1、浙江大學(xué)學(xué)科博士后研究人員聘用合同ContractofEmploymentforPostdoctoralResearcherZhejiangUniversity甲方PartyA：浙江大學(xué)ZhejiangUniversity甲方授權(quán)單位PartyA，sAthorizedInstitute:乙方（申請(qǐng)人）PartyB（TheApplicant）:性另1JGender：國(guó)籍Nationality:護(hù)照號(hào)碼PassportNo:乙方申請(qǐng)到甲方博士后科研流動(dòng)站從事博士后研究工作，甲方經(jīng)考核擬同意接收。經(jīng)甲乙雙方平等協(xié)商，就乙方到甲方從事博士后研究工作達(dá)成如下協(xié)議：PartyBappliesforthep

2、ost-doctoralresearchpositionofPartyA'spostdoctoralresearchstation,andPartyAagreestoapprovePartyB'sapplicationafterassessment.PartyAandPartyBagreeonthefollowingtermsandarticlesinaspiritofequalityandconsensuswithregardtoPartyB'spostdoctoralresearchatPartyA.一、合同的期限Article I TermofEmployment

3、乙方在甲方從事博士后研究工作的期限為年，自乙方到甲方辦完報(bào)到手續(xù)之日（即進(jìn)站之日）起開(kāi)始計(jì)算。若乙方申請(qǐng)?zhí)崆盎蜓悠诔稣?，則本合同的有效期至甲方書(shū)面批準(zhǔn)的出站日期為準(zhǔn)。ThetermofemploymentofPartyBisyears,fromthedatewhenPartyBaccomplishestheregistrationprocedure（theregistrationdateinthestation）.Duringtheemployment,ifPartyBappliesforleavingthepostdoctoralresearchstationinadvanceorpostp

4、oning,thecontractofemploymentwouldexpireuntilthedateapprovedbyPartyAinwritten.二、乙方的義務(wù)Article II ObligationsofPartyB（一）在站期間全職在甲方工作，按規(guī)定及時(shí)完成科研任務(wù)。I. PartyBshallworkfulltimeatPartyAduringtheemploymentandcompletethescientificresearchtasksintimeaccordingtotheregulations.（二）遵紀(jì)守法，遵守全國(guó)博士后管委會(huì)和甲方的有關(guān)規(guī)章制度并履行應(yīng)盡的義務(wù)

PartyBshallabidebythelawsandregulationsofthePeople'sRepublicofChinaandtherulesandregulationsofChinaPostdoctoralCouncilandZhejiangUniversity,andfulfilltheobligations.（三）進(jìn)站之日起三個(gè)月內(nèi)應(yīng)進(jìn)行科研課題的開(kāi)題工作，并填寫(xiě)浙江大學(xué)博士后研究人員開(kāi)題審核表，明確在站期間科研工作的主要內(nèi)容、工作目標(biāo)、預(yù)期成果等，經(jīng)合作導(dǎo)師及學(xué)院確認(rèn)后交甲方備案。III. Theargumentationoftheresearchpro

6、gramshallbecarriedoutwithinthreemonthsafterregistration.PartyBshallalsofilloutTheReviewFormofResearchProposalforPostdoctoralResearchersofZhejiangUniversityandclarifythemaincontents,workobjectivesandexpectedachievementsoftheresearchprogram.Afterconfirmedbythesupervisorandtheinstitute,theformwillbesub

7、mittedtoPartyAforrecord.（四）在站期間按甲方職工考核規(guī)定參加年度考核。IV. PartyBshallparticipateinannualassessmentaccordingtotheemployees'assessmentrequirementsofPartyAduringtheemployment.（五）乙方應(yīng)按規(guī)定時(shí)間及時(shí)辦理出站手續(xù)，對(duì)于未經(jīng)甲方書(shū)面許可而不及時(shí)辦理出站手續(xù)者，不再享受甲方博士后所有待遇，自動(dòng)終止與甲方的人事關(guān)系，并辦理退站。V. PartyBshallfinishtheleavingformalitieswithinprescribe

8、dtime.ThosewhofailtofinishtheleavingformalitiesinduetimewithoutwrittenpermissionfrompartyAwillnolongerenjoyallthebenefitsfromPartyA,andtheemploymentrelationshipwithPartyAshallbeautomaticallyterminatedandwillbewithdrewfromthestation.（六）合同終止后，乙方應(yīng)當(dāng)遵循誠(chéng)實(shí)信用原則，履行保護(hù)甲方的知識(shí)產(chǎn)權(quán)、以及保守秘密的義務(wù)。VI.Aftertheterminationof

