartywhoshouldactonthiscompa

7、，乙方將有機會了解并使用甲方的有關商業(yè)秘密(包括但不限于經營策略、軟件系統(tǒng)、薪酬系統(tǒng)、營銷渠道、員工或客戶資料、供應商、價格系統(tǒng)、知識產權等所有資料及文件)，乙方有在協(xié)議期內及協(xié)議解除后保守甲方商業(yè)秘密不對外泄露的義務，也不能用于為自己謀取利益的經營活動中。乙方不得將涉及甲方商業(yè)秘密的實物、文字材料、電子文檔等以竊取、摘抄、復制、傳真、拍照、電子郵件等方式占有、傳播、出售、使用或允許他人使用甲方的商業(yè)秘密。本條款所規(guī)定行為，乙方如有違反，應向甲方支付違約金人民幣壹拾萬元。Becauseoftheemployer-employeerelationship,secondpartywouldknow

10、nalsumof100,000RMB.第九條乙方有下列情形之一的，甲方可以解除本協(xié)議，但是應當提前十日以書面形式通知乙方：Firstpartycouldcarryoutrescissionofcompactinanyofthefollowingcircumstances,however,shouldnoticesecondpartybywrittenform10daysearly.患病或者非因工負傷，醫(yī)療期滿后，不能從事原工作也不能從事由甲方另行安排的工作的；Inthecaseoffallillorwoundinlineofduty,whenthemedicaltreatmentexpires

11、,ifnotbeabletoparticipateformerworkorotherappointedworkfromfirstparty;不能勝任工作，經過培訓或調崗，仍不能勝任工作的；Incompetent,aftertrainingortransfer-position,stillincompetent;本協(xié)議訂立時所依據(jù)的客觀情況發(fā)生重大變化，致使協(xié)議無法履行，經甲乙雙方協(xié)商不能就變更協(xié)議內容達成一致的；Duetoobjectivereasons,unabletofulfillcompact,moreover,cannotreachtoanagreementwithvariationo

12、ncontract.法律、行政法規(guī)規(guī)定可以解除協(xié)議的。Rescissionofcompactisinaccordwithlawandadministrativeregulation.第十條乙方有下列情形之一的，甲方可以單方面隨時解除協(xié)議，并對乙方不作任何經濟補償；乙方因下列行為給公司造成損害的，甲方有權要求乙方賠償損失：Firstpartycouldcarryoutrescissionofcompactinthefollowingcircumstancesatanytime,withoutmakinganycompensation;firstpartyhastherighttoletthese

13、condpartycompensateforlossinanyofthefollowingcircumstances.在應聘過程中提供的個人證件、體檢、簡歷等個人資料有欺詐行為的；Iftherewerefraudactsonpersonalpapers、medicalcertificates、resume;按公司獎懲的有關規(guī)定，嚴重失職，工作不負責任，玩忽職守、消極懈怠給公司利益造成損害的；Inaccordancewithcorrelativeprovisionofreward/punish,grossneglectofduty,irresponsible,listlessduringwork

14、,resultlosstoprofitofcompany.乙方盜竊公司、員工或客戶財物的；報銷費用時有虛報或假報金額等行為的；Secondpartystealpropertyfromcompanyoremployees;deceptionduringtheprocessofapplyingforreimbursement.泄露公司商業(yè)秘密；利用職務以權謀私、損公肥私的；Breachofconfidence;takeadvantageofdutytoseekpersonprofit.欺詐客戶、公司，謀取私利的，私下從事同業(yè)工作的；Stingclient、companytoseekpersonal

15、profit,participatesametypeofworkinsecret結黨營私、破壞員工關系，生活作風不端正的；Formcliques,wreckrelationshipsBetweenemployees,badlifestyle(immorallove).違法行為或不良社會行為而給甲方形象造成巨大傷害的；unlawfulactorbadbehaviorwhichdiminishthereputationofTalent.有賭博、吸毒等不良行為的；gamble、drugtakingorotherbadbehavior被依法追究刑事責任或違法被處罰的；Beingundertakenfo

16、rcriminalresponsibilityorpunishedforbreakingthelaw.嚴重違反公司的勞動紀律、規(guī)章制度的；法律規(guī)定或雙方約定的其它情形。Committingaseriousbreachofdiscipline、regulationorotheragreementbetweentwoparties.第十一條乙方解除協(xié)議，應當提前三十日以書面形式通知甲方。Secondpartymakeearlyrescissionofcompact，shouldprovide30dayspriornoticetofirstparty.第十二條甲乙雙方約定無論何種情形解除協(xié)議，乙方都
