”,andotherrelevantnationallawsandregulations,aswellasthespecificnatureofthisproject第一條總則Article1GeneralPrinciples1.1合同文件ContractDocuments本合同包含合同、展示、施工圖紙、作法說(shuō)明、招投標(biāo)文件以及合同所指的其他文件，它們均被視為合同的一部分。合同文件應(yīng)該能夠相互解釋， 互為說(shuō)明。組成本合同的文件及優(yōu)先解釋的順序如下：本合同、中標(biāo)通知書(shū)、投標(biāo)書(shū)及其附件、標(biāo)準(zhǔn)、規(guī)范及有關(guān)技術(shù)文件、圖紙、工程量清單及工程報(bào)價(jià)單或預(yù)算書(shū)。合同履行中，發(fā)包人承包人有關(guān)工程的洽商、 變更等書(shū)面下一或文件視為本合同的組成部分。Thiscontract includesthecontract itself, exhibits, construction drawings,explanations ofworkprocedures,tenderdocuments,aswellasotherdocumentsspecifiedbythecontract.Thecontractdocumentsshouldbemutuallyexplainableandmutuallydescriptive.Thedocumentsthatconstitutedthecontractandthepriorityhierarchyofexplanationsofthedocumentsareasfollows:thiscontract;theofficialletterofwinningthetender;Letterofbiddinganditsannex,standards, guidelines, andrelevanttechnical documents,drawings,BillofQuantity(BOQ),quotation ofprices,andprojectbudget.Duringtheimplementation ofthecontract, anywritten agreementsordocumentsbetweentwopartiessuchaschange-ordersarealsoregardedwillbedeemedaspartofthiscontract.1.1.1項(xiàng)目概況ProjectIntroduction1.1.2工程名稱：NameofProject:1.1.3工程地點(diǎn)：LocationofProject:工程范圍：除了本合同其他條款另有說(shuō)明外，乙方應(yīng)提供為履行合同所需的所有服務(wù)，用品以及其他保障工程進(jìn)行所需的必要花費(fèi)以完成下列工作：Scopeoftheproject: unlessotherwiseexplainedbyotherarticlesinthiscontract,PartyBshallprovide allservices,utensils, andothernecessarycostfortheimplementationofthiscontract;thescopeofprojectincludes,butnotlimitedto:※室內(nèi)裝飾工程，詳見(jiàn)附件一和附件二Innerdecoration,seeappendix1&2※室外裝飾工程(門(mén)窗、屋面、臺(tái)階等) ，詳見(jiàn)附件一和附件二Fa?ade(includingdoors,windows,roofandstairs)seeappendix1&2※電器工程，詳見(jiàn)附件一和附件二ElectronicEngineering,seeappendix1&2※空調(diào)工程，詳見(jiàn)附件一和附件二AirConditioningSystem,seeappendix1&2※給排水及采暖工程，詳見(jiàn)附件一和附件二WaterSupply,SewageandHeatingSystem,seeappendix1&2※消防工程FireControlSystem,seeappendix1&2※其他圖紙上所列項(xiàng)目(任何對(duì)原定設(shè)計(jì)的變更應(yīng)提供新的圖紙并有甲方的簽字確認(rèn)) 以上所有的工程項(xiàng)目以下統(tǒng)稱為“工程”。Otheritemslistedintheconstructiondrawings(anychangeddrawingsshallbeprovidedandconfirmedbyPartyA).Alltheseaforementioned itemsaregenerally referredas“project”hereafter.1.132承包方式：乙方以包工包料，包工程質(zhì)量，包安全，包文明施工的方式承包工程N(yùn)atureofContracting:PartyBshallberesponsibleforbothlaborandmaterialsforthisproject,andwill responsible forthequalityofthisproject,safety,aswellascodeofconductduringtheconstructionproject.1.1.4甲方工地代表由甲方指派。On-siterepresentativeofPartyAshallbeappointedbyPartyA1.1.5開(kāi)工日期：Dateoftheprojectbeginning:1.1.6竣工日期：Dateoftheprojectcompletion:1.1.7工程質(zhì)量：質(zhì)量合格，達(dá)到本合同要求和國(guó)家質(zhì)量驗(yàn)收標(biāo)準(zhǔn)，并確保竣工驗(yàn)收一次合格。