9、thecontract,PartyBshallfollowtheprincipleofhonestyandcredibilityandfulfillitsobligationtoprotectPartyA'sintellectualpropertyrightsandkeepsecrets.（七）乙方來(lái)甲方報(bào)到時(shí)，須將人事檔案轉(zhuǎn)移至甲方，并提交博士學(xué)位證書(shū)原件。若乙方來(lái)甲方工作前有工作單位，須將人事和工資關(guān)系轉(zhuǎn)移至甲方，否則不能辦理報(bào)到手續(xù)。VI. PartyBshallsubmittheoriginaldoctoralcertificatetoPartyAwhilegetregistr

10、ation.三、甲方的義務(wù)Article III ObligationsofPartyA（一）依照國(guó)家和甲方有關(guān)規(guī)定為乙方提供工資、社會(huì)保險(xiǎn)、住房公積金、子女入托等待遇。I. PartyAshallprovidebenefitsforPartyBaccordingtothelawsandtherulesofPartyA,includingsalary,socialinsurance,housingprovidentfund,kidsnursery,etc.（二）甲方合作導(dǎo)師在乙方進(jìn)站前，明確乙方在站期間科研課題的主要內(nèi)容及預(yù)期目標(biāo)，并提供必要的科研條件，保證乙方在進(jìn)站后可立即開(kāi)始工作。II.

11、ThesupervisorofPartyAshallconfirmthemaincontentsandexpectedobjectivesofPartyB'sresearchprogrambeforeadmissionandprovidenecessaryresearchconditionstoensurePartyBtostartworkimmediatelyafterregistration.課題主要內(nèi)容Maincontentsoftheresearch:預(yù)期目標(biāo)Expectedobjectives:（三）甲方合作導(dǎo)師在乙方進(jìn)站之日起三個(gè)月內(nèi)，應(yīng)對(duì)乙方科研課題完成開(kāi)題審核，進(jìn)一步明

12、確乙方在站期間科研工作的主要內(nèi)容、工作目標(biāo)和預(yù)期成果等，并將浙江大學(xué)博士后研究人員開(kāi)題審核表交所在院系備案存檔。III. ThesupervisorofPartyAshallreviewtheproposaloftheresearchprogramwithinthreemonthsafterregistrationtofurtherclarifythemaincontents,workobjectivesandexpectedachievementsofPartyBsresearchworkduringtheemploymentandsubmitTheReviewFormofResearchP

13、roposalforPostdoctoralResearchersofZhejiangUniversitytotheinstituteforrecord.（四）乙方在站期間按甲方職工進(jìn)行年度考核，工作期滿出站前一個(gè)月內(nèi)安排出站科研評(píng)審等工作。IV. PartyAshalltakeanannualassessmentforPartyBduringtheemploymentaccordingtotheemployeesassessmentrequirementsofPartyAandorganizefinalevaluationofPartyBrsesearchworkonemonthbefore

14、completion.四、知識(shí)產(chǎn)權(quán)歸屬Article IV OwnershipofIntellectualPropertyRights甲乙雙方一致同意，乙方在站期間因通過(guò)發(fā)明、設(shè)計(jì)、創(chuàng)作等完成的專(zhuān)利、作品、商標(biāo)、植物新品種等成果而產(chǎn)生的知識(shí)產(chǎn)權(quán)（含上述有關(guān)知識(shí)產(chǎn)權(quán)成果的申請(qǐng)權(quán)）歸屬于甲方。BothPartyAandPartyBunanimouslyagreethattheintellectualpropertyrights,whicharisefromalltheachievements（includingpatents,works,trademarks,newplantvarieties,e

15、tc.）completedbyinvention,design,creationduringtheemploymentofPartyB,shallbevestedinPartyA（includingtheapplicationrighttotheaboveintellectualpropertyrights）.四、合同的變更、解除和終止ArticleVRevision,RescissionandTerminationoftheContract（1） 訂立本合同所依據(jù)的法律、行政法規(guī)、規(guī)章制度發(fā)生變化，本合同應(yīng)變更相應(yīng)的內(nèi)容。1. Thecorrespondingcontentsofthisco

