1、精選優(yōu)質(zhì)文檔-傾情為你奉上編號:_培訓(xùn)機(jī)構(gòu)英語外教聘用合同甲 方:_乙 方:_簽訂日期:_年_月_日甲方: 乙方:經(jīng)甲乙雙方友好協(xié)商,達(dá)成如下協(xié)議:一、協(xié)議期限:1. 協(xié)議期限: 年 月 日至 年 月 日。2. 試用期限: 年 月 日至 年 月 日。二、職能劃分1. 甲方雇傭乙方為我英語培訓(xùn)機(jī)構(gòu)英語外籍教師。2. 乙方需遵守甲方各項職能條款,認(rèn)真?zhèn)湔n。乙方須為每節(jié)課準(zhǔn)備教案及教學(xué)計劃。甲方會定期或不定期檢查外教上課準(zhǔn)備情況。三、工作時間1. 乙方一周工作5天,2天休息日。一周上課時間為25小時。辦公時間為5小時(其中包括學(xué)員口試、準(zhǔn)備教案及和教學(xué)相關(guān)的事宜)。每節(jié)課不超過50分鐘。乙方有義務(wù)參

2、加甲方安排的戶外活動及戶外代課行為。2. 若乙方一周沒有完成其上課時間,則會在其后的工作日內(nèi)補(bǔ)上相應(yīng)的上課小時數(shù),包括取消課程,學(xué)員未到課程,學(xué)員一周前取消的課程。課程為少兒課程和成人課程。四、工資及福利每月工資總額為: 元,其中包括如下項目:1. 乙方每月基本工資為 元。2. 甲方每月10號支付乙方上月工資。3. 甲方每月支付乙方 元交通補(bǔ)助,以幫助乙方按時完成上課。4. 甲方每月支付乙方 元電話補(bǔ)助。若乙方使用公司電話來打私人電話,則扣除電話補(bǔ)助。5. 甲方每月支付乙方 元作為醫(yī)療補(bǔ)助。6. 乙方每月可得到 元全勤獎勵,其中包括:不遲到、不早退、不請假。若乙方出現(xiàn)遲到、早退、提前下課行為,

3、則每次扣除 元。若曠到整節(jié)課,則扣除 元。若乙方遲到或提前下課15分鐘以上且并未在24小時前通知甲方者,則按曠到一整節(jié)課情況處理。乙方若生病或遇緊急事情需請假者,則須提前通知甲方。7. 乙方每工作一個整月,則每月可享受 元飛機(jī)補(bǔ)助。8. 乙方病假、事假以及法定節(jié)假日期間都無補(bǔ)助工資。9. 若乙方病假超過30天,則視為自動解除勞動合同關(guān)系。五、乙方義務(wù):1.乙方須遵守中華人民共和國法律。2.乙方須遵守甲方員工守則及規(guī)章制度,遵守培訓(xùn)中心指南。3.乙方若出現(xiàn)犯罪、入獄等行為,則該合同自行解除。4.乙方有義務(wù)積極參加甲方安排各種商業(yè)及非商業(yè)活動及戶外代課行為。5.乙方須提供個人照片作為甲方安排相應(yīng)廣

4、告宣傳。6.乙方不得傳播宗教或和政治有關(guān)的演講,以及宣傳非法宗教信仰等活動。乙方不得在課堂上以任何行為宣揚(yáng)非法宗教信仰及和政治有關(guān)的內(nèi)容。7.乙方不得使用任何形式的體罰對學(xué)生進(jìn)行懲罰或?qū)W(xué)生和同事進(jìn)行言語上的侮辱和歧視。8.乙方不得在本中心以外的學(xué)校擔(dān)任任何形式的兼職外教、家教,若發(fā)生此種行為,甲方則有權(quán)扣除乙方自此行為開始時的工資。9.乙方不得將此合同及私人電話號碼以QQ、MSN或郵件等形式告知給學(xué)生,若給學(xué)校帶來任何損失,則乙方承擔(dān)全部責(zé)任。10.乙方須幫助中方老師及其他中方員工提高英語水平。11.乙方不得穿著奇裝異服、拖鞋等進(jìn)入課堂。12.乙方應(yīng)該對此合同的內(nèi)容保密,不得將合同內(nèi)容告之第

5、三方。六、甲方職責(zé)1.甲方將乙方介紹給學(xué)校所有員工。2.甲方須協(xié)助乙方教學(xué)活動,幫助其處理學(xué)員投訴。3.甲方提供乙方相應(yīng)工作條件。4.甲方提供合作者。5.甲方每月按時支付乙方工資七、合同終止1. 如遇以下情形,合同自動終止A 乙方違背甲方職責(zé)范圍。B 乙方破壞勞動紀(jì)律。C 甲方將會將乙方在校表現(xiàn)評估考慮在內(nèi),如果乙方持續(xù)兩個月內(nèi)排名表現(xiàn)評估最后一位,甲方將依據(jù)評估結(jié)果解除此合同。2. 試用期之后,甲方如對乙方表現(xiàn)不滿意,應(yīng)給予乙方提前兩個月的通知,否則甲方應(yīng)給予乙方 元的未提前告知終止合同罰金。如果乙方需要解除合同,乙方需提前兩個月給予甲方書面通知并從甲方處得到許可,甲方也可通過同樣程序進(jìn)行合