驗(yàn)收內(nèi)容包括但不僅限于：隱蔽工程；分項(xiàng)工程；實(shí)驗(yàn)報(bào)告；材料檢驗(yàn)報(bào)告。如果由于驗(yàn)收未能一次通過(guò)而導(dǎo)致后續(xù)工程開(kāi)工的延遲， 乙方將按照每日工程總款的2%。金額賠償給甲方作為罰金，但最多不超過(guò)工程總價(jià)款的 5%。Quality ofProject: The qualityshouldbe “Excellent”,and shall meettherequirements bythiscontractand theNational QualityStandards, and shouldbeguaranteedtobeacceptedatthefirstattemptuponprojectcompletion,andshallalsoLEEDcertified.Thescopeofas-built acceptaneeincludes, butnotlimitto:①concealedwork,②itemizedproject,③reportsofexperiments,and④reportsofmaterialtesting.Intheeventofprojectfailstobeacceptedatthefirstinspectionandthusincursdelaysbeginningofthesubsequentprojects.PartyBshallcompensatePartyAatthedailyrateof2 %oofthetotalcontractamoun taspenalty,butthetotalamountshallnotexceed5%ofthetotalcontractamount.1.1.8工程資質(zhì)：在實(shí)施此合同所涉及的工程時(shí)，乙方應(yīng)確保其具有相關(guān)資質(zhì)。如乙方因?yàn)椴痪邆湎嚓P(guān)資質(zhì)導(dǎo)致甲方的損失或工程進(jìn)度的滯后，乙方承擔(dān)全部責(zé)任。Qualifications: PartyBrepresentsandwarrantsitiscompetentandlegitimatetocarryouttheservicesthatsetforthunderthisAgreementwhenimplementingthiscontract.PartyBshallberesponsibleforanydelayoftheconstructioninducedbytheirinsufficientqualifications.1.2合同價(jià)款：ContractAmount本合同價(jià)款為人民幣 ，為固定總價(jià)合同價(jià)款。Thetotalcontractamountisxxxx,whichisfixedcontractamount本合同包括設(shè)備材料費(fèi)、人工費(fèi)、機(jī)械費(fèi)、管理費(fèi)、利潤(rùn)、稅金、代辦費(fèi)用、保險(xiǎn)費(fèi)、運(yùn)輸費(fèi)、勞務(wù)費(fèi)用、總承包服務(wù)費(fèi)以及為完成工程所必須的其他一切費(fèi)用， 和工程各系統(tǒng)檢驗(yàn)檢測(cè)、安裝調(diào)試等費(fèi)用。該款項(xiàng)為甲方應(yīng)付給乙方的全部費(fèi)用，并已經(jīng)包含物價(jià)變動(dòng)因素。Thisagreementincludesthecostofequipmentandmaterials,laborcost,machinerycost,managementcost,profit,tax,governmentchargesonbehalfofPartyA,insuranee,transportation,labor,subcontractservicefee,andallothercostforthecompletionoftheproject,aswellaseverysystemtesting, installation, andcommissioningcosts.ThistotalcontractamountisexactamountthatPartyAshallpaytoPartyBanditincludesthefactofpricefluctuation.1.3工程結(jié)算FinalAuditofproject1.3.1本工程計(jì)價(jià)依據(jù)GB50500-2008《建設(shè)工程工程量清單計(jì)價(jià)規(guī)范》 采用固定總價(jià)，除施工期間甲方要求變更現(xiàn)有圖紙及發(fā)生的增減項(xiàng)洽商，甲方將作價(jià)格調(diào)整。ThisprojectisusingfixedtotalamountaccordingtoGB50500-2008thePricingGuidelinesbyCodeofQuantityinConstructionProjects,exceptthatPartyAmaymakepriceadjustmentintheeventoftheexistingconstructiondrawingsarechangedoraddorremoveanyconstructionworkaccordingtotherequestofPartyA1.3.2所有的人工費(fèi)用都不得以任何理由進(jìn)行過(guò)調(diào)整，結(jié)算時(shí)只接受投標(biāo)文件中約定的價(jià)格。