16、ntractshallberevised,ifthelaws,regulations,rulesaresubjecttochangeonwhichthecontractisbased.（2） 訂立本合同所依據(jù)的客觀情況發(fā)生重大變化，致使本合同無(wú)法履行的，經(jīng)甲乙雙方協(xié)商同意，可以變更本合同相關(guān)內(nèi)容。II. Iftheobjectivesituationonwhichthecontractisbasedchangesandthecontractcannotbefulfilled,therelevantcontentsofthiscontractcanbechangedbytheagreemento

17、fbothparties.（三）乙方有下列情形之一的，甲方可以解除本合同：III. IfanyofthefollowingsituationsoccursduringPartyBstermofemployment,PartyAshallterminatethecontract:1. 乙方申請(qǐng)退站；*PartyBappliesforstoppingtheresearchwork;2. 乙方因違反校紀(jì)校規(guī)等；*PartyBviolatestherulesandregulationsofPartyA;3. 經(jīng)甲方考核，乙方業(yè)務(wù)能力不適合繼續(xù)從事博士后研究工作的；*PartyBhaspoorresea

18、rchabilityandisunabletoengageinpostdoctoralresearchworkcontinuouslyafterassessment.4. 年度考核不合格的；*TheannualassessmentofPartyBisunqualified.5. 乙方因患病等原因難以完成研究工作的.*PartyBfailstoaccomplishtheresearchworkbecauseofphysicalillness,etc.（四）甲方因上述原因解除本合同的，應(yīng)當(dāng)書(shū)面通知乙方。無(wú)需給予乙方任何補(bǔ)償。乙方應(yīng)在解除本合同后一周內(nèi)辦理完退站手續(xù)。IV.Ifanyoftheabo

19、vesituationsoccursduringPartyBstermofemployment,PartyAshallgivePartyBanoticeabouttherescissionofthecontractinwrittenandtherewillbenocompensationforPartyB.PartyBshallcompletetheleavingformalitieswithinoneweekaftertherescissionofthiscontract.六、違約責(zé)任ArticleVILiabilityforBreachoftheContract（一）甲、乙任何一方違反本合

20、同，給對(duì)方造成損失的，應(yīng)當(dāng)賠償損失。I. IfeitherPartyAorPartyBviolatesthiscontractandcauseslossestotheotherparty,therelevantpartyshallcompensatefortheloss.（二）乙方有下列情形之一的，應(yīng)當(dāng)賠償甲方損失：II. IfPartyBhasoneofthefollowingsituations,PartyBshallcompensatePartyAfortheloss:1. 由甲方出資對(duì)乙方進(jìn)行的專(zhuān)業(yè)培訓(xùn)，乙方中途退站或完不成科研任務(wù)而退站，應(yīng)向甲方支付違約金。違約金數(shù)額為甲方已支付的全

21、部培訓(xùn)費(fèi)。*PartyBshallpayPartyAtheliquidateddamagesfortheprofessionaltrainingtoPartyBpaidbyPartyA,ifPartyBwithdrawsfromthestationhalfwayorleavesthestationduetofailingofcompletingtheresearchwork.TheamountofliquidateddamagesisthetotaltrainingfeepaidbyPartyA.2. 由甲方批準(zhǔn)乙方出國(guó)（出境）研修或?qū)W術(shù)交流，乙方中途退站或完不成科研任務(wù)而退站，應(yīng)向甲方支付違

22、約金。違約金數(shù)額為乙方出國(guó)（出境）研修或?qū)W術(shù)交流期間甲方支付給乙方的薪酬、福利費(fèi)和出國(guó)（出境）經(jīng)費(fèi)。*PartyBshallpayPartyAtheliquidateddamagesforPartyB'soverseastrainingoracademicexchangesapprovedbyPartyA,ifPartyBwithdrawsfromtheresearchstationhalfwayorleavesthestationduetofailingofcompletingtheresearchprogram.Theamountofliquidateddamagesisthefe

23、epaidbyPartyAtoPartyBduringtheperiodofPartyB'soverseastrainingoracademicexchange（includingcompensation,welfareandoverseasfund）.（三）乙方未經(jīng)甲方書(shū)面批準(zhǔn)而不及時(shí)辦理出站手續(xù)，造成的后果由乙方承擔(dān)。111. PartyBshallberesponsiblefortheconsequencesifPartyBfailstofinishtheleavingformalitiestimelywithoutwrittenpermissionfrompartyA.七、其他ArticleVIIOtherArticles（1） 乙方未經(jīng)甲方同意或未辦離校手續(xù)擅自離開(kāi)甲方，按浙江大學(xué)教職工考勤辦法和請(qǐng)假制度給予相應(yīng)的行政處理。1.