6、同終止。否則,乙方給予甲方 元人民幣作為未提前告知終止合同罰金,在乙方未經(jīng)允許就終止合同的情況下,甲方將扣除其他所有補(bǔ)貼。八、違背本合同應(yīng)承擔(dān)的責(zé)任乙方應(yīng)承擔(dān)乙方對甲方造成的經(jīng)濟(jì)損失,甲方依據(jù)違反者的責(zé)任決定實(shí)際的賠償責(zé)任和經(jīng)濟(jì)損失。九、甲乙雙方應(yīng)通過協(xié)商解決爭端。十、其他本合同一式兩份,每份具有同等法律效應(yīng),甲乙雙方各執(zhí)一份,合同自簽字蓋章之日起生效。甲方: 乙方:年 月 日 年 月 日Foreign Teacher Employment ContractAfter discussion and negotiation, Party A and Party B have agreed to

8、ty A employs Party B as English Teacher in the training center.2. Party B must follow the job responsibility regulations as stated by Party A, making thorough preparations before classes. Party B must prepare teaching plan before every class, Party A will arrange supervisor to have regular or irregu

9、lar check the teaching plan as well as observe the whole class, having told Party B 1 minute before class begins.No.3 Working time1. Party A will arrange the time for start and end of work. The teaching hour will be 25 per week. Each class is not more than 50 minutes. Party B also has the responsibi

10、lity to go for outdoor activities and classes arranged by Party A. Not more than 5 classes will be given each day. 2. If Party B does not make the full teaching hours per week, the left teaching hours will be added in the future working days, including the cancelled classes, no showing class and no

11、booking classes from students of the previous weeks. The classes are adults class and kids class.3. Party B gets winter holiday as well as summer holiday totally for . The exact time will be reached by Both Party.No.4 Salary and welfare. The salary for one month including the other items will be 440

12、0 , the salary includes the following items:1. According to Party A current salary system, Party Bs salary will be RMB/month. 2. Party A pays salary at the 10th of every month. On the 10th of every month, Party B will get the salary of last month.3. Party A will pay Party B RMB/month as transportati

13、on allowance in order to guarantee Party Bs timely arrival.4. Party A will pay Party B RMB/month as communication allowance. If Party B fails to answer the phone call from school , this allowance will be cut.5. Party A will pay Party B RMB/month as medical treatment allowance.6. In case Party B is l

14、ate for work / class or leaves work / class early , he/she pays a fine of RMB. While missing one period of class will be fined RMB if Party B doesn't inform Party A at least 24 hours in advanced, late for class or leave the class early within 15 minutes is equal to miss the whole class. Party B

15、must inform Party A in case of sickness lateness or emergency.7. Party B enjoys RMB air ticket allowance if Party B works for Party A for a whole month, Which means no leave, sick leave, no lateness for class or leave the class early for the whole month. Party B will get the RMB allowance when this

16、one year contract expires .8. If Party B ask for holidays or during the legal festivals, Party B will get no salary.9. If Party B ask for sick holidays more than 30 days, it means Party B will dismiss the contract.No.5 Party B's Obligations 1. Party B should obey The Peoples Republic of China Co

17、nstitution2. Party B should comply with Party As << Staff Manual>> rules and regulation, obeying centers confidential rule.3. In case Party B commits a serious crime, being condemned or put into jail, this contract will be discontinued automatically.4. Party B must fulfill the job respon

18、sibilities as stated by Party A and guarantee the quality and quantity, Party B has the duty to participate in all the business and non-business activities and outdoor activities organized by Party A. 5. Party B should provide personal photograph to Party A to do some advertisements on websites conn

19、ected with the school. 6. Party B should not spread the rumors or make speeches about politics, religions or use offensive words etc in public. 7. Party B must not use any forms of physical punishment or insult to the students or colleagues under any circumstances.8. Party B should not do part time

20、job, lectures and personal tutoring outside training center. If this happens, Party A will deduct Party Bs salary since the month Party B started.9. Party B should not give the contact information to the students such as QQ , MSN E-mail or telephone number, if cause any lost expenses of the school,

21、Party B should take all the responsibilities.10. Party B should help Chinese teachers and the other staff to improve their English level. Certain hours a month, the fixed time should be agreed on by both sides.11. Party B should not wear underpants or slippers or clothes which are indecent.12. Party

22、 B should keep company information confidential and must not reveal this to a third party.No. 6 Party A's Obligations 1. Party A shall introduce Party B to the school staff.2. Party A shall conduct direction, supervision and evaluation of Party B's work, and shall inform Party B if there are

23、 complaints about Party Bs class teaching.3. Party A shall provide Party B necessary working conditions.4. Party A shall provide co-workers.5. Party A shall pay Party B's salary regularly by the month. No.7 The termination of contract.1. If one of the following happens, Party A could dismiss thi

24、s contract and get Party B fired.a Party B disobey Party B's Obligations.b Party B breaks the labor disciplines. c Party A will take foreign teachers evaluation into consideration when Party B is working in training center, if Party B continues on the last position for two months, Party A could

25、dismiss this agreement based on the result of the evaluation test.2. After the probation, party A decides to terminate the contract when Party B hasn't broken his/her obligations, Party A should give Party B two months notice, or Party A will pay RMB to Party B for ending the contract without informing Party B. If Party B wants to dismiss this agreement, Party B need to