AlllaborcostshallNOTbeadjustedinanyevent.Onlythepricesstimulatedinthebiddingdocumentsareacceptedatthefinalauditaftercompletion.1.3.3因工程調(diào)整而產(chǎn)生的工程洽商， 如洽商費(fèi)用超過(guò)人民幣五萬(wàn)元整， 則洽商文件必須在工程中期驗(yàn)收當(dāng)日被提交給甲方， 所產(chǎn)生的洽商費(fèi)用在交付中期款時(shí)一并核算結(jié)清。 如洽商費(fèi)用低于五萬(wàn)元人民幣整，則洽商文件必須在工程驗(yàn)收當(dāng)日內(nèi)提交給甲方， 所產(chǎn)生的費(fèi)用在交付工程驗(yàn)收款時(shí)一并核算結(jié)清。IfthecostofchangeordersareoverRMB50,000Yuan,thenallchangeordersissuedbecauseoftheconstructionadjustmentsshallbesubmittedtoPartyAonthesamedayoftheconstruction mid-termcheckandacceptanee, andtheapprovedamountwillbepaidtoPartyBwiththeconstructionmid-termpayment;ifthecostsofthechangeordersarelessthan50,000Yuan,thenallchangeordersissuedbecauseoftheconstructionadjustments shallbesubmittedtoPartyAonthesamedayoftheconstruction completioncheckandacceptanee, andtheapprovedamountwillbepaidtoPartyBwiththeconstructioncompletionpayment.第二條政府批復(fù)Article2GovernmentApprovals2.1乙方負(fù)責(zé)協(xié)助甲方辦理此項(xiàng)施工需要辦理的所有政府報(bào)批， 包括但不僅限于消防、環(huán)保的報(bào)批與其他與本工程相關(guān)的報(bào)批，甲方負(fù)責(zé)政府行政審批的費(fèi)用。PartyBshallberesponsible toprocessgovernmentapprovalsrelatedtotheproject,including butnotlimitedto:fire control, environment protection andotherapprovalsrelatedtothisProject.PartyAisresponsibleforthecostsoftheseapprovals2.2乙方負(fù)責(zé)其工程報(bào)備PartyBshallberesponsibleforconstructionapplications,approvalsandrelatedcosts.2.3乙方應(yīng)承擔(dān)2.2所述報(bào)備不全而導(dǎo)致的政府罰金，并且不能順延工期。PartyBshallberesponsibleforanygovernmentfinesduetoincompleteapprovalprocesses,andshouldNOTcausedelayintheconstructionperiod.第三條 甲方的權(quán)利和義務(wù)Article3RightsandObligationsofPartyA3.1向乙方提供經(jīng)確認(rèn)的施工圖紙或做法說(shuō)明五份， 并向乙方進(jìn)行現(xiàn)場(chǎng)交底， 向乙方提供施工所需要的水電設(shè)備，并說(shuō)明使用注意事項(xiàng)。PartyAshallprovideFIVEcopiesofconfirmed construction drawings andexplanationsofworkprocedures,andshallconducttechnicalclarification.PartyAshallprovidePartyBwithnecessarywaterandpowerequipmentandtheinstructionsonusingtheequipment.3.2指派xxxx為甲方駐工地代表，負(fù)責(zé)合同的履行。對(duì)工程質(zhì)量、進(jìn)度進(jìn)行監(jiān)督檢查，辦理驗(yàn)收、變更事宜。甲方的工地代表如果認(rèn)為乙方的某雇員行為不當(dāng)或散漫不羈， 或甲方認(rèn)為該雇員不能勝任，則乙方應(yīng)立即進(jìn)行撤換，并且未經(jīng)甲方實(shí)現(xiàn)書(shū)面許可， 乙方不得在施工中再行雇傭該等人員。被撤換的任何人員應(yīng)盡可以能立即由甲方代表所批準(zhǔn)的勝任的人員代替。PartyAappointsxxxxastheon-siterepresentativetosupervisethefulfillmentofcontractobligations,tooverseethequalitycontrolandchecktheprojectprogress,andtohandleissuessuchasacceptaneeandvariations.Intheeventoftheon-siterepresentativeofPartyAbelievesthatanyemployeeofPartyBhasimproperconductormisbehaviors,orifPartyAconsidersuchemployeeisnotcompetentfortherelevantwork,PartyBshalldismissandreplacethisemployeeimmediately;andunlesshavingreceivedconsentbyPartyAinwritinginadvanee,PartyBshallnolongerhirethespecifiedemployeeinthefollowingphaseofthisproject.PartyBshouldmakeeveryefforttoreplacethedismissedemployeewithcompetentpersonnelauthorizedbyon-siterepresentativeofPartyA.3.3甲方按照付款約定向乙方支付工程款。