1、 / 10 / 10兼職用工協(xié)議甲方（用人單位）：乙方（勞務(wù)人員）：名稱姓名：法定代表人（主要負(fù)責(zé)人）：身份證號碼:通訊地址： 通訊地址： 聯(lián)系電話：聯(lián)系電話：鑒于乙方現(xiàn)在屬于兼職用工人員，乙方不具備勞動法律關(guān)系的主體資格，無法與甲方建立勞動（合同）關(guān)系。甲乙雙方經(jīng)平等協(xié)商， 共同決定建立勞務(wù)關(guān)系。因此，本計月服務(wù)協(xié)議屬于勞務(wù)協(xié)議，不在中華人民共和國勞動法調(diào)整范圍內(nèi)，而在中華人民共和國民法 通則的調(diào)整之中。甲乙雙方在充分明確這一法律關(guān)系的基礎(chǔ)上，根 據(jù)民法通則和其他相關(guān)法律、法規(guī)，自愿簽訂本協(xié)議，共同遵守 協(xié)議所列條款。、協(xié)議期限本協(xié)議期限自 年月日起，至 年月日止，其中前90天為試工期（注：

2、本試工期與勞動法中的試用期不是 同一概念）。試工期內(nèi)，甲乙雙方均可無條件隨時通知對方解除本協(xié) 議。二、工作條件甲方應(yīng)根據(jù)國家有關(guān)規(guī)定，為乙方提供符合職業(yè)安全衛(wèi)生條件的工作環(huán)境。三、工作（生產(chǎn)）任務(wù)乙方同意服從甲方的工作（生產(chǎn)）需要，在 崗位, 承擔(dān) 工作（生產(chǎn)）任務(wù)。四、工作要求.乙方的工作崗位由甲方根據(jù)工作需要進(jìn)行安排和調(diào)整。乙方必 須按照甲方的工作要求，盡職盡責(zé)做好工作。.乙方應(yīng)嚴(yán)格遵守國家各項法律規(guī)定。遵守甲方的工作規(guī)范、操 作規(guī)程、勞動安全衛(wèi)生制度等各項規(guī)章制度，包括員工手冊中寫 明的各項規(guī)定和要求。.愛護(hù)甲方財物，保守甲方機密，維護(hù)甲方利益，服從甲方的領(lǐng) 導(dǎo)、管理和教育。.對于因乙方

3、過失給甲方造成經(jīng)濟(jì)損失的，甲方有權(quán)要求乙方承 擔(dān)賠償責(zé)任。五、勞動報酬甲乙雙方約定，乙方的工資為 元/月，在履行本協(xié)議 期間如有薪資調(diào)整或變化，則調(diào)整后按新標(biāo)準(zhǔn)執(zhí)行。乙方作為勞務(wù)人員，在甲方工作期間，只享受本協(xié)議中約定的福 利和待遇，甲方內(nèi)部文件中涉及的員工其他福利或待遇均不適用于乙 方。六、協(xié)議的解除與終止.在本協(xié)議期限內(nèi)，任何一方均有權(quán)提前十五個工作日通知對方 解除本協(xié)議。解除本協(xié)議不需支付經(jīng)濟(jì)補償金。.甲方因乙方違紀(jì)，可隨時與乙方解除本協(xié)議。此時，不需按上 款規(guī)定提前通知乙方。.甲方不按本協(xié)議約定提供必要的勞動條件或勞動報酬時，乙方 可以隨時解除本協(xié)議，不受提前通知的限制。.本協(xié)議到期或

4、過期，如雙方未續(xù)簽，自行終止本協(xié)議，不需提 前通知。.甲乙雙方無論因何原因解除或終止本協(xié)議，乙方均應(yīng)立即辦理 工作交接、歸還甲方財、物等離職手續(xù)。具體程序如下： / 10乙方離職時應(yīng)按規(guī)定交接相關(guān)的工作，直到離職手續(xù)完成為止，公司才發(fā)放當(dāng)月工資 , 如離職時沒有完成歸還甲方財、物等離職手續(xù) 而離開， 甲方有權(quán)在不違反公布及可公開獲悉的法律、 法規(guī)的原則下，扣除乙方的部分工資、 其他報酬及報銷費用， 以抵充乙方欠負(fù)甲方的任何數(shù)額及/或以支付法律、 法規(guī)規(guī)定的其他稅項、 費用等及 / 或以作為其他合法用途。七、其他1 乙方的人事檔案仍由原單位管理，甲方不負(fù)責(zé)處理與乙方人事檔案有關(guān)的任何事宜。2因甲
