1、Tendering IssuesTeam number 4 chose the track of Tendering issues. Based on the contract of Tbilisi Railway Bypass Project, for which the Employer has applied a loan from the European Bank for Reconstruction and Development and the European Investment Bank (hereinafter referred to “the Bank) and inv
2、ites sealed tenders from contractors for the Design and Construction of the Tbilisi Railway Bypass. CRCC 42 Bureau Group Co., Ltd. and 7th Design and Survey Institute formed a joint venture to tender for the project. After a comprehensive discussion, we got a clear idea about the tendering, and we d
3、ivided tendering into two stages: prequalification and tendering stage, during the discussion we analysed every detail of the tendering progress including the requirements that involved in the context and other things that we think need to be shared to all. The works are as follows: I. Prequalificat
4、ionThe requirement of Prequalification of BiddersOn acknowledging the Instruction to bidders, the potential contractors shall enter into the procedure of Prequalification in order to be selected as the competent contractors, prior to the issue of the invitation to bid. It is recommended for large or
5、 complex work and , exceptionally, for custom designed equipment and specialized services. Benefits of Prequalification The prequalification process is of advantage to contractors and purchaser alike.For the contractors: the prequalification process enables contractors, who may insufficiently qualif
6、ied on their own, to avoid the expense of Bidding or to form a joint venture, which may give a better chance of success. For the purchasers:To assess the interest generated by the project among qualified firms, and to make any necessary adjustments in the procurement process.To reduce the amount of
7、work and time involved in evaluation bids from unqualified contractors.To encourage local firms to form joint ventures with other local or international firms, thereby benefiting from their resource and experience; and To reduce significantly, if not eliminate, problems associated with low prices su
8、bmitted by bidders of doubtful capability. Basis for Prequalification The purchaser is responsible for preparing the prequalification documents and evaluating the applicants. The prequalification documents should provide a clear basis upon which prospective bidders can be evaluated, following and ob
9、jective process based on faire and transparent criteria. The documentation sought should always be relevant, clearly stated. 10、ral capabilities should be related to the availability of current, relevant experience and the value of work undertaken. (b) Award of bid and Contract duly signed(c) Brief introduction of works, including scope of work, place, and duration. Personnel CapabilitiesThe managerial and technical competen
11、ce of a contractor is largely related to its key personnel on site. The applicant should demonstrate having staff with extensive experience Applicants should normally be required to name a principle candidate and an alternate for each key position: A minimum number of years of experience in a simila
12、r position; andA minimum number of years of experience and /or number of comparable projects carried out in a specified number of preceding years. Equipment Capabilities An inventory of construction equipment represents a high capital cost overhead to a contractor.Even in such cases, main contractor
13、s may not own the equipment; rather they may relyon specialist subcontractors or equipment hire firms. The availability of thesubcontractor and the specified equipment should be subject to verification (at the timeof prequalification, or at the time of bidding) in such cases.Financial Position Audit
14、ed financialstatements or balance sheets should be sought as a general guide to the financialhealth of the applicant. For example, the financial results over the last five years and theprojection for the following two years should be positiveNames and addresses of the applicants banker(s), as well a
15、s the names andaddresses of individuals familiar with their financial standing.Litigation HistoryPurchasers should be on their guard against contractors who resort to excessive claimsand litigation as a means to increase income after an award of contract. Applicants with a consistent and significant
16、 history of excessive contract arbitration andlitigation resulting in awards or decisions against them should not be qualified to bid.So that the litigation history may be evaluated, applicants should be required to list allcontracts over a stated number of years (normally the last five years) that
17、resulted inlitigation or arbitration proceedings, with an indication of the matters in dispute, theparties involved, the amounts in dispute and the outcome of the litigation.II. Prepare the tendering documentsWe normally organize three groups of people to prepare the tendering documents. Each group