PartyAshouldmakepaymentstoPartyBaccordingtothepaymentterms.3.4如甲方認(rèn)為乙方確已無(wú)能力繼續(xù)履行合同的， 則甲方有權(quán)解除合同， 乙方必須在接到甲方書(shū)面通知后兩周內(nèi)撤離場(chǎng)地以便乙方繼續(xù)施工。對(duì)乙方完成工程量的結(jié)算不作為撤離場(chǎng)地的條件，結(jié)算應(yīng)在竣工一個(gè)月之內(nèi)完成，付款方式按照本合同條款。IntheeventofPartyAconsiderPartyBisindeedunabletofurtherfulfill itscontractobligations,thenPartyAhastherighttoterminatethecontract,andPartyBshouldvacatetheprojectsitewithintwoweeksafter receiving PartyAsnotice, sothatPartyAcanresumeconstructionassoonaspossible.Confirmation offinished quantity shallNOTberegardedasaprerequisitetoPartyB'svacationoftheprojectsite,andtheconfirmation shouldbeprocessedwithinonemonthaftertheproject completion.Paymentshallbemadeaccordingtothepaymenttermsinthiscontract.3.5甲方有權(quán)要求乙方按照甲方的組織設(shè)計(jì)和施工工期進(jìn)行施工， 乙方如對(duì)甲方的要求和指令不予執(zhí)行的，則按照乙方違約處理，乙方應(yīng)承擔(dān)違約責(zé)任。PartyAhastherighttoinstructPartyBto dotheconstructionaccordingtoPartyA'sorganization andplannedconstruction period;intheeventofPartyBignoresandrefusestoobservePartyA'sinstructions,PartyBwillbedeemedasbreachofthecontract,andPartyBshallbeheldresponsiblefortheliabilitiesofbreachingthecontract.3.6甲方有權(quán)要求乙方服從甲方的統(tǒng)一安排和管理， 乙方的施工人員必須遵守各項(xiàng)規(guī)章制度。 對(duì)于乙方施工人員違規(guī)操作所產(chǎn)生的后果， 乙方承擔(dān)全部責(zé)任。甲方有權(quán)從工程總價(jià)款中扣除相應(yīng)的款項(xiàng)。PartyAhastherighttoinstructPartyBtoobservethegeneralarrangementandmanagementbyPartyA,andtheconstructionstaffsofPartyBmustobserveallrulesandregulations.PartyBshallbefullyresponsiblefortheconsequencesofsuchviolationsbythestaffofPartyB.PartyAhastherighttodirectlydeductthecorrespondingamountfromthetotalcontractamount.3.7甲方所有的通知可以以書(shū)面或口頭形式發(fā)岀， 乙方接獲甲方的通知后應(yīng)根據(jù)通知規(guī)定的內(nèi)容執(zhí)行。AllnoticesfromPartyAcanbemadebothinwritingandorally,buttheoralinstructionsareonlyapplicabletotherepresentativeofPartyA.PartyBshall,uponreceivingnoticesfromPartyA,executethecorrespondingmattersaccordingtothecontentofthenotices.3.8未經(jīng)甲方同意，乙方不得將工程轉(zhuǎn)讓或分包， 對(duì)于乙方將工程擅自轉(zhuǎn)讓或分包的， 甲方有權(quán)解除合同，乙方必須接受并承擔(dān)由此造成的一切后果。PartyBshallNOTtransferorsubcontracttheprojecttoanythirdpartywithouttheconsentofPartyA;intheeventofPartyBtransfers orsubcontracts theprojecttoanythirdpartywithouttheconsentofPartyA,PartyAhastherighttoterminatethecontract,andPartyBmustacceptandberesponsibleforanyconsequeneeofsuchviolation.3.9甲方有權(quán)制定專業(yè)分包商， 并按照乙方在投標(biāo)文件中承諾的配合管理費(fèi)率向乙方支付配合管理費(fèi)。