1、合作研究協(xié)議書(shū)撰寫(xiě)說(shuō)明及范本基本內(nèi)容（但不僅限于如下部分）：1. 合作研究題目2. 雙方主持人和主要參加者包括合作雙方主持人和主要參加者的列表。3. 合作研究計(jì)劃、分工和進(jìn)度簡(jiǎn)述研究課題的內(nèi)容，清楚闡明合作雙方分別承擔(dān)的研究工作和相應(yīng)責(zé)任，必要時(shí)需提出時(shí)間表。4. 經(jīng)費(fèi)來(lái)源和使用簡(jiǎn)述雙方合作研究的經(jīng)費(fèi)來(lái)源和如何使用，必要時(shí)外國(guó)合作方需提供相關(guān)證明或書(shū)面承諾5. 知識(shí)產(chǎn)權(quán)歸屬、使用和轉(zhuǎn)移闡述合作研究成果的歸屬、使用或共享等有關(guān)約定；6. 研究期限、變更和退出寫(xiě)明合作研究的起止日期，如何處理項(xiàng)目結(jié)題前項(xiàng)目主持人和主要參加人的變更等。7. 協(xié)議法律效力的約定 協(xié)議生效、有效期、中止等的有關(guān)約定8.

Duration, Amendament and Withdrawal Clearly state the specific dates that the collaborative research starts and ends and the process to deal with changes concerning principle investigators and main participants before the research terminates. 7. The IPR of common results will be shared by all parties concerned. The IPR of results obtained independently

12、 by one party without any assistance from the other party or obtained before or after the collaboration will belong to the respective party. Authorship and acknowlegement in papers should be based on contribution to the project and decided in discussions involving all parties concerned. Before submi

13、tting any application for realted intellectual property rights, one party should first consult with the other party and may proceed only after the other party has agreed without objection on the ownership of the IPR. Without the written consent of both parties, none of the projects common IPR may be

14、 transferred to any third-party. VI. Duration, Amendament and Withdrawal The project will terminate upon completion of all research activities, which is agreed on the date of *. A research partner who decides to withdraw from the project before the above-mentioned date shoold notice other members of the collaborative research at least three months before the change happens.