PartyAhastherighttoappointspecialsub-contractors,andshallpaythemanagementfeetoPartyBaccordingtotherateofsubcontract managementandcoordination feestipulatedinthebiddingdocuments3.10按照招標(biāo)文件中的相關(guān)條目，甲方有權(quán)自行采購(gòu)材料供給乙方，并按照乙方在投標(biāo)文件的相關(guān)條目中汲取人工費(fèi)、機(jī)械費(fèi)、輔助材料費(fèi)等向乙方支付費(fèi)用。 甲方?jīng)]有義務(wù)向乙方支付其他費(fèi)用。PartyAhastherighttopurchaseandprovidePartyBwithmaterialsonitsown,andshallpaylaborcost,machinerycost,andaccessorycosttoPartyBaccordingtotherelevanttermsinthebiddingdocuments.PartyAhasnoobligationstopayanyothercoststoPartyB第四條乙方的權(quán)利義務(wù)Article4RightsandObligationsofPartyB4.1參加甲方組織的施工圖紙或做法說(shuō)明的現(xiàn)場(chǎng)交底， 擬定施工方案和進(jìn)度計(jì)劃， 交由甲方審定。施工過(guò)程中，乙方按照甲方的有關(guān)指示及修改變更要求進(jìn)行相應(yīng)調(diào)整。PartyBshallparticipateinthetechnicalclarificationonconstructiondrawingsandexplanations ofworkproceduresorganizedbyPartyA,andshoulddeveloptheconstructionplanandtheprogressscheduleforPartyAtoreview.Duringconstruction,PartyBshouldmakesuchadjustmenttotheconstruction planandtheprogressscheduleperPartyA'sinstructionandchange-orders.4.2指派xxxx為乙方駐工地代表，負(fù)責(zé)合同的履行，按照要求組織施工，保質(zhì)保量、按期完成施工任務(wù)。解決由乙方負(fù)責(zé)的各項(xiàng)事宜。乙方駐工地代表在本公司的工作時(shí)間不得少于 90%工作日。PartyBappointsxxxxastheon-siterepresentativeofPartyBtotakechargeoffulfilling thecontract obligations. Theon-site representative ofPartyBshallorganizetheconstructionaccordingtocontractrequirementssothattheprojectcanbecompletedaccordingtothequalityandquantity requirements andonatimelymanner.Theon-siterepresentativeofPartyBshallworkontheprojectsitefornofewerthan90%ofthetotalworkingdays.4.3嚴(yán)格執(zhí)行施工規(guī)范、安全操作規(guī)程、防火安全規(guī)定、環(huán)境保護(hù)規(guī)定。嚴(yán)格按照?qǐng)D紙或做法說(shuō)明進(jìn)行施工，做好各項(xiàng)質(zhì)量檢查記錄，參加竣工驗(yàn)收，編制竣工資料及工程結(jié)算。PartyBshallstrictlyobserveconstruction guidelines, safetyrequirements,firesafetyregulations, environment protectionregulationsandLEEDrequirements.PartyBshalldotheconstructionbystrictly adheringtotheconstruction drawingsandexplanationsofworkprocedures,andshalleffectivelyrecordeachQA/QCinspection.PartyBshallattendthecompletionacceptanee,anddevelopat-builtsubmittalsandfinalprojectaudit.4.4根據(jù)甲方和設(shè)計(jì)方一致通過(guò)的設(shè)計(jì)圖紙進(jìn)行施工， 遵從甲方工地代表和設(shè)計(jì)方的指示， 如乙方發(fā)現(xiàn)在工程標(biāo)準(zhǔn)和設(shè)計(jì)圖之間存在不一致時(shí)，應(yīng)以書(shū)面形式通知甲方和設(shè)計(jì)方。PartyBshallcarryouttheconstructionaccordingtothedesigndrawingsagreeduponbybothPartyAandthedesigner,shallobservetheinstructions ofdesignerandtherepresentativeofPartyA;intheeventofPartyBfindsinconsisteneebetweenprojectstandardsanddesigndrawings,PartyBshouldinformthedesignerandPartyAinwriting.4.5遵守國(guó)家或地方政府及有關(guān)部門(mén)對(duì)施工現(xiàn)場(chǎng)管理的規(guī)定及甲方的規(guī)章制度， 妥善保護(hù)好施工現(xiàn)場(chǎng)周圍的建筑物、設(shè)備管線等不受損壞。 做好施工現(xiàn)場(chǎng)保衛(wèi)、 消防和垃圾消納等工作，處理好由于施工帶來(lái)的擾民問(wèn)題及周圍單位（住戶）的關(guān)系；如果由于乙方導(dǎo)致任何設(shè)施、 設(shè)備或管道在工地內(nèi)外受損。 將由乙方賠償損失。 乙方負(fù)責(zé)與甲方的施工協(xié)調(diào)事項(xiàng)， 并獨(dú)自完全承擔(dān)所有相關(guān)責(zé)任。PartyBshallobservepoliciesofon-sitemanagementbythestateandlocalgovernmentauthoritiesaswellasPartyA'srulesandregulations;PartyBshallcompensateforthelossestoanyfacilities,equipmentorpipelinesbothinsideandoutsideoftheconstructionyardcausedbypartyB.PartyBshallberesponsibleforthecoordinationofconstructionissueswithpartyA,andshall independently andfullyassumescorrespondingresponsibilities.任何原建筑物結(jié)構(gòu)的拆改或設(shè)備管道的挪移， 乙方應(yīng)向甲方申報(bào)； 在甲方批復(fù)前，不得擅自動(dòng)工。PartyBshouldreporttopartyAofanydemolitionoforvariationtoanyoriginalbuildingstructureorre-position ofequipmentpipes;PartyBwillrefrainfromanysuchworkpriortoreceivingP artyA'sapproval乙方應(yīng)保護(hù)所有設(shè)備以及工程成品，并承擔(dān)竣工移交前所引起損壞的損失賠償。PartyBshouldprotect allequipment andfinished parts,andshallassumecompensationresponsibilitiesofanylossespriortocompletionhand-over.乙方負(fù)責(zé)用擴(kuò)展保險(xiǎn)責(zé)任批單為與建筑物相關(guān)的工程以及工程所需的材料購(gòu)買工程一切險(xiǎn)，乙方及乙方分包商 (以下簡(jiǎn)稱“分包商”) 應(yīng)對(duì)工程進(jìn)行中自己或其他方的財(cái)產(chǎn)岀資購(gòu)買相應(yīng)的保險(xiǎn)，這些財(cái)產(chǎn)包括：工棚，鐵架塔，腳手架，工具及其他的一些材料。PartyBshallpurchaseConstructionAllRisksInsuraneefortheprojectandrequiredmaterialsrelatedtothebuildingstructurebyusingextendedcoverageendorsement;duringconstruction.PartyBanditssubcontractors(hereafter abbreviatedas"subcontractors") shouldpurchasecorresponding insuraneefortheirownorotherparties'properties,suchastemporaryconstructionbarracks,ironframesandtowers,scaffolding,utensilsandothermaterials.從工程開(kāi)始至工程竣工驗(yàn)收?qǐng)?bào)告上所列明的日期之日止，乙方應(yīng)全權(quán)負(fù)責(zé)整項(xiàng)工程。不管任何原因?qū)е碌墓こ痰膿p壞， 乙方負(fù)責(zé)修理還原，以使整個(gè)工程竣工時(shí)能完全依照合同要求以及甲方工地代表的指示，狀況良好。Fromthebeginningofconstructiontothecompletiondatestipulatedbytheas-builtacceptaneereport,PartyBwillbefullyresponsiblefortheentireproject.PartyBshallfixandreinstateanddamagestotheprojectitemsregardlessofthecause,sothattheprojectshallbeingoodconditionuponcompletion,accordingtothecontractrequirementsandtheinstructionsofPartyA'srepresentative.4.10除非合同另有規(guī)定，乙方應(yīng)就下列事項(xiàng)獨(dú)自完全承擔(dān)如下賠償責(zé)任，并確保甲方完全免責(zé)：與因工程施工及維修而對(duì)人身造成的任何傷害或損害或?qū)ω?cái)產(chǎn)造成任何損害有關(guān)的所有損失及權(quán)利要求。但在下列情形下的賠償或補(bǔ)償除外：Unlessotherwisespecified,PartyBshouldindependentlyandfullyassumethefollowingcompensationliabilities,andexemptPartyAfromallliabilities: allinjuryandrightsclaimsrelatedtoanypersonalinjuriesorpropertydamageorlossasaresultoftheconstructionproject,exceptforthefollowingcompensationorreimbursement:4.10.1 工程或其任何部分永久性使用或占用工地。Permanentuseoroccupationoflandbytheprojectoranypartoftheproject.4.10.2甲方享有在任何土地上，下，里或穿越其施工的權(quán)利。PartyAhastherighttotraversetheconstructionsitefromabove,beneath,orinsidethesite.4.10.3 根據(jù)合同規(guī)定對(duì)財(cái)產(chǎn)的損傷或傷害是工程施工或維修之不可避免的后果時(shí)。Thepropertydamageorlossisaninevitablelosscausedbytheconstructionorrepairaccordingtothecontra~requirements.4.11乙方保證施工現(xiàn)場(chǎng)清潔，符合環(huán)境衛(wèi)生管理的有關(guān)規(guī)定，交工前清理現(xiàn)場(chǎng)達(dá)到甲方要求，如達(dá)不到甲方的要求，乙方承擔(dān)因自身違反規(guī)定造成的損失和罰款。PartyBshallkeeptheconstructionsitecleanandmeettheregulationsofenvironmentsanitation,andmakesuretheconditionofthesitemeetstherequirementsofPartyA.IftheconditionoftheconstructionsitedoesNOTmeettherequirementsofPartyA,PartyBshallberesponsibleforanylossorfineasaresultofitsownviolationofsuchregulations.乙方必須要按照施工圖所顯示的設(shè)計(jì)要求施工，并符合施工規(guī)范規(guī)定。所有因?qū)κ┕D的誤解或疏忽引起的施工錯(cuò)誤， 須返工者，其一切費(fèi)用均有乙方自負(fù)，且不得因此延長(zhǎng)完工期限。PartyBMUSTadheretothedesignrequirementsintheconstructiondrawings,andmustmeettherequirementsofconstructionguidelines.PartyBshallbefullyresponsibleforanycostofreworkonconstructionmistakesasaresultofmisunderstandingoftheconstruction oftheproject.乙方應(yīng)與每位施工人員訂立務(wù)工合同，辦理合法務(wù)工證件并承擔(dān)費(fèi)用。PartyBshouldsignlaborcontractwithallitsconstructionstaffs,andissueproperworkBeresponsibleforthecorrespondingcost.4.14乙方應(yīng)每月按時(shí)向每位施工人員發(fā)放工資，如果乙方未按規(guī)定發(fā)放工資而給甲方帶來(lái)的任何損失，則乙方承擔(dān)完全賠償責(zé)任。PartyBshouldmakesalary/wages staffsintimeonamonthlybasis,andwillbefullyresponsibleforanyliabilitiescausedbyanylossordamagetoPartyAasaresultofPartyB'sfailuretopaysalariesandwagesaccordingtotherequirements.4.15在履行本合同過(guò)程中如對(duì)任何第三人造成任何侵害和損失， 30%室外門(mén)窗及幕墻工程驗(yàn)收合格后5個(gè)工作日內(nèi)甲方支付總工程款的 20%,室內(nèi)中間驗(yàn)收完成后5個(gè)工作日內(nèi)甲方支付總工程款的20%,工程完工驗(yàn)收合格并乙方向甲方提交完整的竣工資料后 5個(gè)工作日內(nèi)支付工程總價(jià)款的27%,工程完工驗(yàn)收合格保修期一年后 5個(gè)工作日內(nèi)支付工程總價(jià)款的 整個(gè)工程無(wú)瑕疵，但隱性瑕疵不受此限。乙方應(yīng)按相關(guān)規(guī)定對(duì)該工程在設(shè)計(jì)使用年限內(nèi)提供保修。PartyBshallcompletetheprojectwithexcellentworkmanshipandguaranteesthat,exceptforothermachinesorequipment,theprojectasawholewillbefreeofdefectwithineighteenmonthsafterthecompletionacceptaneeorpriortothelastpayment(whicheverislater);warrantyonhiddendefectsisnotlimitedtothisdate.Thewarrantyperiodshallbeinaccordaneewiththerelativeregulationsanddesignedworkinglife.7.2在工程建設(shè)過(guò)程中，或上述保修期內(nèi)，乙方應(yīng)及時(shí)修復(fù)材料或人工的瑕疵，由此引發(fā)的損失或損壞將有乙方完全賠付。Duringthewholeconstruction
